The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on December 13, 1977. Present: Mayor-Commissioner Lee P. Moore CommissionerJohn G.~Morris Commissioner Julian L. Stenstrom Commissioner. A, A. McClanahan Commissioner Eddie O. Keith City AttorneyC. Vernon Mize, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. The meeting was called to order by the Chairman. Mr. Loomis Leedy, the City's Fiscal Agent, submitted an offer from Fisher, Johnson, Allen & Burke, Incorporated, and Arch W. Roberts and Company to purchase $750,000 City of Sanford Public Improvement Revenue Bonds dated September 1, 1977 and maturing September 1, 1978-81, with a discount of $9,750, and also submitted a good faith check in amount of $7,500. Commissioner Stenstrom moved to accept the aforesaid offer and to authorize sale of $750,000 Public Improvement Revenue Bonds. Seconded by Commissioner McClanahan and carried. On motion of Commissioner Stenstrom, seconded by Commissioner Keith and carried, over dissenting vote of Commissioner McClanahan,. Resolution No. 1238 was read in full and adopted. Said resolution being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, AUTHORIZ- ING AND DIRECTING APPROPRIATE ACTION TO BRING ABOUT THE ISSUANCE OF AN INDUSTRIAL REVENUE BON~ ISSUE UP TO $750,000.00 FOR THE FINANCING OF THE CONSTRUCTION OF AN INDUSTRIAL PLANT FOR USE BY KELLER INDUSTRIES, INC., IN THE cITY OF SANFORD, FLORIDA. WHEREAS~, on Augustil~ 1977 at a..spe~ial session, of the City Commission of the City of Sanford, Florida, Keller Industries, Inc., requested the City Commission to validate a $600,000.00 industrial revenue bond issue to fund the construction of a 15,000 square foot building to be used as an aluminum smelter for the manufacturer of aluminum products, and WHEREAS, it has been determined by the Zoning and Planning Commission of the City of Sanford and the City Commission of the City of Sanford that the property upon which Keller Industries, Inc., proposes to construct its facility is properly zoned to allow the contemplated industrial use, and WHEREAS, the City Commission at a special session on October 3, 1977 voted to authorize appropriate action for an industrial revenue bond issue of up to $750,000.00 for the construc- tion of an industrial ~acility by Keller Industries, Inc., and WHEREAS, further consideration was given to the matt. er by the City Commission in a public meeting before the City Commission Mi!,i N U T E S .......... :, .................. .City:.:Commission;Sanf~or~l; Florida~ December !3, at 7:00 P.M. .19 77 industrial use were considered after hearing from all concerned Parties, and WHEREAS, it is the opinion of the City Commission of the City of Sanford, Florida that the proposed project of Keller Industries, Inc., will make a significant contribution to the economic growth of the city, will provide gainful employment and will serve a public pnrpose by advancing the economic prosperity and general Welfare of the State of Florida, and WHEREAS, the City Commission is of the opinion that the City of Sanford, Florida will be able to cope satisfactorily with the impact of the industrial project contemplated by Keller Industries, Inc., and will be able to provide the public facilities, including utilities and public services that will be necessary for the construction, operation, repair and maintenance of the project, NOW', THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA,"'that the appropriate officials of the City'Of sanford, be and they are~' ' ' hereby authorized and directed to proceed with the necessary action to bring about an industrial revenue bond issue °flup t° $750,000.00 for the financing of the construction of an';induStrial plant fOr~use by Keller Industries, Inc., in the City of Sanford, Florida~. On motion of Commissioner Morris, seconded by Commissioner Stenstrom and carried, a public hearing, tabled at regular meeting of November 28, 1977, to consider rezoning a portion of property between'First Street and Second street and between Avocado Avenue and Mangoustine Avenue from RMOI to GC-2 District was removed from table. ...... , .............. On recommendation of the Planning and Zoning Commission, Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordinance to rezone Lots 19 through 26 and Lot 36, and abutting vacated alleys, Graceline Court, from RMOI to GC-2 District. Seconded by Commissioner Morris and carried. On motion of Commissioner McClanahan, seconded by Commissioner Stenstrom and carried, a public hearing, tabled at regular meeting of November 28, 1977, to consider rezoning a portion of property between 24th Street and 24th Place and between Maple Avenue and Laurel Avenue from RC-1 to GC-2 District was removed.from.table. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning of Lots 1, 2, 9, 10, 19, 20 and the South 27.2 feet of Lots 3 and 18, Block 15, 3~d Section Dreamwold and Lots 1 through 12, Beck's Addition. No one appeared. The Planning and Zoning Commission submitted a recommendation to rezone the property as advertised. Commissioner McClanahan moved to authorize the City Attorney to prepare the proper ordinance to rezone only Lots 1,.2~ 9, 10, i9. and~20 and the South'-:27.2 feet of Lots 3 and 18, Block 15, 3rd Section Dreamwold from RC-1 to GC-2. Seconded by Co~missioner Keith and The Police Chief reported that Jesse Holloway, Goldsboro Bar, 1610 West 13th Street, carried. had requested permission to sell alcoholic beverages on Sunday, Christmas Day, 1977. iiCommissioner McClanahan moved to deny the request and affirmed that the Ordinance prohibiting sale of alcoholic