The City Commission of the City of Sanford, Florida, met in Regular Session in
the City Hall in the City .~'0f!' Sanford, Florida, at 7:00 o'clock P. M. on April 25, 1977.

The meeting was called to order by the Chairman.
The first item of business was the opening of bids submitted in accordance with
Invitation to bid published in the Evening Herald on April 15, 1977 as follows:

of the Public Records of Seminole County, Florida.
This is generally known as the old central fire station, or Pal-
metto Avenue Fire Station.
Sealed bids will be received in the Office of the City Clerk,
City Hall, Sanford, Florida, until 5:00 P.M. on April 25, 1977. Any
bid received after 5:00 P. M. on April 25, 1977 will not be considered.
All bids shall be for cash sale, net to the City of Sanford. The City
of Sanford reserves the right to negotiate a sale with the highest
bidder, and to reject any or all bids.

Commissioner McClanahan moved to reject both bids as being too low. Seconded by
Commissioner Stenstrom and carried.
Commissioner McClanahan moved to re-advertise for bids for the Old Central Fire
Station, to be opened May 9, 1977, and to omit "The City reserves the right to negotiate
with the highest bidder". Seconded by Commissioner Morris and carried.
Letter submitted from the Sanford Housing Authority stating the terms of Mr. E. L.
Blacksheare and Mr. D. C. McCoy would expire on May 20, 1977. Commissioner Morris moved to
re-appoint Mr. Blacksheare and Mr. McCoy to said Board. Seconded by Commissioner Keith and
carried.

Recommendation dated April 22, 1977 submitted from the Planning and Zoning Commis-
sion to approve change of use for 401 Sanford Avenue to a Night Club, with sale of Beer and
Wine for Consumption on Premises, with the stipulation that a letter from the owner of Park
and Shop (Mr. Gazil) allow parking in his lot after store hours for 401 customers.
Mr. Charles Mitchell, 401 Sanford Avenue, was present to support the request, but
stated he could not obtain a letter pertaining to the parking.
Commissioner McClanahan moved to deny the request for sale of Beer and Wine, with
Consumption on Premises, due to the location being within 500 feet of an already established
place of business with Consumption of Premises. Seconded by Commissioner Keith and carried.
A public hearing was held in accordance with notice published in the Evening Herald
on April 15, 1977 as follows:

introduced and placed on its first reading and read in full at the meeting of April 11, 1977,
was next placed on its final reading. After being read by title, the Chairman announced that
the Commission would hear from those persons present to speak in favor of, or in opposition
to, the proposed ordinance. No one appeared.
Commissioner Morris moved on its passage and adoption. Seconded by Commissioner
Stenstrom and carried.
Thereupon, the Chairman announced that the City Commission of the City of Sanford,
Florida, had passed and adopted said Ordinance No. 1381, entitled:

The City Clerk reported that the annual meeting of the Chamber of Commerce will
conflict with the Regular City Commission meeting on May 9, 1977. Commissioner McClanahan
moved to authorize the Meeting to be held on May 10, 1977 at 8:00 P. M. Seconded by Commis-
sioner Morris and carried.
On recommendation of the City Manager, Commissioner McClanahan moved to authorize
salary reclassifications as follows:
George Markos,. from Fireman C to D - $9,457.86 annual.
Robert S. Hawkins, from Fireman E to F - $10,445.34 annual.
Fred Bowen, from Fireman E to F - $10,445.34 annual.
Seconded by Commissioner Stenstrom and carried.
Commissioner Morris moved to authorize the Mayor to execute an Enforcement Compliance
Schedule for the U. S. Environmental Protection Agency. Seconded .by Commissioner McClanahanr
and carried. :
The City Manager reported that Seminole County had delivered a 14 page resolution
stating that Double Taxation does not exist in Seminole County; that the resolution had been
delivered to the City Clerk at his home on April 12 at 5:50 P. M., and recommended to file
suit against the County to resolve the issue, and further, to meet with the County to dis-
cuss double taxation.
Commissioner Stenstrom moved to authorize the City Attorney to proceed to file a
suit against Seminole County for relief from double taxation. Seconded by Commissioner Mc-
Clanahan and carried.

