M. 19 79 MILI:5'I'A'I'Iq LI<tJ.~.~ SUPPLY {JUMP,~alqY Commissioner Stenstrom moved that the regular City Commission meeting of May 28, 1979 be held on May 29, 1979 and the aforesaid public hearing be tabled until May 29, 1979. Seconded by Commissioner Fart and carried. A public hearing was held in accordance with notice published in the Evening Herald on April 6, 1979 as follows: NOTICE OF'PROCEEDING FOR VACATING AND ABANDONING ALLEYS. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the ~ity of Sanford, Florida, at 7:00 o'clock P. M. on April 23, 1979, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and 'the public in and to an east-west alley and a portion of a north-south alley lying between Eighth Street and Ninth Street extended'easterly and between Bay Avenue and Mellonville Avenue, more particularly described as follows: me That portion of an east-west alley lying between Lots 1 through 5 and Lot 10, and extended easterly to the west line of Lot 8, and That portion of a north-south alley lying between Lots 6, 7 and 8 and Lot 5, all in Long's 2nd Add., Plat Book 4, page 3, Public Records of Seminole County, Florida. City Commission of the City of Sanford, Florida City Clerk Publish: April 6, 1979· The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed vacating. Mr. J. A. Calhoun, 2039 Mellonville Avenue, Sanford, appeared in opposition. Mr. Marion Gordon, 720 Mellonville Avenue, petitioner, appeared to support the request. He stated he does not object to the alleys staying unopened as they are now. Commissioner Fart moved to deny the request to vacate and abandon the alleys as advertised, and to state that they will not be opened. Seconded by Commissioner Keith and carried. The City Manager reported that Mrs. Nora Gordon, President, Downtown Business Association, had submitted a letter opposing the street closing. ~Commissioner Morris moved to deny the request. Seconded by Commissioner Keith and carried. Commissioner Keith moved to remove from table, request to consider to re-compute the monthly allotment for cost of fuel from 63¢ to 73¢ per gallon for use of private vehicles. Seconded by Commissioner Stenstrom and carried. Commissioner Morris moved to table same for two months. Seconded by Commissioner Keith and carried. Commissioner Fart moved to remove from table, request from Mr. Kay Shoemaker, for a water line extension to Kaywood Subdivision. Seconded by Commissioner Keith and carried. Commissioner Morris moved to accept offer from Mr. Shoemaker to pay the material costs of a six inch water'lime and to authorize the City to install a 12 inch water line. Seconded by Commissioner Stenstrom and carried. Request submitted from Donald M. Faulkner, Florida Business Equipment Company, for a 60 day extension, to July 1, 1979, to use a mobile trailer sign, at Florida Business Equipment Company, 2923 South Orlando Drive. Commissioner Stenstrom moved to authorize same. Seconded by Commissioner Keith. MotiOn failed to carry over dissenting votes of Mayor Moore, Commissioner Farr and Commissioner Morris. Commissioner Morris moved to authorize same. Seconded by Commissioner Keith and carried. Condemnation Group 54 submitted from the Minimum Housing Code Inspector and the Fire Chief. Commissioner Morris moved to authorize a public hearing to be held May 14, 1979 to consider same, and notices to be sent to property owners as shown on the tax assessment roll. Seconded by Commissioner Stenstrom and carried. The City Clerk submitted a tabulation of bids for purchase of city property, re- ceived and tabled at meeting of April 9, 1979, as follows: (< See..facing page.) Commissioner Stenstrom moved to remove consideration of bids received April 9, 1979 from table. Seconded by Commissioner Morris and carried. Commissioner Fart moved to accept bid submitted from Mr. Philip Sciortino in amount of $1,800.00 for Item # 15, Park, Country Club Manor, Unit I. Seconded by Commissioner Stenstrom and carried. Commissioner Fart moved to accept bids submitted from Mr. W. A. Hoffman, Jr., Trustee, as follows: 1. $3,755.00 for Item # 18, Lots 6, 8, 10, 12 & 14, Block A, Celery Avenue Addition, PB 1, pg 125, Public Records of Seminole County, MINUTES City Commission, Sanford, Florida April 23, at 7:00 o'clock P.M. 19__ 79 $5,255.00 for Item ~ 19, Lots 6,8,9, 11, 12, 13 & 14, Blk B, Celery Avenue Addition, PB 1, pg 125, Public Records of Seminole County, Florida. Seconded by Commissioner Stenstrom. Motion failed to carry over dissenting votes of Mayor Moore, Commissioner Morris and Commissioner Keith. Commissioner Morris moved to reject all bids, except the one previously accepted, and to return the respective binder checks. Seconded by Commissioner Fart and carried over dissenting vote of Commissioner Stenstrom. Commissioner Stenstrom moved to authorize the properties to be readvertised for sale, with proposals to be received by 7:00 P.M. on May 29, 1979, and the minimum acceptable bid to be not less than the assessed value of the property. Seconded by Commissioner Morris 'and carried. On motion of Commissioner Keith, seconded by Commissioner Morris and carried, Ordinance No. 1469, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING THAT NORTH- SOUTH ALLEY LYING BETWEEN 25TH STREET (GENEVA