Tamm, Jr. The first item of business was presentation of plaque~ to retired city employees as follows: Solon Teston, Parks and Cemetery Superintendent, 44 years service. Homer Thomas, Shop Superintendent, 24 years service. A public hearing was held in accordance with notices authorized at meeting of April 23, 1979 to consider condemnation of 12 structures or'buildings on Reports Nos. 79- 906 through 79-917, Group 54. The Chairman announced that the Commission would hear from any property owner or representative thereof. A review of each individual report was as follows: 79-906 517 Hickory Ave. Victoria G. After consideration, Commissioner Morris moved that finding the buildings under Reports Nos. 79-906 through 79-917 to be unsanitary, unsafe and delapidated, that said structures be condemned and the owner given a notice of 90 days in which to repair or give just cause why same has not been repaired or demolished; and after 90 days to authorize the City to demolish the structures and levy a lien against the property for said removal. Seconded by Commissioner Keith and carried over the dissenting vote of Commissioner Farr. A public hearing was held in accordance with notice published in the Evening Herald on April 20, 1979 as follows: MINUTES City Commission, Sanford, Florida May 14, at 7:00 o'clock P.M. 19__ 79 NOTICE OF'PROCEEDING FOR VACATING AND ABANDONING PORTIONS OF STREETS TO WHOM IT MAY CONCERN: You will take notice that the City commission of the City of Sanford, Florida, at 7:00 o'Clock P.M. on May 14, 1979, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to portions of Prlnceton Avenue and Yale Avenue, lying between East 25th Place (Palm Drive) and East 26th Street (Woodruff Street) and between Poinsetta AVmnue and the Seaboard Coast Line Railroad right-Of-way, being more particularly described as follows: me That portion of Princeton Avenue lying between and , abutting~ Lots 16 through 30, Block 6 and Lots 1 through 15, Block 8, and That portion of Yale Avenue lying south of the north lot line of Lot 16, Block 8, extended easterly, and between and abutting Lots 16 through 30, Block 8, and Lots 17 through 32, Block 9. all in Palm Terrace, PB 4, Pg 82, Public Records of Seminole County, Florida.. The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed street closings. No one appeared. The City Clerk reported that the abutting property owner is the City of Sanfordo The City Manager reported there are no utilities in the street Eight-of-ways. Commissioner Morris moved to authorize the City ~ttorney to prepare the proper ordinance to vacate and abandon the street right-of-ways~as advertised. Seconded by Commissioner stenstrom and carried. The next item of business was receiving proposals for the sale of city property in accordance with notice published in the Evening Herald on April 20, 1979 as follows: INVITATION FOR PROPOSAL The City of Sanford will accept firm proposals for the purchase of City property described as follows: (1) Lot 5 & ~of vacated street abutting on the SW, Lake Monroe Industrial Park, PB 14, pg 29, Public Records of Seminole County, Florida. (2) Lot X, Lake Monroe Industrial Park, PB 14,~pg 29, Public Rec- ords of Seminole County, Florida. (3) Lot 6 & ~ of vacated street abutting on the SW, Lake Monroe Industrial Park, PB 14, pg 29, Public Records of Seminole County, Florida. Proposals may be.made for each separate parcel, or for the total property. The proposal should be in a sealed envelope and clearly marked as such on the outside. It should be submitted to the City Commission of the City of Sanford, no later than 7:00 o'clock P.M. on Monday, May 14, 1979. Proposal shall include the parcel number and description, and the following: 1. The net price of the land to be paid to the City of Sanford. 