M,. 1976 MIDSTATE LEGAL SUPPLY COMPANY The City Commission of the City of Sanford, Florida, met in regular session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on March 2'2, 1976. Present: Mayor~Commissioner Lee P. Moore Commissioner John G. Morris Commissioner A. A. McClanahan Commissioner Julian L. Stenstrom Commissioner Gordon T. Meyer City Attorney C. Vernon Mize, Jr. City Manager W. E. Knowles 'City Clerk H. N. Tamm, Jr. Police Chief Ben E. Butler The meeting was called to order by the Chairman. Dr. Merle E. Parker, National Chairman and Director of Legal Research Citizen's -- Legal Protective League, appeared to submit and read a written statement requesting the Commis- sion's cooperation in enforcing Section 859.06 and 859.07, of the Florida Statutes, regarding possession and use of cigarettes by juveniles at Seminole County Schools. Request submitted for a 90 day time extension on Condemnation Report No. 75-677, 1704 West 16th Street, Derry McGill, Sr., Owner. On recommendation of the Minimum Housing Code Inspector and the City Manager, Commissioner Meyer 'moved to authorize a final extension. Seconded by Commissioner Stenstrom and carried. On motion of Commissioner Stenstrom, seconded by Commissioner Morris and carried, Ordinance No. 1332, entitled: AN ORDINANCE OF THE CITY OF SANFORD,'FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT CHANGING THE ZONING OF THAT CERTAIN PROPERTY LYING ON THE WEST SIDE OF UPSALA ROAD, OPPOSITE LARKWOOD DRIVE, AND NORTH OF TEE N' GREEN ESTATES TO SR-1 (SINGLE-FAMILY RESIDENTIAL DWELLING) DISTRICT. was introduced and placed on its first reading and read in full. On motion of Commissioner Stenstrom, seconded by Commissioner McClanahan and carried over the dissenting vote of Commissioner Meyer, Ordinance No. 1333, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING THAT CERTAIN EAST-WEST ALLEY AND THAT CERTAIN NORTH-SOUTH ALLEY LYING BETWEEN 18TH STREET AND 20TH STREET AND BETWEEN CHASE AVENUE AND LAKE AVENUE, RESERVING THE USE OF SAME UNTO THE CITY OF SANFORD, FLORIDA, FOR UTILITY PURPOSES. was introduced and placed on its first reading and read in full. Petition submitted from Shoemaker Construction Company, Inc., requesting annexation of the South one-half of Lot 51, New Upsala, Plat Book 1, Page 67.. Commissioner McClanahan moved to authorize the City Attorney to prepare the proper ordinance and resolution to annex same. Seconded by Commissioner Morris and carried. Planning and Zoning Commission submitted a recommendation dated March 19, 1976, as follows: Recommend City pave streets in Georgetown that were eliminated from the Street Paving Program because of future drainage lines and that engineers use right-of-way instead of paved area for the storm drainage. Streets which will not be used for drainage structures: Pine Avenue from 10th Street to 13th Street East llth Street from Pine Avenue to Sanford Avenue East 9th Street from Pine Avenue to Cypress Avenue East 8th Street from Pine Avenue to Cypress Avenue b. Streets which will be used for drainage structures: Cypress Avenue from 10th Street to 13th Street 10th Street from Cypress Avenue to Pine Avenue Pine Avenue from 7th Street to 10th Street On recommendation of the City Manager, Commissioner Meyer moved to include streets listed in a., above, in the Revenue Sharing Street Paving Program. Seconded by Commissioner Morris and carried. On recommendation of the City Manager, Commissioner McClanahan moved to include street listed in b., above, in the Revenue Sharing Street Paving Program, and to off-set the pave- ment 10 feet for future drainage work. Seconded by Commissioner Morris and carried. Commissioner McClanahan moved to include paving in amount of $41,318 of streets with right-of-way partly in the City and partly in the County, in the Revenue Sharing Street Paving Program, as follows: E1 Capitan Drive from Santa Barbara Drive to Florida Avenue, E1 Capitan Drive from Osceola Drive, south 522 feet, DeSoto Drive from Florida Avenue to 100 feet West of E1 Portal, Osceola Drive from 30 feet East of E1 Portal, west 380 feet, Briarcliffe Drive from 300 feet west of Grenada to 480 feet west of Grenada, Sarita Street from 300 feet west of Grenada to 670 feet west of Grenada, Roosevelt Avenue from Southwest Road, north 520 feet, Pear Avenue from West 18th