AVENUE) AND 25TH PLACE AND BETWEEN PARK AVENUE AND MAGNOLIA AVENUE, RESERVING THE USE OF SAME UNTO THE CITY OF SANFORD, FLORIDA FOR UTILITY PURPOSES, PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. was introduced and placed on first reading and read in full. On motion of Commissioner Stenstrom, seconded by Commissioner Fart and carried, minutes of April 9, 1979 were approved. The City Manager reported that the developer of San Situs was notified April 10, 1979, to submit a design plan for the intersection of Shannon Drive and 17-92, but that nothing had been received. Commissioner Fart moved to table consideration of same until correspondence is received from the developer, Seconded by Commissioner Stenstrom and carried. The City Attorney reported on an agreement proposed by the Seaboard Coast Line Railroad, for the City to pay to said company the sum of $615.00 per year for maintenance of railroad crossing signal arms on McCracken Road. He stated if the City does not agree to pay half the annual maintenance cost and the signals are not inStalled, and if an accident occurs, the City could be claimed to be at faUlt. He recommended if the City enters into an agreement to maintain the signals, that an indemnity clause be included in the contract to indemnify the City for all claims at said crossing. The City Manager recommended the City adopt an ordinance requiring the Railroad to install and maintain crossing signals at all street crossings in the City. He stated that it is not the federal government that requires the City to pay the maintenance costs, but rather, it is the Seaboard Coast Line Railroad. Commissioner Stenstrom moved to authorize the City Attorney to draft a complete indemnification clause to be submitted to the State of Florida Department of Transportation, and table consideration Of an agreement until the Department of Transportation takes action on the indemnification clause. Seconded by Commissioner Fart and carried over dissenting vote of Commissioner Morris. On recommendation of the City Manager, Commissioner Morris moved to authorize Countdown Enterprises Promotion Agency and Studio B to use the Civic Center, with alcoholic beverages, on April 21, 1979, with payment of $250.00 fee. Seconded by Commissioner Keith and carried. Commissioner Keith reported that the Department of Environmental Regulation has mandated that a plan be prepared by June 30, 1979. Mr. Bob Kelly, Public'WOrkS Director, recommended the plan as set forth in the report. Commissioner Fart moved to authorize Commissioner Keith to inform CALNO that the City agrees with the direction CALNO is proceeding, and to meet with them and report back to the Commission on any changes. Seconded by Commissioner Stenstrom and carried. Commissioner Fart moved to authorize the Mayor to direct letters to the legislative ~de!egation in oPposition to the following: SB 198 HB 94 HB 792 HB 892 HB 1046 Putting 5% cap on local government budget changes, but not State, with proposed State sales tax revenue up 17% and the legislature will not cap State budget - only local budgets. Advertising of vacancies on lOcal boards. State law setting incentive pay for firefighters. State law removes~local right to regulate cablevision rates. State set fiscal criteria for lOcal governments and supervise if they pass critical stage. Seconded by Commissioner Morris and carried. The City Manager reported that some of the residents in the neighborhood of the Therm-O-Tane Gas Company, 414 West Ninth Street, had submitted to Fire Chief Harriett a petition concerning the company's operation. Chief Harriett had called the State Fire Marshall's Office, and met with the business owners, State Fire Marshall's Office Inspector, and the City Building Official, and further, that results of tests run indicate the operation to be within state requirements. On motion of Commissioner Stenstrom, seconded by Commissioner Fart and carried, Salary Reclassifications were authorized as followS': Arlene Davison, City Manager's office, from Clerk/TYpist II E to F, $7,799.70 annual. Elwell Ferrell, Street Department, from'Equipment Operator II D to E, $8,740.59 annual. George Markos, from Firefighter E to F, $13,427.02 annual. The City Manager reported that the docks leased by Holiday Inn in the ~e$..t basin MINUTES City Commission, Sanford, Florida April 23, at 7:00 o'clock P.M. 19.__ 79 would like t.o acquire a leasehold interest in these docks, and that the motel owner is agreeable to the docks being removed from the motel lease. Commissioner Morris moved to ~ authorize same. Seconded by Commissioner Keith and carried. The City Manager reported that the County CommiSsion did~not .approved the posit~on of sanitary technician, under CETA funding. The Commission authorized the City Manager to request a review. The Commission authorized letters of commendation for completion of school courses as follows: Josie Beall - GED program. Rick Holloway - AS degree from SCC in Constructional Engineering. Bill Braceland - AA degree with honors from SCC in Business Administration. Letter submitted from Mr. Edward P. Calvin, DVM, requesting the City to ins~.all an additional water meter at his residence, next to the animal hospital on East Celery Avenue, outside the City.
