The City Commission of the Czty of Sanford, Florida, met in RegUlar Session
in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P.M. on February
12, 1979.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with notice published in the Evening
Herald on January 19, I979 as follows:
NOTICE OF PROCEEDING FOR VACATING
AND ABANDONING A PARK
TO WHOM IT MAY CONCERN:
You will take notice that the City Commission of the City of
Sanford, Florida, at 7:00 o'clock P.M. on February 12, 1979,
in the City Commission Room at the City Hall in the City of
Sanford, Florida, will consider and determine whether or not
the City will close, vacate and abandon any.right of the City
and the public in and to a park located NOrth of C 46-A and
West of Upsala Road, as described as follows:
Beg at the SW cor Lot 51, New Upsala, run thence
N 00° 11' 40" W 165.0 ft to POB, thence run E 176.35
ft, thence S 656.65 ft. thence W 174.12 ft, thence
N 00° 11' 40" W to POB, Uppland Park, Plat Book 20,
page 5, Public Records of Seminole County, Florida.
Persons interested may appear and be heard at the time and
place specified.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed vacating and abandoning of the
park. No one appeared.
Commissioner Keith moved to authorize the City Attorney to prepare the proper
ordinance to vacate and abandon the park as advertised..Seconded by Commissioner Stenstrom
and carried, over dissenting votes of Mayor Moore and Commissioner Fart.
The Central Examining Board submitted recommendations as follows:
Add Section 6-6 to read:
6-6. Adoption of Sanford Energy Efficiency Code
The State of Florida Model Energy Efficiency Building
Code,dated Oct., 1978, prepared for the State of
.Florida Department of Administration State Energy Office,
as amended, is hereby adopted by the City and a copy o~f
Rame, a~ amended, is filed in the office of the City Clerk
as a matter of permanent record of the City~ and the
matters and contents therein are made a part of this

Add Section 6-6.1 to read:
6-6.1 Amendments
Code adoPted in Section~6-6 is amended as follows:
Section 101.3, Scope
Subparagraph (a) 2. Exempt Buildings
change (f) to read:
(f). "Any commercial building with a heated or cooled
area of less than 1500 sq. ft."
Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper
ordinance to adopt same. Seconded by Commissioner Keith and carried.
Mr. Tom Wilson III, Executive Director, Sanford Housing Authority, was present to
explain an Urban Development Action Grant to restore Commercial Districts. He stated that the
Sanford Housing Authority would be a sub-grantee and handle all the work. The City could
obtain title and rehabilitate sub-standard commercial structures, then the previous owner of
record would have the first chance to repurchase it. Commissioner Farr moved to indicate to
Mr. Wilson and the Sanford Housing Authority that the City would like him to continue
investigation of the plan, and come back to the Commission with further details and!~formation.
Seconded by Commissioner Morris and carried.
Mr. Fred Salgado, President, National Capital Companies, Ltd., representing Seminole
Resorts, Inc., a partnership and new owner of the Holiday Inn of Sanford, was present to ask
the Commission to approve the assignment of the lease from Monroe Motels, Inc., to Seminole
Resorts, Inc. He stated they want to renovate and update the motel rooms and commercial area
and presented sketches depicting a nautical theme in the restaurant and lounge. Commissioner
Fart moved to approve the renovations and approve the assignment of the lease to Seminole
Resorts,Inc., subject to the franchise, and to authorize the Mayor to~execute same. Seconded
by Commissioner Mom~is and carried.
Mr. Kevin Rorke, General Manager, Seminole Cablevision, appeared to support a request
by Seminole Cablevision for a rate increase to $8.00 per month. Mr. Frank Sharp, Marketing
Manager and Mr. Charles King, Engineer, were also present to support the request. Commissioner
Stenstrom moved to authorize the City Attorney to prepare the proper ordinance to grant the
increase as requested. Seconded by Commissioner Morris. Motion failed to carry over dissenting
votes of Mayor Moore, Commissioner Keith and Commissioner Farr.

