A public hearing was held in accordance with notice published in the Evening Herald on April 25, 1975, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on May 12, 1975, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property lying at the southwest corner of the intersec- tion of 24th Street and French Avenue is proposed to be re- zoned from RC-1 (Restricted Commercial) District to GC-2 (Gen- eral Gommerciat) District. 'Said property being 'more parti- cularly described as follows: Lots 11 and 12, (less road), Block 15, 3rd Section Dr'eamwold, PB 4, Pg 70, Seminole County, Florida. City Clerk -~ Publish: April 25, 1975. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or against, the proposed r~zoning. No one appeared in opposition. Mr. Sickler appeared to represent Elleson Bakery, proposed lessee, and to read a letter from Louis Tobin, owner of the property, supporting the request. On recommendation of the Planning and Zoning Commission, Commissioner Meyer 'moved to authorize the City Attorney to prepare the proper ordinance to rezone the property as described in the foregoing notice of public hearing. Seconded by Commissioner Stenstrom and carried over the dissenting vote of Commissioner McClanahan. M. on May 12, 1975, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: Article V, Use Provisions, Section 8, RC-1, Restricted Com~ 'mercial District, Sub-section B, Conditional Uses Permitted, shall be amended by the addition of paragraph (8), as follows: (8) Single-family and two-family dwellings. Article V, Use Provisions, Section 9, GC-2, General Commer- cial District, Sub-section B, Conditional Uses Permitted, paragraph (1) shall be amended as follows: (1) Any conditional use permitted in the RC-1 Re- stricted Commercial District, or any use permitted in the RI-i, Restricted Industrial District. Article V, Use Provisions, Section 9, GC-2, General Commer- cial District, Sub-section B, Conditicn al Uses Permitted, shall be amended by the addition of paragraph (9), as fol- lows: (1) Multiple-Family housing structures conforming to the requirements of the RMOI District. M. on May 12, 1975, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: Article VIII, Supplementary Regulations, .Section 6, Site De- velopment Plan, Paragraph 2 shall be amended to read as fol- lows: (2) In passing upon and approving such site devel- opment plan, the Planning and Zoning Commission shall consider the location, size, height, spacing of any building, structure or use and its appurtenances, access and circulation for vehicles and pedestrians, streets, parking areas, yards and open spaces, and relationship to adjacent property. The Planning and Zoning Commis- sion ~may attach to,its approval of a site develop- ment plan any reasonable condition, limitation or requirement which is found necessary, its judgement, to effectuate the purposes of this section and to carry out the spirit and purpose of the zoning or- dinance, including any special limitations, require- ~ments, or conditions where the site is within an area of high or 'moderate water recharge as designated by the Sanford Planning ~and Zoning Commission. The Chairman announced that the Commission would hear from those present to speak in favor of, or against, the.proposed amendment. No one appeared. Commissioner Stenstrom 'moved to authorize the City Attorney to prepare a resolution recommending that if the state legislature passes a state-wide comprehensive land planning act, that the Seminole County Comprehensive Land Planning Act be set aside. Seconded by Commissioner Meyer and carried. Request submitted from David Redwine, Seminole Paint and Body Shop, for six 'months extension on agreement dated September 24, 1974 to pave Myrtle Avenue from the north edge of the building to Park Drive by May 1, 1975. Commissioner Meyer moved to authorize the request. Seconded by Commissioner Stenstrom and carried. Request submitted from Robert Ansley for water service to his residences on the north side of Celery Avenue, East of the radio station. Knowles from Clerk/ typist III-E to F - $7,605 annually. Seconded by Commissioner Stenstrom and carried. Commissioner Morris 'moved to t~ble consideration of a Utility Service Agreement with Newburgh Development until May 27 to give parties involved time to consolidate city and county requirements for construction of st'reets ~and drainage in subdiVisions, Seconded by Commissione~ McClanahan. Motion failed to. carry over dissenting votes 'of Commissioner Stenstrom, Commission~'r Meyer and Mayor Moore. . ... Commissioner McClanahan moved to rescind the Sewer and Water Service Agreement dated October 15, 1973 since no action has been taken to develope the property. Seconded by Commis- sioner Meyer and carried over the dissenting votes of Commissioner Stenstrom and Commissioner Morris. Commissioner Stenstrom moved to authorize a similar service agreement with Time Con- struction Company of Florida, with additions as follows: 1. Include a clause to prohibit assignment to anyone else. 2. Water and sewer to be 70% completed within 180 days. 3. Utilities, streets and drainage to be in compliance with city subdivision code. 4. Sewer and water service for 125 homes. Seconded by Commissioner Morris and carried over the dissenting votes ~f Commissioner Meyer and CommisSioner McClanahan. Commissioner Morris 'moved to authorize the Mayor to execute a letter of proposal for Comprehensive Goals and Objectives funds from Department of Community Affairs. Seconded by Commissioner Stenstrom and carried. Commissioner Meyer moved to authorize the City Manager and City Attorney to contact William Colbert, Attorney, and officials of Monroe Harbour to work out a direct lease between the City and Barrett Marine, and submit same to the Commission. Seconded by Commissioner Sten- strom and carried. The City Manager was authorized to pursue the possibility of purchasing approximately 11.7 acres of property north and east of the Municipal Stadium, at a price of $2,500 an acre. On recommendation of the City Manager, Commissioner Meyer 'moved to authorize salary reclassifications in the Police Department as follows: Lewis Coombs from C to D - $10,318 annually. Herbert Shea from C to D - $10,318 annually. John Cash from C to D - $10,318 annually. Seconded by Commissioner Stenstrom and carried. The City Manager reported that cert~ain stipulations had not been performed for time extensions granted on Condemnation No. 74-589, Sanford Naval Academy, owner, and No. 74-612, J. W. Agee, owner. Co'mmissioner Morris ~moved to authorize the Building Official to send letter; to the owners, calling their attention to the conditions still existing, and requesting a re- ply within 10 days. Commissioner Meyer moved to table consideration of obtaining Law Enforcement Compre- hensive Professional Liability and Public Official Liability until recommendations are received from the Insurance Committee. Seconded by Commissioner StenStrom and carried. Commissioner Morris moved to authorize the City Manager to direct letters to officials in other municipalities relating his experiences in working with the Florida Legislature in Tallahassee. Seconded by Commissioner~Stenstrom and carried. Commissioner McClanahan ·moved to authorize the City Manager to attend the state legis- lature in Tallahassee the week of May 1~ to discuss the problems of municipalities. Seconded by Commissioner McClanahan and carried. On recommendation of the City Manager, Commissioner~Stenstrommoved to transfer the balance of the Security Complex Construction Trust Fund in amount of $24,934.39 to the Public Improvement Revenue Bonds Sinking Fund Reserve, in accordance with requirements of Ordinance No. 1054. 7:00 P. M. during the 'months'of June, July and AugUst. carried over the dissenting vote of Commissioner Meyer.
