The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the City of Sanford, Florida, at 7:00 ~'clock P. M. on September 12, 1977.

Absent: Police Chief Ben E. Butler
The Mayor recounted events to date regarding the contract with Southern Bell for
installation of the telephone system in the new City Hall. He stated the City had advertised
for proposals, not bids, and two had been submitted from Southern Bell and Florida Interconnect
Telephone Company. Also, the Commission had been invited to observe a demonstmation of the
proposed Southern Bell system, set up at Southern Bell's expense, and never was contacted by
Florida Interconnect Telephone Company personnel and further, Southern Bell pays taxes and
fees in the City of Sanford. A Petition for Re-dress had been delivered to his office, it
was not accepted and the City Attorney was authorized to notify the Attorney for Florida
Interconnect Telephone Company that Sanford would not confer with them in an Administrative
Meeting.
A public hearing was held in accordance with notice published in the Evening Herald
on August 23 and September 2, 1977 as follows:
NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES
AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF
THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA.
Notice is hereby given that a Public Hearing will be held at the
Commission Room in the City Hall in the City of Sanford, Florida, at
7:00 o'clock P. M. on September 12, 1977, to consider changes and amend-
ments to the Zoning Ordinance of the City of. Sanford, Florida, as fol-
lows:
That certain property located at the Northwest corner of the
intersection of West First Street (Highway 46), and Poplar
Avenue is proposed to be rezoned from RMOI (Multiple-Family
Residential, Office and Institutional) District to GC-2 (Gen-
eral Commercial) District. Said property being more particu-
larly described as follows:
The North one-half of Lot 14, Block Y, St. Gertrude's
Addition to Town of Sanford, Plat Book 1, Page 113,
Public Records of Seminole County, Florida.

LeRoyce Stadig, lessee and petitioner, was,present to support the request.
On recommendation of the Planning and Zoning Commission, Commissioner Stenstrom
moved to authorize the City Attorney to prepare the proper ordinance to rezone the property
as advertised. Seconded by Commissioner Morris and carried.

to speak in favor of, or in opposition to, the proposed street closings.
The City Clerk reportad that notices had been mailed to property owners on August
23, 1977.
A petition dated September 12, 1977 was submitted by residents on Bay Avenue in
opposition to closing part of Bay Avenue as advertised:
Vance A. Taylor, 2419 South Bay.
Dorothy M. Bach, 2425 South Bay.
Charlotte Nealon, 2440 South Bay.
Viola Laspee, 2442 Bay Avenue.
Fred L. Laspee, 2442 Bay Avenue.
Robin Crockett, 2443 Bay Avenue.
The City Manager reported that a sewer line is located in the Bay Avenue right-
of-way.
Leroy Heath, 2420 South Bay Avenue, stated he was opposed to closing part of
Bay Avenue.
Commissioner Morris moved to table consideration of same. Seconded by Commissioner
Keith and carried.
Vance Taylor, 2419 South Bay Avenue, stated he did not want the oak trees to be

taken down; and that he would be in favor of closing Bay AvenUe up to the trees.
Mr. Loomis Leedy, Fiscal Agent, appeared to discuss steps to set up an irrevocable
bank trust for retirement of 1965 and 1971 Public Improvement Revenue Bond Issues. He stated
the sinking fund would be short about $97,000 in order to initiate the trust at the present
W. Scott Burns, Chairman, Sanford Airport Authority,, submitt&d a recommendation
to re-appoint John Mercer and-H.~;A. Moreland.to:the Sanford Airport Authority, for four year

Maynard, 1805 West 13th:$.treet.~The?City Manager stated~that the City--cannot extend utili-
ties to this area. The Commission,~declined to annex~the property, becauSe utilities cannot
be provided.
Request submitted from the ~BuildingqOfficial fOr a,~waiver to~increase the size of