Commissioner Morris moved to authorize the City Attorney to prepare a resolution
on Seminole County's Comprehensive Land Plan and present same at the public hearing on May 17,
1977. Seconded by Commissioner Stenstrom and carried.
The Commission authorized an amendment to LPW Contract to install "air scrubbers"
for the Commission Room in the new City Hall.
The City Attorney reported that the city's contract to purchase 86 acres did not
include a requirement for the owners to file an application for rezoning, and recommended
the city to initiate the request, and that the attorney for the Department of Environmental
Regulation had advised that after all other requirements had been met, that a letter could
be directed advising that a permit will be issued upon the rezoning being completed.
Commissioner McClanahan moved to authorize the City Manager to request the Planning
and Zoning Commission to hold a public hearing to consider rezoning to AD (Agricultural)
District the Westerly approximate 20 acres of the 86 acre tract, and to authorize the City
Clerk to send proper notice to the property owner. Seconded by Commissioner Keith and carried
The City Manager reported that the Police Officers had voted to change the Police-
men's Pension Fund from the local act to be covered under FS Chapter 185. On recommendation
of the City Manager, Commissioner McClanahan moved to authorize the City Attorney to prepare
a resolution authorizing same. Seconded by Commissioner Keith and carried.
The City Manager, Commissioner Stenstrom and the President or. the Art Association
were appointed as the selection committee to obtain a painting of the present City Hall.
Letter dated May 18, 1977 submitted from the School Board of Seminole County, giving
90 day notice to cancel lease dated October 27, 1971, for use of the Municipal Stadium.
The City Manager reported that the Director of Recreation and Pa~ks had submitted
a recommendation to replace the present lighting system; remove the concrete block wall around
the stadium and install chain link fencing; and/or sublet the stadium to Wes Rinker, on a
maintenance type sub-lease. The City Manager was authOrized to wOrk out a lease agreement
with Wes Rinker, reserving the right for the City-to use the stadium for city purposes.
Commissioner McClanahan introduced Resolution No. ~1225, and moved on its passage
and adoption. Seconded by Commissioner Stenstrom and carried. Said Resolution being in

SANFORD AVENUE AND PARK AVENUE, SAID 25TH
STREET BEING DESIGNATED BY THE DEPARTMENT
OF TRANSPORTATION AS STATE ROAD NO. 46.
WHEREAS, it has been brought to the attention of the City
Commission of the City of ~Sanford, Florida,' that parking on the North
side of 25th Street between Sanford Avenue and Park Avenue causes a

WHEREAS, it is the opinion of the City Commission that the
restriction of parking, whereby parking would not be allowed in that area
during nighttime hours, would, not be detrimental to the commercial
businesses in the area.
NOW, THEREFORE, BE IT RESOLVED by the City Commission
of the City of Sanford, Florida, that the Department of Transportation of
the State of Florida be requested to prohibit parking in the City of Sanford,
Florida, between the hours of 7:00 p.m. and 7:00 a.m. on the North side
of 25th Street between Sanford Avenue and Park Avenue, said 25th Street
being designated by the Department of Transportation as State Road No. 46.
BE IT FURTHER RESOLVED by the said City Commission that
a copy of this Resolution be furnished to the District Office of the Department
of Transportation of the State of Florida.

WHEREAS, Article I, Section VI, of the Florida Constitution
provides that the right of persons to work shall not be denied on account
of membersh%p or non-membership in any .labor union or labor organization,
and
adoption.
and figures as follows:
WHEREAS, the Florida Legislature adopted Chapter 447 of the
Florida Statutes, which permits public employees to organize~or refrain
from organizing in labor unions or labor organizations, and
WHEREAS, the imposition of a service fee upon employees who
do not desire union membership or representation would constitute an
infringement upon their constitutional and statutory right to refrain from
exercising organizational rights granted to other employees..
NOW, THEREFORE, BE IT RESOLVED by the City Commission
of the City of Sanford, Florida, that the City Commission of the City of
Sanford, Florida, hereby opposes the passage.of the proposed House Bill
No. 380 which would require non-union employees to pay a service fee
in the amount of regular union dues to the union which repressnts a bar-
gaining unit ~hich the employee may be included within, even though the
employee does not desire union representation, because such a service fee
requirement violates Article I, Secion VI, of the Florida Constitution.
BE IT FURTHER RESOLVED by the said City Commission
that a copy of this Resolution be furnished to the various.members of the
Seminole County Legislative Delegation.

COMPENSATION PLAN WITH THE INTERNA-
TIONAL CITY MANAGEMENT ASSOCIATION

WHEREAS, the City of Sanford, Florida, has in its employ
personnel who are rendering valuable services to the City, and
WHEREAS, the City has considered the establishment of a
Deferred Compensation Plan for said employees, and
WHEREAS, said employees.often are unable to acquire retire-
ment securities under the existing and available retirement plans due to
the contingencies of employment mobility, and
WHEREAS, the City of Sanford received benefits under said
plans by being able to assure reasonable retirement security to said
employees, by being more able to attract competent personnel to its service,
and by increasingits flexibility in personnel management through elimination
of the need for continued employment for the sole purpose of allowing an
employee to qualify for retirement benefits.
NOW, THEREFORE, BE IT RESOLVED by the City Commission
of the City of Sanford, Florida, as follows:
1. That a Deferred Compensation Plan for the employees of
the City of Sanford, Florida, beles~Rblished and the Mayor is hereby
authorized to execute the Deferred Compe.nsation Plan with the International
City Management Association Retirement Corporation; said plan being
attached hereto and made a part of this Resolution.
2. That the City Clerk may on behalf of the City execute
all Joinder Agreements with the employees and other eligible officials
and officers, which are necessary for said persons to participate in the
plan.

As the City Commissicn of the
City of Sanford, Florida
The City Commission authorized,the City Manager to include in the remodeling costs
an estimate to tile the ~alls and floor of the Civic Center Restrooms.
The Commission authorized to request the Seaboard Coast Line Railroad for use of
the old REA siding area as a parking lot for the Coastline Recreation Park on West Eighth Street.
There being no further business, the meeting was adjourned.
