The City Commission of the City of Sanford, Florida, met in Regular Session in
the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on February 14, 1977.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with notice published in the Evening Herald
on January 28, 1977 as follows:
NOTICE
The City Commission of the City of Sanford,
Florida at 7:00~o'clock P. M. on January 24 and Feb-
ruary 14, 1977 in the Commission Room at the City
Hall in the City of Sanford, Florida will hear com-
ments regarding its HUD Community Development Block
Grant for an Open Space Project in the census tracts
205 & 209.
Said Open Space Project will be considered
by the City Commission before the public at the
regular meeting of January 24 and February 14, 1977.
Ail parties in interest and citizens shall have
an opportunity to be heard at said meeting.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, an application to HUD for a Community Development
Block Grant for the proposed~development of the park on West Fifth and Sixth Streets and a
park in the Southeast portion of the City, in Census tracts 205 and 209. No one appeared.
Commissioner Morris moved to authorize the City Manager to execute the proper appli-
cation for said grant. Seconded by cOmmissioner Stenstrom and carried.
Wayne Heasley, Watson and Company, submitted completed plans for the proposed City
Hall. Commissioner Stenstrom moved to approve the plans, and to authorize to advertise
for bids with bid opening to be March 10, 1977. Seconded by Commissioner McClanahan and carrie¢
Tom Wilson, Executive Director, Sanford Housing Authority, appeared and stated that
his Board had received an invitation to participate in an urban homestead program of distressed
property repossessed by HUD. He stated the City would be the sponsoring agency, and the
Sanford Housing Authority the operating agency. Commissioner McClanahan moved to anthorize
a joint meeting with the Sanford Housing Authority Board of Directors to discuss same. Seconded
by Commissioner Keith and carried.

The Mayor stated that the Department of Environmental~:Regulations had requested
the City to make a declaration of zoning within 30 days, on the proposed landfill property
at Paola Road and Oregon Avenue. :
Commissioner McClanahan moved to instruct the Planning and Zoning Commission to
study and make'a recommendation to the Commission for sanitary landfills to be'a permitted
use in an agriculture zone after two public hearings before the City Commission. Seconded
by Commissioner Stenstrom and carried.
Clayton Thomas, P. O. Box 552, Altamonte Springs, and Lawrence Livingston, Sanford
Court, Sanford, were present to support~a'request.to~continue the non-conforming use of a
structure as a restaurant at 1926 West 13th Street. .Onrecommendation of the Building Official~
Commissioner McClanahan moved~to authorize same. .Seconded by~Commissioner Keith and carried.
On recommendation of the City Manager, Commissioner Stenstrom moved to authorize
payment of statements as follows:
1. Watson and Company, Architects, in amount of $12,593.73 for
re-design work on the proposed City Hall. .,
Fitzpatrick.~and'Ha~tsock,' C.P,A., in amount 0f $1,500 for balance
of fee for annual audit.
Seconded by Commissioner Morris and .carried.
Commissioner Morris moved to authorize the City Manager to prepare proposed budgets
for Federal Revenue Sharing funds and Federal Anti-Recession funds, with priorities as follows:
(1) Solid waste disposal.
(2) Public safety.
Se¢~onded by Commissioner Keith and carried.
On recommendation of the City Attorney, Commissioner Morris moved to authorize the
Mayor to execute an Engineering contract with Clark, Dietz and Associates, for a sewer evalu-
ation study under the 201 Grant. Seconded by Commissioner Stenstrom and carried.
On recommendation of the City Attorney, Commissioner Morris moved to settle suits
out of court as follows:

Sandra Roberts v. City of Sanford

Seconded by Commissioner McClanahan and carried over the dissenting vote of Mayor Moore.
On recommendation of the Minimum Housing Code Board of Adjustment and Appeals,
Commissioner Stenstrom moved to appoint members to the board:

The City Clerk reported that the bank note in amount of $175,000 for City Hall land
and Architect's fees, had matured on February 13, 1977, and Atlantic National Bank of Sanford
will renew same for 90 days at the same interest rate of 4~%. On motion of Commissioner
McClanahan, seconded by Commissioner Morris and carried, same was authorized.
Request submitted from Gary Warner, owner, 401 North Mangoustine, for a 90 day time
extension on Condemnation Report No. 76-743. On recommendation of the Minimum Housing Code
Inspector and the City Manager, Commissioner Morris moved to authorize same. Seconded by
Commissioner Stenstrom and carried.
On motion of Commissioner Stenstrom, seconded by Commissioner Morris and carried,
minutes of January 14, 24 and 28, 1977 were approved.
On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried,
Vouchers for the month of January, 1977 were approved as follows:

WHEREAS, the City of Sanford, Florida, previously
received a grant in the sum ot $93,735.00 from the United States
Environmental Protection Agency for use in the wastewater treat-
ment program, and
WHEREAS, the City has been advised by the Regional
Administrator of Region IV of the United States Environmental
Protection Agency that an additional $262,~587.00 is available to
increase the grant to the sum of $358,322.00, and
WHEREAS, in order to accomplish the study to develop
a wastewater treatment program, the additional funds are needed
and the additional offer from the Environmental Protection Agency
should be accepted.
NOW THEREFORE, BE IT RESOLVED that the City
Commission of the City of Sanford, Florida, hereby accept~ the
additional offer of $262,587.00 from the United States Environmental
Protection Agency for use in the wastewater treatment program.
BE IT FURTHER RESOLVED that a copy of this
Resolution be submitted as required by law to the Region IV office
of the United States Environmental Protection Agency.
THIS RESOLUTION ADOPTED this 14th day of
February, A.D. 1977.

