MIDSTATE LEGAL SUPPLY COMPANY The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 23, 1976. A public hearing was held in accordance with notice published in the Evening Herald on AugUst 10, 1976, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 23, 1976, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as fol- lows: A portion of that certain property located between Hiawatha Avenue and Orlando Drive and between Santa Barbara Drive and French Avenue is proposed to be rezoned to GC-2 (General Com- mercial) District. Said property being more particularly de- scribed as follows: Lot 9, Block 15, Dreamwold, PB 3, Pg 90. Ail parties in interest and citizens shall have an opportunity to be heard at said hearing. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. No one appeared. The Planning and Zoning Commission submitted a recommendation to rezone the prop- erty as advertised. Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordinance to rezone the property as advertised. Seconded by Commissioner Morris and carried. Notice is hereby given that a Public Hearing will be held at the Commission Room i'n the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 23, 1976, to consider the adoption of an Annual Budget for the fiscal year of October 1, 1976 to September 30, 1977. A copy of said budget shall be available at the Office of the City Clerk for all persons desiring to examine the same. Commissioner McClanahan moved to authorize the City Attorney to prepare the proper ordinance to adopt the proposed Capital Budget for Fiscal Year 1976-77. Seconded by Commis- sioner Morris and carried. Mr. R. L. McLain, 708 Elm Avenue, appeared to support a request for a time exten- sion to pave a driveway and parking area at a day care center at 708 Elm Avenue, in accord- ance with site plan approved by the Planning and Zoning Commission. On motion of Commissioner McClanahan, seconded by Commissioner Meyer and carried, the City Manager was authorized to meet with Mr. McLain and to make waiver or variance as needed to maintain a safe situation. Petition submitted from the Sanford Seminole Development Company, for annexation of the East one-half of Block 80, M. M. SmJhhs Subdivision, located East of Airport Boulevard and North of Jewett Lane. Commissioner Meyer moved to authorize the City Attorney to prepare the proper ordinance to annex said property. Seconded by Commissioner Stenstrom and carried. Commissioner Stenstrom moved to authorize the CityiAttorney to prepare the proper ordinance to adopt the. proposed budget for Fiscal Year 1976-1977. Seconded by Commissioner Meyer and carried. A public hearing was held in accordance with notice published in the Evening Herald on August 9, 1976,, as follows: NOTICE OF PUBLIC HEARING FOR THE PROPOSED ADOPTION OF A CAPITAL PROGRAM FOR THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford,Florida, at ..7:00 o'clock P..M. on August 23, 1976, to consider the adoption of a Capital Program. A copy of said Capital Program shall be available at the office of the City Clerk for all persons desiring to examine the same. Mr. Elmer Thompson, Director of Passenger Provisions, appeared to support the request as set forth in Item No. 1. Commissioner Meyer moved to authorize sale of Beer and Wine, C.O.P. at Auto Train Boutique and Terminal. Seconded by Commissioner McClanahan and carried. Mr. Leo Williams, owner/operator of the proposed Pool Hall at 400 Sanford Avenue, appea:ed to support the request as set forth in Item No. 2. Statement in amount of $471.60 submitted from Mrs. Melvin Miller, 2301 Grandview Avenue, for reimbursement of medical expenses for injuries alledged to have been caused when the ground gave way beneath her at a sewer cave-in. On recommendation of the City Manager, Commissioner McClanahan moved to authorize payment of same, upon execution of a proper release. Seconded by Commissioner Morris and carried. On motion of Commissioner Stenstrom, seconded by Commissioner Meyer and carried, Ordinance No. 1352, entitled: AN ORDINANCE AMENDING ORDINANCE NO. 1349 OF THE CITY OF SANFORD, FLORIDA, ENTITLED: "AN ORDINANCE PROVIDING FOR THE REFUNDING AND REFINANCING OF AN OUTSTANDING OBLIGA- TION OF THE CITY OF SANFORD, FLORIDA, AND THE ACQUISITION AND CONSTRUCTION OF A NEW CITY HALL AND PUBLIC WORKS COMPLEX FOR THE CITY; PROVIDING FOR THE ISSUANCE OF NOT EXCEEDING $2,100,000 PUBLIC IMPROVEMENT REVENUE BONDS, SERIES 1976, OF SUCH CITY TO PAY THE COST OF SUCH PROJECT; PROVIDING FOR THE RIGHTS OF THE HOLDERS OF SUCH BONDS; PROVIDING FOR THE PAYMENT THEREOF; AND MAKING CERTAIN OTHER COVENANTS AND AGREE- MENTS IN CONNECTION WITH THE ISSUANCE OF SUCH BONDS ." Commissioner Morris moved to approve a mutual fire aid agreement with Seminole County, as recommended by the City Manager and the Fire Chief. Seconded by Commissioner Morris and carried. The City Manager reported that Brailey Odham, developer of Ginderville Heights subdivision, would oversize from six inches to eight inches, the water line extension on South Sanford Avenue, if the City will pay the difference of approximately $2,400 for materials.~ On recommendation of the City Manager, Commissioner McClanahan moved to authorize the addi- tional cost to oversize the line to eight inches, and to order approximately 1,350 feet of the pipe after the developer has paid his portion of the purchase price to the City. by Commissioner Meyer and carried. The City Manager submitted a tabulation of bids for slurry seal, as follows: 1. Driveway Maintenance, Inc. 0.1923c/square yard Miami, FL ~ · On recommendation of the City Manager, Commissioner Morris moved to accept low bid of J & B Slurry Seal Company, Winter Park, Florida, in amount of $'..17_~ per square yard.. Seconded by Commissioner Stenstrom and carried. Commissioner Stenstrom moved to authorize salary reclassification of Aaron Keith, Utility Department Crew Leader from D to E, $7,793.96 annual. Seconded by Commissioner Meyer and carried. On recommendation of Robert M. Rosemond, Chairman, Sanford'Airport Authority, Commissioner McClanahan moved to re-appoint Scott Burns as a Commissioner of the Sanford Airport carried. Authority, effective October 1, 1976. Seconded by Commissioner Morris and Request submitted from John D. Whelchel, President, Mayfair Tennis Club, to with- draw their bid for "Out Lot One" at'the golf course, and refund of $1,000 binder. Commissioner Meyer moved to authorize same, and to refund binder, less cost to the City for advertising and appraisal. Seconded by Commissioner-Stenstrom and carried. Request submitted from J. S. "Red" Cleveland, Director of Aviation, Sanford Airport Authority, for tranSfer of funds in'the 1976 Airport Authority budget, as follows: a. Increase line item 8621 BUilding~Repair & Mai'ntenance by $3,000 b. Decrease line item 8622 - Parking Lot Construction & Repairs by $3,000 On, motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, same was authorized. 'CommisSioner Morris moved to appoint Nicholas J. Mergo, 124 Larkwood DriVe, to the City of Sanford Board of Bond Trustees. Seconded by Commissioner Meyer and carried over , August 23 at 7:00 P. Commissioner Meyer moved to appoint Clifford McKibbin, Jr., 2450 Mellonville Avenue, to the City of Sanford Board of Bond Trustees. carried. Seconded by Commissioner McClanahan and Commissioner Morris moved to commit the City of Sanford to expend $87,500 from Renewal and Replacement Fund for.studies of the Sanford Sewer System, under the 201 Regional Planning Study; with the Federal government to provide matching funds. Seconded by Commis- ~ sioner McClanahan and carried. The City Attorne. y was authorized to meet with the Lake Mary City Attorney and Seminole County City Attorney to discuss setting up a management entity for a Regional Sewer Treatment Plant Authority.
