A public hearing was held in accordance with notice published in the Evening Herald on June 21, 1979 as follows: NOTICE OF PROCEEDING FOR VACATING AND ABANDONING AN ALLEY. TO WHOM IT MAY CONCERN: You will take notice that the City Commission of the City of Sanford, Florida, at 7:00 o'.clock P. M. on July 9, 1979, in the City Commission Room at the City Hall in the City of Sanford, Florida, will consider and determine whether or not the City will close, vacate and abandon any right of the City and the public in and to a north-south alley ly- ing between Myrtle Avenue and Elm Avenue and between Fulton Street and the easterly extension of Commercial Street, being more particularly 'described as follows: That certain north-south alley in Block 1, Tier 6, Town of Sanford, Plat Book 1, page 58, Public Records of Seminole County, Florida. The Chairman announced that the Commission would hear from those persons present to speak in favor of,or in opposition to, the proposed alley vacating. No one appeared. Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordinance to vacate and abandon the alley as advertised. and carried. Seconded by Commissioner Stenstrom and carried. Commissioner Morris moved to table same until receipt of report from Planning and Zoning. Seconded by Commissioner Stenstrom and carried. Mr. J. W. McFayden submitted a request for sale of Beer and Wine for consumption on premises at 322 Sanford Avenue. Commissioner Morris moved to table ~ntil later in the meeting. Seconded by Commissioner Stenstrom and carried. Mr. Harold M. Christensen submitted a copy of a bill dated August 19, 1974 in amount of $220.50 for materials he purchased for the repair of a sidewalk at 301 W. 10th Street. Mr. Christensen stated that the City had requested him to have the sidewalk repaired, and now the City had repaired sidewalks in a residential area at no cost to the property owner. Commissioner Morris stated that this was being done only in areas heavily used by the public. The City Manager reported that in 1974 the City Policy for repairing sidewalks was for the property owners to pay for the materials and the City would furnish the labor, and the policy had not chan~ed. Commissioner Morris recommended the bill be ~ejected. Seconded by Commissioner Ke~th and carried over dissenting votes of Commissioner Stenstrom and Commissioner Fart. i Martha Yancey suggested the City install an outside Bulletin Board at the 'Civic Center. Commissioner Stenstrom authorized the City Manager to investigate sa{n~e and submit facts and figures. Seconded by Commissioner Keith and carried. Resignation from the Planning and Zoning Commission submitted from ~homas Wilson, III, and same was accepted with regrets. : ~ Commissioner Keith ~.ecommended Leroy Johnson, school teacher, to fill the vacancy on the Board of the Sanford Housing Authority. No action was taken by the Commission. On motion of Commissioner Stenstrom, seconded by Commissioner Fart ~nd carried, Ordinance No. 1475 entitled: ORDINANCE NO. 1475 AN ORDINANCE OF THE.CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING THAT EAST- ~ST ALLEY LYING BET%~EN SAN CARLOS AVENUE AND SAN MARCOS AVENUE AND BET~EN SECOND STREET AND FOURTH STREET, RESERVING THE USE OF SAME UNTO THE CITY OF SANFORD, FLORIDA FOR UTILITY PURPOSES, PROVIDING FOR SEVER- ABILITY, CONFLICTS AND EFFECTIVE DATE. was introduced and placed on first reading and read in full. Commissioner Morris moved to remove from table request for sale of Beer and Wine for~consumption on premises at 322 Sanford Avenue. Seconded by COmmissioner Fart .and carried. J. W. McFayden, 1015 Holly Avenue, appeared to support his request for the sale of Beer and Wine for consumption on premises. On motion of Commissioner Fart, seconded by Commissioner Morris and carried over dissenting vote of Commissioner Keith, said request was approved. Commissioner Stenstrom moved to authorize payment of statement in amount of $560.