Street, south 170 feet, Peach Avenue, from West 18th Street, south 125 feet, Strawberry Avenue, from West t8th Street, south 100 feet, East 26th Street from North Carolina Avenue to Princeton Avenue, Palmetto Avenue from 28th Place, north 100 feet, East 28th Place, from Palmetto Avenue, east 160 feet. Seconded by Commissioner Stenstrom and carried. On 'motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, minutes of March 8, 1976, were approved. On recommendation of the City Manager, Commissioner McClanahan moved to include Glenway Drive abutting Lots 46, 47 and 48, Cottage Hill Subdivision, in the Revenue Sharing Street Paving Program, with property owner A. C. Rotundo to pay $325 for curbing. Seconded by Commissioner Meyer and carried. The Commission accepted the resignation of Harry Lee, Jr., from the Central Examin- ing Board, and authorized a lette~ thanking him far his service. _. On recommendation of the City Manager, Commissioner Morris moved to authorize acceptance of low bid of Ditch Witch Trencher, Inc. in amount of $5,345.00, and to authorize purchase from Reserve for Renewal and Replacement. Seconded by Commissioner McClanahan and carried. The City Attorney submitted a recommendation to settle the case of J. Clayton Hart- soe vs City for $1,300. Commissioner Meyer moved to authorize same. Seconded by Commissioner Morris and carried. On recommendation of the City Manager, Commissioner Ste'nstrom moved to authorize salary reclassifications as follows: Frank Pritchard, from Laborer IIC to D - $6,890.62 annual. Ben Jackson, from Laborer IIC to D - $6,890.62 annual. iSeconded by Commissioner Meyer and carried. Commissioner Morris 'moved to authorize, effective April 1, 1976, a merit step increase of 5~7o for the City Manager and employees in the administrative pay schedule as follows: Howard J. Kille'n G. On recommendation of the City Manager, Commissioner Meyer 'moved to authorize trans- fer for Public Works complex plans, in amount of $337 from Contingency Account No. 2-01-89001-9 to Engineering Department Accounts, as follows: 2-01-10301-7, Office Supplies $, 70.55 2-01-10349-6, Non-Classified Supplies $266.40 Seconded by Commissioner Stenstrom and carried. Mr. Steve Chapman, Myrtle Beach, South ca=:olina, appeared to request the Commission to allow part time occupancy of 'mobile homes located on four lots adjacent to the Park Avenue Trailer Park. Mr. Chapman stated the running carriage will be removed and the home placed on a permanent foundation, with regular siding on the outside walls. Commissioner McClanahan ['moved to waive the restriction regarding residential use and being parked in a regularly license~ ~.itrailer park as set forth in Sections 18-19 and 18-20 of the Sanford City Code. Seconded by Commissioner Stenstrom and carried. The City Manager reported receipt of an IPA grant in amount of $4,061 for studies and education of elected officials. Commissioner Meyer 'moved to authorize the City Manager to proceed with the program, and to invite elected officials of other municipalities to attend. Seconded by Commissioner Morris and carried. Commissioner Meyer 'moved to table consideration of closing streets not of use to the general public. Seconded by Commissioner Morris and carried. Seconded by Commissioner Meyer and carried. Commissioner Morris moved to authorize the City Attorney to defend the City in the case of Cox vs City and to defend the Fire Chief in two additional cases involving a fire at the Seminole County Jail. Seconded by Commissioner Stenstrom and carried. Commissioner Morris moved to authorize the City Attorney to investigate enforcement of Sections 859.06 and 859.07 of the Florida Criminal Code. Seconded by Commissioner McClana- hah and carried. Mr. Bob Goetzinger, representing Gregory Lumber Company, appeared to request to pave the parkway on the East side of Maple Avenue, between Fifth Street and Sixth Street to permit off-street parking. Commissioner Meyer moved to authorize same, with Gregory Lumber to pay :all expenses. Seconded by Commissioner Stenstrom and carried. The City Attorney opined that recent state legislation regarding annexation super- cedes 1973 HB 1914, Laws of Florida, and that the City annexations should be by the require- ments of Chapter 171, Laws of Florida, 1975. 422 MINUTEs City commission Sanf0rd, Florida.
