A public hearing was held in accordance with notices authorized at meeting of September 25, 1978, to consider condemnation of 20 structures or buildings on Report Numbers 78-862 through 78-881, Group 52. The Chairman announced that the Commission would hear from any property owner or representative thereof. Fox, owner, 406, 408, 410,412, 414 and Sanford Avenue, Condemnation Report No. 78-879, appeared to request a ~90 day time After consideration, Commissioner Morris moved that finding the bui,ldings under Reports Nos. 78-862 through 78-881 to be unsanitary, unsafe and delapidated, that said structures be condemned and the owner given a notice of 90 days in which to repair or give just cause why same has not been repaired or demolished; and after 90 days to authorize the City to demolish the structures and lev~ a lien against the property for said removal. Seconded by Commissioner Stenstrom and carried. A public hearing was held in accordance with notice published in the Evening Herald on October 5, 1978 as follows: NOTICE OF PROCEEDING FOR VACATING AND ABANDONING EASEMENTS TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of S~nford, Florida, at 7:00 o'clock P.M. on October 23, 1978, in the City Commis- sion Room at-the City Hall in the City of Sanford, Florida, will con- sider and determine whether or not the City will vacate and abandon any right of the City and the public in and'to'-two-easements~.~y~g West of Hidden Lake Drive and between Loch Low Drive and Meadow Hills Court,further described as follows: a. Ten foot utility easement lying between Lots 3 and 4, Block J, Hidden Lake Unit I-C, b. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed, closing and vacating of easements. Mr. William Hutchison, Attorney, appeared to support the request. Commissioner Morris moved to authorize the City Attorney to prepare the proper ordinance to vacate and abandon the easements as advertised. Seconded by Commissioner McClanahan and carried. Mr. Tom Smith, representing the Sanford Church Softball League, appeared to request permission to use three-City softball fields on Saturdays and to play three games on each. The Director of Recreation was authorized to work out a solution with Mr. Smith. MINUTES City Commission, Sanford, Florida October 23: 19 78 MIDSTATE LEGAL SUPPLY COMPANY Offer in amount of $19,000.00 submitted of Lots 63,71,76 and 80, Geneva Terrace. Commissioner Morris moved to authorize~the City Clerk to re-advertise the availability of the property for sale. Seconded by Commissioner Stenstrom and carried. Request submitted for use of mobile trailer signs as follows: A. The Youth Group of The Church of God of Prophecy, 2509 Elm Avenue, request to use a mobile sign at 2933 Orlando Highway, in front of the former Endicott Motor Dealership, from October 24 through 31, 1978, to advertise a spook house, sponsored by the Church. B. James P. McMahon, Manager, Burger Chef, 2506 South French Avenue, requested to use a mobile sign in front of the restaurant, from October 24, 1978 to January 1, 1979, for advertising purposes. Commissioner Morris moved to authorize same, with the stipulation that no flashing lights be used on the signs. Seconded by Commissioner Stenstrom and carried. Request submitted from Virginia S. Young, Broward County Chairman of Floridians Against Casino Takeover, to adopt a resolution opposing the legalization of casino gambling. Commissioner McClanahan moved to authorize the Mayor and City Clerk to execute the proper resolution for same. Seconded by Commissioner Keith and carried. Request submitted from Amos C. Jones, Executive Director, Seminole Community Action, for the Commission to appoint a representative to the Board of Directors of the Seminole Community Action, Inc., for the new program year. Commissioner Stenstrom moved to table consideration of same. Seconded by Commissioner Morris and carried. On motion of Commissioner Stenstrom, seconded by Commissioner McClanahan and carried, requests for time extensions on condemnations were authorized as follows: from Robert E. City of Sanford vs. Helen Constam~ine, et al, $2,328.40. Seconded by Commissioner McClanahan and carried. Commissioner Morris moved to authorize tho"redeem Tax Deed Application No. 100, for 1975, against Lot 8 and the East 11 feet of vacated right-of-way, Block 8, Tier A, E. ~ Traffords Map of Sanford, and to transfer funds from Contingency tm provide for same. Seconded by Commissioner McClanahan and carried. Commissioner Morris~ moved to declare as surplus and offer for sale eight parcels of property obtained through foreclosure, as follows: 1. Lot 8, Block 8, Tier A, Traffords ~nd E 11 ft of vac street. 