February 9 at 7:00 P.M. 19 76 The City Commission of the City of Sanford, Florida, met in regular session in the City Hall in the City of Sanford, Florida,· at 7:00 o'clock P. M. on February 9, 1976. Present: Mayor-Commissioner Lee P. Moore Commissioner John G. Morris Commissioner A. A. McClanahan Commissioner Julian L. Stenstrom Commissioner Gordon T. Meyer City Attorney C. Vernon Mize, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler The meeting was called to order by the Chairman. A public hearing was held in accordance with notice published in the Evening Herald on January 19, 1976, as follows: NOTICE OF PROCEEDING FOR VACATING AND CLOSING ALLEYS. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'clock P. M. on February 9, 1976, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to an East-West alley and a North-South alley lying between 18th Street and 20th Street and between Chase Avenue and Lake Avenue, being more partic- ularly described as follows: That certain East-West alley and that certain North- South alley abutting Lots 2 through 6, San-Sem Knolls, Plat Book 12, page 48, and abutting Lots 53 through 64 and 67 through 69, Pinehurst, Plat Book 3, page 71. Tatum, Jr. City Clerk The Chairman announced that the Commission would hear from those persons present to speak in favor of, or against, the proposed alley closing. Those appearing in opposition were as follows: Charles M. Rogers, 1915 Chase Avenue. Roger Finnefrock, 1008 West 20th Street. Robert F. Maurer, 1913 Chase Avenue. Commissioner Meyer moved to table consideration of closing the alleys for further study. Seconded by Commissioner Stenstrom and carried over the dissenting vote of Commis- sioner Morris. Ronald Dorchester, representing Seminole Cablevision, 2619 South French Avenue, appeared to support a request by his organization for a rate increase. Commissioner Morris moved to authorize the City Attorney ,to prepare the proper ordinance to amend the rates:as,requested. Seconded by Commissioner Stenstrom. Commissioner McClanahan moved to table consideration of the rate increase until a work session can be arranged with Seminole Cablevision. Seconded by Commissioner Stenstrom. Motion failed to carry over dissenting votes of Mayor Moore, Commissioner Meyer and Commis- sioner Morris. ,~ Commissioner Meyer moved to amend the motion as follows: 1. Thereupon, the vote was called on the motion, as amended, and carried by unanimous vote. Mr. Jack Homer, 123 Linda Lane, Lake Mary, representing the Sanford-Seminole Ballet Guild, appeared to support a request for free use of the Civic Center for a Centennial Pre- sentation on February 21 and 22, 1976. Commissioner Stenstrom moved to approve the request. Seconded by Commissioner Meyer and carried over the dissenting vote of Commissioner McClanahan. On recommendation of the Minimum Housing Code Inspector, Commissioner Stenstrom moved to autho- rize same. Seconded by Commissioner Meyer and carried. Recommendations dated February 6, 1976 submitted from Planning and Zoning Commission, as follows: 1. Approved Plat of Uppland Park,~ 2. Recommend approval of the RC-1 zone in Uppland Park with two "NO" votes. 3.: 'Recommend approval of the~SR-1 Zone~in Uppland Park with one "NO" vote. 4. Approved the Conditional Use for a home occupation at 115 Country Club Drive but not more~ than~one commercial vehicle to be parked here. 5. Recommend Jinkins Circle Park be annexed along with the next annexation. 6. Approved fees for flea 'market tables as submitted by License Official. Commissioner Meyer moved to authorize a public hearing to be held February 23, 1976 to consider Items #2 and #3. Seconded by Commissioner Stenstrom and carried. Commissioner McClanahan moved to authorize the City Attorney to prepare the proper ordinance and resolution of intent to annex approximately 2.4485 acres lying West of and abut- ting West Jinkins Circle. Seconded by Commissioner Meyer and carried. Commissioner Meyer moved to table consideration of Irem #6. Seconded by Commis- sioner Stenstrom and carried. Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordinance and resolution of intent to annex lots 1, 2, 3 and 4, Block 6, Rosalind Heights, between East 29th Street and 30th Street, extended East, and between Magnolia Avenue and Park Avenue. Seconded by Commissioner Meyer and carried. On 'motion of Commissioner Meyer, seconded by Commissioner McClanahan and carried, minutes of January 26, 1976, were approved. Seconded by Commissioner Stenstrom and carried. On recommendation of the City Manager, Commissioner Meyer moved to authorize the purchase and installation of six street lights on Escambia Drive, with underground wiring, at a cost of $935.00. Seconded by Commissioner McClanahan and carried. Commissioner.McClanahan moved to table consideration of city installing street lights, with developer furnishing materials. Seconded by Commissioner Stenstrom and carried. Consideration next given to establishing a city policy for paving and or opening streets as follows: Commercial structure: City will open and property owner to be required to pave. Single family residence: City will open and no paving will be required. The City Engineer and the City Manager were authorized to submit recomraondations for guidelines. On recommendation of the City Manager, Commissioner Morris moved to.authorize salary reclassification of James Hensley, Maintenance Repairman, from C to D - $7,415.82 annual. Seconded by Commissioner Meyer and carried. On recommendation of the City Attorney, Commissioner McClanahan moved to authorize the City Attorney to settle for $3,000, suit against the City for alledged injuries to a man, ilcaused by a catch basin grate at 20th Street and Maple Avenue. .Morris and carried. Seconded by Commissioner Commissioner Meyer moved to authorize purchase and installation of two signs at the MI N UT'ES ........... Cit~_Commission~: Sanford, ~qorida' ·February 9 at 7: 00 P. M. 19. 76 The City Manager was authorized to obtain cost estimates for high hazard insurance for refuse workers. The City Manager reported that the State Department of Transportation had indicated they were going to install railroad gates at Sixth Street and French Avenue, and had requested the City to designate as one-way, the driveways to the railroad and Scotty's, even though the City has no jurisdiction. Commissioner Meyer moved to state the City's position as follows: The gates are not wanted, and the City to do all in its power to keep them from being-installed. Seconded by Coz~issioner Stenstrom and carried. Commissioner Meyer moved·to authorize extending water lines to James Lee's property ~on Riverview Avenue, outside the City, which is not contiguous to the City, and the developer to pay all costs and a $500 tap fee. Seconded by Commissioner Stenstrom and carried over the dissenting vote of Mayor Moore. On recommendation of the City Manager, Commissioner Meyer moved to approve payment to Halifax Paving Company in amount of $81~594.43 from Revenue Sharing Trust Fund, for street paving contracts as follows: :, Contract II $59,569.48 Contract IV $22,024.95 Seconded by Commissioner Morris and carried. Sara Jacobson and Tom McDonald, First Vice Chairman, Downtown Development Corpora- tion, were present to request-a special meeting with the Commission to consider proposed legislation. The Commission~authorized a special meeting to be held at 4:00 P. M. on Feb- ruary 16, 1976, to discuss same.