Commissioner Morris moved to authorize action as recommended by the Minimum Housing.Code
Inspector and the City Manager. Seconded by Commissioner Keith and carried.
Requests to use mobile trailer signs submitted as follows:
William C. Conley, for period to May 1, 1979 at the southwest
corner of 17-92 and 25th Street, to advertise the opening
of his Fina Service Station.
Donald M. Faulkner, for period to March 15, 1979 in front of
the former Flagship Bank Building in the Sanford Plaza, to
advertise the Grand Opening of the Florida Business Machine
Company.
c. Tom Wynn, Toy and Hobby Chest, for period of February 20 to
April 20, 1979, at the southeast corner of the Zayre Plaza
parking lot, to promote special sales and Easter Season buying.
Commissioner Fart moved to authorize same for 30 days, with the stipulation that no flashing
lights be used on the signs. Seconded by Commissioner Keith. Motion ~ailed to carry over
dissenting votes of Mayor Moore, Commissioner Morris and Commissioner Stenstrom.
Commissioner Stenstrom moved to authorize same for 60 days~ with the stipulation
that no flashing lights be used on the signs. Seconded by Commissioner Morris and carried
over dissenting vote of Commissioner Fart.

WHEREAS, there has been filed with the City Clerk of the
City of Sanford, Florida, a petition containing the name of the
property owner in the area hereinafter described requesting annexation
to the corporate area of the City of~ Sanford, Florida, and requesting
to be included therein; and
WHEREAS, the Property. Appraiser of Seminole County, Florida,
has certified that there is one (1) property owner in the area to be
annexed and that said property owner has signed the petition for
annexation; and
WHEREAS, it has been determined that the property described
hereinafter is reasonably compact and contiguous to the corporate
area and municipal limits of the City of Sanford, Florida, and it
has been detex,,,ined that the annexation of said property will not
result in the creation of an enclave; and
, WHEREAS, the City of Sanford, Florida, is in a position
to provide municipal services to the property described herein, and
the City Commission of the City of Sanford,'Florida, deems it in the
best interest of the City to accept said petition and to annex said
property.
NOW, THEREFORE, BE IT ENACTED BY THE CITY OF SANFOR~,

SECTION 1: That the following described property, being

SECTION 4: That upon this ordinance becoming effective,
the residents and property owner of the property described herein
shall be entitled to all the rights and privileges and ~mmunities

Commissioner Morris moved to approve an Affirmative Action report submitted
at meeting of January 22, 1979, Seconded by Commissioner Keith and carried.
Commissioner Stenstrom moved to remove from table, discussion of the intersection
of 17-92 and Shannon Drive. Seconded by Commissioner Morris and carried.
A proposed intersection plmn was submitted by the City Manager.
Commissioner Stenstrom moved to adopt the plan, contingent upon it being acceptable
to San Situs. Seconded by Commissioner Keith and carried. ·
On motion of Commissioner Keith, seconded by Commissioner Morris and carried,
Resolution No. 1261 was read in full and adopted. Said resolution being in words and figures
as follows: -
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SANFORD, FLORIDA, ENDORSING A PROPOSED
AMENDMENT TO SECTION 119.07~, FLORIDA STATUTES,
COMMONLY REFERRED TO AS THE "PUBLIC RECORDS
LAW"; SAID AMENDMENT PROVIDING GUIDELINES FOR
EXEMPTING CERTAIN GOVERNMENTAL RECORDS FROM
PUBLIC INSPECTION, PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the strength and effectiveness-of a Public Records
Law depends on its clarity and predictability to enable private citizens,
for whose benefit such law was intended, to more easily utilize inform-
ation obtained from public records; and
WHEREAS, the present "Public Records Law" does not provide
guidelines as to what is and what is not available to private citizens
from the public records of the various governmental entities; and
WHEREAS, in order to eliminate the confusion presently
surrounding access to public records, it is the opinion of the City
Commission of the City of Sanford, Florida, that there is a need for an
amendment to the present Public Records Law to insure-individual
privacy of employees and officials of governmental entities, a need
for efficient and orderly administration of governmental agencies and
a need for effective enforcement of the criminal law of the State of
Florida.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of
the City of Sanford, Florida, that the proposed amendment to Section
119.07, Florida Statutes, set forth in the proposed Legislative Act,
attached hereto and made a part hereof is hereby endorsed and the
City Commission urges the Florida Legislature to adopt said amendment.
BE IT FURTHER RESOLVED that a copy of this Resolution be
furnished to the Florida League of Cities, Inc. and that the said
Florida League of Cities, Inc. be urged to endorse said proposed
legislation.