beverages on Sundays would be in effect on Christmas and New Year's days SeConded by Commissioner Keith and carried. in 1977. Recommendations dated December 2, 1977 submitted from the Planning and Zoning Commission as follows: Recommend approval to the City Commission to rezone from RMOI to GC-2, Lots 19 thru 26 and Lot 36, Graceline Court, 1215 W. First St. (Applicant-Roger Hunt, for Used Car Lot.) Tabled to next meeting, a Public Hearing to rezone from MR-2 to GC-2, Lots 1,2,3,6,7,8,9 and 10, Blk 6, Tr. 10, Town of Sanford, located between 4th & 5th Sts. and between Holly and Maple. (Horton, Bennett, Ogden, Osgood, Yates). Owners of Lots 4 and 5 were present and in opposition to GC-2, but had no objection to RC-1 adjacent to, and/or including their lots. The Board requested an opinion from the City Attorney as to whether RC-1 would be sppt zoning for the entire block of 10 lots. Statement dated December 5, 1977 in amount of $567.99 submittedifrom Margaret McCormick Interior Design, Inc., for work on the new City Hall. Commissioner Stenstrom moved to authorize same for 60 days, with no flashing lights. McClanahan and carried. Request to.be designated depositories for~City funds for 1978 submitted from Flag- ship U. S. Bank of Seminole, Flagship State Bank and Atlantic National Bank of Sanford. Commissioner McClanahan moved to-designate same as~depositories for City funds for 1978. Seconded by Commissioner Morris and carried. Request submitted from Joel Field for a 90 day time extension on Condemnation Report No. 77-776, 228 West 19th Street. On recommendation of the Minimum~Housing Code Inspector, Commissioner McClanahan moved to authorize same. carried. Seconded by Commissionez On motion of Commissioner Stenstrom, seconded by Commissioner Morris and carried, Ordinance No. 1403, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN WITHIN THE CITY OF SANFORD, FLORIDA, SAID AMENDMENT CHANGING THE ZONING OF A PORTION OF THAT CERTAIN PROPERTY LYING BETWEEN FRENCH AVENUE AND MAPLE AVENUE AND BETWEEN 24TH STREET AND 24TH PLACE TO GC-2 (GENERAL COMMERCIAL) DISTRICT. was introduced and placed on its first reading and read in full. Fire Chief Harriett, Fire Prevention Officer Poovey, and Building Official Bill Braceland were present to answer questions regarding the Life Safety Code. Mr. Forrest Foggin, 1902 French Avenue, Sanford, related incidents that happened: during the construction of his building at 1902 French Avenue; and to appeal the Board of Adjustment's denial Of a variance to allow him to build to the property line. The City Manager stated that appeals from the Board of Adjustment must be directed to the Circuit Court only. Building Official Bill Braceland stated that the Board of Adjustment is able to grant variances in hardship cases; and that Mr. Foggin's was not a hardship, it was a case of a builder trying to put.too much on the lot. Commissioner McClanahan moved to authorize the City Manager to try to solve the problem. Seconded by CommisSioner Stenstrom and carried. Gordon Meyer stated he built and occupied a five-unit office building in 1973, and that when a recent vacancy occurred, the occupant was denied an occupancy permit because the walls were not constructed of one hour fire resistant material, as required by the Life Safety Code. Commissioner Morris asked if the City could adopt addition regulations to enable the City to issue permits for construction complying with an equivalent as required in the code. Commissioner Morris moved to authorize the Mayor to execute a letter for coordi- nated efforts between Seminole County and the municipalities in Seminole County to review the 208 management resolution and work out a cooperative and coordinated management system. Seconded by CommiSsioner Keith and carried. The City Manager was authorized~-to contact other Seminole'County municipalities to determine their interest in legislation for annexation of pockets entirely surrounded by a city. The Commission authorized Ewell White to construct a planter on each side of his gate, 16 feet from the curb line, 106 Club Road. Commissioner Morris moved to authorize the City Attorney to prepare a resolution claiming double taxation for period from October 1, 1970 through September 30, 1977. Seconded by Commissioner Stenstrom and carried. On recommendation of the Suggestion Review Committee, Commissioner Morris moved to approve the suggestion submitted by Angelo A. Camacho regarding the disposition of old City uniforms. Seconded by Commissioner Stenstrom and carried. On recommendation of the City Manager, Commissioner McClanahan moved to approve the Sanford Housing Authority's application to HUD for funding in amount of $258,500 for a pro- gram to reclaim substandard housing by purchasing, improving and reselling, said program to be used to train unemployed. Seconded by Commissioner Morris and carried. The City Attorneyreported that he had received a letter from the attorney for Sanford 86 Ltd. Partnership, proposing that $4,000 of the $10,000 deposit be dispered to the City and the balance of $6,000 be retained as liquidated damages to them. On recommendation of the City Attorney, Commissioner Stenstrom moved to accept the proposal. Seconded by Commissioner Keith and carried. The City Manager reported that the City.had.salvaged the hollow cornerstone from the old City Hall, and that the metal box in it contained a Woman's Club Book, partial list of City officials, and other papers. Commissioner Stenstrom suggested putting a list-of names of all City Boards, Agencies, and employees in the cornerstone in the new City Hall.
