A public hearing was held in accordance with notice published in the Evening HerAld on November 8 and 18, 1977 as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 28, 1977, to consider changes and amend- ments to the Zoning Ordinance of the City of Sanford, Florida, as fol- lows: A portion of that certain property lying between 24th Street and 24th Place and between Maple Avenue and Laurel Avenue is proposed to be rezoned from RC-1 (Restricted Commercial) District to GC-2 (General Commercia.1) District. Said prop- erty being more particularly described as follows: Lots 1, 2, 9, 10, 19, 20 and the South 27.2 feet of Lots 3 and 18, Block 15, 3rd Section Dreamwold, Plat Boo~ 4, page 70, Public Records of Seminole County, Florida, and Lots 1 through 12, Beck's Addition, Plat Book 3, page 101, Public Records of Seminole County, Florida. The Planning and Zoning Commission submitted a recommendation to rezone the property as advertised. The City Clerk reported that notices had been sent to property owners on October 26, 1977. Raymond Weinmann, 607 West 24th Street, Sanford, stated he had no objection to the rezoning, as long as no "rough" businesses were established there. Commissioner Morris moved to table consideration of the rezoning. Commissioner McClanahan and carried. Seconded by Commissioner Stenstrom and Commissioner Morris moved to remove from table, a public hearing to consider clos- lng portions of Third, Fourth and Fifth Streets, and part of an unnamed North-South Street, and parkw~s, lying West of Persimmon Avenue and between the Westerly extension of Second Street and the Seaboard Coast Line Railroad right-of-way. Commissioner Morris moved to authorize the City Attorney to prepare the proper ordinance to close, vacate and abandon the streets and parkways within property described as follows: Commence at the intersection of the Southerly right-of'way line of S 46 and the Westerly right-of-way line of Persimmon Avenue according to Florida Land and Colonization Company's Map of St. Gertrude: Addition, Plat Book 1, Page 117, Seminole County, as located in the Town of Sanford, Florida, run thence South along the Westerly right-of-way line a distance of 400 feet for a Point of Beginning, thence continue South along the Westerly right-of-way line a distance of 920.95 feet to the Easterly right-of-way line of the Seaboard Coast Line Railroad, thence~ North 54° 21' .3.5U.-W along the Easterly:right- · of-way of the Seaboard Coast Line Railroad a distance of 566.42 feet. thence N 0° 21' 07" E a distance~of 578.84 feet, thence N 886 29' 09" E a distance of 456.93 feet to the Point of Beginning. Blair McGarvey for waiver of Section 8-25 of the City Code, requiring the installation of overhead electrical wiring on Lots 16 through 20, Block 3, Dreamwold 3rd Section, since all the :existing houses in the area have overhead wiring. Commissioner Morris moved to grant the waiver. Seconded by Commissioner--stenstrom and carried. The City Attorney. reported that, as part of the settlement of the suit between Seminole County and the City of Sanford, regarding Ordinance No. 1390, that Ordinance No. 1390 was quashed and dectarad of no. further force and effect .on November 28, 1977 by the Circuit Court of the Eighteenth Judicial Circuit, Seminole County, Florida, and that Semi~ole~.Coun~y-~:~ has no objection to some of the property contained in Ordinance No. 1390 being annexed into the City. On motion of Commissioner Morris, seconded by Commissioner Stenstrom and carried, Ordinance No. 1402, entitled: -AN~ORDINANCE OF -THE CITY OF SANFORD, FLORIDA, TO ANNEX WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, FLORIDA, UPON ADOPTION OF SAID ORDINANCE, A PORTION OF THAT CERTAIN PROPERTY LYING APPROXIMATELY 168 FEET EAST OF UPSALA ROAD AND APPROXIMATELY 1460 FEET NORTH OF PAOLA ROAD, IN ACCORDANCE WITH THE VOLUIYfARY ANNEXATION PROVISIONS OF SECTION 171.,044, FLORIDA STATIY~ES. was introduced and placed on first reading and read in full. The City Manager reported that requests had been submitted for water connections to property outside the City on East Celery Avenue as follows: 1. Chase and Company - First house on the North side, East of the City limits. 2. Mr. Robert Ansley, North side of Celery Avenue, East of radio station. Commissioner McClanahan moved to authorize both water connections, subject to payment of connection fee of $500 each. Seconded by Commissioner Morris and carried. On recommendation of the City Manager, COmmissioner Stenstrom moved to authorize salary reclassification of Harold Bradley, from Equipment Operator I D to E, $7,923.51 annual. Seconded by Commissioner Morris and carried. Admiral Richard Fowler, Silver Lake, asked if there would be any further action by the Commission regarding Keller Industries. The Mayor stated there would be none right now; however, later on, there would have to be ordinances and resolutions to validate the Industrial Revenue Bond Issue. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize Payment in amount of $1,866 from Revenue Sharing Trust Fund to Watson and Company, Architects for the new City Hall. Seconded by Commissioner Morris and carried. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize a city policy to make it mandatory for law enforcement officers to wear bullet proof vests while on duty. Seconded by Commissioner Morris and carried. The City Manager was authorized to prepare a list, indicating those employees having 10 years or more vested interest in the Florida Retirement System; and those employees having less than 10 years in the Florida Retirement System. Resolution submitted from the Semimole County Board of Realtors, recommending amending the Seminole County Comprehensive Planning Act of 1974. Commiss£oner McC'lanahan moved to authorize the City Attorney to draft a bill to repeal the Seminole County Comprehen- sive Planning Act of 1974. Seconded by Commissioner Stenstrom and carried. The City Attorney reported that the double taxation suit against Seminole County was under advisement by Circuit Court Judge Dykes, and he had not ruled on it. The City Manager reported that ~he City has $4,666.78 in unpaid, contested Unemployment Compensation claims, over the past two years. Commissioner Morris moved to authorize payment of same. Seconded by Commissioner Stenstrom and carried. Commissioner Stenstrom moved to authorize the City to prepare proPosed legislation to submit to the Legislative Delegation, to annex property completely surrounded by the City. Seconded by Commissioner Morris and carried. The City Manager reported that the Chamber of Commerce had requested the City to purchase a copier-for:th:em, under State Contract, and they will pay the City. Commissioner Stenstrom moved to authorize the City to purchase same, and deduct the payment from their annual publicity appropriation. Seconded by Commissioner McClanahan and carried. On recommendation of the City Manager, Commissioner Morris moved to authorize SEEDCO to use the Civic Center, with alcoholic beverages, December 2, 1977, at $250 fee. Seconded by Commissioner McCtanahan and carried. Tom Wilson, ExecUtive Director, Sanford Housing Authority, submitted a report prepared by Gutman, Dragash, Associates, Inc. for a four-story 60 unit housing development for the Elderly to be located in Sanford, and requested the Commission to authorize his office to submit to HUD an application for a preliminary loan for traditional low rent public housing. Commissioner McClanahan moved to authorize same. Seconded by Commissioner Morris and carried. Request submitted from Jeff Hodges, representing Citrus Country Toyota, 185 West Airport Boulevard, to use a trailer sign on the Northwest corner of their lot, for a new dealership and new car sales promotion, for 90 days beginning November 29, 1977. On motion of Commissioner Stenstrom, seconded by Commissioner McClanahan and carried, same was authorized, with the stipulation that no flashing lights be used on the sign. M. z9 77 The Commission authorized a transfer from contingency in amount of approximately $200 to provide for a case to display the bi-centennial quilt, donated to the General Sanford Museum by the Woman's Club' of San.ford. The Commission requested Building Official Bill Braceland to be present at the next City Commission meeting to explain the-Life Safety Code.
