Commissioner Stenstrom read a statement, summarizing as false, a charge by the host of a talk show over WKIS Radio that Sanford Police Detective Walter Jones had been offered a promotion to sergeant if he would not testify against the City in an EEOC. investigation. Russell Odham, 102 Krider Road, appeared to request the City to donate a 2 inch meter set for landscaping in the median at the entrance to Sanora Subdivision. Commissioner McClanahan moved to authorize same, with the stipulation that the monthly bill be paid by private sources. Seconded by Commissioner Keith and carried. A public hearing was held to consider the Sanford Airport Authority's proposed 1978-79 budget in accordance with notice published in the Evening Herald on August 14, 1978. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed budget. - Mr. Marv Greenstein, Assistant Airport Manager, was present to support same. Commissioner Morris moved to approve the budget as submitted. Seconded by ComMissioner Keith and carried. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed amendments. Mr. Russell Odham, 102 Krider Road, questioned if any of the proposed amendments would affect the PUD zoning. The Commission stated it would not. On recommendation of the Planning and Zoning Corr~nisSion, Commissioner Keith moved to authorize the City Attorney to prepare the proper ordinance to amend the Zoning Ordinance as advertised. Seconded by Commissioner McClanahan and carried. Mr. Tom Wilson, III, Executive Director, Sanford Housing Authority, was present to discuss the final application for Community Development Block Grants and ask the Commission to approve the application. Commissioner Morris moved to approve same. Seconded by Commissioner Keith and carried. Commissioner Morris moved to authorize the City Manager to execute the necessary papers for the aforesaid application. Seconded by Commissioner McClanahan and carried. Ms. Val Colbert, representing SISTER, Inc., and Chairman of the Train Town Project, was present to ask the Commission to change Sanford's theme to "Train Town USA". She stated this would give merchant,sand civic groups a setting that could be carried out in the decor of businesses, and that a trolly-type train could be used to transport persons between ~m~l~ M~m~l ~n~l_ th~ Downtown business district. M. 19 78 Mr. Dick McFadden, Buffalo, New York, appeared to state his business is to create an environment to stimulate retail sales, and that he felt the proposed train-town setting would accomplish this. Commissioner McClanahan moved to authorize the City Attorney to prepare a resolution, supporting SISTER, Inc.'s Train Town Project. Seconded by CommiSsioner Stenstrom and carried. Requests submitted for water connections to.property outside the City aS follows: 1. Chrylser Realty Corporation, on the East side of 17-92, South of the 7-11 Store at the South entrance to Sunland Estates, 1~ inch water connection. Mr. J. C. Seconded by Commissioner Stenstrom and carried. The City Attorney reported that the six months residency requirement to become an elector under Sec. 8.07 of the City Charter has been ruled unconstitutional by the State of Florida, and that Sec. 8.02 of the City Charter requires Candidates for City Commission to be a qualified elector. The Commission authorized to leave the Charter as it is, and to require Candidates for City election-to abide by the six months requirement. Commissioner Stenstrom moved to remove~from table, discussion, of damage to Mr. Norval Angle's automobile. Seconded by Cormnissioner McClanahan and carried. The City Attorney submitted an opinion that the City ~ould be liable if the City had prior knowledge, or Should have known, that the tree was defective. Commissioner McClanahan moved to reimburse Mr. Angle for the value of the car, $1,475.00, less the salvage price, $275.00, for a net amount of $1,200.00. -Seconded by Commissioner Stenstrom and carried over the dissenting vote of Mayor Moore. On motion of COnimis.siOner Keith, seconded bY Commissioner Stenstrom and carried, minutes of August 14 and 18, 1978 were approved. Commissioner McClanahan moved to authorize transfers from the Contingency account as follows: ~$200.00 for transcript o'f statements concerning the promotion of a police officer. Up to $200.00 for transcripts of statements concerning traf- fic summons. Seconded by Commissioner Keith and carried. On recommendation of the City Manager, Commissioner Morris moved t~o authorize sewer connections for any ~ot in Park Ridge (Fairlane Estates), which is served by an existing sewer line, but not to expand the ~existing system. Seconded by Commissioner StenStrom and carried. On recommendation of the City Manager, Corr~aissioner Morris moved to authorize an amendment in amount of $12,111.31 to increase the engineering contract-for sewer system evaluation study under a 201 federal grant. ,Seconded by Commissioner Stenstrom and'carried. Seconded by Commissioner Stenstrom and The City Manager submitted a request from Mr. Edward Dansberger, to permit parking on the parkway on the South side of 22nd Street at the intersection with French Avenue. He submitted a memo from the