2. Ail fees shall be paid by the buyer-none by the City of Sanford. Include a certified check for ten (10) per cent of the proposal as a binder. This proposal is open to anyone. Commissioner Fart moved to accept bid in amount of $51.00 submitted from Mr. Adams !or Lot X, Lake Monroe Industrial Park, and to authorize the Mayor and City Clerk to execute a deed for said property. Seconded by Commissioner Morris and carried. Commissioner Morris moved to authorize to reject all bids submitted for Lot 7, Lake /4:4 MIN'UTES City Commission, Sanford, Florida May 14, at 7: 00 o' clock P.M. 19 79 Commissioner Stenstrom moved to accept bid in amount of $9,500.00 submitted from Mr. Philip Sciortino for Lot 5 and portion of vacated street, Lake Monroe Industrial Park. Seconded by Commissioner Keith. Commissioner Morris stated that in 1971 all the Lake Monroe Industrial Park parcels except Lot X had been appraised at $185,000.00, and that the highest bid submitted now was only $57,000.00 The vote was taken on the motion, and same failed unanimously. Commissioner Morris moved to reject all remaining bids and to authorize to return the binder deposits for same. Seconded by Commissioner Fart and carried. Letter submitted from Mr. M.L. Raborn, Realtor, Raborn Realty, suggesting a packet be prepared and sold at a cost of 10¢ per sheet, for information on property advertised for sale. Commissioner Morris moved to authorize same. Seconded by Commissioner Farr and carried. Commissionmr Farr moved to remove from table, a public hearing, tabled April 9, 1979 to consider rezoning the unplatted portion of Hidden Lake from PUD to SR-1A District. Seconded by Commissioner Stenstrom and carried. Commissioner Fart moved to table same for 90 days. Seconded by Commissioner Keith and carried. Mrs. Lucy Smith, 815 Laurel Avenue, appeared and stated she represented about 35 of her ne~.~hh~, to complain about Therm-O-Tane's liquid gas operation at 414 West Ninth Street, next to her home. She stated'that gas trucks occasionally leaked and are parkedwithin 25 feet of her home each night, and further, one is parked within 10 feet. She also objected to the trucks being parked there at night and on weekends, with no one to look after them. The City Manager submitted a copy of a letter to Ms. Smith, from Mr. Lewis H. Homer III, Staff Attorney, Central-Florida Legal Service, Inc., stating that there is probably not a great enough risk incident to have the activity stopped as a public nuisance.. He also stated there is a large liquified petroleum gas plant operated by the Flo-Gas Corporation nearby. 'Mr. Bill Allen, Gas Safety Inspector, Florida State Fire Marshall's Office, stated he has no record of anything blowing up at the Therm-O-Tane Operation, that small tanks are filled from a large tank, and the trucks fill at Osteen. Mr. Robbie Robertson, owner, Therm-O-Tane, stated that the trucks, which are any- where from full to empty, are parked inside the fence and they have had no leakRr: in 22 years. G. Manning Harriettt, Fire Chief, stated that Therm-O-Tane~is properly licensed by the City and by the State. The Commission authorized the Fire Chief, Mr. Bill Allen and Mr. Robbie Robertson to meet with Mrs. Smith and her neighbors, for a tour~zof the Therm-O-Tane operation, and explanation of propane gas. CIMPA'I~ Memo submitted from Mr. F. G. Plapp, Executive Secretary, Civil Service Board, stating that on June 30, 1979 the two year term for Dr. John F. Darby as a member of the Civil Service Board will expire. Commissioner Keith moved to re-appoint Dr. Darby to the Civil Service Board. Seconded by Commissioner Morris and carried. Memo submitted from Mr. G.W. Braceland, Building Official, that the three year terms of office of Planning and Zoning Board members will expire June 30, 1979, as follows: J. Q. Galloway C.B. Franklin On motion of Commissioner Stenstrom, seconded by Commissioner Keith and carried, same was tabled. CommisSioner Stenstrom moved to authorize both requests, for 60 days, provided no flashing lights are used. Seconded by Commissioner Keith and carried. Mr. Ken McIntosh, Attorney for Keller Industries, appeared and stated that Keller Industries has projected an~ operational date of June 25, 1.979, and submitted requests as follows: Cornwall Road improvements: Request the City to provide the labor and equipment, in approximate amount of $12,000.00, and Keller and Hun~ would provide materials and testing in .approximate amount of $28,000.00, to pave Cornwall Road from Sanford Avenue easterly to the railroad crossing. Water lines to new plant: Request the City to install water line to the plant site for drinking, restrooms, fire proteetion, and_as a back-up for their private supply. Seconded by Commissioner Keith and carried over dissenting vote of Commissioner Morris. Commissioner Fart moved to authorize same. Seconded by Commissioner Stenstrom and carried over dissenting