A public hearing was held in accordance with notice published in the Evening Herald on February 21, 1979 as follows: NOTICE OF PROCEEDING FOR VACATING AND ABANDONING A PORTION OF AN ALLEY TO WHOM IT MAY CONCERN: You will take notice that the City Commission-of?the City of Sanford, Florida, at 7:00 o'clock P.M. on March 12, 1979, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to a portion of a north- south alley lying between Eighth Street and Ninth Street extended east- erly and between Bay Avenue and Mellonville Avenue, more particularly described as follows: That portion of a north-south alley lying between the north lot line of Lot 10 extended easterly and the south lot line of Lot 10 extended easterly, Long's 2nd Add., Plat Book 4, page 3, Public Records of Seminole County, Florida. Tamm, Jr. City Clerk The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed alley closing. 1979. The City Clerk reported that notices were sent to property owners on February 20, Mr. J. A. Calhoun, 2039 Mellonville Avenue, was present to support his request to close the alley. On motion of Commissioner Morris, seconded by Commissioner Stenstrom and carried, the City Attorney was authorized to prepare the proper ordinance to vacate and abandon the alley as advertised. Request submitted from Mr. John S. Root, Seminole Answering Service, to waive a portion of the restrictions for a home occupation. Mr. Root was present and stated he wanted~ to relocate his answering service business to his home at 401 West 10th Street, to employ MINUTES City Commission, Sanfovd, Florida March 12, 19. ~9 MIDSTATI~ LEGAL SUPPLY COMPANY Commissioner Morris .and carried over dissenting vote of Commissioner Farr and Commissioner Keith. Request submitted from Reverend Canene Johnson, House of Prayer Baptist Church, for a one year time extension to pave the parking lot for the church, at 505 East Third Street. Reverend Johnson appeared to support the request and stated they want to be able to occupy the building prior to paving the parking lot. Commissioner Morris moved to authorize the request. Seconded by Commissioner Stenstrom and carried. The City Manager was authorized to submit a report at the next meeting, on an unpaved parking lot across the street from Seminole Memorial Hospital. Request submitted for a permit to hold a Benefit Concert for the Harry-Anna Crippled Children's Hospital. Ms. Barbara Greanya and i L~ M~. Mikki Thoman, Country Club Productions, 600 Park Avenue, Apartment No. 1, Sanford, were present and stated they had obtained permission to hold the concert at the American Legion Fair Grounds on South 17-92, on JUne 10, 1979. Commissioner,s: Stenstrom moved to authorize the request. Seconded by Commissioner Fart and carried over dissenting vote of Commissioner Morris. No one appeared. Commissioner Keith moved on the passage and adoption of Ordinance No. 1463. Seconded by Commissioner Fart. Commissioner Stenstrom reported he had received a letter from the Home Builders of Mid-Florida, citing alternatives for energy conservation, and moved to table adoption of Ordinance No. 1463, and refer back to the Central Examining Board for a recommendation. Seconded by Commissioner Morris and carried over dissenting votes of Commissioner Fart and Mayor Moore. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1464 entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, VACATING AND ABANDONING THAT CERTAIN PARK SITUATED IN UPPLAND PARK SUBDIVISION AND LOCATED NORTH OF STATE ROAD 46-A AND WEST OF UPSALA ROAD: RESERVING THE USE OF SAME UNTO THE CITY OF SANFORD, FLORIDA FOR UTILITY PURPOSES, PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. The City Manager submitted a report of military leave pay indicating $895.06 due to Danny Martin and $234.32 due to Kenneth Forsythe, in accordance with FS 250.48. Commissioner Stenstrom moved to authorize payment only to the two employees who had filed claims, and to transfer $1,130.00 from Contigency to provide for same. Seconded by MINUTES City Commission, Sanford, Florida March 12, 19 79 Consideration next given to City participation with the Seaboard Coast Line Railroad Company for annual maintenance of railroad street crossing signals to be installed by the state, with federal.participation. The City Attorney stated that in his opinion, the City may have potential liabi- lity in the event of an accidmmt at a c=ossing where the state had offered to install a signal and did not, due to the City not agreeing to participate to provide for annual maintenance. The City Manager suggested that if the City accepts a maintenance agreement for a railroad c~ssing and pays the maintenance fee, the Department of Transportation and Seaboard Coast Line Railroad relieve the City of all liability for that c=ossing. Commissioner Stenstrom moved to table consideration of same. Seconded by Commissioner Fart and carried. The City Manager submitted a report on proposed amendments to the refuse ordinance, Chapter II, Sanford City Code. Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordinance to amend the code for same. Seconded by Commissioner Keith and carried. · The City Manager reported that Jose Jesus Tristan had left the City and recommended this account receivable in amount of $69.21 be deleted from City records. Commissioner Stenstrom moved to authorize same. Seconded by Commissioner Fart and carried. Commi~'sioner Keith moved to authorize salary reclassification for James A. Cohen, from Plant Superintendent D to E, $14,732.79 annual. carried. Seconded BY Commissioner Farr and The City Manager reported that he had received a letter from Mr. Cliff Guillet of the East Central Florida Regional Planning~Council, setting forth resumption of the 208 Planning Program and requested appointees for the Advisory Committee. Commissioner Fart moved to appoint James A. Cohen and Mack LaZenby as the City representatives. Seconded by Commissioner Stenstrom and carried. On recommendation of the City Manager, Commissioner Morris moved to authorize Celery City Lodge #542 IBPOE of W to use the Civic Center, with alcoholic beverages, March 30, 1979, with payment of $250.00 fee. Seconded by Commissioner Stenstrom and carried. The City Manager reported