On motion of Commissioner Meyer, seconded by Commissioner McClanahan and carried, Ordinance No. 1309, entitled: AN ORDINANCE'OF THE CITY OF SANFORD, FLORIDA, DETERMINING THE AMOUNT AND FIXING THE RATE OF TAXATION AND ~AKING THE ANNUAL TAX LEVY OF THE CITY OF SANFORD, FLORIDA, FOR THE FISCAL YEAR ~975-1976. --- was Cntroduced and placed on its first reading and read in full. On motion of Commissioner Meyer, seconded by Commissioner McClanahan and carried, minutes of August 11 and 12, 1975, were approved. The City Manager submitted a list of items from the August 12, 1975 meeting with -- the Builders Forum Committee, and desired action of the City Commission as follows: 1. Miami curbs, swale type construction, or a combination of the two may be used in the City of Sanford but shall be restricted to residential areas and with the city engineer's approval. 2.Sidewalks are not requested by the City of Sanford, but if they are installed, the developer shall provide sidewalks with a minimum width of four feet. 3. The City of Sanford will notify the .~ublic Service Commission that the City requests and supports of requiring all electric utilities to provide a uni- form fee throughout the state for underground electrical services. 4. The City Commission refers to the Planning and Zoning Commission a review of required living area sizes to see if a revision or a new classification is desirable and would be recommended as follows: Square footage requirements be lowered for dwelling units as follows: Efficiency Apartments 1 - bedroom'home or apartment 2 - bedroom home or apartment Anything over 2 - bedroom home or apartment 'must have a minimum of' 280 square feet 460 square feet 600 square feet 700 square feet These square footage requirements shall be applied to single and two-family dwellings as well as multi-family dwellings. These can be utilized in a special zoned district with minimum lot size of 5,000 square feet with a front yard setback of 25 feet; side yard setback of 5 feet; a rear yard setback of 20 feet. These density requirements should also apply as a conditional use in other districts. The present utility'conneCtion fee will remain in effect. The request to allow overhead electrical service to low cost homes was denied and ~ the City Commission voted that the present requirements remain. This allows overhead electrical service to all structures except any new subdivi- sions shall provide underground electrical systems. The request the City work with the County to provide water and sewer to any low cost homes project done through Farm Home Administration was eliminated since the City Commission had already demonstrated its willingness to consider :,M IiN U T E S August 25 at 7:00 P M. Commissioner Meyer moved to adopt same. Seconded by Commissioner Stenstrom and carried. The City Manager submitted the requested report on an increase from 125% to 150% of the base rate for Water and Sewer Utility Charges for service outside the City, reflect- ing an increase in revenue of $21,658.27. He also stated that Seminole County had adopted an ordinance to control utilities outside 'municipalities. Commissioner McClanahan moved to table consideration of same. Seconded by Commissioner Meyer and carried. The City Manager reported receipt of Notification of Grant Award Action dated Aug- ust 14, 1975 in amount of $93,735, from U. S. Environmental Protection Agency for planning and preliminary engineering studies and reports for sewer and wastewater treatment facilities. The City Manager submitted the engineering agreement from Clark, Dietz and Associ- ates for the Inflow and Infiltration Study for the Regional Sewer Plant in amount of $124,- 980.00. Commissioner Meyer moved to authorize the Mayor to execute same. Seconded by Com- missioner Stenstrom and carried. The City Manager was authorized to meet with the Chairman, Board of Commissioners, Seminole County, to ascertain if they are going to participate in this project. Commissioner Meyer next introduced Resolution No. 1196 and after being read in full, moved on its passage and adoption. Seconded by Commissioner Stenstrom and carried. Said Resolution being in words and figures as follows: RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, ACCEPTING A GRANT FROM THE UNITED STATES GOVERNMENT FOR THE PREPARATION OF A FACILITIES PLAN FOR THE PLANNING AREA DESIGNATED UNDER SECTION 201 OF THE AMENDMENTS TO THE FEDERAL -WATER POLLUTION CONTROL ACT OF 1972. WHEREAS, the City Commission of the City of Sanford, Florida, has determined that it is advisable and in the best interest of the Citizens of Sanford, Florida, that the City apply for a grant of Federal funds for an inflow and infiltration study under the Environmental Protection Agency of the United States Government in an effort to realize a regional sewer plant for Northern Seminole County which would include the City of Sanford, and WHEREAS, the United States Environmental Protection Agency has, by letter dated August 21, 1975, offered a Federal grant in the sum of $93,735.00 to the City of Sanford for the preparation of a Fadilities Plan for the Planning Area designated under Section 201 of the Amendments to the Federal Water Pollution Control Act of 1972, said stun representing seventy- five (75%) per cent of the Environmental Protection Agency eligible project cost, and WHEREAS, the.City Commission of the City of Sanford, Florida, MINUTES City Commission,.Sanford, Florida , August 25 at 7:00 P. MIDSTATE LEGAL SUPPLY COMPANY to sign an appropriate resolution accepting said grant, NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that the offer of a Federal grant by the United States Environmental Protection Agency in the sum of $93,735.00 to the City of Sanford, Florida, for the preparation of a Facilities Plan for the Planning Area designated under Section 201 of the Amendments to the Federal Water Pollution Control Act of 1972 be and the same is hereby accepted. City Clerk Recommendation submitted by Gutman, Dragash and Associates, Architects, for payment of Application and Certificate for Payment Number 13 in amount of $5,000, from R. E. Wilker- son, for work on the Sanford Law Enforcement Center. Commissioner Stenstrom 'moved to autho- rize payment of the difference between $5,000 and the total of additional costs incurred, due to contractor delay, for installation of the telephone system at the Sanford Law Enforce- ment Center. Seconded by Commissioner Meyer and carried. Commissioner Stenstrom moved to support the City of Naples, Florida, in Naples vs. PERC,in defense of establishing a local PERC by ordinance, and to authorize payment of $500 to defray costs in this lawsuit. Seconded by Commissioner McClanahan and carried. The City Manager submitted a review of bids received by the city, compared with state bid specifications and costs, and recommended the City place purchase orders now, for delivery after October 1, 1975, on all cars, trucks, typewriters, and calculators under the state bid. Commissioner McClanahan moved to authorize same, and to increase the carburetor size from two barrel to four barrel in police pursuit cars. Seconded by Commissioner Meyer and carried. Copy submitted of proposed agreement for :tennis court and swimming pool complex for John Whelchel to sub-lease part of Out Lot 1 from Mayfair Country Club, Inc. Commissioner McClanahan moved to authorize~the Mayor to execute the lease, when it is approved by the City Manager and the City Attorney. Seconded by Commissioner Meyer and carried. Commissioner Meyer ~moved ~to authorize"transfer of-$150 from Contingency for cover- ing pool table at ;the ~fire station. Seconded by Commissioner Stenstrom and carried. On recommendation of the City Attorney and the City'Manager, Commissioner McClanahan moved to authorize payment of $8,305'.82 in workmen's compensation case of Eddie Lee Smith, and transfer from Contingency for same. Seconded by Commissioner Meyer and carried. Seconded by Commissioner McClanahan and carried. Commissioner Stenstrom 'moved to appoint John Steffens as the City's representative on the Seminole County Technical Coordinating Committee. Seconded by Commissioner Meyer and carried. On recommendation of the City Manager, Commissioner Meyer moved to authorize release of performance bond for Wilco Construction Company for paving of Georgia Avenue. Seconded by Commissioner Stenstrom and carried. Commissioner Stenstrom 'moved to authorize the City Attorney to prepare a resolution to specify a publicity program as a specific municipal project; set up an appropriation for publicity in amount of $15,000, and direct the Sanford Chamber of Commerce to develop and carry out the publicity program. Seconded by Commissioner Meyer and carried. Commissioner McClanahan moved to authorize to obtain the fair market value of the Palmetto Avenue fire station property from two appraisers, and authorize a total fee of $200 for the service. Seconded by Commissioner Meyer,and carried. The City Manager was authorized to review and report on the City's group hospitali- zation insurance room rate coverage. On recommendation of the City Manager, Commissioner McClanahan 'moved to authorize a public hearing to be held September 22 to consider closing, vacating and abandoning por- tions of West 14th Street, as follows: a. That portion of 14th Street lying between the west right-of-way line of Lake Avenue and the east right-of-way line of Roundtree Street; b. That portion of 14th Street lying :between the southerlY extension of the west right-of-way line of Williams Street and the northerly extension of the west line of Lot 65, Block K, A. D. Chappells Subdivision, Plat Book 1, Page 71. Seconded by Commissioner Meyer and carried. Commissioner McClanahan moved to re-appoint A. K. Shoemaker and John Daniels to the Sanford Airport Authority. Seconded by Commissioner Meyer and carried. The City Manager reported no action had been taken by owner Linda Murphey to re- move a house trailer ~parked on Knudson Drive in violation of the City Code. Commissioner McClanahan moved to authorize the City Manager to handle the situation. Seconded by Commis- sioner Stenstromand carried. Commissioner McClanahan 'moved to canceil the Commission meeting for September 1, 1975. Seconded by Commissioner Stenstrom and carried. The City Manager was authorized to send a letter to Dan Pelham, Pr&ncipal, Sanford Middle School, stating that he and the Police Chief would investigate his request for school. crossing signs on Lake Avenue.
