A public hearing was held in accordance with notice published in the Evening Herald on October 4 and 14, 1977 as followS: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at.the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 24, 1977, to consider changes and amend- ments to the Zoning Ordinance and the Comprehensive Land Use Plan of the City of Sanford, Florida, as follows: That certain property abutting the North right-of-way line of Lake Mary Boulevard and lying approximately 925 feet West of Hidden'Lake Drive is proposed to be rezoned from SR-1AA (Single-Family Residential Dwelling) District to GC-~ (General Commercial) District~ ~ Said p~operty being more~particularly described as follows: Beginning at the NE corner of Lot 25, Lake Minnie Estates, as recorded in Plat Book 6, Page 92 of'the Public Records of Seminole County, Florida, run S 11° E 973.14 feet; S 73© 54' W 241.84 feet; S 84© 59' 57" W 208.71 feet; S 11° E 417.42 feet to Point of Beginning; thence run N 11© W 208.71 feet; N 84° 59' 57" E 208.71 feet; S 11© E 208.71 feet; thence SWly to Point of Beginning. No one appeared. Planning and Zoning Commission submitted a recommendation to deny the rezoning. Commissioner McClanahan moved to deny the rezoning. M. on October 24, 1977, to consider the adoption of an ordinance by the. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. That that certain property in Seminole County, Florida, described as follows be and the same is hereby annexed to and made a part of the City of Sanford, Florida, pursuant to the voluntary annexa- tion provisions of Section 171.044, Florida Statutes (1976): Lot 46, Less the South 330 feet, excepting the West 168 feet of said South 330 feet, NEW UPSALA, according to the Plat thereof as recorded in Plat Book 1, Page 67, of the Public ReCords of Seminole County, Florida.. SECTION 2. Seconded by Commissioner Morris and carried. ~ Petition submitted by Mr. and Mrs. R. M. Wilkins, 433 Scott Avenue, for annexa- tion of Lots 5 and 8, Block 4, A. B. RussellJs Addition to Ft, Reed.. The Ci.ty Manager reported the property is not contiguous to the City, no sewer is available, only a 3/4 inch water line is available, and recommended to deny. 'Commissioner Morris moved to deny the annexation. Seconded by Commissioner McClanahan and carried. The City Manager reported that Keller Industries had chosen :an alternate site for their proposed smelter plant, South of Cornwall Road and West of the Seaboard Coast Line Railroad right-of-way. Also, the property owner on the South had requested the City to pave Cornwall Road from Sanford Avenue East to the Seaboard Coast Line Railroad, a distance of 2,108 feet, with the property owner to pay for materials. Mr. Howard Marsee, Attorney from the firm of Fitts, Eubanks, Ross and Rumberger, stated he represented cnncerned 'property owners in the Silver Lake area. He suggested the Commission hold a public hearing, with reasonable notice to everyone concerned, and asked if City, State and Federal requirements had been met by Keller for the construction of their proposed smelter plant. Mr. William E. Leach, 100 East Airport Boulevard, Sanford, stated he had been laround smelting plants for many years and felt the plant should be brought to Sanford He stated this type of operation was governed by OSHA as well as to produce more jobs. follows: Those appearing'in' opposition~to the.proposed Keller .Industries Plant'were as Steve Sirkin, Silver Lake. Commissioner Morris moved to authorize a:~Special Meeting.to be. held November 21 at 7:00 P. M. so that proponents and opponents of.Keller Industries could be heard. SUPPLY COMPAN~ 19 77 On recon~aendation of the City Manager, Commissioner McCl~nahan :moved to authorize salary reclassification for Johnnie Cain, from Refuse Laborer II D to E, $8,112.17 annual. Seconded by Commissioner Keith and carried. The Suggestion Review Committee.recommended a $25 award to Don Parnell, Dianne Magner and Rick Holloway for suggestion of a jumper wire to protect servicemen from electrical shock while installing or removing meters. Commissioner Stenstrom moved to authorize same. Seconded by Commissioner Keith and carried. On recommendation of the City Manager, Commissioner Stenstrom moved to adopt Policies as follows- (1) Employees' Personnel Files only one file maintained on each employee. Central Repository for all employees' files shall be the personnel section of the Office of Assistant to the City Manager. (2) Employees - Non Work Related Injuries - if employee injured while partici- pating in non-work related physical exercise and/or activities, or sustains any non-work related injury during working hours, cost for treatment for such shall be the responsibility of injured employee and any time away from work will be charged to sick leave. Seconded by Commissioner Morris and carried. Commissioner McClanahan moved to authorize $1,718.00 expenditure from U. S. Revenue Sharing contingency funds, to replace the Public Works and~Utitity base station radio, which was struck by light.ening. Seconded by Commissioner Stenstrom and carried. Commissioner Stenstrom moved to authorize the closing of First Street from Park Avenue to Magnolia Avenue. on October 26, t977~from 9:15 A. M. to 10:15 A. M. for the Golden Age