The City Commission of the City of Sanford, Florida, met in Regular Session in
the City Hall in the City of Sanford, Florida, at 7:00 o'clock .P.M. on February 26, 1979.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with notices authorized at meeting of
February 12, 1979, to consider condemnation of 24 structures or buildings on Report Numbers
79-882 through 79-905, Group 53.
The Chairman announced that the Commission would hear from any property owner or
representative thereof. A review of each individual report was as follows:

Ms. Marguerite Sheehan, owner of property at 814 Elm Avenue, Condemnation Report
No. 79-899, appeared and stated she wants to bring the property up to code.
After consideration, Commissioner Keith moved that finding the buildings~ under
Reports Numbers 79~882 through 79-905 to be unsanitary, unsafe and delapidated, that said
'structures be condemned and the owner given a notice of 90 days in which to repair or give
just cause why same has not been repaired or demolished; and after 90 days to authorize
the City to demolish the structures and levy a lien against the property for said removal.
Seconded by Commissioner St~nstrom and carried.
Request submitted from John F. Kurzon, Jr. , Y-ENTERPRISES, INC., to waive the
~subdivision regulations to permit installation of Overhead electrical service to 45 lots
between Georgia Avenue and Hartwell Avenue, south of 25th Street. Commissioner Farr moved
to table same until a representative of Y-ENTERPRISES, INC., is present. Seconded by
Commissioner Stenstrom and carried.

dissenting votes of Commissioner Stenstrom and Commissioner Keith, Ordinance No. 1463, eh-

Mr. Jim DeJohn appeared as representative for Mrs. Camilla Muse, heir to property
owned by R. C. Whitten, deceased, at 612 East Second Street, Conde~mation Report No.
79-883, and 616 East Second Street, Condemnation Report No. 79-884, and stated Mrs. Muse
wants to improve the property at 616 East Second Street ir~ediately, and requested a six
months time extension for same. He requested a 90 day time extension for Mrs. Muse to
decide what she will do with the property at 612 East Second Street. The Commission
affirmed earlier action of 90 day extensions to bring the properties to code, or demolish
same.
On motion of Commissioner Keith, seconded by Commissioner Stenstrom and carried
over dissenting votes of Mayor Moore and Commissioner Fart, Ordinance No. 1464, entitled:

On motion of Commissioner Stenstrom, seconded by Commissioner Keith and carried,
minutes of February 12, 1979 were approved.
After review and comparison of the Sanford refuse code with the Clearwater refuse
code, the Commission stated that Sanford has the necessary controls and only need additional
~personnel to enforce this code.
The City Manager reported there is an initiation fee of $2,500.00 to join the
East Central Florida Regional Planning Council, and an annual assessment is at the rate
of 6¢ per capita. Coa.,issioner Morris moved to authorize the City Attorney to prepare
the proper resolution, stating the desire of the City of Sanford to join. Seconded by
Commissioner Farr and carried over dissenting vote of Commissioner Stenstrom.
The City Manager reported on land for expansion of the regional sewer treatment
plant as follows:
Forrie parcel - 4.1 acres. Asking $:70,000.00; assessed value .-.. is. $11,030.O0..-
Warner-.Unlimited~- Inc.-, parcel -c8.4 acres. .Asking $217,000.00; assessed value is $44,000.00.
The Commission authorized the City Manager to negotiate a sales price for each parcel and
report to the Commission.
The City Manager reported that Dr. J. W. Hickman had asked the City to stop putting
street sweeping loads on his property at the intersection of First Street and Sanford Avenue,
and requested to deposit only "hard fill". Commissioner Farr moved to stop dumping street
sweeper loads on the property. Seconded by Cow. uissioner Keith and carried over dissenting
.votes of Commissioner Stenstrom and Commissioner Morris.
Commissioner Keith moved to approved a renewal of work contract with the City
Manager. Seconded by Commissioner Morris and carried over dissenting votes of Commissioner
Stenstrom and Commissioner Fart.
The City Manager and City Attorney were authorized to obtain more information
and report to the Commission at the next meeting, on Federal/State participation program to
install Railroad crossing gates at all Railroad crossings, with the City to pay half the
annual maintenance agreement cost.
On recommendation of the City Manager, Commissioner Farr moved to authorize salary
reclassification of S. T. Williams, refuse driver, from Equipment Operator II-C to D,
i$8,319.68 annual. Seconded by Commissioner Stenstrom and carried.
Commissioner Farr moved to table consideration of the proposed intersection of SR

