A public hearing was held in accordance with notice published in the Evening Herald and the Orlando Sentinel on October 27 and 28, .1978, respectively, as follows: NOTICE OF PUBLIC HEARING TO WHOM IT MAY CONCERN': The City Commission of the City of Sanford, Florida will hold a public hearing on November 27, 1978, at 7:00 P.M. in the Commission Chambers,City Hall, Sanford, Florida. The purpose of the hearing is to grant interested citizens, environmental'groups, local pUblic officials, representatives from local and State agencies, and representatives from regional and State clearing houses the opportunity to ask questions and express opinions about the 201 Facility Plan~ Sanford~ Lake Mary~ North Seminole County Planning Area, Final Draft; dated October, 1978. Any'Pers0~ groUp,~ 0r repre'sentative for any governmental unit or other entity which desires to be heard is encouraged- to contact the City Clerk of the City of Sanford in order that a tentative schedule of participants can be prepared. The Plan is available for public inspection at the office of City Clerk in the Sanford City Hall. A fact sheet is available to the public describing the major issues involved, tentative staff determinations, and procedures for obtaining further information. Knowles, City Manager Commissioner John Morris, Chairman of the' Interim North Seminole Sewer Treatment Plant System Committee, reviewed the performance of this committee and introduced Mr. Paul Porter, Clark, Dietz and.Associates. Mr. Porter made a presentation on the history, intent and scope of the proposed plan to locate defects and make necessary repairs to City of Sanford sewer lines, funded by the federal government and said city, and further, plans to go into the second aspect of the 201 Program of providing sewer service to the entire region, the total cost, the federal costs, the local costs and the average costs for a typical residential user, funded by the federal government add City of Lake Mary, County of Seminole, and City of MINUTES City Commission, Sanford, Florida , November 27, 19 78 The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the adoption of the 201 Plan. No one appeared. Commissioner Morris moved to accept the final draft of the 201 Facility Plan as presented. Seconded by Commissioner Keith and carried. A public hearing was held in accordance with notice published in the Evening Herald on November 7 and 17, 1978 as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE MONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA. Notic.e~_islhereby'given that a PuSlic-H~aring will b~ hetd~ at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P.M. on November 27, 1978, to consider changes and amendments to the Zoning Ordinance of the City of Sanford, Florida, as follows: A portion of that certain property lYing-between East First Street and East Second Street and between Cypress Avenue and Pine Avenue is proposed to be rezoned from RMOI (Multiple-Family Residential, Office and Instlt~ti~flal) District to GC-2 (General Commercial) District. Said property being more particularly described as follows: The West 100 feet of Block 14, lying South of First Street, and the North one-half of vacated East Street abutting on the South, Chapman & Tucker Addition to Sanford, Plat Book 1, Page 24 of the Public Records of Seminole County, Florida. Tamm, Jr. City Clerk Publish: November 7 and 17, 1978. The City Clerk reported that notice was sent to the property owners on October 24, 1978. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition~ to, the proposed rezoning. Planning and Zoning Commission submitted a recommendation to deny the requested rezoning. Mr. Ned Julian, Atttorney representing Mr. Clingensmith, Pharmacist, Faust's Drug Store, appeared in opposition and asked.the Commi-s~ion to abide by the recommendation of the Planning and Zoning Commission. He stated this Would"be contract zoning, that the zoning hardship was created by the owner, the proposed GC-2 zoning was not in compliance with the Comprehensive Plan, and that he had not seen any construction plan. Mr. Bill Hutchison, Attorney representing Mr. and Mrs. Harry Robson, owners of the property prpposed ~for rezoning, and Mr. Charles Cantrell, who is purchasing the property, was present to support the proposed rezoning, and stated they have plans to .......... He sUbmitted a petition which he said contained 100 to 150 signatures of residents of Btam Towers, supporting the proposed rezoning, and a letter from the Board of Directors of Btam Towers. Commissioner McClanahan moved to table the public hearing and refer consideration of rezoning the property to the Planning and Zoning