in an MR-1 zone. Commissioner McClanahan moved to authorize the City Manager:to meet with
the petitioner to permit the construction, subject to site plan approval by Planning and
Zoning. Seconded by Commissioner Stenstrom and carried·
Recommendations dated September 2, 1977 submitted from the Planning and Zoning
Commission as follows:
1. Recommend approval of the rezoning of the N~ of Lot 14, Blk Y, from RMOI to
GC-2.
Recommend-approval for the sale-of:beer.:~an.d wine for consumption on premises
at 1010 State St. :.
Recommend approval of the sale of beer and wine for consumption off premises
at the Convenience Storeiin. Uppland~park, on Upsala Road.'
The City Clerk submitted a map reflecting Discount Communications, 1010 State Street,
is within 500 feet of Bacio's, which currently sells Beer and Wine for ~Consumption on Premises·
Mr. Bowlin, Discount Communications, lOlO.State Street~ stated he wants to open a
saafood restaurant and needs the Beer and Wine License.
Commissioner McClanahan moved to authorize the City Attorney t'o prepare the preper
ordinance to amend the City Code to permit the Commission to waive the 500 foot distance
requirement for sale of alcoholic beverages. Seconded by Commissioner Keith and carried.
Commissioner McClanahan moved to table consideration of the Beer and Wine, Consump-
il tion on Premises license at 1010 State Street. Seconded by Commissioner Stenstrom and carried·
Commissioner McClanahan moved to authorize package sale of Beer and Wine at the
Convenience Store in Uppland Park, on Upsala Road.
Seconded by Commissioner Morris and carried.

Commissioner Stenstrom moved to remove from table, discussion of contents of a time
capsule in the new City Hall. Seconded by Commissioner McClanahan and carried. The Commis-
sion authorized to request ideas to be submitted by City Employees and City Residents.
Dr. Henry McLaulin appeared to support a letter complaining that he cannot get a
permit to shoot squirrel~: that are cutting pecans off his tree before they are ripe. The
Commission stated they will advise the Police Chief that he can issue the permit.

AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
TO ANNEX WITHIN THE CORPORATE AREA~ OF THE
CITY OF SANFORD, FLORIDA, UPON ADOPTION OF
SAID ORDINANCE, A PORTION OF THAT CERTAIN
PROPERTY LYING APPROXIMATELY 168 FEET EAST
OF UPSALA ROAD AND APPROXIMATELY 1460 FEET
NORTH OF PAOLA ROAD, IN ACCORDANCE WITH THE
VOLUNTARY ANNEXATION PROVISIONS OF SECTION

WHEREAS, there has been filed with the City Clerk of the
City of Sanford, Florida, a petition containing the names of the property
owners in the area described hereinafter requesting annexation to the
corporate area of the City of Sanford, Florida, and requesting to be
included therein; and
.WHEREAS, the Property Appraiser of~Seminole County,
Florida, having certified that there are four property owners in the area
to be annexed, and that said property owners have signed the petition for

WHEREAS, it has been determined that the property described
hereinafter is reasonably compact and contiguous to the corporate area

WHEREAS, the City of Sanford, Florida, is in a position to
provide municipal services to the property described herein, and the City
Commission of the City of Sanford, Florida, deems it in the best interest
of the City to accept said petition and to annex said property.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF
THE CITY OF SANFORD, FLORIDA:
SECTION 1. That that certain property in Seminole County,
Florida, described as follows be and the same is hereby annexed to and
made a part of the City of Sanford, Florida, pursuant to the voluntary
annexation provisions of Section 171.044, Florida Statutes (1976):
The North 1/6 of Lot 48, NEW UPSALA, according
to the Plat thereof as recorded in Plat Book 1, Page
67, of the Public Records of Seminole County,
Florida, LESS the West 168 feet and LESS the East
250 feet,
and ALSO
The South 330 feet of Lot 46, NEW UPSALA, according
to the Plat thereof as recorded in Plat BoOk 1, Page
67, of the Public Records of Seminole County,
Florida, LESS the West 168 feet thereof.
SECTION 2. That upon this ordinance becoming effective, the
residents and property owners of the property described herein shall be
entitled to all the rights and privileges and immunities as are from time to
time granted to residents and property owners of the City of Sanford,
Florida, and as are further provided in Chapter 171, Florida Statutes (1976),
and shall further be subject to the responsibilities of residence or owner-
ship as may from time to time be determined by the governing authority of
the City of Sanford, Florida, and the provisions of said Chapter 171,
Florida Statutes (1976).
SECTION 3. That this ordinance shall become effective
immediately upon its passage and adoption.
A copy shall be available at the Office of the City Clerk for all
persons desiring to examine the same.

was next placed on its final reading. After being read by title, the Chairman announced
~hat the Commission would hear from those persons present to speak in favor of, or in opposi-
tion to, the proposed ordinance. No one appeared.