Commissioner Keith moved, to authorize a public hearing to be held March 26, 1979
to consider rezoning from RC-1 (Restricted Commercial) District to RMOI (Multiple-Family
Residential, Office and Institutional) District, property described as follows:
W 100 feet of Blk.14, lying S of ,First Street and the N½ of
vacated East Street abutting on the south, Chapman & Tucker Addi-
tion to Sanford, PB 1, Pg 24 of the Public.~Records~'of Seminole
County, Florida.
Seconded by Commissioner Morris and Carried over dissenting vote of Commissiormr Farr.
Commissioner Morris moved to remove from table, consideration of a request from
Y-ENTERPRZSES, INC. of Maitland, to waive the requirement for underground utilities in a
proposed subdivision on Georgia and Hartwell Avenues. Seconded by Commissioner Stenstrom
and carried.
1~. John F. Kurzon, Jr., appeared to support the request to install overhead elec-
trical service. He stated underground service would cost $11,000.00 more than overhead
service, that the poles are already set on 21 of the 26 lots on Georgia Avenue and Florida
Power and Light will have to set two or three addigional poles. Also, that the transformers
are already in place, Florida Power and Light will not remove existing poles, and service
would be run down the existing poles and trenched to each house.
The City Manager and Building Official submitted recommendations to deny the request.
Commissioner Stenstrom moved to waive the subdivision regulations as requested. Seconded
by Commissioner Morris. Mot±on failed to carry over dissenting votes of 14ayor Moore,
Commissioner Fart and Commissioner Keith.
The City Manager was authorized to discuss same with Florida Power and Light Cor-
poration to determine if the lines can be installed underground and report to the Commission.
Corr~nissioner Morris moved to authorize payment of statement in amount of $875.85,
submitted from City Attorney C. Vernon Mize, Jr., for services rendered in the double taxation
suit of the City of Sanford vs. Seminole County.

The City Manager reported that D. Martin was paid the remainder of what the City
owed him for military leave pay for 1978; and that K. Forsythe was not eligible for a
vacation in 1978 and the City had paid his full salary while at military camp in 1978.
The Commission asked for a statement of pay in prior years in which these employees had not
been paid military leave.
Letter submitted from Mrs. S. O. Chase, resigning frmm the Henry Shelton Sanford
Memorial Library and Museum Association. Commissioner Stenstrom moved to authorize the
City Manager to extend a letter of acceptance, with regrets. Seconded .by Conm~issioner Farr
and carried.

The Commission approved the City Manager's absence from the City, to work with the
Florida League of Cities in Tallahassee on April 9th through 13th, and May 21st through
25th, during the legislative session.

On recommendation of the Board of Trustees of the Henry Shelton Sanford Memorial
!Library and Museum Association, Commissioner Farr moved to appoint Mrs. Roger Stewart, 305
Tammy Drive, to said board. Seconded by Commissioner Stenstrom and carried.
Request submitted from Lieutenant William Lykens, Police Department, for a six
months leave of absence beginning March 10, 1979. The City Manager reported that Lieutenant
Lykens had stated this was requested in order to look for another job. The City Manager
recommended to deny the request. On recommendation of Co~mL~issioner Morris, Commissioner
for Police, Commissioner Keith moved to authorize six months leave o~ absence for Lieutenant
~:Lykens, without pay. Seconded by Commissioner Fart and carried.
The City Manager submitted a letter from Charles M. Eaton and Slim Fontneau; new
iowners of the Fountain Lodge, requesting the City to provide better water pressure for their
imotel, which is outside the City, at no cost to them. Mr. Eaton and Mr. Lowell Potter were
present to support the request. No action was taken by the Cor~m-~ission.
Commissioner Farr stated he had received several complaints about persons loitering
around the gazebo at the park on Oak Avenue, between Fourth Street and Fifth Street, and
~recommended the City install a security light in the .gazebo. Commissioner Fart moved to
authorize transfer of up to $200.00 from Contingmncy for installation of a security light in
the gazebo. Seconded by Commissioner Stenstrom and carried.
Ms. Margaret Jones, Route 2, Box 3-M, Sanford, appeared to request information
!regarding Comdemnation Report No. 79-902, 1115 Orange Avenue. The Commission stated it had
~been condemned and the owner had been given 90 days to repair or demolish it.
On motion of Commissioner Fart, seconded by Commissioner Stenstrom and carried, the
Mayor was authorized to execute a 40 year lease for recreation purposes bet-~een the City
and the Seminole Sunrise Kiwanis for approximately 12.8 acres located between 25th $treet and
~26th Place and between Poinsettia Avenue and the Seaboard Coast Line Railroad right-of-way.
The City Attorney reported on the status of suit of Bonnie Brown vs. City of
Sanford. Commissioner Morris moved to authorize the City Attorney to negotiate a settlement
not to exceed $2,500.00. Seconded by Cmt...~issioner Keith and carried.
Mr. Bill Kirchoff, Seminole County Commissioner District 5, appeared to request
the Commission to permit bus stop signs to be placed on poles with other non-moving traffic
signs such as "No Parking", "2 Hour Parking", etc. The City M~nager stated that the Florida
Uniform Traffic Regulations prohibit other signs on the same pole with a regulatory sign,
since it negates the regulatory sign.
