The meeting was called to order by the Chairman.
A public hearing was held in accordance with notice published in the Evening Herald
on April 28, 1978 as follows:

The Chairman announced :that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed revocations.
Mr. Gene O'Connell, 134 Hidden kake Drive, ,Sanford, representing Kimber Realty,
owner of five lots in Hidden Lake, stated he does not want residences constructed that are
not comparable with preSent structures.
Mr. Wayne Sanborn, representing First Federal of MidiFlorida, 1040 West University
Avenue, DeLand, owner of undeveloped portions of Sanora and Sanora South, stated his firm
wants to retain the Planned Unit Development Plan.
Mr. W. C. Hutchison, Attorney, 230 North Park Avenue, stated Hidden Lake Develop-
ment Corporation, Mr. and Mrs. A. B. PeterSon, Jr., and Flagship Bank of Orlando, owners of
Hidden Lake Property, want to retain the Planned Unit Development Plan.
Mr. Hutchison also represented McCormick and McCormick, Inc., owner of 35 acres
near Carriage Cove, and stmted they want to retain the Planned Unit Development Plan.

The City Manager recommended:
(1) ,The City. Attorney be authorized to prepare the proper ordinance to amend
the Zoning Ordi~nce, Azticle VIII, Supplementary Regulation, Section 1.
Planned Unit Development District, paragraph C. Review and Approval
Procedures, subparagraph (8), to permit the Commission to reinstate any
lapsed development plan for an additional period of one year.
(2)
Authorize City Staff to issue building permits under old PUD plans, upon
receipt from property owners of proper letter of intent that all develop-
ment will comply with PUD plan of record.
Commissioner Morris moved to authorize the City Attorney to prepare an emergency
ordinance to implement Item (1), above. Seconded by Commissioner Keith and carried.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, vacating and abandoning the easement.
Mr. Mel Mindich, representing Dreyfus Development Company, stated the vacating was
necessary to re-align the roadway with the already installed underground drainage and sewer
lines, and to widen the right-of-way from 70 feet to 80 feet.

be recorded upon completion .of the afOresaid closing and vacating procedUre.

Commissioner McClanahan moved to authorize the City Attorney to prepare the proper

Mr. Bill Heffernan, Jr., Attorney for .Mr. R. G. Knodracki, app,eared to appeal the
denial of a building permit for 2711 Orlando Drive.." The CitY Clerk reported that the Plan-
ning and Zoning Commission had denied the site plan and conditional use for a new metal parts
storage building for Kondracki and Sons, due partly to Mr. Kondracki's statement and in-
sistence that all repair work had to be done out front.
Mr. Heffernan stated that Mr. Kondracki wants to work in front until the new metal
building is up; then he will clean out:~.~he bays in the existing building and do more work
inside, however, 10 to 15 cars currently being repai:red will remain in front on the apron.
He stated he will improve the property as follows:
(1) Erect a site proof fence on the North side of the existing building.
(2) New building will allow more storage space.

The City Manager reported that Mr. Kondracki has been before the Planning and
Zoning Commission three times; each time he has been asked to clean up the property, and
he has not done so He also stated that the Planning and Zoning Commission had denied the
site plan, as presented.
Commissioner Stenstrom moved to table consideration of the site plan, until same
is presented to the Commission. Seconded by Commissioner McClanahan and carried over
dissenting votes of Mayor Moore and Commissioner Keith.
Request submitted from the Ambassador of Christ Church, 750 West Ninth Street, for
a time extension to pave the pmrking lot. The City'Clerk reported that the Planning and
Zoning Commission approved the~site plan and conditional use for a church, with stipulations
of paving and land-scaping. Commissioner McClanahan moved to authorize a 12 months waiver
of the requirement to pave theparking lot. Seconded by Cor~issioner Morris and carried.
Mr. Ken McIntosh, Attorney, was present to explain a proposed resolution to
initiate a tax exempt revenue bond issue to construct 50 dwelling units for economically
disadvantaged persons. He stated that Sanford Villas Limited would be the owner, and as a
private owner, would pay full City Taxes of approximately $15,000 to 17,000 per year. He
also stated the City would have no liability for the bonds.
Mr. Joe Chapman, President, Royal American Construction Company, Panama City, Florida,i
and Mr. Wick Austin, holder of the housing assistance payment agreement from HUD for 50 units
of rental housing, were also present.
Commissioner Stenstrom moved to authorize the Mayor to execute' Resolution No. 1244,
to initiate the bond issue. Seconded by Commissioner Morris and carried. Said resolution
being in words and figures as follows:

elderly and handicapped persons of~low-income located in.the County
of Seminole, Florida (the "Project"); and. .
WHEREAS, the project wi~ll be developed and~owned~by a
limited partnership.organized and existing .under the Uniform
Limited Partnership Law Act in the State of F, lorida; and

of Section8 of the United States Housing Act of, 1937, as amended,
the United States Department of Housing and Urban Development

Agreement"), providing for~ the execution of a Housing Assistance~
Payments Contract (the "Section 8 Contract").by HUD and the

obligated to make housing assistance payments to the Owner~ on behalf~

its right, title and interest in and to the Section 8 Agreement
and Section 8 Contract~ to the corporation; and
WHEREAS, in order to raise funds with which to provide
the pe'rmanent mortgage financing for the project, the corporation
intends to issue Sanford Housing Development Corporation, Inc.,
First Lien Revenue Bonds, Series 1978, (Sanford Apartments-Section 8
Assisted Elderly ProjeCt), dated as .~of April 1, 1978 .(the "Bonds"),
to be secured by a Trust Indenture dated as of April 1, 1978, from
the corporation to a bank or trust company, as Trustee; and
WHEREAS, it is now necessary and advisable for the 'City
Commission of the City of Sa~iford to adopt this resolution so as to

