The City Commission of the City of Sanford, Florida, met in Regular Session in
the City Hall in the City of Sanford, Florida, at 7:00 o'clock P, M. on July 23, 1979.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with notice published in the Evening Herald
on July 9, 1979, as follows:

ABANDONING A PORTION OF A STREET.
TO WHOM IT MAY CONCERN:
You will take notice that the City Commission of the City of Sanford,
Florida, at 7:00 o'clock P. M. on July 23, 1979, in the City Commission
Room at the City Hall in the City of Sanford, Florida, will consider
and determine whether or not the City will close, vacate and abandon
any right of the City and the public in and to a portion of a street
lying between 27th Street, Orlando Drive and Lake Jennie, being more
particularly described as follows:
The westerly one-half (30 feet) of that certain street named
THE CROSSWAY, as delineated on an Amended Plat of Druid Park,
Plat Book 7, pages 5 and 6, Public Records of Seminole County,
Florida.
Persons interested may. appear.and be heard at the time and place speci-
fied.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed street closing.
The City Clerk reported that notices were mailed to property owners on July 6,
1979.
Mr. Frank Whigham, Attorney, representing Smitty's Inc., owner of property abut-
ting The Crossway, appeared to support the request and stated Seminole County has been re-
quested to close the Easterly one-half of the street, which is not in the City.
Commissioner Keith moved to authorize the City Attorney to prepare the proper
ordinance to close, vacate and abandon the street as advertised. Seconded by Commissioner
Stenstrom and carried.

You will take notice that the City Commission of the City of Sanford,
Florida, at 7:00 o'clock P. M. on July 23, 1979, in the City Commission
Room at the City Hall in the City of Sanford, Florida, will consider
and determine whether or not the City will close, vacate and abandon
any right of.the City and the public in and to an alley and a utility
easement lying between Colonial Way and Katherine Court and between
French A~enue and CordoVa Drive, described as follows:
(a) That certain utility easement lying on the East 5 feet of
property described as follows:
Beginning on the Easterly right-of-way of French Avenue,
24.!.4 feet SOuth :of thC North line of Lot 1:, Bloc~k .8, ~
of HIGHLAND PARK, according to the Plat thereof as re-
corded in Plat Book 4, page 28, of the Public Records of
Seminole County, Florida, run South 60 feet to the South
line of Lot 5, Block 8, HIGHLAND PARK, thence Southeast-
erly along South line of Lot 5, Block 8, 72.85 feet to
the West line of 10 foot alley, thence Northeasterly

Mr. James Thoman, 600 Park Avenue, appeared to support a request for a.license
for a Benefit Concert, to be held September 29, 1979 at the Sanford Memorial Stadium, and

stated they want to be completely within the law; he is prepared to put his board of trus-
tees and his weight behind this concert, and he will monitor funds and offered parental
help to police the concert, under the direction, of the Police Chief.
The vote was taken, and the motion failed to carry over dissenting votes of Com-
missioner Fart and Commissioner Keith.
The City Manager was authorized to discuss the proposed concert with Mr. Thoman,
and report to the Commission.
Offer submitted in the amount of $2,700.00 from W. A. Hoffman, Jr., Trustee, to
purchase City property assessed in the amount of $2,650.00, and advertised for sale on March
26 and May 1, 1979, described as follows:
Lot 16, less State Road right-of-way, Frank L. Woodruffs Sub-
division, Plat Book 3, Page 44, Public Records of Seminole
County, Florida.
Commissioner Keith moved to accept the offer as submitted. Seconded by Commis-
sioner Fart and carried.
Petition for annexation of property located at the intersection of East Airport
Boulevard and the Seaboard Coast Line Railroad right-of-way submitted from Rose and Natale
Belsito, for property described as follows:
Begin at the intersecticn of the South line of Section 6, Township
20 South, Range 31 East and the WesterlY right-of-way line of the
Oviedo Branch of the ACL Railroad, run thence Northwesterly along
said Western right-of-way line 273.3 feet, thence West parallel
with the South line of said Section 6, 200.00 feet, thence South-
easterly parallel with the said ACL Railroad right-of-way 273.33
feet to the South line of Section 6, thence East' along said Section
line 200 feet to. the point of beginning, less the South 35 feet for
road. Ail in the SE~ of the SW~ of Section 6, Township 20 South,
Range 31 East and containing 1 acre net.
The Commission authorized the City Attorney to prepare the proper ordinance to be placed
on first reading on August 13, 1979.

On motion of Commissioner Stenstrom, seconded by Commissioner Keith and carried over dis-
senting vote of Commissioner Fart, same were apprOved as recommended.
Request submitted from Mr. Chuck Baker, Vice President of the Pizza Division,
Semoran Management Corporation, to use a mobile trailer sign in front of the Pizza Hut,
2002 French Avenue, to advertise a new product. Commissioner Stenstrom moved to authorize
same, for 60 days, with the provision of no flashing lights. Seconded by Commissioner Keith
'and carried over the dissenting vote of Commissioner Fart.

Commission would hear from those 'persons-present to speak' in favor of,,or in opposition to,

The City Managerreported~that the, painting of~the..new City Hall had been framed
at a cost of $135.69. Commissioner Stenstrom,moved to authorize payment of same.~ Seconded

Hall computer room. Seconded by. Commissioner Stenstrom and carried.' :
Commissioner Fart moved to authorize a salary reclassification for Elsie Marforio
from Clerk Typist II E to F, $7,799.70 annual. Seconded by Commissioner ~Stenstrom and car-
tied.
The City Manager reported that repairs, to a blower motor coupling and a bearing
housing at the Wastewater Treatment Plant will cost approximately $5,104.00. On recOmmenda-
tion of the City Manager, Commissioner Stenstrom moved to authorize the emergency purchase

The City Manager reported that the-City.:is ob~taining costs for a sign at the
Civic Center, and estimates should be available by July 30, 1979 at the 4:00 P. M. meeting.
The City Manager submitted a copy of a letter from the Florida Department of
Transportation, stating that the Seaboard Coast Line Railroad will pay 100% of the mainten-
ance cost for the railrOad crossing signal at McCracken Road.
The City Attorney reported he had conferred with Mr. Bruce R. Granoff, Attorney
for the Enforcement Division of the Environmental Protection Agency, regarding a civil
penalty in sum of $4,000.00 for alleged improper use of weed control spraY on a drainage
!ditch near Scott Avenue. He stated that the Envirmnmental Protection Agency is not con-
cerned whether or not the fish were killed, but that the City used the spray where run-off
was likely to occur. He recommended acceptance and execution.of a Consent Agreement and
Fina'~' Order, andpayment of the:.'$4~O00-,'00'ciVil penalty~- '
Mr. William Balser, 222 Bradshaw Drive, Sanford, stated that other companies in
Florida use sprays, with similar use re.s~z:ictions,, on:low areas where run~o~Z water, carries
it into streams, and the Environmental Protection Agency does not cite them.

The City Attorney recommended settlement of $5,000.00 for claim by Bonnie Tucker~
alleging to have fallen on a sidewalk in extremely bad condition, and injury caused by a

moved to appoint Mrs. Martha Yancey, Sanford, to represent the City on said committee.
Seconded by Commissioner Stenstrom and carried.
Commissioner Keith moved to appoint Mr. Leroy Johnson to the Sanford Housing
Authority Board of Directors. Seconded by Commissioner Fart and carried.
The Commission authorized the City Manager to be out of town July 24 through
29, 1979.
