M. 19 75 The City commission of the City of Sanford, Florida, met in regular session in the City Hall in the City of Sanford, Florida, at 4:00 o'clock P. M. on May 19, 1975. Present: Absent: Mayor-Commissioner Lee P. Moore Commissioner John G. Morris Commissioner A. A. McClanahan Commissioner Julian L. Stenstrom Commissioner Gordon T. Meyer City Attorney C. Vernon Mize, Jr. Acting City Manager S. M. Richard City Clerk H. N. Tamm, Jr. City Manager W. E. Knowles Police Chief Ben E. Butler The meeting was called to order by the Chairman. Request submitted from Seminole Bakery Products, Inc., for time extension to pave that portion of Laurel Avenue abutting Lots 16 and 17, Block 5, Second Section of Dreamwold. Commissioner McClanahanmoved to table consideration of same pending receipt of an opinion from the City Attorney to be submitted May 27,' 1975. carried. Seconded by Commissioner Morris and On recommendation of the City Manager, Commissioner Meyer ·moved to authorize a 90 day time extension on Condemnation No. 74-620, Group 32, 716 Hickory Avenue, Rosalie Law- son, owner. Seconded by Commissioner Stenstrom and carried. Letter of resignation from the Airport Authority submitted from John M. Fitzpatrick. On ~motion of Commissioner McClanahan, seconded by Commissioner Morris and carried, same was accepted with regrets, and a letter was authorized to be sent to Mr. Fitzpatrick in appre- ciation of his service. On recommendation of Dick Evans, Chairman, Sanford Housing Authority, Commissioner Stenstrom ~moved to re-appOint Samuel Wright, Jr., to the Sanford Housing Authority, for term of office to expire May 20, 1979. Seconded by Commissioner Morris and carried. Recommendation dated May 16, 1975 submitted from the Planning and Zoning Commission, as follows: 1. Recommend approval to the City Commission the rezoning from MR-1 to RC-1, the east 50 feet of the West 200 feet of Lot A, San Lanta. Commissioner Meyer moved to authorize a public hearing to be held May 27, 1975 to consider same. Seconded by Commissioner McClanahan and carried. i Commissioner Stenstrom read a statement, as follows: On April 14,~when this Commission acted upon a,unanimous recommendation~from the Planning and Zoning Board to rezone an acre of land to PUD by the request of owner J. Brai ley Odham, I announced 'my association with Cardinal Industries as a pub- lic relations consultant and revealed that Cardinal was under contract to purchase the property. Cardinal, and since Cardinal could not utilize the land until it obtained ownership a~d subsequent site plan approval by. the Planning and Zoning Board, and since no one appeared to speak in opposition to the proposed rezoning at the first ad- vertized public hearing on April 28 and the second advertized public hearing on May 15, and since I felt that favorable ac- tion on the part of this Commission was in the best interest of the City of Sanford and its citizens, and since my parti- cipation or abstention in the voting in either hearing would not have altered or affected the'decisions reached by this Commission, I did not consider it necessary to further abstain. However, since a newspaper has chosen to raise the ques. tion of a possible violation of a state statute on the grounds that my association with Cardinal Industries 'may have impaired my independence of judgment in the performance of 'my duties, I hereby request the unanimous consent of this Commission to permit me to withdraw 'my votes and to amend the 'minutes of the April 28 'meeting to let the record indicate a "no" vote, and to amend the ~minutes of the May 15 meeting to let the record indicate an abstention. Commissioner McClanahan moved to table consideration of minutes~Of May 12 and May 15 until the City Attorney arrived at the meeting. Seconded by Commissioner Morris and carried. Commissioner Stenstrom abstained from voting. The Commission authorized a 'meeting to be held with the Insurance Committeedon ~iJune 3 at 12:00 noon. On recommendation of the City Manager, Commissioner McClanahan moved to reclassify Fireman Richard A. Cohen from Fireman D to E - $9,422.40 annual. Seconded by Commissioner Meyer and carried. Commissioner McClanahan moved to re-appOint Dr. John Darby to the Civil Service Board for a two year term ending June 30, 1977. Seconded by Commissioner Meyer and carried. Commissioner McClanahan 'moved to remove from table consideration of the 'minutes of May 12 and May 15, 1975. Seconded by Commissioner Meyer and carried. On motion of Commissioner Meyer, seconded by Commissioner McClanahan and carried, minutes of May 12, 1975, were approved. Commissioner McClanahan moved to amend the ~minutes of April 28 to reflect that Commissioner Stenstrom abstained from voting on the first reading of Ordinance No. 1293, rezoning Brailey Odham property. MIDF~T~TE ~LEGAL SUpIgL¥ COMPANY Commissioner Morris 'moved to authorize the Mayor to execute an agreement between the City of Sanford and Time Construction Company for Water:'and Sewer Service for 125 dwel- ling units on approximately 48 acres south of SR 427. Seconded by Commissioner Stenstrom and carried over the dissenting vote of Commissioner Meyer. Commissioner Meyer moved to authorize the Mayor, City Attorney, and City Manager i!to meet with Lake Mary officials and property owners involved, to discuss property annexed by the City of Sanford, and included in the city limits 'of Lake Mary, when it was incorporated. Seconded by Commissioner McClanahan and carried. There being no further business, the meeting was adjourned. MAYOR ATTEST: jd