The City Manager reported that upon recodification of the City Code, a section
had been omitted authorizing a three week temporary permit to park trailers/motor homes, and
recommended to amend the Cit.y Code to permit same.~ Commissioner Stenstrommoved to autho-
rize the City Attorney to prepare the proper ordinance for same. Seconded by Commissioner
McClanahan and carried.
On recommendation of the City Manager, Commissioner Stenstrom mOved to authorize
salary reclassification of James Hensley from Maintenance Repairman D to E - $8,222.63. i.
Seconded by Commissioner Keith and carried.
The City Manager reported that the cost of Block Exams had risen from a scale

examination. On motion ~of Gommissioner Stenstrom, Seconded by Commissioner Keith and carried,
same was authorized.
After discussion, Commissioner McClanahan moved that the Animal Control Officer's
salaries be reclassified from the present pay scale 28 to scale 32 for the two officers in
the field, with the officer at the pound to stay in pay scale 28. Seconded by Commissioner
Keith and carried.
Commissioner McClanahan moved to authorize the City Manager to write a letter to
Goodwill, Inc., instructing them to remove their collection boxes, except the one at the
Goodwill building, and not to allow material at that one to accumulate and become unsightly.
Seconded by Commissioner Stenstrom and.carried.
On recommend~tion.~of'the City.Manager, Commissioner Morris moved to increase the
utility deposit~to $25.00.: Seconded by Commissioner Stenstrom and carried.
The Commission authorized to meet with City Auditors, Fitzpatrick and Hartsock,
C.P.A., at noon February 23, 1977 to discuss the annual Audit.
Petition submitted ~fr°m 'Mr. and Mrs. Paul E. Smith to annex the West 100 feet of
Lot 22, Lake Minnie Estates, and the City Clerk reported that same had been certified by the
Seminole County Tax Assessor. Commissioner Morris moved to authorize the City Attorney to
prepare the proper ordinance to annex said property and to advertise same. Seconded by Commis-
sioner Stenstrom and carried.
Statement submitted from City Attorney C. Vernon Mize, Jr., in amount of $10,633.01
for services rendered in the Public Improvement Revenue Bo'nd validation suit. Commissioner
McClanahan moved to table same until the bonds are sold.

Commerce, for an exempt license ~r a non-profit tour program, to cater mostly to senior

~ ~> WHEREAS, the Laws of the State of Florida apparently
do not require a governmental entity to comply with a Municipality's
Ordinances when constructing buildings within a municipality for
use by the governmental entity, and
WHEREAS, it is important and in the best interest of the~
public's safety and welfare that a Municipality's Ordinances be
complied ~ith in all matters relative to construction within the
Municipality.
. N~OW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF SANFORD, FLORIDA, that the
Seminole County Legislative Delegation be requestedto introduce -
in the 1977 Session of the Florid~Legistature appropriate legislation
to require that any governmental entity constructing buildings~within
a municipality shall comply with~hat Municipality's Ordinances as to
zoning, building permits, building codes, site plan requirements,
parking requirements, life safety codes, connection fees for utilities
amd~insp, ecti~ons~to enforce compliance with said Ordinances.

WHEREAS, Chapter 171, Florida Statutes, sets forth
the requirements for annexation of pzoperty into a municipality, and
WHEREAS, ~here is a definite need for an. amendment to
the Law to provide for annexation of property.which is completely
surrounded by pzoperty within the municipality without the necessity
of a referendum by the property owners within such area, and
.WHEREAS,~ such an amendment is needed in order to
promote the orderly and efficient growth of~the municipality, and-
further, to enable the municipality to provide the necessary services
to the citizens of the municipality.

COMMISSION OF THE CITY OF SANFORD, FLORIDA, that the
Seminole County Legislative:Delegation be requested to introduce

NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF SANFORD, FLORIDA, that the
Seminole'County Legislative Delegation be requested to introduce
appropriate legislation in the 1977 Session of the Florida Legislature
to amend Chapter 125.01(6), Florida Statutes,':to require a joint
meeting by the governing bodies of the Munieipality and County in
the event the County fails to develop appropriate mechanisms for
the taxation of residents or property in unincorporated areas in the
County for services which are for the benefit of property or residents
in the unincorporated areas of the CoUnty, and further, to require that
each governing body make available to th~ other information supporting
the respective positions.