vote of Commissioner Morris. On recommendation of the City Manager, Commissioner Fart moved to authorize the Citizen Band Radio Club use of the Civic Center with alcoholic beverages on May 12, 1979, upon payment of $250.00 fee. Seconded by Commissioner Stenstrom and carried. . Commissioner Keith moved to authorize salary reclassifications as follows: Howard Killen from Licensing Official E to F $12,512.33. The City Manager reported that the State Department of Transpoytation will-~iden 25th Street on the south side, west of French Avenue, to eliminate the off-set, and will eliminate parking on the south side of 25th Street, between French Avenue~and Laurel Avenue. Commissioner Stenstrom moved to adopt Resolution No. 1264. Seconded by Commissioner Morris and carried. Said ResoLution being in words and figures as follows: RESOLUTION NO. 1264 RESOLUTION REQUESTING THE PROHIBITION OF VEHICLE PARKING WHEREAS, City of Sanford , in cooperation with the State of Florida DepartJnent of Transportation, finds it to be in the public interest to prohibit parking on certain streets within the corporate limits of C~ty of Sanford ; NOW, THEREFORE, BE IT RESOLVED that . PUBL IC B M I N U T E S City Commission, Sanford, Florida May 14, at 7:00 o'clock P.M. 19 79 49 On recommendation of the City Manager, Commissioner Morris moved to authorize the City Attorney to prepare the proper resolution to pppose HB 629, which violates home rule and increases local costs in building divisions of municipalities and counties. Seconded by Commissioner Stenstrom and carried. On recommendation of the City Manager, Commissioner Keith moved to authorize transfer in amount of $300.00 from Contingency to Civil Service Advertising to provide for adwertising vacant positions. Seconded by Commissioner Stenstrom and carried. Recommendation submitted from the Suggestion Review Committee to award $25.00 to Jan Stuart for recommendation as follows: That the person interested in purchasing City property be required to put up a deposit .in an amount sufficient to cover, the. appraisal fees and advertising, fees. If the property is not appraised or advertised, the deposit to be returned. If the property is appraised and advertised for sale deposit could be utilized as part of their binder deposit. If a bid submitted by another personis accepted by the Commission, their deposit to be refunded. If the Commission does not accept any bids, their deposit to be retained to pay the appraisal fees and advertising fees. Commissioner Fart moved to authorize a $25.00 award to Jan Stuart and further, to adopt same as City Policy. Seconded by Commissioner Stenstrom and carried. The Commission authorized the City Manager's proposed budget work schedule, beginning May 29 or 30, as follows: 8:00 AM to 3:00 PM 3:00 PM to 5:00 PM 5:00 PM - evenings home office - City Hall home The City Manager reported that Flagship Bank had notified the City they will terminate their program of accepting utility payments on June 29,1979. The City Manager reported that Seminole County would reconsider the City's request for a position for a sanitary technician under the CETA program. The City Manager reported that the City ~ Lake Mary declined to participate in the costs for the water main extension on CR 46-A, west of the Mayfair Country Club. The City Manager Submitted a letter from Philip C. Sciortino, stating that his title company is unable to issue title insurance on the park property in Country Club Manor Unit 1, on which he was the successful bidder, because the property is dedicated as a park to both the City and the property owners of the surrounding development. Commissioner Fart moved to authorize a public hearing to be held June 11, 1979 to consider vacating the park property, and to authorize the City Attorney to prepare the proper ordinance vacating same. Seconded by commissioner Stenstrom and carried. The commission authorized the City Manager to purchase one set of Elected Officials Handbooks, Series I and Series II, at $20.00 per set. Commissioner Keith moved to authorize the City Manager to call the legislative delegation, stating the Commission's opposition to proposed collective bargaining MINUTES City Commission, Sanford, ~lorida May 14 at 7:00 o'clock P.M. 19 79 The City Manager submitted a revised policy for military leave for National Guard