·.00 to Mrs. Lucille Rogers for her painting of the new City Hall. Fart and carried. The City Manager reported that the air conditioner in the Civic Center has been failing, and the estimated cost for rePairs im $5,432.00. The City Manager pubmitted a letter from Roger D. Neiswender, CountM Administrator, sta~ing that the County does not have a poliCy to provide for construction of sidewalks MINUTES City Commission, Sanford, Florida July 9 at 7:00 P. M. 19.79 LEGAL SUPPLY COMPANY from French Avenue to Georgia Avenue. The City Commission authorized transfer from Contingency of $850.00 for material for sidewalk repairs at Ail Souls Catholic Church. The City Manager submitted a letter of appreciation from Mack N. Cleveland, Jr., Attorney, for the Plaque and resolution presented to him from the City of Sanford for his 25 years service on the Civil Service Board. Letter submitted from Terry Goembel, County Property Appraiser, estimating the 1979 taxable value of $150,534,635.00, which-will produce an estimated tax revenue of $16,- 419.00 above proposed budget estimate. The City Manager submitted a letter of gratitude from Ms. Paula Rood for services rendered by the Sanford Fire Department Rescue Team when her father, Mr. Laundenbach, was stricken by a heart attaCk on his arrival in Sanford by Auto Train. She also made a con- tribution to the Sanford Firemen's Benefit Fund Invitation submitted by Florida League of Cities for'advertisment in the Florida Municipal Record for the 53rd annual convention, and same was declined. Bid submitted in the sum of $250.00 from Urban, Peirsol, Williamson, and Davis, Attorneys, to purchase for their client, City property described as follows: W 15 ft of E ~ of Lots 11 & 34, Blk 9, Dreamwold, PB 3, pg 90, Public Records of Seminole County Florida, and enclosed a binder in the amount of $25.00. Commissioner Morris moved to accept the bid as submitted. Seconded by .Commissioner Stenstrom and carried over dissenting vote of Commissioner Fart. Frank Baio, Manager, Church's F~ied Chickeni ~2561 French-~Avenue requested use~-of a mobile trailer, sign~for~6,0 days to begin July 10, 1979. Commissioner Stenstrom moved to authorize same, with no flashing-lights. Seconded by Commissioner Morris and carried. Letter submitted from Thomas Wilson, III, Executive DireCtor of the Sanford Hous- ing Authority, requesting the City Commission to forbear the payment in lieu of taxes for_ Fiscal Year 1980. Commissioner Stenstrom moved to deny the request. Seconded by Commissioner Fart and carried. The City Clerk submitted a report on information received from the Supervisor of Elections regarding the punch card voting machines and voter lists to be used at the next city election. The City Commission expressed their cooperation in undertaking the change over, and did not wi-sh to purchase any of the voting machines previously used for elections. Diana L. Jarrett submitted a request, to establish an annual license fee for an Auto Exchange at the Drive-In Theatre, for operation from 8:00 A. M. to 5:00 P. Seconded by Commissioner Fart and carried. Commissioner Morris moved to authorize the Mayor and City Clerk to execute a plat of Ramblewood and to accept payment of $4,768.00 in lieu of open space for 1.6 acres at $2,980.00 per acre, for park purposes. Seconded by Commissioner Stenstrom and carried. The City Manager submitted ~ tabulation of costs fo~ services of an.auctioneer . for sale of surplus personal property to be held the early part of August. Commissigner Keith moved to authorize the auction to be held by Dell's Auction Service. Seconded by Commissioner Fart and carried. Commissioner Stenstrom announced that many terms had expired on theAuxilary Boards of the City, and moved to appoint Bart Gallagher to the Planning and Zoning Board to fill the unexpired term of Tom Wilson. Seconded by. Commissioner Morris and carried over dissent- ing vote of Commissioner Fart. On motion of Commissioner Stenstrom, seconded by Commissioner Keith and carried over dissenting vote of Commissioner Morris, Ordinance No. 1476 entitled: ORDINANCE NO. 1476 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1321, SAID ORDINANCE PROVIDING FOR A SCHEDULE ~F TRAVEL EXPENSE AND REIMBURSEMENT FOR CITY OFFICIALS AND CITY EMPLOYEES WHILE ENGAGED IN CONDUCTING BUSINESS IN BEHALF OF THE CITY OF SANFORD, FLORIDA; SAID SCHEDULE TO PROVIDE FOR PER DIEM IN THE SUM OF $40.00 PER DAY, MILEAGE OF $ .19 PER MILE, BREAKFAST EXPENSE OF $2.45, LUNCH EXPENSE OF $3.50 AND DINNER EXPENSE OF $7.00, PROVIDING_.
