Commissioner Fart moved to table until April 23, 1979, consideration of the bids for parcels 1 through 5 and 14 through 22, and to authorize the bids to be tabulated, with a report on the assessed value, the appraised value if any, and outstanding city liens. Colbert, from the firm of Stenstrom, Davis, McIntosh and Julian, Attorneys, representing Mr. and Mrs. Wade Singletary, 812 East Fourth Street, stated his cli- ents oppose the proposed street closing for reasons as follows: 1. This was attempted and rejected in 1972. 2. A 30" sewer main traverses the alley and nothing can be built on it anyway. 3. It has been used for the past 20 years. 4. It is used for garbage pick-up. 5. Rose Street-permits parking in the rear of some homes. 6. There appear to be telephone lines in it. 7. Closing it would cause more inconvenience and be of no benefit to the public. Mr. William Price, 214 Lakeview Avenue, stated he agrees with Mr. Colbert. Commissioner Farr stated that the petitioner, Mr. Bob Van Dyke, a builder, wants to build a $75,000.00 to $85,000.00 structure on Lots 10 and 11, and needs the street right- of-way to be in compliance with the set-back requirements, and that Mr. Van Dyke knows he cannot build over the sewer line. The City Manager submitted a recommendation to close the street as advertised, and retain all but the north 4 feet as a utility easement. Commissioner Keith moved to deny the request~to vacate and abandon the Easterly 138.7 feet of Rose Street. Acting Mayor-Commissioner Stenstrom appointed Commissioner Fart temporary Chairman and seconded the motion. Commissioner Fart stated he will file a voting conflict of interest form. Commissioner Stenstrom and Commissioner Keith voted in favor of the motion, and Commissioner Fart voted against the motion. The City Attorney gave the opinion that this vote did not constitute action by the Board, due to lack of three affirmative votes. Gaylord, 207Whippoorwhill Lane, Plant Manager, Rinker Materials Corporation, stated his company wants to upgrade and construct a modernized block plant. He stated there is a lot less dust with the new method of production, On recommendation of the Planning and Zoning Commission, Commissioner Keith moved to authorize the City Attorney to prepare the proper o~dinance to rezone the property as advertised. Seconded by Commissioner Farr and carried. The next item of business was the conti'nuation of a public hearing, tabled from meeting of January 8, 1979, to consider rezoning the unplatted portion of Hidden Lake from PUD to SR-1A District. The Planning andZoning Commission submitted a recommendation to table same for 30 days. On recommendation of the Planning and Zoning Commission, Commissioner Fart moved to table, same to May 14, 1979. Seconded by CommiSsioner Keith and carried. Commissioner Farr moved to reconsider closing the Easterly 138.7 feet of Rose Street Seconded by Commissioner Keith and carried. The City Clerk reported that an out-of-state party had requested a city license to install coin-operated photo copy vending machines in the City and that in accordance with Section 16-12 of the City' Code, the License Official had recommended fees as follows: (a) $5.00 per machine for unit price of 25¢ amd less. M. 19 79 MTI').RTATR T,F..~AL ,RTTI)PT,~' ~OMPAN¥ WHEREAS, in order to facilitate the construction of a Holiday Inn on said land by the said Monroe Motels, Inc., the City of Sanford did Join in a Mortgage of said lands to Gulf Life Insurance Company, which Mortgage is dated April 20, 1967 and filed April 20, 1967 in Official Records Book 612, page 317, of the Public Records of Seminole County, Florida; and .WHEREAS, in order to further secure said construction loan from Gulf Life Insurance Co. any, Monroe Motels, Inc. assigned its lease to Gulf Life Insurance Company as additional collateral, which assignment of lease is dated December 26, 1967, and is recorded in Official Records Book 644, page 171. of the l~ublic Records of Seminole County, Florida; and WHEREAS, A. J. Thomas, Jr. and Ella Mae Merrill, who are owners of all of the capital stock in Monroe ~btels, Inc., have entered into a contract with National Capital Companies, Ltd., a Pennsylvania corporation, its nominee or assignee, for the sale of all of the capital stock of Monroe Motels, Inc.; and WHEREAS, the