The City Commission of the City of Sanford, Florida, met in Adjourned Regular Ses- sion in the City Hall in the City of Sanford, Florida, at 8:00 o'clock P. M. on May 10, 1977. The first item of business was the opening of bids submitted in accordance with Invitation to Bid published in the Evening Herald on APril 29, 1977 as follows: INVITATION TO BID The City of Sanford offers for sale a building and land described as follows: Lot 14, Block 3, Tier 1, and the Easterly vacated two feet of Palmetto Avenue, E. R. Trafford's Map, of the TOWN OF SANFORD, FLORIDA, according to the plat thereof as recorded in Plat Book 1, Page 58, of the Public Records of Seminole County, Florida. This is generally known as the old central fire station, or Pal- metto Avenue Fire Station. Sealed bids will be received in the Office of the City Clerk, City Hall, Sanford, Florida, until 5:00 P. M. on May 9, 1977. Any bid re- ceived after 5:00 P. M. on May 9, 1977 will not be considered. All bids shall be for cash sale,: net to the City of Sanford. Commissioner McClanahan moved to accept the high bid in amount of $20,300, subject to condi- tions set forth in the legal advertisement, and to authorize the Mayor and City Clerk to exe- cute the proper deed upon approval of the City Attorney. Seconded by Commissioner Morris and carried. A public hearing was held in accordance with notice published in the Evening Herald on April 18, 1977 as follows: NOTICE OF PROCEEDING FOR VACATING AND CLOSING AN ALLEY. Tamm, Jr. City Clerk Publish: April 18, 1977; The City Clerk reported that notices had been sent to property owners on April 18, 1977. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed alley closing. Those appearing in opposition were as follows: Richard Dove, 2531 French Avenue, Sanford, Florida, stated his customers use -the alley, and it is used for refuse pick-up, and that if it is closed, it will reduce the value of his property. Russell Harned, Mt. Plymouth Lake, Florida, stated the alley was there when he purchased the property, and that he agreed with Mr. Dove. Steve Saboff, 4605 Rose of Jericho Court, Orlando, Florida, stated he leases property abutting the alley from ABC Oil Company, and that he wants the alley left open for use by his customers. The Mayor read a letter submitted from T. W. Mero stating opposition to the proposed closing; and stated a letter had been received from ABC Oil Company in opposition. Those appearing in favor were as follows: · W. C. Galley, 2506 Laurel Avenue, Sanford, Florida, stated his fence had been torn down several t~nes by vehicles using the alley. Richard Sites, 2510 Laurel Avenue, stated he had been forced to erect a fence around his property to keep vehicles from using his property as the alley, and that now his fence was being hit. Sharon Bass, 504 Bayard Street, stated they had erected a fence, which had been torn down. Cynthia Galley, 2506 Laurel Avenue, stated she was not really in favor of closing the alley, but would like a barrier put up to keep trucks from using the alley. M. __19 7 7 Commissioner McClanahan moved to table consideration of closing the alley until May 23, 1977, and to authorize City Staff to determine if the power poles can be relocated, if truck traffic should be restricted, or other recommendations. Seconded by Commissioner Morris and carried. Request submitted from the Sanford Airport Authority for transfer of funds in amount of $5,000 in the Airport Authority 76-77 Budget as follows: · ?.f! '.. Increase line item 8685 - Insurance - by $5,000. Decrease liqe~ item 8624 - Street Construction and Repair - by $5,000. On recommendation of the City Manager, Commissioner Morris moved to authorize same. Request submitted from J. H. Crapps to close, vacate and abandon B~y Avenue between the South right-of-way line of 24th Street and the South line of Lot 91 extended Easterly, all in Sanfo Park Subdivision, Plat Book 5, Page 62. Commissioner McClanahan moved to autho- rize a public hearing to be held June 13, 1977, to consider same, and to authorize the City Clerk to send notices to property owners. Seconded by Commissioner Morris and carried· On motion of commissioner St~enstrom, seconded by Commissioner McClanahan and carried, the l~yor was authorized to execute an Interlocal Agreement with Seminole County to utilize their contribution in amount of $1,500 for CIP Seawall Beautification. Recommendations dated May 6, 1977 submitted by the Planning and Zoning Commission as follows: 1. Public Hearing on rezoning for landfill postponed. City Attorney conceded that the Notice To Public must be published in accordance with FL Statutes, and hearing held on June 2, 1977. To initiate the terms of office for P & Z members in-accordance with Ordinance No. 1381, the members present drew lots. Th~ Recording Secretary drew for the three absent members. Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordinance to annex the property. Seconded by Commissioner Keith and carried. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize payment, from City Hall grant fund, of statements as follows: a. Watson and Company, Architects, in amount of $1,827.80. b. Jammall and Associates, Engineers, in amount of $1,270. Seconded by Commissioner McClanahan and carried. The City Clerk reported that the note for purchase of City Hall land and Architect's fees, in amount of $175,000 at Atlantic National Bank of Sanford is due May 13, 1977, with interest in amount of $1,941.78; and that Atlantic National Bank of Sanford will renew the note for 90 days.at the-same-interest rate of 4~%. Commissioner Morris 'moved to renew the note and authorize payment of the interest. Seconded by Commissioner McClanahan and carried. The City Manager submitted a report on proposed legislation, and.was authorized to report the Commission's view~s on~,the: proposed.bil~ls.to the Legislative Delegation. