A public hearing was held in accordance with notice published in the Evening Herald on March 31, 1977 as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florid~ at 7:00 o'clock P. M. on April 11, 1977, to consider changes and amend- ments to the Zoming Ordinance of the City of Sanford, Florida, as fol- lows: A portion of that certain property abutting Sixth Street on the South and betweemPecan Avenue and Poplar Avenue is proposed to be rezoned from RI-1 (Restricted Industrial) District to MR-1 (MultiPle-Family Residential Dwelling) District. Said property being more particularly described as follows: The North one-half (less Ry) of Block 8, Tier 13, Town of Sanford, PB 1, pg 112, Pub!ic Records of Seminole County, Florida. On recommendation of ~-the Planning and Zoning Commission, Commissioner Stenstrom ~moved. to authorize the City Attorney to prepare the proper ordinance to rezone the property_ as advertised. Seconded by Commissioner Keith and carried. M. on April 11, 1977, to consider changes and amendments to the Zoning Ordinance of the~City of Sanford, Florida, as follows: A portion of that certain property abutting Persimmon Avenue on the West, and lying between Second Street extended to the West and the North line of the Seabomrd Coast Line Railroad Right-of-Way, is proposed to be rezoned from GC-2 (General Commercial) District to MI-2 (Medium Industrial) District. Said property being more particularly described as follows: Beg 1,429.4 ft E of intersection of the S line of SR 46 with the Nly line of A.C.L. Railway; Run E 453.6 ft; S to Railway; Nly on Railway to a pt S of the beginning; N to the beginning (less roads and the N 400 ft S of SR 46), Section 26, Township 19 South, Range 30 East, Seminole County, Florida. The Chairman announced that the Commission would hear from those persons present to sp in favor of, or in opposition'to, the proposed rezoning. Richard Mamley, Attorney from the firm of Hutchison and Morris, 230 North Park Avenue, Sanford, appeared as spokesman for residents in the area to oppose the rezoning. He stated they were concerned about the traffic problem, noise and air pollution, eyesores, depreciation of pro erty values, and that rezoning to MI-2 would allow other heavy industrial uses, other than the ~ proposed concrete block'plant. He also stated that formerly the City Commission had denied rezo ' ing to Commercial, a house directly across the street from this property, in order to preserve the residential integrity of the area. Mr. Tom Blaney, Auto Train, stated oppoSition tO the rezoning, and cited traffic problems,_that the change of zoning would allow most anything to come in and that would affect the aesthetics of the Auto Train property, and would be detremental to Auto Train's operation. Mr. Dave Fart, 106 Larkwood Drive, Sanford, representing ~Sunstand, Inc., owner, and A-1 Block Company, appeared to support the rezoning. He stated that a tour of a similar block plant in Orlando had shown no air pollution, and no 'noise pollution in the street adjacent to the plant. He stated that the proposed block plant would generate less traffic per day ~ than Auto Train; that the land use plan shows this property as industrial, and that the prop- erty is surrounded by industrially zoned property. M. 1977,, MIDSTATE LEGAL SUPPLY COMPANY Block Plant Company, would build a buffer area and landscape around the block plant, and that he would donate blocks to the property owners on Persimmon Avenue who wanted to construct a wall on the street side of their property. He stated the, owner plans to employ 30 to 50 employees, and is seeking additional land to expand. A. D. Drennen,..1095~West Fourth Street, appeared in opposition. On recommendation of the Planning.-:and Zoning Commissipn, Commissioner Stenstrom moved to authorize.the, City Attorney to prepare~the, proper ~ordigance .t.o. rezone, the property as advertised. Commissioner McClanahan ~o~e'd~to authorize the City staff to discuss same with the Seminole County staff, and repor~ t:o the 'City Commission at the April 25, 1977 meeting. Seconded by Commissioner Keith and carried. Petition submitted requesting the!:Commission to prohibit parking also on the East side 'Of SUmmerlin ~venu~ "between the'RailrOad'and 20th~Street. Commissioner Keith moved to affirm the actio'n of'the~commission~On March 28, 1977, to prohibit parking on the West side only. Seconded by Commissioner"MorriS and carried, over the dissenting vote of Mayor Moore. ~ ~ Request submitted from Mr. A. L. Hunt, 2485 Palmetto Avenue, to prohibit parking on the North side of 25th Street, between Sanford Avenue and Park Avenue. Commissioner Sten- strom moved to authorize the City Attorney to prepare a resolution requesting DOT to prohibit said parking, during' the hours,of 7:00 P. M. to 7:00 A. M. and carried. Request submitted from C. O. Boykins for an occupational license for a Bottle Club at 400 South Sanford Avenue. On recommendation of the City Manager, Commissioner Morris moved to authorize a public hearing to be held May 9, 1977 to consider same, and to authorize the City Clerk to direct a notice of same to property owners within the block. Seconded