duty, and stated it complies with.th~.Florida StatBtes, as follows: 6.6 Military Reserve Leave Employees as members of National Guard or Military Reserve Units shall be entitled'to leaVe of absence from thei~'~esPective duties,.. ~ithout~oss of pay, °n all days during which they ~hall be engaged in active State or Federal duty, fie~d exercises or other training ordered under the provisions of Florida Statutes Chapter 115 and 250, provided these leaves shall not exceed seventeen (17) days at any one time. Except for emergency sitUations, it shall be the employees responsibility to notify their ~epartment Head at least (2) weeks in advance of any such leave. Seconded by Commissioner Morris and carried. The City Manager reported that the U.S.. Environmental Protection Agency. Said resolqtion being in words and figures as follows: RESOLUTION NO. 1265 RESOLUTION OF THE CITY COMMISSION OF THE ~CITY OF SANFORD, FLORIDA, ACCEPTING A GRANT FROM THE UNITED STATES GOVERNMENT FOR THE PREPARATION OF A FACILITIES PLAN FOR THE PLANNING AREA DESIGNATED UNDER SECTION 201 OF THE AMENDMENTS TO THE FEDERAL WATER POLLUTION CONTROL ACT OF 1972. WHEREAS, the City Commission of the City of Sanford, Florida, has determined that it is advisable and in the best interest of the Citizens of Sanford, Floridac, that the City apply for a grant of Federal funds for a facilities plan study under the Environmental Protection Agency of the United States Government in an effort to realize a regional sewer plant for Northern Seminole County which would include the City of Sanford, and WHEREAS, the United States Environmental Protection Agency has, by letter dated May 9, 1979, offered a ~ederal~grant in the sum of $437,208.00 to the City of Sanfo~d for the preparation of a Facilities Plan for the Planning Area designated under Section 201 of the Amendments to the Federal Water pollution Control Act of 1972, said sum representing seventy-five (75%) per cent of the Environmental Protection Agency eligible project cost, and MINUTES City Commission, Sanford, Florida May 14 at 7: 00 o; c lock P.M. 19 79 WHEREAS, the City Commission of the City of Sanford, Florida,at its regular meeting.of May'14, 1979, having voted to accept the offer of said Federal grant and having authorized the Mayor of the City of Sanford, Florida, to sign an appropriate resolution accepting said grant, NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that the offer of a Federal grant by the United States Environmental Protection Agency in the sum of $437,208.00 to the City of Sanford, Florida, for the preparation of a Facilities Plan for the Planning Area designated under Section 201 of the Amendments to the Federal Water Pollution Control Act of 1972 be and the same is hereby accepted. Tamm, Jr. City Clerk The City Manager reported that Seminole County Commission has changed the CETA program, so that any CETA employee hired after April 1, 1979 will have a maximum salary of $6,635.00, and if a higher salary is paid, the City would be required to pay the difference first, without reimbursement, before the CETA funds would begin. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize the present CETA positions to be continued until October 1, 1979, as follows: Custodian $6,163.00 Clerk/tyPist - building department $5,777.82 Clerk/typist - police department $6,395.29 and further, not to fill any additional positions and to decline the allocation of the positions. Seconded by Commissioner Keith and carried. The City Manager submitted a proposed 15 year lease of the S~nford Municipal Stadium by Wes Rinker Florida Baseball School, and stated the proposed lease incorporated everything the Commission had indicated it wanted. Commissioner Stenstrom moved to include a sectioh requiring a Certificate of Insurance to be filed with the City, and to authorize the Mayor and City Clerk to execute the lease. Seconded by Commissioner Fart and carried. The Mayor stated he had received letters from two retired city employees, requesting an increase in the City pension. Commissioner Morris moved to authorize the pension for four retired employeeS, including the insurance pension payment, to be raised to a minimum of $100.00 per month, or to the equivalent of the minimum benefits now paid under FRS for their years of service, whichever is greater, effective October 1, 1979.
