A public hearing was held in accordance with notice published in the Evening Herald on June 22, 1976, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on July 12, 1976, to consider changes and~amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: That property located at the Northeast corner of the inter- section of Art Lane and Lake..~Mary Boulevard is proposed to be rezoned from SR-1 AA (Single Family Residential) District to GC-2 (General Commercial) District. Said property being more particularly described as follows: Commencing 75 feet North and 801 feet East of the Southwest corner of Government Lot 3, Section 10, Township 20 South, Range 30 East, run North 417.42 feet~, thence~run~East 417~42 feet, thence run South 417.42 feet, thence West 417.42 feet, to point of beginning and, commencing 75 feet North and 741 feet East of the Southwest corner of Government Lot 3, Section 10, Township 20 South, Range 30 East, run North 417.42 feet, thence East 60 feet, thence South 417.42 feet, thence West 60 feet to the po~t of beginning. The Planning and Zoning Commission submitted a recommendation to rezone the property !to RC-1 (Restricted Commercial) District. Dr. Kornick was present and stated he plans to construct an animal clinic on the Property, and that he would agree to leave a set back wide enough to accommodate future street Widening. Seconded by Commis- sioner Stenstrom. Commissioner Morris moved to amend the motion to include "subject to the requested set back requirements." Seconded by Commissioner McClanahan and carried. Thereupon, the Chairman called for the vote on the motion, as amended, and same was carried. On motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, Ordinance No. 1347, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT CHANGING THE ZONING OF THAT CERTAIN PROPERTY LOCATED AT THE NORTHEAST CORNER OF THE INTERSECTION OF ART LANE AND LAKE MARY BOULEVARD TO RC-1 (RESTRICTED COMMERCIAL) DISTRICT. was introduced and placed on its first reading and read in full. Mr. Ralph McLain, 708 Elm Avenue, appeared to support his request. The Planning and Zoning Commission submitted a recommendation to rezone the prop- erty as advertised. On recommendation of the Minimum Housing Code Inspector and the City Manager, Commissioner Meyer moved to authorize same. Seconded by Commissioner Morris and carried. Commissioner Stenstrom moved tO remove from. table consideration of a resolution supporting State Representative Robert Hattaway's attempts to clarify the Sunshine Law. Seconded by Commissioner Morris and carried. On motion of Commissioner-Stenstrom, seconded by Commissioner Morris and carried, Resolution No. 1210 was adopted. Said resolution being in words and figures as follows: A RESOLUTION SUPPORTING STATE REPRESENTATIVE ROBERT HATTAWAY~FOR HIS ASSISTANCE TO TRUE GOVERNMENT IN THE SUNSHINE. WHEREAS, State Representative Robert Hattaway~co-sponsored legislation to clarify and protect Government in the Sunshine, and WHEREAS, the Sanford City Commission realize the importance of true open local government for their residents, and WHEREAS, this subject has not been fully understood by the citizens of Florida due to the way the law is.written, which has required many interpretations that also are not fully understood, and WHEREAS, the residents of the State of Florida, Seminole County, the CitY of Sanford most especially, the legislative district of State Representative Robert Hattaway should thank him for his assistance, NOW THEREFORE, BE IT RESOLVED BY THE SANFORD CITY COMMISSION: SECTION I: That State Representative Robert Hattaway is hereby thanked and praised for his assistance and courage in handling legislation to clarify the Government in the Sunshine law. SECTION II: Members of the Sanford City Commission stand ready, willing and able to assist Representative Hattaway and members of the Florida Legislature in strengthening Government in the Sunshine. On motion of Commissioner Meyer, seconded by Commissioner McClanahan and carried, minutes of the meeting of June 28, 1976, were approved. Letter next submitted from T. E. Tucker, Chairman of the Board of Directors of the Flagship Bank of Sanford, requesting the City to close, during the month of July,~ the purchase of property abutting the City Hall site on the West, and lying between Commercial .~Street and Seminole Boulevard. On recommendation of the City Manager, Commissioner McClanahan moved to purchase, for $100,000, said property; and to close the sale during the month of July; and to request the local banks to submit interest 'bidS on a loan in amount of $175,000, to cover the pur- chase of the property and architect's fees until funds are received from sale of revenue certificates, about ~ovember 1, 1976; and further, to authorize the ~ayor and City Clerk to execute a note for same at the lowest interest bid. Seconded by Commissioner Morris and carried. Mayor Moore abstained from voting. On recommendation of the City Manager, Commissioner Meyer moved to authorize the Mayor and Fire Chief to execute a mutual aid fire agreement with the City of Altamonte Springs. Seconded by Commissioner Morris and carried. The City Manager reported that Mr. Tomlinson, custodian of the Sanford Naval Academy, had informed the City that the ball field behind