by Commissioner Stenstrom and carried. Commissioner Stenstrom moved to authorize transfer in amount of $299.74 from Contin- gency Account to City Manager's Travel Expense, to provide for transportation for three round- trips to Tallahassee for one meeting with the Florida League of Cities, and two meetings before PERC. Seconded by Commissioner Keith and carried. ~ John Daniels, Chairman, ~Trustee Board of St. James A,M;E..Church, corner of Cypress Avenue and Ninth Street, appeared ,to support a request to waive restrictions to permit the church to erect, on the parkway,~a-.two-sided florescent bulletin:board.type ground ~ign, five feet wide by six feet high. Commissioner McClanahan moved to grant a variance to permit same. Seconded by Commissioner Morris and carried. Commissioner Stenstrom moved to deny the request of the Sanford Housing Authority for the City of Sanford to participate in the HUD Urban Homesteading Program. Seconded by Commissioner McClanahan and carried. The City Manager reported receipt of a petition requesting the City to widen Hardy Avenue, a regulation residential street. On recommendation of the City Manager, Commissioner Morris moved to post "No Truck" signs on Hardy Avenue. carried. Seconded by Commissioner Keith and On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, the City Manager was authorized to obtain a four by six acrylic painting of the present City Hall. Seconded by Commissioner Stenstrom and carried. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize salary reclassifications as follows: Jimmie L. The City Manager reported that the plumbing fixtures at the Civic Center need to be replaced at an estimated cost of $2,900 for same, and to provide for handicap requirements. Commissioner McClanahan moved to authorize the City Manager to obtain costs for complete renovations to be funded from the Revenue Sharing Trust Fund. Seconded by Commissioner Morris and carried. The City Manager was authorized to proceed with a proposed salary survey. Commissioner Morris moved to table, until April 25, 1977, the consideration of a suit against Seminole County, regarding the question of double taxation. Seconded by Commis- sioner McClanahan and carried. The City Manager reported that insurance coverage certificates had not been kept current on the Marina, that the Harbor Master Building has been occupied without a lease, and that the marina lease holder has been informed of same. The City Attorney and City Manager were authorized to discuss the requirements of the lease with the marina operator. The City Manager reported that he had received no reply from Moulder Brothers Nur, sery regarding a water line extension, and recommended to cease negotiations with them. The City Manager was authorized to send a letter with return receipt requested, to inform Moulder Brothers of this action. The City Manager reported that information for the city-wide clean-up could not be printed on the utility bills in time for the program, and recommended to advertise same in the newspaper. Commissioner Stenstrom moved to authorize a transfer from Contingency to provide for same. Seconded by Commissioner Keith and carried. Commissioner Stenstrom moved to authorize the City Manager to attend the FCCMA seminar April 20 through 22, 1977 in Ft. Lauderdale, Florida. Seconded by Commissioner Morris and carried. Commissioner McClanahan moved to authorize Commissioner Morris and the City Manager to attend a hearing in Tallahassee, April 14, 1977 regarding local legislation for a regional sewer authority. Seconded by Commissioner Stenstrom and carried. The City Manager reported that the postage for mailing notices to delinquent Utility Accounts for the past three months had amounted to $540.40, and recommended to eliminate same, and to stamp a delinquent notice on the Utility Bill, with the specified date due and cut- off date. After discussion, same was authorized. The City Manager reported that he is preparing a letter to the Department of En- vironmental Regulation to answer their questions regarding the sanitary landfill, and on recommendation of the City Manager, the Commission requested the Planning and Zoning Commission to consider rezoning to AD (Agricultural) District, approximately 20 acres at the Northeast intersection of Paola Road and SR 46A to AD. Commissioner McClanahan moved to reject same, and to declare the property surplus, and to advertise for bids, with the stipu- lation that the city has the right to negotiate a sale price with the highest bidder. by Commissioner Stenstrom and carried. The City Manager was authorized to obtain proposals for an interior design consult- ant for the new City Hall. Commissioner Morris moved to authorize payment of statements submitted by C. Vernon Mize, Jr., City Attorney, as follows: Case of Wanda L. Watkins v. City of Sanford, Florida, and J. A. Cash - $1,322.80. Seminole County Jail fire cases - $700.00. Seconded by Commissioner Keith and carried. Commissioner Morris moved to authorize a change in the regional sewer concept, to delete Seminole County and become a bi-party agreement, and let Seminole County rejoin~.~at a later date, if they desire.