Olympics. Seconded by.Commissioner Keith and carried. The City Manager reported that Police Chief Wally LaPeters had not been able to find a suitable home in the City. The Commission approved the Police Chief to reside outside the City. ,Commissioner Stenstrom moved to authorize payment of approximately $2,878.65 to Kenwood Moving and Storage, Inc., Cedar Rapids, Iowa, for the moving expenses for the Police Chie£ and also,-.air~--fare~ for his family, and further~ to authorize a transfer from Contigency to provide for same. Seconded by Commissioner Morris and carried.. A public hearing was held in accordance'with notices mailed to Bacio's Italian Villa, Inc. and Mr. Ed's Pizza, as follows: NOTICE IS HEREBY GIVEN IN ACCORDANCE WITH CHAPTER 3, Section 3-4 of the City of Sanford Code that a Public Hearing will be held at 7:00 o'clock P. M. in the City Commission Room, City Hall, to consider a request for the sale of alcoholic beverages for consumption on prem- ises. · ~'~ Provisions of said section require a notice to be directed to existing businesses already established for the sale of alcoholic beverages for consumption on premises located within 500 feet of the proposed estab- lishment of the applicant.~ Date of Public Hearing: Applicant: · Address: Business: October 24, 1977~ Allen R. The Chairman amnounced:that the Commission would hear from thOse persons present to speak in opposition ~to; or in favor of, the requested~ alcoholic beverage license. Mrs. Annette Bisigni, 230 Krider~Road, representing Bacio's Italian Villa, Inc., appeared in opposition to the license. Mr. Allen R. Bowling, 300 Art Lane, appeared to support his request. Commissioner Morris moved to waive the 500 foot requirement between businesses selling alCoholic beverages, for consumption on premises, and to authorize the request. SecOnded by Commissioner McClanahan and carried over the'dissenting vote of Commissioner Stenstrom. The City Manager reported that all of the police officers had voted fOr their pension system to go strictly un, er Chapter~185, Florida Statutes, and recommended the following: (1) Instruct the City Attorney to contact the Attorney General's Office to get information on how an officer can choose to stay under the present retirement plan, if he was hired under it. (2) Instruct the City Attorney to prepare legislation to abolish the present Pension Fund, which abolishment will automatically place the police pension fund under Chapter 185. (3) Prepare proper advertisement for legislative hearings. After discussion, the Commission authorized same. On request of the City Manager, the Commission approved transfer from Contigency in amount of $75.00 to provide for purchase of a traveling trophy fOr combat pistol team matches between the Sheriffs Department and the Sanford Police Department team. The City Manager was authorized to survey other cities to determine how wrecker service calls are handled in those cities. Taylor Roundtree appeared to request a two week extension to comply with a lot mowing complaint,for property located at Mulberry Avenue and llth Street. The Commission authorized same. The City Manager reported that there is a 1964 Ford Van and a 1968 Dodge Van from the Police Department which are no longer in use and he would like to buy one and the Police Chief wants to buy one. The Commission asked for written' bids from wholesalers for each van, and sell for the highest figure. On motion of Commissioner McClanahan, seconded by Commissioner Keith and carried, Resolution No. 1237 was read in full and adopted. Said Resolution being in words and figures as follows: RESOLUTION ,OF-THE CITY OF SANFORD, FLORIDA, NAMING AND DED1CATING THAT CERTAIN RECREATIONAL PARK SITUATED ON CELERY AVENUE BETWEEN MELLONVILLE AVENUE AND SCOTT AVENUE AS THE RANDALL CHASE MEMORIAL PARK. 1977 iM IN U T E S ~., City Commission, Sanford'~:F,~orida.:'::~. :October 24 at 7:00 P. Florida, desires to.honor and memorialize one of its former members for.his outstanding leadership and service to the City of Sanford, and WHEREAS, Randall Chase ,Was generally recognized throughout the S~.ate of Florida as a very successful citrus and vegetable grower and business man during more than fifty years of his illustrious career,.and WHEREAS, in addition to his business endeavors,. Randall .Chase was unselfishly devoted to ~governmental, civic, educational, religious and charitable endeavors including the Boy Scouts of America, the Children's Home Society, the Episcopal Church, and further served as Mayor of the City of Sanford, and WHEREAS, in addition to the many other numerous accomplishments and service, Randall Chase served his country in both World War I and II as naval aviator, and WHEREAS, the City Commission wishes to memorialize Randall Chase for his more than fifty years of .service to his city, county', state and country. NOW, THEREFORE, BE IT RESOLVED that the City Commission of the City of Sanford, Florida, hereby names and dedicates that certain recreational park situated on Celery Avenue between Mellonville Avenue and Scott Avenue as the Randall Chase Memorial Park. BE IT FURTHER RESOLVED that this Resolution be read and presented to the family of Randall Chase at the dedication of the park scheduled for Monday, November 14, 1977.