City Engineer stating that when the parking was eliminated on French Avenue, the Commission authorized the construction of a curb cut on 22nd Street for off- street parking. The City Manager stated the parking on the parkway would cause vehicles to back into the street at the intersection of a busy highway and recommended to deny the request as a traffic haZard. Commissioner McClanahan moved to deny same. Seconded by Commissioner Morris and carried. The City Manager submitted a request from Sterchi Brothers Stores, Inc., 1100 French Avenue, for waiver of the "non-conforming clause" to permit them'to remove the front portion of their building to install parking, and also to enlarge the building on the South side. He reported they are requesting site plan approval from the Planning and Zoning Commission and a waiver on lot coverage from the Board of Adjustment. On recommendation of the City Manager, Commissioner Morris moved to authorize them to expand their building as described. Seconded by Commissioner Stenstrom and carried. The City Manager reported that a Hunt Company representative has requested the City to consider participation in paving Cornwall Road from Sanford Avenue East to the railroad tracks, with his company to pay for materials and the City to provide labor and equipment. Commissioner McClanahan moved to decline participation in the project. Seconded by Commissioner Morris and carried. The City Manager reported that the office of State Attorney had inquired if the Commission would be receptive to consider leasing 6,883 square feet of the first floor of the City Hall. On recommendation of the City Manager, Corr~r~issioner McClanahan moved to authorize negotiation of same as a temporary measure. Seconded by Commissioner Stenstrom and carried. Commissioner Keith moved to authorize extended use of three investigation division vehicles after hours, until the first meeting in January, 1979. On recommendation of the City Manager, Commissioner Keith moved to authorize trans- fer in amount of $19.~00 from Contingency to Civil Service account for two books to update the Civil Servi~e examinations. On recommendation of the City Manager, Commissioner Stenstrom moved to correct a transfer of funds made at the meeting of August 14, 1978, .to transfer $3,156.51 from Public Projects fund instead of General Fund Contipgency account to provide for cost of material for parking lot on West 13th Street. Seconded by Commissioner Keith and carried. Commissioner SPenstrom moved to adopt the Utility Fund 1978-79 budget as presented. Seconded by Commissioner Keithmd carried. The City Manager reported that the new, proposed rules of the Sta~te ~PERC have been received, and, are expected:to be adopted about November 1, 1978. He stated Sanford will have 45 days from their adoption: to get the local opt~onPERC into existence and rules adopted, and further, that David Kornreich, the City's labor attorney, is not sure the local PERC would be best. Commissioner McClanahan moved to proceed with implementation of the local PERC. Seconded by Commissioner Stenstrom and carried. M. 19 78 MIDBTATE LEGAL SUPPLY COMPANY The City Manager reported that the Building Official had submitted a report listing residences in the Dreamwold Subdivision South of 25th Street that have duplicate or in- correct addresses, and further, that owners contacted do not want to change the addresses. Also, that the postmaster had asked the City to take some action. After discussion, the Commission authorized to leave the addresses as they exist. On motion of Commissioner McClanahan, seconded by Commissioner Keith and carried, a public hearing tabled at meeting of July 10, 1978 was removed from table. Said public hearing to consider condemnation of property at 3515 Orlando Drive, Condemnation Report No. 78-848, Sanford Mobile Park, Inc., owner. Commissioner McClanahan reported that all occupants are out of the trailers, and moved to table the public hearing until October 9, 1978. Seconded by Commissioner Stenstrom and carried. The Commission authorized the City Manager to investigate~the feasibility of in- stalling a sidewalk on the South side of First Street in front of Bram Towers. The City A~.torney reported that Mr. Phillip Logan, Attorney for Shoemaker Construction Company, had submitted a deed to the City for open space property located North of Mayfair Villas and East of Uppland Park, with stipulations that the City leave it in its natural state for percolation, and use as a bird sanctuary for 50 years. Commissioner McClanahan moved to table consideration of same until the City Staff can review and make a recommendation. Commissioner McClanahan moved to authorize the City Attorney to offer Wilco Construction Company 25% of the sale price of the property, when and if, it is sold. Seconded by Commissioner Stenstrom and carried over the dissenting ~ote of Commissioner Morris. The City Engineer stated that Mr. Dansberger wants two additional parking spaces on 22nd Street, which will come closer to French Avenue. Commissioner McClanahan moved~to reconsider action taken earlier in the meeting. Seconded by Commissioner Stenstrom and carried.
