A public hearing was held in accordance with notice published in the Evening Herald on March 11, 18, 25 and April 1 and 8, 1976, as follows: NOTICE OF PUBLIC HEARING TO CONSIDER ANNEXATION Notice is hereby given that a Public Hearing will be held at the Com- mission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on April 26, 1976, to consider the annexation of property described as follows: Lots .1, 2,. 3 and~4, Block 6, ROSALIND HEI:GHTS, Plat Book 3, Page 47, Public Records of Seminole County. Said property is presently zoned R-1 (Residential) District. All parties in interest and citizens shall have an opportunity to be heard at said hearing. Statement submitted from Alley and Alley, Attorneys at Law, for retainer fee in amount of $500 for period of May 1, 1976 to April 30, 1977. On recommendation of the City Manager, Commissioner Morris moved to authorize payment of same. Seconded by Commissioner Meyer and carried. Requests submitted for outside display of merchandise as follows: a. Ellen Stevens, Rose-Ellen's, 2535 Park Avenue, for a driveway sale April 29 through May 8, 1976, from 9 A. M. to 9 P. M., except Sunday. Downtown Business Association and SISTER, Inc., to hold a sidewalk sale May be 6 through 8, 1976. Commissioner Meyer moved to authorize same. and carried. Seconded by Commissioner Stenstrom On motion of Commissioner Stenstrom, seconded by Commissioner McClanahan and carried, Resolution No. 1209 was adopted and the Mayor was authorized to execute same. Said Resolu- tion being in words and figures as follows: RESOLUTION OF THE CITY OF SANFORD, FLORIDA, REQUESTING APPROPRIATE ACTION BY THE DEPARTMENT OF ENVIRONMENTAL REGULATION OF THE STATE OF iFLORIDA FDR A DETERMINATION OF EFFLUENT DISCHARGE LIMITATIONS, TREATMENT LEVEL REQUIREMENTS AND WASTE LOAD ALLOCATIONS FOR LAKE MONROE AND THE DOWNSTREAM PORTION OF THE ST. JOHN'S RIVER FOR THE ACCOMPLISHMENT OF 201 FACILITIES PLANNING AS PROVIDED FOR BY PUBLIC LAW 92-500 OF THE UNITED STATES OF AMERICA. '.'. ............... .~ ............ the conditions of N.P.D.E.S. permitting and the Department of Environ- mental Regulation Operating Permits, to plan for future growth of the area and to obtain eligibility for future federal grants for sewage treatment works, and WHEREAS, the planning work was begun and approved on the basis that there would be no discharge to the St. John's River or Lake Monroe, and WHEREAS, that determination of "no discharge" was made by the regulatory agencies with very limited knowledge of any really significant effects of a discharge, and WHEREAS, the State of Florida, Department of Environmental Regulation, Bureau of Water Quality has previously cited the need for additional sampling and analysis work for this segment of the St. Johns River with the expectation that the no discharge limitation might be modified, dependent on the results of that subsequent work, and WHEREAS, such sampling and analysis of the St. John's River was not appropriately the responsibility of the City of Sanford, the City of Lake Mary and the County of Seminole due to the various and many other entities and large geographical areas, outside the sponsoring agencies' jurisdic- tions, which may have major effect on said water quality, and WHEREAS, any satisfactory and reasonable relaxation of the no discharge constraint without accompanying significant adverse water quality and environmental effects could inure to the cost benefit of the citizens of the City of Sanford, the City of Lake Mary and the County of Seminole. NOW THEREFORE, BE IT RESOLVED that the City Commission of the City of Sanford officially requests action by the State of Florida, Department of Environmental Regulation as may be necessary to make a determination of effluent discharge limitations, treatment level requirements and/or waste load allocations for Lake Monroe and the St. John's River, downstream, upon which the important decisions of the 201 Planning process will be based. M.19 76 MIDSSATE LEGAL SuPPL~ CO.ANY On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and car- ried, Ordinance No. 1337, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING A PORTION OF MAPLE AVENUE LYING BETWEEN 22ND STREET AND · 24TH STREET IN THE CITY OF SANFORD, FLORIDA. was introduced and placed on its first~.reading and read in full. Planning and Zoning Commission submitted recommendations dated April 16, 1976, as follows: 1. Recommend the approval.for beer and wine sales for consumption