that the City has completed foreclosure proceedings on property as follows: Lot 20 (Less the South 10 feet of the West 40.6 feet and Less the East 2 feet) Lincoln Court, PB 4, Pg 20, Public Records of Seminole County, Florida; and East one-half of Lot 33, South Sanford, PB 1, pg 94, Public Records of Seminole County, Florida. On recommendation of the City Manager, Commissioner Fart moved to declare said parcels surplus, and offer for sale. Seconded ~y Commissioner Morris and carried. MI'NUTES City Commission, Sanford, Florida March 12, 19 79 The City Manager recommended approval of a request from the Sanford-Seminole Art Association, to c~ose First Street between Park Avenue and Palmetto Avenue and Magnolia :Avenue between First Street and Third Street for an Art Show on September 29/30, 1979. Commissioner Stenstrom moved to authorize same. Seconded by Commissioner Morris and carried. On motion of COmmissioner Stenstrom, seconded by Commissioner Fart and carried, transfers were authorized as followS: me $7,850.00 from contingency to: Parks Salary Account #2-01-51101-0 Shop Salary Account #2-01-42101-3 $3,427.10 $4,422.90 b. $2,745.84 from utility unappropriated fund account to: Water Division Salary Account #2-05-30101-3 $2,745.84 On recommendation of the City Manager, Commissioner Fart moved to authorize pur- chase of equipment and chemicals and transfer of $4,493.00 from unappropriated utility fund for same, to provide for Total Kjeldahl Nitrogen and Total Nitrogen testing at the sewer plant as required by the NPDES permit. Seconded by Commissioner Stenstrom and carried. On recommendation of the City Manager, Commissioner Morris moved to authorize a 6.5% across the board cost of living increase for budget preparation. Seconded by Commissione: Fart. Motion failed to carry over dissenting votes of Mayor Moore, Commissioner Fart and Commissioner Stenstromo The Commission authorized the City Manager to .submit costs and figures for an equal increase to each employee. The City Manager reported that the Security Light had been ordered for the gazebo ~t the Park on Oak Avenue between Fourth Street and Fifth Street. Commissioner Keith moved to authorize transfer in amount of $90~O0 from Contingency to Parks Account #2-01-51359-5 for same. Seconded by Commissioner Stenstrom and carried. The City Manager reported that prOposed~,~annexatl°n bill HB'402 has Come out of committee. Commissioner Morris moved to oppose the proposed bill. Seconded by Commissioner Fart and carried. The City Manager reported Mr. Scott Burns had informed him that Florida Power ~nd Light Company planned to install underground service to the 45 lot development of Y Enter- prises on Hartwell and Georgia. Avenues south of 25th Street, and they would not need to in- stall any additional poles on Georgia Avenue, and the cost would be $258.00 per service. The City Manager recommended to affirm the Commission's previous denial to waive the under- ground service requirement..f~ Mr. John Kurzon, Y Enterprises, stated they are trying to hold down the cost of the houses. Commissioner Stenstrom moved to rescind-PreviouS action of the CommisSion on February 26, 1979. Seconded by Commissioner Fart. Seconded by Commissioner Stenstrom and carried over dissenting vote of Commission Morris. The City Manager submitted an offer from Mt.and. Mrs. ~. R~Etlis to purchase Lot 6, Block B, Celery Avenue Addition for $2,000.00. On recommendation of the City Manager, Commissioner Stenstrom moved to authOrize same, with the proceeds to be reserved for recreation uses. Seconded by Commissioner Keith and carried. Statement submitted from the City Attorney in amount of $250.00 for services rendered in case of K tinginsmith, et al vs City of Sanford and Charles Cantrell. On recommendation of the City Manager, Commissioner Morris. moved to authorize payment of same. Seconded by Commissioner Keith and carried. '" - The City Manager reported that the City of Sanford Local Option Public Employees Relations Commission had retained the law offiCes of Rock and Brown as general counsel and recommended transfer from Contingency in amount of'$2,000.00 to provide for same. On motion of Commissioner Fart, seconded by 'Con[missioner Keith and carried, same was authorized. The Ci%y Manager was authorized to submit a report on grants requested and obtained. Commissioner Fart reported he had contacted George McCammon, General Partner, San Situs, about the proposed'~design for the intersection of 17-92 and Shannon Drive,~ar~' that San Situs would prefer to have the original design. The City Manager was authorized to submit a report on the original design at the next meeting. Resolution No. 1262 was introduced and the Mayor was authorized to execute same. Said resolution being in words and figures as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, AUTHORIZING THE CITY OF SANFORD TO BECOME A MEMBER OF THE EAST CENTRAL FLORIDA REGIONAL PLANNING COUNCIL. WHEREAS, the East Central Florida Reginnal Planning Council has invited the City of Sanford, Florida, to become a MINUTE S City Commission, Sanford, Florida March 12, 19 79 WHEREAS, it is the opinion of the City CommisSion that it would be beneficial to the City of Sanford to have membership in said organization to enable the City to be officially informed as to all planning programs involving the growth and development of East Central Florida and further to enable the City to have input in general planning for the future growth and development of the area. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that the City shall become a member of the East Central Florida Regional Planning Council and the City Commission shall proceed further to appoin~ two (2) delegates for membership on the Regional Planning Council. BE IT FURTHER RESOLVED th~;~tT~he City of Sanford, Florida, agrees to adopt and abide by the Regional Planning Council's rules of procedure. Moore Mayor Jr. Mrs. Bill Gielow, 2208 Community Way, Sanford, appeared to represent a volunteer committee composed ofherself, Jack Weible and Mary Smith to beautify the Good Samaritan Home as a memorial to Mother Wilson, and to request the City to erect a fence or plant a hedge between the home and a drainage ditch.