The City Manager submitted an opinion from the City Attorney that the City would be
subject for 1978 and thereafter, to the requirements of Chapter 250.48, Florida Statutes,
to pay its officers or employees who are members of the National Guard or Military Reserve
their full municipal salaries while on authorized military leaves, not to exceed seventeen
days in any one annual period. Also, that the statute prohibits any reduction in an offic~r2~g
or employee's ordinary accrued vacation time by the amount of authorized military leave taken
by the officer or employee.
The City Manager reported present City policy is to provide time off plus the
difference between military and city salary and recommended to continue the policy, and to
support legislation to amend the statute to that effect, and to pay City employees in
accordance with the requirements of FS 250.48. On motion of Commissioner Morris, seconded by
Commissioner Stenstrom and carried, City employees were authorized to be paid in accordance
with the statute for 1978 and thereafter. The City Manager was authorized to work with the

The City Manager submitted a proposed committee bill to add Sec. 171.031 and
amend Sec. 171.0413, to provide a local Annexation Commission and powers, duties and
functions. The Commission authorized to oppose the proposed bill.
The City Manager submitted a proposed policy defining retirement for eligibility
for terminal retirement benefits as follows:

Commissioner Morris moved to authorize the City Manager to execute a lease-purchase
agreement for same over a period of five years. Seconded by Commissioner Keith and carried.
On recommendation of the City Manager, Commissioner Stenstrom moved to authorize
transfer in amount of $1,519.50 from Contingency to Maintenance Division Street Light
Equipment Account for replacement poles and parts for street lights along Seminole Boulevard
outside the City. Seconded by Commissioner Keith and carried.
Commissioner Stenstrom moved to authorize salary reclassifications as follows:

The City Manager reported that Henry N. Ta~, Jr., City Clerk and Finance
Director, had been appointed State Chairman for Central Florida, for the Municipal Finance
Officers Association, for term to expire December 31, 1981. On motion of Commissioner
Morris, seconded by Commissioner Stenstromand carried, the Finance Director was authorized
to attend meetings for same.
Commissioner Morris moved to authorize a public hearing to be held February 26,
1979 to consider Condemnation Group 53, and to authorize notices to be directed to the
owners of the property as last extended on the tax roll. Seconded by Commissioner Stenstrom
and carried.
The City Clerk reported that Mr. J.A. Calhoun had submitted the proper fee and
requested the City to close a portion of a north-south alley, lying south of Eighth Street
and west of Mellonville Avenue. Commissioner Fart moved to authorize a public hearing to be
held March 12, 1979 to consider same, and to authorize the proper notices. Seconded by
Commissioner Stenstrom and carried.
The City Manager reported that Mr. K. R. McLacktan, 7518 Quail Pond Street,
Orlando, Florida 32807, had submitted a proposal in amount of $2,000.00 for release of
the City's interest in the property in Orange County which the City acquired for non-payment
of a statement. On recommendation of the City Manager; Commissioner Keith moved to authorize
the Mayor to execute a Quit Claim Deed for same. Seconded ~by Commissioner Stenstrom and
carried.
The City Manager reported that the Executive Secretary of the Civil Service Board
has requested a transfer in amount of $400.00 from Contingency for advertising costs. On
recommendation of the City Manager, Commissioner Fart moved to authorize ~ransfer in amount
of $300.00 from Contingency for same. Seconded by Commissioner Stenstrom and carried.
The City Manager was authorized to obtain information for the City to join the
East Central Florida Regional Planning Council.
The City Manager was.authorized to write letters to members of the Planning and
Zoning Commission, thanking them for their time and attendance and reminding~them of the
need for a quorum to transact the matters at each meeting.
The Commission suggested that the Seminole Sunrise Kiwanis Club not clear ground
to begin construction of a proposed park and recreation area in Pinehurst Subdivision before
the lease is signed.
The City Manager reported he will be in Tallahassee, February 14 through 16, 1979
and in Key West the afternoon