aforesaid contract has been assigned by National Capital Companies, Ltd., a Penns~.twania corporation, to Holiday Isle Properties, a general partnership composed of John Wallace-Schoettelkotte, Fred Salgado, Ed Welch, John Robert Moore, George Gre§ory, Natasha Gregory, Alex Gregory, Jr. and Victor Notopoulos; and WHEREAS, the said contract for sale of the stock provides for a }~rtgage of the leasehold ~nte=est in the subject property to A. J. Thomas, 3r. anR Mary Jane Thomas, his wife, and Ella Merrill to secure the purchase price for said stock; and %rHEREAS, ail of the parties have requested that the City of Sanford adopt a resolution approving all of the foregoing transac=ions and consenting to the assignment of the stock and execution of the Mortgage of the leasehold estate to A. J. Thomas, Jr. and Mary Jane Thomas, his wife, and Ella Mae Merrill. NOW, THEREFORE, be it resolved by the City Commission of the City of Sanford, Florida as follows: 1. That the lease made by the City of Sanford to Monroe Motels, Inc. dated April 14, 1967 and recorded in Official Records Book 611, pages 554 through 565, of the Public Records of Seminole County, Florida and the Modification thereof dated April 20, 1967, be and the same are hereby ratified and confirmed. 2. That the City hereby, confirms that there has been no default by }~nroe Motels, Inc. under said lease in the payment of rent, that there are no defaults under any;other covenants of the lease, and that there are no charges which the City of Sanford claims 2¸6 MINUTES' City Commission, Sanford, FlOrida April 9 at 7:00 P. The Assignment of Lease in favor of Gulf Life Insurance Company dated December 26, 1967 and recorded in Official Records Book 644, page 171, of the Public Records of Seminole County, Florida, be and the same is hereby consented to by the City of Sanford, and it is further confirmed that said Assignment was in compliance with the requirements as to the assignment of the lease. 4. The Ci:y of Sanford hereby approves the sale of the stock of Monroe Motels, Inc. by A. J. Thomas,.Jr. and Ella Mae Merrill to Holiday Isle Properties, a general partnership composed of John Wallace Schoettelkotte, Ed Welch, Fred Salgado, John Robert Moore, George Gregory, Natasha Gregory, Alex Gregory, Jr. Victor Notopoulos, and approves the proposed dissolution of Monroe Motels, Inc. by said new owners. 5. The City of Sanford hereby consents to the execution of a Mortgage of the leasehold interest by }4nnroe M~tels, Inc. to A.J. Thomas, Jr. and Mary 3ane Thomas, hiw wife, and Ella Mae Merrill, to secure the purchase price of the sale of said stock, and hereby agrees that in the event of default by th= Mortgagor, or any successor thereto, of any of the terms or obligations of said lease and modification thereto, tha~ the City of Sanford will give notice of such breach to the Mortgagees and will allow the Mortgagees thirty (30) days from such notice within which to cure such default under said lease and modification before the City of Sanford shall exercise its rights on account of such default. 6. The City of Sanford hereby approves the renovations and modifications to the ~ased premises which renovations and modifications were presented to the City Commission in its meeting of February 12, 1979. Seconded by Commissioner Keith and carried. The Acting City Manager reported that on December 26, 1978 the City Commission ap- proved low bid in amount of $1,415.00 from C.A.S. Equipment, Inc. to furnish a chlorine low ~ressure alarm back-up portable chlorinator. The purchase order was issued on December 27, /978 with a. February 27,~.1979~delivery date per C.A.S. bid. ~ The Chlorinator was not delivered as of April 2, 1979, inquiry was made to C.A.~S.,~they promised delivery by April 6, 1979. Delivery was made April 9, and the equipment was incomplete. On recommendation of the Acting City Manager, Commissioner Fart moved to cancel Purchase Order #5171 with C.A.S. Equipment and to authorize to accept the bid for the chlorinator from Electra,Tronics, inc., in amount iof $1,448.00. Seconded by Commissioner Keith and carried. The Acting City Manager reported that Mr. C. S. Winn, 2310 West First Street, has submitted a claim in amount of $70.05 for' damage to his vehicle caused by striking a manhole cover which was not properly in plaCe.