Commission. Seconded by Commissioner Keith and carried over dissenting vote of Mayor Moore. Request submitted from Mr. James F. Cowan, to waive the requirement of siCe plan approval for sale of second-hand merchandise from a building and adjacent fenced-in vacant lot at 317 Palmetto Avenue. The City Clerk reported that Mr. Cowan has a current merchant's license at 317 Palmetto Avenue. On recommendation of the City'Manager, commissioner Morris moved to approve the request, for months of November, December and January. Seconded by Commissioner Stenstrom and carried. Request submitted from Tom Wynn, Manager, Toy & Hobby Chest, 2960 Orlando Drive, to use a mobile trailer sign at the northwest corner of 17-92 and Airport Boulevard, for a holiday promotion, Commissioner Morris ~moved to approve same for 30 days, with the stipulation of no flashing.lights. Seconded by Commissioner McClanahan and carried. Request submitted from Rocco Salvia, AAMco Transmissions, 2890 South Orlando Drive, to waive City Code Section 22-16 (e), to erec~ an off-point of purchase sign on Persimmon Avenue, North of the Auto Train exit. Commissioner Morris moved to authorize same, with the stipglation that the sign meet all other requirements. Seconded by Commissioner McClanahan and carried over dissenting vote of Mayor Moore. Request submitted from Mrs. Addie Adams, 208 Hays Drive, to waive City Code Articl~ II (10) and (29), prohibiting day nursery schools as a home occupation, and to permit her to keep 12 children. Commissioner Stenstrom moved to authorize same. Seconded by Commissioner Keith and carried. Recommendation dated November 17, 1978 submitted from the Planning and Zoning Commission as follows: 1. Recommended denial on rezoning from RMOI to GC-2, part of Lot 14, Chapman & Tucker Addition, SE corner of E. First St. & Cypress Ave. Reason - Not in compliance with the Comprehensive Development Plan, and possibility of future undesirable uses permitt'ed in the GC-2 classification. 2. Recommend setting a Public Hearing to rezone the upplatted~ area of Hidden Lakes from PUD to SR-1A.o Commissioner McClanahan moved to authorize a public .hearing to be held January 8, 1979 to consider item (2). Seconded by Commissioner Stenstrom and carried. The City Manager reported that he had sent a letter to Robert Benson 2826 Empire Place, stating that if the $105.00 plus interest was not paid by November 27, 1978, it would be placed on his monthly utility bill and payment collected by discontinuance of service if necessary. He state that no response has been received.. Commissioner McClanahan 'moved to authorize the amount to be placed on the utility bill and collected in the proper manner. Mr. Jack Bridges, Attor~ny representing Monroe Harbour, INC., was present to discuss a proposed lease for the North one-half of the paved parking lot, north of the dry storage building at the Marina. He stated that a lease Period of less than 60 years would,:not, be acceptable to' his client. Commissioner Morris moved to authorize the City to enter into a lease with Monroe Harbour, Inc., with the foll0wing conditions: 1. term to be 60 years. ~ 2.all real property improvements to revert to the City of Sanford. ' 3. lease payment: 5% of first $100,000.00 of rents, plus 2~% of all over $100,000.00, up to $200,000.00 plus, 5% of all over $200,000. with minimum payment of $5,000.00. Seconded by Commissioner Stenstrom and carried over dissenting vote of Mayor Moore. The City Manager reported that an equipment dealer had made an offer of $1,150.00,which is higher than the trade-in allowance, for a 1963 International Diesel tractor, City Inventory No. 165. On recommendation 6f the City Manager, Commissioner Keith moved to authorize the sale, and use proceeds for the replacement. Seconded by Commissioner Stenstrom and carried. Request submitted from William L. Colbert, Christmas Tree Chairman, Optimist Club of Sanford, to use a portable trailer sign at the corner of the Zayre parking lot, facing Highway 17-92, for their annual Christmas tree sale. Commissioner Morris moved to approve same, with the provision of no flashing lights, for approximate time of November 29 to December 26, 1978; and to waive the Temporary Sign Permit fee Seconded ' by Commissioner Stenstrom and C~rried. Commissioner Morris moved to table consideration of a refuse report until December 11, 1978. Seconded by Commissioner McClanahan and carried. The 1977-78 audit was submitted from the Sanford Airport Authority, and same was approved. Commissioner Stenstrom reported he had received~ a 4 page letter and a signed petition from Audrey Corso,requesting-the City review the refuse ordinance and enforce same.