the stadium would be available only if the City would enter into a leaSe agreement with a fee. Commissioner Morris moved to authorize the CitY Manager to continue negotiations towards an eXchange of property for the two baseball fields. Seconded by Commissioner Stenstrom and carried. On.recommendation'of the City Manager, Commissioner Meyer moved to authorize salary reclassification of Janet Dougherty, Finance Department Secretary II-E to II-F, $7,307.10 annual. Seconded by Commissioner Stenstrom and car'ried. On recommendation of the City Manager, Commissioner Morris moved to authorize use of the Civic Center, with alcoholic beverages, July 13, 1976 by the International Associa- tion of Machinist and Aerospace Workers of Waycross Georgia, at the fee of $250. Seconded by Commissioner Meyer and carried. The City Manager reported that George McCammon, Developer of San Situs, had re- quested Florida Power and 'Light Company to remove three power poles from this property. 'The Commission stated the poles are on public property, and instructed Scott Burns, Florida Power and Light Company, not to have them removed. Commissioner Morris moved to authorize the City Manager to inform the Planning and Zoning Commission of the difficulties the City Commission has encountered with George McCammon and San Situs development; and to ask the Planning and Zoning Commission to bear these difficulties in mind in future appearances and requests made to them by George McCammon for San Situs development. Seconded by Commissioner McClanahan and carried. Commissioner McClanahan moved to authorize the City Manager to notify George Mc- Cammon, developer of San Situs, that the three poles of Florida Power and Light Company are properly situated. Seconded by Commissioner Meyer and carried. On motion of Commissioner McClanahan, seconded by Commissioner Morris and carried, Resolution No. 1211 was adopted. Said Resolution being in words and figures, as follows: RESOLUTION OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE FILING OF AN APPLICATION TO BE FILED THROUGH THE FLORIDA BUREAU OF CRIMINAL JUSTICE PLANNING & ASSISTANCE FOR A GRANT FROM THE LAW ENFORCEMENT ASSISTANCE ADMINISTRATION, AN AGENCY OF THE UNITED STATES OF AMERICA, SAID GRANT TO PROVIDE FUNDS FOR THE PUR- CHASE OF AN~AIR SURVEILANCE UNIT FOR THE CITY OF SANFORD POLICE DEPARTMENT TO BE UTILIZED FOR PATROL, SURVEILANCE, SEARCH AND RESCUE. WHEREAS, the City Commission of the City of Sanford, Florida, herein called the "Applicant", after thorough consideration of the problem and available data, has hereby determined that the project hereinafter described is in the best interests of the general public of the City of Sanford; The project involves the utilization of an air surveilance unit for use by the Sanford Police Department for patrol, surveilance, search and rescue. The primary function of. the unit will be to reduce criminal activity by the use of regular patrol, assistance to ground units in locating criminal activity, apprehension of criminal suspects through surveilance and search activities and protection of human life through increased search and rescue capabi- lities. The unit will also be utilized to assist other law enforcement agencies in Seminole County, Florida, in achieving these objectives. That the project generally described above is in the best-interests of the'Applicant and the general public. 2. That Ben E. Bu~ier~ Chief of Police of the City of Sanford, Florida, be hereby authorized to file in behalf of the Applicant an application in the form.:prescribed by the Florida Bureau~of 'Criminal Justiceplanni~g a~d~AssiStance'in conformity with gaid*acC~~ for a gra~t to."be made .to the applicant to assist in "~ defraying the cost of the project generally described above. 3. That if such grants'be made,~the.~APplicant shall provide or make necessary arrangements'go pr0Vide such funds and/ or in-kind contributions in addition to the grant as may be required by the Act to defray the cost of the project generally described above. 4. That the Applicant is aware that at least fifty (50) percent of the minimum required non-federal cost'of the project be~' . appropriated cash and that such funds designated as:loCal hard Cash - contributions in all related project-lbudget s~hedUles tha~-.ar~e to be provided by the Applicant are hereby appropriated new funds for Criminal Justice use for the express purpose of matching the Law Enforcement Assistance Administration funds. 5. That said Ben E. Butler, Chief of Police of the City of Sanford, Florida, is hereby authorized to furnish such other action as may be necessary to enable the Applicant to qualify for said grant. 6. That the Official designated in the preceding paragraph is hereby designated as the authorized representative of the Applicant for the purpose of furnishing to the Florida Bureau of Criminal Justice Planning and Assistance such information, data and documents pertaining to the applicatiOn for said grant as may be required and otherwise to act as the authorized representative of the Applicant in connection with this application. 7. That certified copies of this resolution be included as part of the application for said grant to be submitted to the Florida Bureau of Criminal Justice Planning and Assistance. 8.
