The City Commission of the City of Sanford, Florida, met in regular session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on September 13, 1976. The first item of business was the awarding of plaques and resolutions to Mr. J. H. Van Hoy and Mr. J. M. Senkarik, in recognition of their service as members of the City of Sanford Board of Bond Trustees. Said Resolutions being in words and figures, as follows: RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, COMMENDING J. H. VAN HOY FOR HIS SERVICE TO THE CITY OF SANFORD AS A MEMBER OF THE BOARD OF BOND TRUSTEES. WHEREAS, J. H. Van Hoy was appointed to serve on the Board of Bond Trustees of the City of Sanford on January 12, 1959; and WHEREAS, since the date of his appointment he has served the citizens of the City of Sanford through the unselfish devotion of his time and his talent; and WHEREAS, the Board of Bond Trustees plays an important role in the fiscal function of the government of the City of Sanford in that the Board of Bond Trustees makes important decisions affecting the investment of governmental funds; and WHEREAS, J. H. Van Hoy has been a successful and well-recognized businessman in the community for many years and has at all times displayed cooperation and willingness to render service not only to the City of Sanford but to numerous other civic organizations; and WHEREAS, it is with sincere regret and understanding that J. H. Van Hoy deemed it necessary to resign from the Board of Bond Trustees; NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that the City Commission hereby expresses its genuine gratitude to J. A public hearing was held in accordance with notice published in the Evening Herald on September 6, 1976, as follows: NOTICE THE CITY OF SANFORD IS ACTUALLY LOWERING THE CITY TAX MILLAGE THIS YEAR, EVEN THOUGH THE AD BELOW REFERS TO A TAX INCREASE. THE CITY HAS ELIMINATED ITS OLD BONDED DEBT AND IS TRANSFERRING ITS DEBT MILLAGE. John Fohl, District Aide.'.to .Congressman Richard Keily was'present to answer ques- tions regarding the Grant Seminars for local county and city governments to be held at 9:30 A. M. on September 17, 1976<at the .Seminole County Court House. Mr. Tony Russi, Tony Russi Insurance Agency, 2417 South French Avenue, appeared to register a complaint regarding the patrons of Hot Foots~, a business abutting his property on the north. He stated that since Hot Foots had opened six months ago, his sign had been vandalized twice; beer bottles and cans, wine bottles and trash were continually strewn on his property, and there.had been'people smoking on top of his building. Commissioner McClanahan moved to hold a public hearing September 27, 1976, to con- sider possible revocation and/or denial of renewal of City.Occupational Licenses for Hot Foots, and to authorize the City Clerk to prepare proper notices. Seconded by Commissioner Morris and carried. Robert E. Karns, Chairman of the Insurance Committee, submitted a letter dated August 24, 1976 stating that CNA Insurance Company will not renew, their policy for $.20,000 accidental death coverage for Policemen and Firemen, but that Travelers Insurance Company would offer coverage. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize to obtain coverage with Travelers Insurance Company to conform with Florida [State Statutes Chapters 67-408 and 67-443 and amendments thereto. Request submitted from the Florida Depa~rtment of Criminal Law Enforcement for a lease to mount a two-way radio equipment antenna and transmission line on the elevated water tank on Mellonville Avenue. Commissioner Morris moved. MINUTES City Commission, San~0rd, Florida',' - ............ September 13 at 7:00 P. 1~I 76 Recommend the following Amendment to the Sanford Zoning Ordinance No. 1097. Revise Article VII.' Section 12 to read: Article VII. General Regulation Provisions Section 12. Outside Display of Merchandise and Products Interio~ Lots No outdoor sales or display of merchandise or products will be permitted in connection with any permitted or conditional uses authorized in any commercial or industrial district unless said merchandise or products are situated at leamt nine (9) feet from any property line of the business property or any public right of way upon which the merchandise or products are situated, or unless the merchandise or products are displayed in an en- closure which has received site plan approval in accordance with the general regulations pertaining to site plan approval. Corner Lots In all Zoning Districts all outside displays within one hundred (100) feet of the nearest street intersection shall be set back from all property lines a distance of ten (10) feet. This section shall not apply to the sale of motor vehicles, trailers, mobile homes, boats and other recreational vehicles of a similar nature which are covered in Section 9 of this Article. The owner or operator of any business covered by the pro- visions of this section desiring to have the provisions of this section waived for the purpose of a special sale of merchandise or products on a portion of the property within nine (9) feet of a property line or public right of way shall make application to the City Commission for a special sale permit which may be granted in the discretion of the City Commission for a period not to exceed ten (10) days. The subject of the downtown area, which has no building setback requirement, was also discussed. Due to the potential liability of the City for allowing such displays on public property,it was decided not to make any recommendations although the Board felt some relief, such as conditional uses, might be applicable, if reviewed and approved by the City Commission. (Five (5) feet is the standard City requirement) This would allow displays of varied degrees, depending on the existing width of widewalk. Consideration must also be given to all existing landscaping and benches now restricting ped- estrian travel. Seconded by Commissioner McClanahan and carried. On motion of Commissioner Meyer, seconded by Commissioner Stenstrom and carried, Ordinance No. 1353, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ADOPTING THE STATE OF FLORIDA MUNICIPAL FIREMEN'S PENSION TRUST FUND IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 175, FLORIDA STATUTES, PROVIDING FOR THE CITY OF SANFORD TO CONTRIBUTE AN AMOUNT EQUAL TO TEN PERCENT OF THE SALARY OF EACH UNIFORMED FIREMAN WHO IS A MEMBER OF THE SANFORD FIRE DEPARTMENT, ONE-HALF OF SUCH CONTRIBUTION TO BE CREDITED AS A CONTRIBUTION TO THE TRUST FUND BY THE INDIVIDUAL FIREMAN, PROVIDING FOR THE ASSETS OF THE CITY OF SANFORD FIREMEN'S RELIEF AND PENSION FUND TO BE MAINTAINED LOCALLY, PROVIDING FOR THE MEMBERS OF THE BOARD OF TRUSTEES OF THE FORMER SANFORD FIREMEN'S RELIEF AND PENSION FUND TO BE THE TRUSTEES OF THE MUNICIPAL FIREMEN'S PENSION TRUST FUND AND TO SERVE INACCORDANCE WITH THE REQUIREMENTS OF CHAPTER 175, FLORIDA STATUTES, AND PROVIDING FOR AN EFFECTIVE DATE OF OCTOBER 1, 1976. was introduced and placed on its first reading and read in full.