off premises at the approved Cumberland Farms Store site at Lake Mary Blvd. and Orlando Drive. P & Z recommended a study be made on the possibility of putting a sidewalk from 16th St. & Mangoustine, north to lOth & Mangoustine, for the school chil- dren of Goldsboro School. Recommend a study be made on the block wall traffic hazard at Santa Barbara Drive and Georgia Ave., and the reason for the stop sign being at Santa Bar- bara Drive rather than the private road from Lakeview School. Commissioner Meyer moved to authorize the sale of Beer and Wine, for consumption off premises, at the Cumberland Farms Store at Lake Mary Boulevard and Orlando Drive. Secon- ded by Commissioner McClanahan and carried. Commissioner McClanahan moved to table items 2 and 3, above, for recommendations from the City Manager. Seconded by Commissioner Morris and carried. On motion of Commissioner Stenstrom, seconded by Commissioner Morris and carried, · t minutes of April 12, 1976, were approved. Commissioner Meyer 'moved to authorize to receive interest bids to obtain a loan in amount of approximately $250,000 to finance the construction of the Public Works complex. Seconded by Commissioner McClanahan and carried. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordinance to amend Section 6-16 of the Sanford City Code to require condemnation notices to be sent to owners by certified mail, rather than registered mail. Seconded by Commissioner Meyer and carried. Commissioner McClanahan introduced and moved on the adoption of Emergency Ordinance No. 1338, entitled: An ordinance pursuant to Article VIII, Section 2 (b) of the 1968 Florida Constitution and Chapter 73-139, Laws of Florida, the Municipal Home Rule Powers Act, and Section 447.022, Florida Statutes, Chapter 74-100, Laws of Florida, relating to labor, implementing Section 6 of Article I of the ConstitUtion of the State of Florida; providing right to municipal employees to organize and bargain collectively as to terms and conditions of employment; providing method of bargaining procedure; creating and providing administration by the Sanford public employees relations commission; providing for City Commission review of commission rules; defining rights 19 76 ,iMIN U T E S City Commission, Sanford, ~Florida... .. ~...~ April 26 at 7:00 P, M, recognition, and certification of employee organizations and bargaining agents; providing payment of fees and expenses in collective bargaining process; providing grievance procedures; providing procedures for resolution of impasse; providing factors to be considered by the special master; providing for compensation and records; establishing unfair labor practices by employers and employee organizations; providing procedures to resolve unlawful actions and practices; establishing penalties and remedies, providing injunctive relief; providing effect on merit and civil service systems and state and local control of same; adopting the provisions of §447.023, Chapter 74-100, Laws of Florida, as a part hereof; providing for severability; providing for continued effectiveness of existing agreements; providing an effective date. Commis- sioner Stenstrom moved to approve same. Seconded by Commissioner Meyer and carried over the dissenting votes of Commissioner Morris and Commissioner McClanahan. Petition submitted from Mr. and Mrs. Charles Lusk, 2818 Magnolia Avenue, request- ing annexation of the East one-half of Lots 8 and 9, Evans Subdivision, and for sewer connec- tion at this time. On recommendation of the City Manager, Commissioner Meyer moved to autho- rize the City Attorney to prepare the proper ordinance to annex said property, and to authorize the sewer connection during the processing of the petition. The City Manager reported that the extension, had expired on Condemnation Report No. 74-623, Joe Moss, 301, 303, 305, 307 South Sanford Avenue, and recommended demolition. The Commission authorized a final 10 day notice to be sent to Mr. Moss. The City Attorney reported that an agreement had been received from Butte Knitting Mills, granting unto the City a utility easement at said company's location on highway 17-92, South, in accordance with Commissionmeeting of December 8, 1975. The Mayor and~City Clerk were authorized to execute same. The Commission instructed Jim Jernigan, Director of Recreation, to lower the height of the shrubbery in the median on 17-92, at the intersection of Park Drive, across from the Slumberland Court.