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize transfer in 'amount of $124.35 from Contingency Account to Finance Department for a secretary to attend the Governmental S~ecretarie's Conference in, Stz~ Petersburg on .June 8 through 11, 1977' Seconded by Commissioner McClanahan and carried. The City Manager reported that the term of Dr. John Darby on the Civil Service Board will expire June 30, 1977, and that he is willing.to.-serve~again. Commissioner McClanahan moved to re-appoint Dr. Darby to same. Seconded by Commissioner Keith and carried. The City Manager reported that an employee, who had been with the CitY since 1964 and had retired on April 5, 19'77., ,had re:quested to buy back his past service benefits with the Florida Retirement System and:zequested the City to match his contribution. Commissioner McClanahan moved to authorize the City to match the employee contribution to the Florida Re- tirement System if the person was employed when the City joined the Florida Retir.ement SyStem on May 1, 1973, and if the employee:?makeS the contribution within 90 days after retirement. Seconded by Commissioner Stenstrom and carried. The Director of Recreation and Parks submitted the estimated costs for repairs to the Civic Center to be included in the 1977-78 Budget as follows: 1, Replace all fixtures, valves and hardware in toilets $ 5,200. 2. Install tile in all toilets ~ -~ 4,000. 3. Install concrete ramp in garbage ramp and kitchen service area 600. 4.. Replace folding partitions in Annex and Lobby · . 11,200. (Less expensive walls similar to existing folding curtains - $4,550.) 5. Replace roof on Civic Center and Youth Wing 6. Re.p!ace~tighting in Annex~and Lobby ~ 14,000. 2,500. $37,500. CommisSioner McClanahan moved to authorize items no. 1, 2, 3, 4 and 6, with item 4 similar to the existing fo:lding-¢urtains~.~_Seconded,by~,.Commissioner\~Stenstrom and carried. 99,\ MINUTES City Commissio!l,..Sanford, Florida- - -- · May 10 at 8:00 P.M. 1977 MIDSTATE LEGAL SUPPLY COMPANY The City Manager reported that the LPW City Hall grant will cover most of the costs to enclose a major portion of the first floor; purchase and installation of telephone equip- ment; a stairway; and further, that $175,000 of local funds may be needed for interior designs, architects, furnishings, etc. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize an amendment to enclose most of the first floor, purchase of a private telephone system, and construction of a stairway for the new City Hall. Seconded by Commission~ Keith and carried. Jacqueline Toomer, 1314 Olive Avenue, representing Seminole Neighborhood United Council, submitted a report entitled "Grievances of Citizens in the City of Sanford with Reference to the Sanford Police Department and Sanford Governmental Practices" and requested the Commission to take no action at this time, but to di~scuss same at a later date.~ The Mayor reported that the City of Sanford is under investigation for some of the same matters, and therefore, could not discuss them. Petition for annexation of Lots 13 and 14, Block 13, Dreamwold, was submitted from Mr. and Mrs. Leroy A. Furley. Commissioner McClanahan moved to authorize the City Attorney to prepare the proper ordinance to annex same. Seconded by Commissioner Keith and carried. ' WHEREAS, the County Commission of Seminole County, Florida, is considering the adoption of a comprehensive plan at a public hearing on May 17, 1977, pursuant to the requirements of Chapter 74-612, Laws of Florida, 1974, the same being an act relating to Seminole County local government and'cite~as the "Seminole County Comprehensive Planning Act of 1974~'~ ,'and ...~ :'~ WHEREAS.,.the' City Commission .of the City of Sanford, Florida, recognizes that-it:is'the stated purpose, of'said act to utilize and strengthen the existing r~le., pr~ocesses and powers of: local government in Seminole County; to preserve and enhance present advantages; appropriate use of resources and to deal with problems resulting from development; and to encourage and assure cooperation between and:among~municipalities and county government,~and.. The general philosophy of the proposed comprehensive plan sets forth:~the framework for a consolidation of all major functions of the governments~Of Seminole County and the municipalities within Seminole 'County except'tho,Se func~tions o'f' utilities and law enforcement. 2. The proposed comprehensive Plan grants unto the Board of County Commissioners :the-authority'to define' urban areas:as those areas developed as intensely as municipalities requiring municipal type services regardless of whether or not the development is located within a municipality. 3. The proposed comprehensive plan provides for the county government to adopt guidelines, processes and criteria for review of annexations by the municipalities. 4. The proposed comp~.ehensive plan fails to address i,tself.~to certain matters that are required in the !'Seminole County Comprehensive Planning ~Act of 1974" as follows: a) Intergovernmental cooperation element;" b) Capital improvement budget; ~ c) Housing inventory and means to correct substandard housing in the County; d) Provision for public utility systems of water and sewer for County areas. 5. The propos~comprehensive plan provides for the County to exercise jurisdiction over the municipalities in that provision is made for planning for county-wide services which would include the municipalities. Section 5 (2) of the "Seminole County Comprehensive Planning Act of 1974" limits the County's jurisdiction to the unincorporated areas of the County and provides specifically that any extension of the comprehensive plan can only take place by formal adoption of an official agreement by the governing bodies involved. BE IT FURTHER RESOLVED that a copy of this Resolution be presented to the Board of County Commissioners of Seminole County, Florida, and that the content of this Resolution be read'into the reCord at the public hearing on the comprehensive plan of Seminole County, Florida, to be held on May 17, 1977.
