A public hearing was held in accordance with notice published in the Evening Herald on July 24, 1975, as follows: NOTICE OF PROCEEDING FOR VACATING AND CLOSING PORTIONS OF A STREET TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. M. on August 11, 1975, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to those portions of Cooke Avenue described as follows: me be That portion lying between Grove Manor Drive (Lincoln Street) and Clinton Street, That portion lying between Clinton Street and Washington Street, all in Cottage Hill Subdivision. Tamm, Jr. City Clerk Publish: July 24, 1975. ~ · The Chairman announced that the Commission would hear from those persons present to speak in favor of, or against, the proposed street closing. C. Vernon Mize, Jr., 950 Grove Manor Drive, owner of abutting property,.appeared to oppose the proposed street.closing because he,.and his wife do not want the additional 25 feet of property, and further, this would destroy a natural barrier and buffer to the 'west. Rosa M. Rotundo, 999 Grove Manor Drive, appeared to oppose the street closing, because of the possibility the closing and filling of Cooke Avenue would force the water onto the west end of their property; and requested that~no action be taken until the paving of Grove Manor Drive has been completed to determine the flow of storm waters. T. Hulen Ray, owner of property abutting Cooke-Avenue between Clinton Street and Washington Street, appeared to oppose the closing of the north part of Cooke Avenue. Dot Powell, owner of property abutting Cooke Avenue, appeared and stated she had requested the street to be closed 15 years ago, and would favor closing the south portion of said street. Commissioner McClanahan ·moved to authorize the City Attorney to prepare the proper ordinance to close, vacate and abandon Cooke Avenue between Grove Manor Drive and Clinton Street, less the easterly 25 feet abutting Lot 41. Seconded by Commissioner Stenstrom. Motion failed to carry over dissenting votes of Mayor Moore, Commissioner Morris, and Commis- sioner Stenstrom. Commissioner McClanahan moved to authorize a letter to be sent to Mrs. Stamm stat- ing the City Commission has no objection to her filling a low area of Cooke Avenue abutting her property. Seconded by Commissioner Meyer. Motion failed to carry over dissenting votes of Mayor Moore, Commissioner Morris and Commissioner McClanahan. Commissioner Morris moved to authorize approximately 240 cubic yards of fill neces- sary to bring the low portion of Cooke Avenue up to grade and eliminate the drainage problem in the area. Seconded by Commissioner Stenstrom and carried over the dissmnting vote of Mayor Moore. A public hearing was held in accordance with notice published in the Evening Herald on July 30, 1975, as follows: NOTICE OF PUBLIC HEARING OF ·PROPOSED CHANGES AND AMENDMENTS IN CERTAIN. DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 11, 1975, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property lying between French Avenue and Maple Avenue and between 18th Street and 20th Street is proposed to be rezoned from RC-1 (Restricted Commercial) District to GC-2 (General Commercial) District. Said property being more par- ticularly described as follows: Lots 43, 44 and 45, First Addition to Pinehurst, Plat Book 5, Page 79. Commissioner Meyer moved to authorize the City Attorney to prepare the proper ordi- nance to rezone the property as recommended by the Planning and Zoning Commission. M. on August 11, 1975, to consider the adoption of an Annual Budget for the fiscal year of October 1, 1975 to September 30, 1976. Jack Homer, Executive Director of the Greater Sanford Chamber of Commerce, appeared to request Industrial Promotion Funds in amount of $7,500.00. The Mayor stated the City had received a copy of AGO 75-221, pertaining to donation of funds to a Chamber of Commerce for general purposes, and same had been referred to the City Attorney. Commissioner Meyer moved to authorize the City Attorney to prepare the proper Ordi- nances and Resolutions to set public hearings to adopt the budgets on September 8, 1975. G. B. Smith, 1204 19th Court, appeared and stated that two metal pipes installed .under the street in San Sem Knolls are partially collapsed. Robert Hosford and James Murphy .appeared to appeal a denial by the Planning and Zoning Commission for a home occupation for repair~of small office machines at 130 Mayfair Circle, because the code does not, permit persons other than residents of the house to be em- ployed in a home ocgupation. Commissioner Meyer moved.to authorize said~home occupation as .a conditional use, with a variance on:the~residency requirement, for one year. Commissioner Morris submitted a request for $3,833 to fund the first three months expenSe'~for th~ Downtown Redevelopment Committee; and after discussion, moved to authorize the City Commission to enter into an agreement with the Downtown Redevelopment Committee for a study for a preliminary plan, and to authorize~'payment of $3,833 f°r this' service, and trans- fer from contingency to provide for same. Seconded by CommiSsiOner Stenstrom and carried. John Whelchel appeared to support a request for approval of a sub-lease from May- fair Country Club for a portion~ of Out Lot 1 for USe as a Bath and Tennis' Club. The City Attorney discussed the proposed lease and the Commission generally accepted the terms and instructed the City Attorney to add some standard clauses to the lease and return it to the Commission for approval. Seconded by Commissioner Stenstrom and carried. Commissioner Meyer. moved t~o authorize payment for two portable radio units for the Police Department at a cost of $2,267, and transfer from Contingency to provide for same, and to accept check in amount of. $1,822 from LEAA funds for same.. Seconded by Commissioner Mc- Clanahan and carried. Commissioner McClanahan moved to authorize payment of $394.16 to Mrs. Ada L. Reiley for damage to her car by police activity. Seconded by Commissioner Morris and carried. Seconded by Commissioner Morris .and carried. The City Manager reported that J. Brailey Odham, developer of Sanora South Subdivi- sion, 2nd Section, requested to use standard curb on the entrance road, with Miami curb on the side road cul-de-sacs and same 'met with the approval of the City Engineer and City Manager in this area. Commissioner Meyer moved to authorize same. Seconded by Commissioner Sten- strom and carried. The City Engineer reported the contractor had completed well 75-1(5) and same met specifications in the contract; however, othe drawdown was not felt to be satisfactory and on recommendation of the City Manager, Commissioner Meyer moved to'approve additional funds up to $3,000, from Utility Trust. Fund to drill deeper and for further pumping. Seconded by Commissioner McClanahan and carried. Commissioner Meyer moved to authorize the City Attorney to proceed with defense of the Police Department, Police Chief and Raymond Bennett, in case of J. Clayton Hartsoe vs. Raymond Bennett, Ben Butler, Police Chief of the City of Sanford, and the City of San- ford, a municipal corporation. Seconded by Commissioner Morris and carried. The City Attorney was authorized to prepare a Resolution of Welcome to the King of Sweden when he visits the United States during the Bicentennial Celebration.
