CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONINGORDINANCE OF THE CITY.OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P;. M. onJanuary 2, 1978, to consider changes and amend- ments to the Zoning Ordinance and the Comprehensive Land Use Plan of the City of SanfOrd, Florida, as'follows: A portion of that certain~property lying between~Fourth'Street · and Fifth Street and between Holly Avenue and Maple Avenue is proposed to be rezoned from MR-2 (Multiple-Family Residen- .~ial Dwelling) District to GC-2 (General Commercial) District. WHEREAS, Ordinance No. 1390 passed and adopted by the City Commission on September 12, 1977 was quashed and declared of no further force and effect on November 28., 1977 by the Circuit Court of the Eighteenth Judicial Circuit, in and for Seminole CoUnty, Florida_, in that certain'case entitled County of Seminole} State of Florida, vs. City of Sanford, a Florida municipal corporation; Case No. 77-2015-AP-01-E, and ~ WHEREAS, the~County Commission of Seminole County, ' Florida, has advised the City Commission of the.-.City, of Sanford, Florida that it has no objection tothe annexation of the property hereinafter described, and WHEREAS, the City Commission has been adviSed that it is necessary that a new ordinance be adopted to appropriately annex the property hereinafter described into the corporate limits of the City of Sanford, Florida, and WHEREAS, there has been filed with the City Clerk of the City of Sanford, Florida, a petition containing the names of the property owners in the area described hereinafter requesting annexation to the corporate area of the City of Sanford, Florida, and requesting to be included therein; and WHEREAS, the Property Appraiser of Seminole County, Florida, having certified that there, are four property owners in the area to be annexed, and that said property owners have signed the petition for annexation; and WHEREAS, it has been determined that the property described hereinafter is r:easonably compact and contiguous to the corporate area of the City of Sanford, Florida, and it has further been determined that the annexation of said property will not result in the creation of an enclave; and WHEREAS, the City of Sanford, Florida is in a position to provide municipal services to the property described herein, and the City 'M: I'N U T E S City Commission,'.~Sanfortl, Florida: ;:_..::~anuar~y. 2, at 7: 00 P. That that certain property in Seminole County Florida, described as follows be and the same is hereby annexed to and made a part of the City of Sanford, Florida, Pursuant to-the voluntary annexation provisions of Section 171.044, Florida Statutes: The South 250 feet of Lot 46, NEW UPSALA, accord~ ing to the Plat thereof, as recorded in Plat Book 1, page 67, of the Public Records of Seminole County, Florida, Less the West 168 feet thereof; AND the North 30 feet of Lot 48, said NEW UPSALA, Less the East 250 feet and Less the West 168 feet; AND the North 1/6 of said Lot 48, Less the North 30 feet and Less the East 250 feet and Less the West 368 feet. SECTION 2. That upon this ordinance becoming effective, the residents and property owners of the property described herein shall be entitled to all the rights and privileges and immunities as are from time to time granted to residents and property owners of the City of Sanford, Florida, and as are further provided in Chapter 171, Florida Statutes. SECTION 3. That this ordinance shall become effective immediately upon its passage and adoption. On recommendation of the City Manager, Commissioner Morris moved to authorize the Sanford Housing Authority use of 10,000 square feet of City property to build and maintain a basketball court in Dr. Starke Park, adjacent to Lake Monroe Terrace on West Fifth Street, with the provision that no lights are erected, and with a reverter clause to the City if the property is not properly maintained. WHEREAS, the City Commission herein called the "Applicant", after thorough consideration of the problem and available data, has determined that the project described above is in the best int;erests of the general public: Micro-film, records system, and WHEREAS, under the terms of Public Law 90-351 as amended, the United States of America has authorized the Law Enforcement Assistance Administration, . through the Florida Bureau of Criminal Justice Planning and Assistance, to make Federal Grants and to its benefit to file an application under said Act and to authorize other action in connection therewith; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA: Section 1. That the project generally described above is in the best interests of the Applicant and the general public. Section 2. That Wallace N. Recommendation dated December 28, 1977 submitted from the Building Official for the Central Examining Board as follows: 1. Recommend Section 8-3 of the City Code be amended to read: Sec. 8-3. NATIONAL ELECTRIC CODE ADOPTED. The National Electrical Code of 1978 as prepared by the National Fire Protection Association, as amended by Central Florida Advisory Code Committee Notice F, and further amended as follows: "Aluminum conductors shall not be installed and used in any residential, commercial or other structures hereafter altered, built, constructed, erected, re- paired or moved into the City of Sanford, Florida, with the ~xception of No. 6 AWG and larger conductors for circuits which originate from a panel and terminate at a single device.", is hereby adopted as the electric code of the city, one (1) copy of which code is on file in the office of the city clerk as a matter of permanent record of the city and the matters and contents therein are made a part of th~ chapter by reference as fully and completely as if set forth herein, and such copies shall remain on file in said office available for public inspection. The ·City Manager reported that Mr. Woody Cash had requested return of the Masonic Lodge box, contents, and corner stone from the old City Hall. The City Manager was authorized to return same and to request the lodge to consider placing same in the General Sanford Museum and Library. The City Manager reported that he had met with the Board of Adjustment on December 20 to review the request of Mr. Forrest Foggin for a variance at 1910 French Avenue and the Board of Adjustment voted to. grant the request after the City is furnished with the items as follows: a. A written statement from Mr. Foggin that he will purchase the lot to the rear of his property in 1978 as represented to the Board, and b. A written statement from the property owner of the lot to the rear of his property that the owner will sell that lot to him in 1978. The City Manager reported that it had cost the City $969.58 to replace a light pole on the lakefromt, outside the City, which was struck on December 9, 1977. Commissioner McClanahan moved to turn off the street lights outside the City, on Seminole Boulevard along the lakefront. Seconded by Commissioner Morris. Motion failed to carry over dissenting votes of Mayor Moore, Commissioner Keith and Commissioner Stenstrom. The Commission authorized a notice by letter to be sent to all owners of property on which are located signs not conforming with the sign ordinance, stating that the five year time period in which to bring the signs into compliance will expire in August, 1978. The City Manager reported that a large Christmam tree will be transplanted in the park at First Street and Park Avenue, but ~t may take more than one try to get one to grow. The City Manager reported that the City of Altamonte Springs was the only ~ity to respond to a letter requesting any interest in a'~.local bill to eliminate enclaves, and the reply was affirmative. The City Manager reported that Mr. Jones, Jones Electric, had requested permission to pave the parkway on the West side of Laurel Avenue, South of Fourth Street, to be used as a parking area. The City Manager recommended to deny same. Commissioner McClanahan moved to authorize same, with any input from the City staff toward keeping it orderly.