2. Lot 8, Bl~ck 12, Tier C, Traffords 3. Lots 1 & 2, Block 12, Tier F, Traffords 4. Lot 24, Block 20, Pine Level 5. Lot 16, Block A, M. M. On motion of Commissioner Morris, seconded by Commissioner Keith and carried, minutes of October 9, 1978 were approved. The City Attorney submitted an opinion that the City was not liable to Reverend Ermo Ingel for $195.57 for damage to his car, caused by a limb falling from a tree~ at 1104 South Myrtle Avenue. The City Attorney stated the tree looked ok, and the City had no complaints nor knowledge of anything wrong with the tree. Commissioner St~nstrom moved to deny the request for payment of damages. Seconded by Commissioner Keith and carried. Mr. Robert L. Mooney, Realtor Associate, representing Frisson, Spencer and Lund, appeared to support his request for water and sewer service for an industrial use outside the City at a site West of Airport Boulevard and South of First Street. Seconded by Commissioner Stenstrom and carried. Commissioner McClanahan moved to clarify action taken at the meeting of October 9, 1978 as follows: Move to reinstate Ben E. Butler to the permanent position o.f Chief of Police. Seconded by Commissioner Keith and carried. The City Manager requested the Commission rescind Resolution No. 1232, adopted September 12, 1977 and effective October 1, 1977. Said resolution authorizing the City Manager to supervise the operation of the Police Department and the Fire Department on a temporary basis. Commissioner Stenstrom moved to rescind same. Seconded by Commissioner McClanahan and carried. Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper resolution to authorize the City Manager.-~":~ the administrative supervision applicable to personnel, records,policy, discipline, etc., as they relate to EEO and Civil Service rules and regulations, of the Police and Fire Departments, not the line operations. Seconded by Commissioner McClanahan and carried. Request submitted from James A. Morace, 109 Skogen Court, Sanford, to purchase property platted far a City park North of Tee 'N' Green SubdiviSion and West of Uppland Park Subdivision, and abutting his property. Dave Fart stated the Planning and Zoning Commission had considered this a desirable location fDr tennis courts. Commissioner McClanahan moved to table same to determine if more land is available to expand the park. Seconded by Commissioner Morris and carried. Request submitted from Harcar to renew a lease for parking at l~¢~:.per square foot, on a tract of property 50 feet by 50 feet, around Well # 8, West of 17-92. The City Manager reported that the previous lease expired and they want to re-establish the I~ase from December 14, 1975 to December 14, 1980, with rental fee to be re-ne§ptiated for future use. On recommendation of the City Manager, Commissioner Morris moved to authorize the Mayor and City Clerk to execute same. Seconded by Commissioner Stenstrom and carried. E-Z Pack 21,576.00 5,500.00 16,076.00 On recommendation of the Public Works Director, Commissioner Morris moved to accept low bid meeting specs, of Heintzelman Truck Center in amount of $55,894.00. Seconded by Commissioner McClanahan and carried. Mt. Larry Motsinger, Evnironmental Equipment Company, appeared to state he felt Environmental Equipment Company was the low bidder. The City Manager explained that their bid had not met the specifications. ~ The City Manager reported that Don Reynolds, Principal, Seminole High School, had replied that the school could not construct a Christmas decoration for City Hall. On recommendation of the City Manager, Commissioner McClanahan moved not to close City Hall for a holiday on Veterans Day, but to close November 23 and November 24, 1978, for the Thanksgiving Holidays. Seconded by Commissioner Stenstrom and carried. Request submitted from Fricke and Fricke Associates, Inc., representing the owner of 539 Valencia Drive, requesting the City to vacate 1.4 feet of a utility easement under a two story garage and apartment on the East one-half of Lot 25 and all of Lot 26, Block 7, San Lanta. On recommendation of the City Manager, Commissioner Morris moved to authorize a Public Hearing to be held November 12, 1978, to consider same, and notices to be sent. Seconded by Commissioner Stenstrom and carried. Commissioner Morris moved to authorize salary reclassifications as follows: Albert Payne, from Housing Code Inspector D to E, $13,138.80'annual. Willard.~Sessions, from Laborer II E to F, $8,963.47 annual. Seconded by Commissioner Stenstrom and carried. Letter submitted from Jack Bridges, Attorney for Lake Monroe Harbour, Inc., developers for proposed expansion at the Marina. Said letter setting forth pro forma statement of operation. Seconded by Commissioner Morris. The Mayor stated this item was in the budget, and had been approved. Commissioner Keith moved to table same to obtain information and re-evaluate the life insurance coverage for other general employees. Seconded by Commissioner McClanahan and' carried.