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSIONERS OF THE CITY
OF SANFORD, FLORIDA, AS FOLLOWS:
SECTION 1: It is hereby found and determined that the
plan of the corporation with respect to the project, including the
corporation's projected program and expenditures, will tend to
provide decent, safe and sanitary housing for elderly persons of
low income at rentals which such persons can afford and is hereby

SECTION 2: It is hereby further found and determined
that the Articles of .Incorporation .and By-Laws of the corporation
presented to, this meeting are consistent ,with the Plan of the
corporation and are hereby approved. ~811.105~(b)(1).
SECTION 3: It is hereby, further, found and determined
that the form of Indenture presented to this meeting is consistent
with the plan of the corporation and is.~hereby approved.~.~
. SECTION 4' It. is hereby further found and determined
that the Bonds will be issued in ~connection with a low-income
housing project to be situated in Seminole County, Florida.
SECTION 5: It is hereby further found and determined
that the issuance of the..Bonds by the Corporation pursuant to the
Indenture will. serve to enable the corporation to carry out its
plan and is hereby approved., provided that-each of, the~ Bonds,'~shall
expressly recite that :
"Neither the United States of America, the State
of Florida, the County of Seminole, the City of
Sanford, nor any other political subdivision, agency
or body corporate and politic of the State of
Florida shall in any event be liable for the~
payment of the principal of or interest on the
Bonds or for the performance of any pledge,
obligation or agreement of any kind whatsoever
,of the .corporatiOn, and none of the Bonds nor
any of the corporation's agreements or obligations
shall be construed to constitute an indebtedness
of the United .States or. America, the State of
Florida, the County of Seminole, the City of
Sanford, or any other political subdivision,
agency or body corporate and politic of the
State of Florida, within the meaning of any
constitutional or statutory provision what-
so ever.
SECTION 6: This City Commission hereby approves and
consents to the determination to be made by HUD that the
corporation constitutes an "agency" or instrumentality and a
"public housing ~gency" within the meaning, but only for the
purposes of Section 3(6) of the United States Housing Act of 1937,

as amended, and HUD Regulations 24 CFR, Part 811, Subpart

SECTION 7: The City hereby agrees to review the annual
audit to be made of the corporation pursuant to provision therefore
contained in the Indenture and' to cause such audit, together with
the City's review, to'be forwarded to HUD and to accept title to or

SECTION 8: It is hereby directed that the Bonds shall be
delivered within sixty (60) days of the adoption of this resolution

SECTION 9: If any section, paragraph or provision of
this resolution shall be held to be invalid or unenforceable for
any reason, the invalidity or unenforceability of such section,
paragraph or. provfsio~ shall.not affect,· any of the,,remaining
provisions of this resolution.
SECTION 10: All resolutions and orders:.or parts thereof
in conflict herewith are, to the 'extent of .such: conflict hereby
repealed, and this resolution shall :take effect from and after its
passage, the public welfare requiring it.

as follows:
Reco~nend approval of a request from Max Levine, in the SC-3
District .at 115 N. Laurel Ave. for a change of use from a
warehouse to retail sales and auction, and a request for a
conditional use f:or "sale of beer and wine for consumption off
.premises after approwal by the Sanford City CommissiOn", sub-
ject to proof in writing from First Federal Savings and Loan of
Seminole that they may use their parking lot after 6:00 P. M.

Recommend to City Commission on PUDS. SANORA - SANORA SOUTH,
AMERICANA - CARRIAGE COVE, HIDDEN LAKE. The P and Z Board recom-
mends all platted areas remain as they are (PUD) and do nothing
in regard to rezoning with unplatted areas, let them revert
back to SR-1AA in accordance with Zoning Ordinance. Rezoning
fees would be waived for the original PUD owners resubmitting
application for rezoning from SR-1AA back to PUD. (Due to re-
vocation of unplatted areas.)

Change Subparagraph (8) to read:

Approval of the City Commission shall be in effect
for at least a two year period, however, if no con-
struction has begun within two years after approval
of .the development plan schedule, or if the applicant
fails to maintain the approved development plan sched-
_ule, .the approval of the development plan (undeveloped
area) shall lapse and be of no further effect. At its
discretion and for good cause, the City Cor~i~ission may
extend for one additional year the period for beginning
construction. If the approvals.of a development plan lapses
under this provision, the City Commission shall take the
necessary rezoning action to remove the undeveloped area of
the planned unit development from the official zoning map,
file a notice of revocation with the recorded development
plan, and upon zoning recommendations from the Planning and
Zoning Commission~ rezone the revocated undeveloped area.

The City Manager requested guidelines for a salary schedule adjustment for City
employees for 1978-79 Budget preparation. Commis~sioner Stenstrom moved to authorize the
City Manager to prepare the 1978/79 budget using 1977/78 salary scale, and to plug in any
cost of living s~lary adjuStment after the budget has been studied. Seconded by Commissioner
McClanahan and carried.
On recommendation of the City Manager, Commissioner Morris moved to authorize the
Citizens Band Radio Club to use the Civic Center on May 20, 1978, and.serve alco.holic

On recommendation of the City Manager, Commissioner Keith moved to re-appoint
Don Jones to the Civil Service Board for a two-year term beginning. July 1, 1978. Seconded
by Commissioner Stenstrom~and:carried.
The City Manager reported that the parking lot on the vacated railroad right-of-
way abutting 13th Street'.had ~been completed and was further authorized to proceed with the
installation of the approved no-parking signs--and re-striping of the center line of 13th
Street.
The City Manager reported that DOT will undertake a study of Highway 17-92,
South of Sanford, to consider, increasing the capacity of said road.
The Commission authorized the City Manager to investigate and report on the
possibility of the City providing ambulance service at a nomioal fee;