Thereupon, the Chairman announced that the City Commission of the City of Sanford,
Florida, had passed and adopted said Ordinance No. 1390, entitled:

Carl Gutman, Architect, was present to show proposed sketches of additions to the
Commissioner Stenstrom moved to authorize the following:
(1) City Commission approve the over-all conceptual rendering as presented.
(2) City Commission address the possibility of::~he Marina lessee acquiring use of
75 feet of Lot 8, to the West of the dry storage building.
(3) Use of the North side, so that as plans are developed, they could be submitted
to the Commission for approval.
Seconded by Commissioner Keith and carried.
On recommendation of the City Manager, Commissioner McClanahan moved to authorize
the City to rebuild the walkways at the Marina launchings:ramp, at an estimated cost of $1,140,
plus posts if needed, and to authorize transfer from Contingency for same. Seconded by Com-
missioner Morris and carried.
On recommendation of the City Manager, Commissioner Morris moved to authorize pay-
ment of statement in amount of $3,962.79 submitted from Margaret McCormick, Inc., for interior
design work on the new City Hall. Seconded by Commissioner Stenstrom and carried.
Commissioner McClanahan moved to authorize salary reclassification of Elizabeth
Hill from Patrolman C to D - $10,885.49 annual. Seconded by Commissioner Stenstrom and carried
The City Manager was authorized to talk to David Smith about the poorly maintained
Railroad crossings in Sanford.
On recommendation of the City Manager, Commissioner McClanahan moved to authorize
transfer in amount of $247.27 from Contingency to Civil Service Division, Advertising Account.
Seconded by Commissioner Stenstrom and carried.
Request submitted from Elsie Menendez for a 90 day time extension on Condemnation
Report No. 77-762, 807 Pine Avenue.
McClanahan moved to authorize same.
On recommendation of the City Manager, Commissioner

The City Attorney submitted a report on the status of the Downt~m~n Development
Corporation, stating that the legislation requires the City Commission to appoint the initial
14 members of the Board. The Commission authorized the Downtown Development Corporation
to submit recommendations for appointees.
On motion of Commissioner Stenstrom, seconded by Commissioner Keith, Resolution
No. 1232 was introduced and read in full. Said resolution being in words and figures as fol-
lows:

CITY MANAGER TO SUPERVISE THE OPERATION OF
THE POLICE DEPARTMENT AND THE FIRE DEPART-
MENT ON A TEMPORARY BASIS.
WHEREAS., Section 5.01 of Article V of the Charter of the City
of Sanford, Florida, provides for the appointment of the"Chieflof ~he Police

Department and the Chief of the Fire Department by the City Commission,
and further, provides that the Chiefs of said departments are responsible to the
City Commission for the proper functioning of said departments; and
WHEREAS, it is necessary that the Charter of the City of
Sanford, Florida, be amended if the supervision of the Police and Fire
Departments is to be chamged from the City Commission to the City Manager
on a permanent basis; and
WHEREAS, it is the desire of the City Commission, in order to
have a more orderly and efficient supervision of said departments, to confer
upon the City Manager the authority to supervise the operation of both the
Police Department and the Fire Department until such time as the Charter
may be amended.
NDW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF SANFORD, FLORIDA, that the City Manager be and he is
hereby vested with the authority to supervise the operation of the Police and
Fire Departments on a temporary basis until further action of the~>City
Commission or until such time as the Charter may be amended to provide
for such supervision on a permanent basis.
This Resolution shall be effective October 1, 1977.

Commissioner Morris moved to amend the motion to adopt Resolution No. 1231, to
add "effective October 1, 1977." Seconded by Commissioner McClanahan and carried.
The vote was taken on the motion as amended, and same was carried.
Commissioner McClanahan moved to remove from table, consideration of use of city
vehicles after regular work hours. Seconded by Commissioner Stenstrom and carried.
On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried,

The City Manager reported on a list of grievances from the Sanford Police Depart-
ment employees and stated they Were being checked.
The City Manager reported that Rich Quigley, Assistant to the~CiLy Manager, had
attended a meeting, held by the Florida Division of Community Affairs,' regarding the City's
request for a Community Service Trust Fund Grant for a portion of the EEO Officer implemen-
tation. He stated that Sanford's request for $6,325 was cut to $3,818; while Seminole County's
request in amount of $10,000 and Altamonte Springs~ request in amount of $2,001 were both fully
funded. The City Manager was authorized to contact Mr. Ravenel to discuss same~with him.
Commissioner McClanahan moved to table consideration of same until September 26,
1977. Seconded by Commissioner Stenstrom and carried.
The City Attorney reported that Finance America is going to floor plan inventory
for the Marina, and they have requested the City to ~aive any rights to attach any items
on that plan. On recommendation of the City Attorney, Commissioner McClanahan moved to autho-
rize the Mayor to execute the wazver. Seconded by Commissioner Stenstrom and carried. There being no further business,, the meeting was adjourne;~/j
