A public hearing was held in accordance with notice published in the Evening Herald on September 27, 1976, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 11, 1976, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as fol- lows: A portion of that certain property lying on the East side of Sanford Avenue and between 25th Street and 25th Place is proposed to be rezoned to GC-2 (General Commercial) District. Said property being more particularly described as follows: Ae From RC-1 (Restricted Commercial) District: Lots 6, 7, 8, 9 and 10, Block 1, Palm Terrace, Plat Book 4, Page 82. From SR-1 (Single Family Residential Dwelling) Dis- ~trict: ~ ~ Lots 11, 12 and 13, Block 1, Palm Terrace, Plat Book 4, Page 82.' ~ Ail parties in interest:and.citizens shall have an opportunity to be heard at said hearing. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. William Hart, owner of Lots 8 through 13, was present and stated he wants to expand his restaurant, on Lots 8, 9 and!10, and continue to utilize other lots for parking. The Planning and Zoning Commission submitted a recommendation to rezone the property as advertised. Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordinance to rezone the property as advertised; Seconded by Commissioner Meyer. Commissioner McClanahan moved to amend the foregoing motion to eliminate lots 12 and 13, used for restaurant parking, from the rezoning, and only rezone Lots 6 through 11 M ?I N U T E S City'Commission, San'ford; Florida.. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 11, 1976, to consider the adoption of an ordinance by the City of Sanford, Florida, as follows: ~ ORDINANCE NO. 1354 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, TO ANNEX WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, UPON ADOPTION OF SAID ORDINANCE, A PORTION OF THAT CERTAIN PROPERTY LOCATED EAST OF AIRPORT BOULEVARD AND NORTH OF JEWETT LANE IN ACCORDANCE WITH THE VOLUNTARY ANNEXATION PROVISIONS OF CHAPTER 171.044, LAWS OF FLORIDA, 1975. WHEREAS, there has been filed with the City Clerk of the City of Sanford, Florida, a petition containing the name of the property owner in the area described hereinafter r~questing annexation to the corporate area~of the City of Sanford, Florida, and requesting to be included therein; and WHEREAS, the Property Appraiser of Seminole County, Florida, having certified that there is one property owner in the area to be annexed and that said property owner has signed the petition for annexation; and WHEREAS, it has been determined that the property described hereinafter is contiguous to the corporate area of the City of Sanford, Florida, and it has further been determined that the annexation of said property will not result in the creation of an enclave, and W~tEREAS, the City of Sanford, Florida, is in a position to provide municipal services to the property described herein, and the City Commission of the City of Sanford, Florida, deems it in the best interest of the City to accept said petition and to annex said property. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. That that certain property in Seminole County, Florida, described as follows be and the same is hereby annexed to and made a;part of the City of Sanford, Florida, pursuant to the voluntary annexation provisions of Chapter 171.044, Laws of Florida, 1975: The East one-half of Block 80, M. M. Smith's Subdivision, according to the Plat thereof as recorded in Plat Book 1, Page 55, Public Records of Seminole County, Florid . SECTION 2. The next order of business was a public hearing, tabled at meetiqg of September 27, 1976, to consider rezoning property abutting French Avenue on the East, and between 20th Street and Colonial Way, Lots 16 through 19, Block 1, Highland Park. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. Frank Whigham, Attorney for George E. Smith, petitioner, appeared and stated his business was quite small, and he wanted to enlarge it, to be competitive with the area. A. A. McClanahan, 409 Editha Circle, representing property owners in the immediate vicinity, appeared in opposition to the proposed rezoning, and :stated there had been no ob- jection to Mr. Smith's business operation since he had been there, or to an addition to the building; however, the concern was that GC-2 zoning would permit many other uses. On recommendation of the Planning and Zoning Commission, Commissioner Morris moved to deny the rezoning. Seconded by Commissioner Meyer and carried. Commissioner McClanahan abstained from voting. Commissioner Stenstrom moved to authOrize Mr. Smith to proceed with the modifica- tion of his building, subject to site plan approval by the Planning and Zonihg Commission. Seconded by Commissioner Meyer and carried. Commissioner McClanahan abstained from voting. A public hearing was held to consider the revocation of a municipal occupational license, as follows: 1975-76 License No. 1595, issued to Kenneth Eden, d/b/a Peoples Choice, 2599 Sanford Avenue. and to consider not renewing the license for 1976-77.
