M. on August 27, 1979. Present: Mayor-Commissioner Lee P. Moore Commissioner John G. Morris Commissioner Julian L. Stenstrom Commissioner David T. Fart C~mmissioner Edwin O. Keith City Attorney C. A public hearing was held in accordance with notice published in the Evening Herald on August 7 and 17, 1979 as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE, AND AMENDING THE FUTURE 1AND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY OF SANFORD, FLORIDA. Notice is hereby given, that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on August 27, 1979, to consider changes and amendments to the Zoning Ordinance, and amending the future Land Use element of the Comprehensive Plan of the City of Sanford, Florida, as follows: A portion of that certain property lying between West 25th Street and Sarita Street and between Grenada Avenue and French Avenue is proposed to be rezoned from MR-1 (Multiple-Family Residential Dwelling) District to RMOI (Multiple-Family Resi- dential, Office and Institutional) District, and amending the future Land Use element of th~ Comprehensive Plan. Recommendation submitted from the Planning and Zoning Commission to rezone the property as advertised. Mr. Don Royer, 900 East Horatio Avenue, Maitland, appeared and stated he owns; part of the property, rand.is in favor of the proposed rezoning. Commissioner Morris moved to authorize the City Attorney to prepare the proper. ordinance to rezone the property as advertised. Seconded by Commissioner Stenstrom and carried over dissenting vote of Mayor Moore. MINUTES City Commission, Sanford, Florida August 27 at 7:00 P. M. 1979 meeting of May 28, 1979, to consider rezoning the unplatted portion of Hidden Lake from PUD to SR-1A District. Seconded'by Commissioner Keith and carried. Commissioner Morris moved to table same until the Planning and Zoning Commission submits a recommendation~ Seconded 'by Commissioner Stenstrom and carried. Mr. Neil Yoder, Group Representative, Blue Cross and Blue Shield Insurance Com- pany, submitted a check in amount of $25,689.00, as a refund, of excess premiums and final accounting of the group policy for period of June 1, 1977 through June 30, 1978. Mr. Ken Kroesser was present to support a request to sell alcoholic beverages, under a Class 5 COP Alcoholic Beverage license at The Ark, 1010 State Street. Commissioner Stenstrom moved to table same until meeting of September 10, 1979. Seconded by Commissioner Morris and carried. Mr. Kroesser stated that they needed a decision tonight so they could obtain the necessary financing. Commissioner Farr moved to remove consideration of the Class 5 COP Alcoholic Beverage license from table. Seconded by Commissioner Morris and carried. Commissioner Farr moved to authorize to waive the 500 foot distance requirement between businesses selling alcoholic beverages, and to' authorize the sale of alcoholic bev- erages under a Class 5 COP Alcoholic Beverage license at The Ark. Seconded by Commissioner Morris and carried over dissenting votes of Commissioner Keith and Commissioner Stenstrom. Mr. Dennis Stewart, 2762 Ridgewood Avenue, presented a proposed ordinance to require the City to be responsible for maintenance and liable for those walkways designated as "high pedestrian use" and to hold the property owner .to Lhe same responsibility for those walkways not designated as "high pedestrian use". Request submitted from Mr. Ken Kroesser to use a mobile trailer sign at The Ark, 1010 State Street, for 30 days beginning August 28, 1979, to advertise a grand opening. Mr. Kroesser was present to support the request. Commissioner Fart moved to authorize same, with the provision of no flashing lights. Seconded by Commissioner Morris and carried over dissenting vote of Commissioner Stenstrom. Recommendation dated August 17., 1979 submitted from the Plannings.and Zoning Com- mission,-~as'follows: 1. Recommend approval to the City Commission rezoning from MR-1 to RMOI, Lots 23 thru 33 and W~ of Lot 34, Block 9, Dreamwold. RTTPPT.¥ O. nMPANY BUILDING CODE ~ECTION 1: That Section 6-1 of Chapter 6, entitled "Building 'Code" of the Sanford City Code be amended to read as followS; Sec. 6-1. Adopted That the 1979 edition of the Standard Building Code with Appendix D; prepared by the Southern Building Code Congress, as amended is hereby' adoPted by' the City', one (1) copy of which code is filed in the office of the City Clerk as a matter of permanent record of the City', and the matters and contents therein are made a part of this Chapter by reference as fully and completely as if set forth herein, and such copy shall remain on file in said office available for public inspection. Reason: Update to latest edition. Sec. 2: That Section 6-1.1 of Chapt·er 6, entitled "Building Code,J be amended to read as follows: Sec. 6-1.1 AMENDMENT That Section 102.1 and 102.2 entitled "Building Official" and "Inspectors" be deleted in their entirety. Reason:Job descriptions covered in City Position Classification Manual. Section 3: That Chapter XXIII entitled "Signs and Outdoor Displays" is hereby deleted in its entirety. Reason: Signs covered in City Sign Ordinance. Section 4: That Section 403.2 entitled "Tenant Separation" is hereby amended to read as follows: Add sentence to read: "Provided smoke detectors are located within each tenant area." Reason: Allows reduction in tenant separation for certain occupancies with smoke detectors. Section 5: That Section 901.6 entitled "General" is hereby amended to read as follows: In all buildings constructed over forty-five (45) feet from ground level,.approved sprinkler equipment and smoke detection devices meeting the requirements of the Standard Building Code shall be installed on all floors. Reason: More realistic requirement compatible to safety and available fire-fighting equipment. GAS CODE Section 1: That Section 12-1 of Chapter 12, entitled "Gas Code" of the Sanford City Code is hereby amended to read as follows: Sec. 12-1 ADOPTED The St'andard Gas Code, 1979 edition, prepared by the Southern Building Code Congress, is hereby adopted by the City, one (1) copy of which code is filed in the office of the City Clerk as a matter of permanent record of the City', and the matters and contents therein are made a part of this Chapter by' reference as fully· and completely · .as if set forth herein, and such copy shall remain on file in said office available for public in- spection. Reason: Update to latest edition. No amendment. HOUSING CODE Section 1: That Section 14-1 of Chapter 14 entitled 110 MINUTES City Commission, Sanford, Florida August 27 at 7:00 P.M. 19 79 Sec. 14-1 ADOPTED The 1979 edition of the Standard Housing Code, prepared by' the Southern Building Code Congress, is hereby adopt- ed by the City one (1) copy of which code is filed in the office of the City Clerk as a matter of per- manent record of the City, and the matters and con- tents therein are made a part of this Chapter by reference as fully and completely as if set forth herein, and such copy shall remain on file in said office available for public inspection. Reason: Update to latest edition. No amendments. MECHANICAL CODE Section 1: That Section 16~-1 of Chapter 16~ entitled "Mechanical Code" of the Sanford City' Code be amended to read as follows: Sec. 16~-1 ADOPTED That the 1979 edition of the Standard Mechanical Code, as prepared by the Southern Building Code Congress International, Inc. as amended, is here- by' adopted by the City', and a copy of same as amended is filed in the office of the City Clerk as a matter of permanent record of the City, and the matters and contents therein are made a part of this Chapter by reference as fully and com- pletely as if set forth herein, and such copy '~ shall remain on file in said office available for public inspection. Reason: Update to latest edition. Section 2: That Sec. 16~Jl.1 of Chapter 164 entitled "Mechanical Code" of the Sanford City Code is hereby amended to read as follows: Sec. 16~-1.1 AMENDMENTS . That Section 106, the same being entitled "Fees" is hereby' deleted in its entirety. Reason: Covered by City Fee Schedule. Section 3: That Section 111 and 112 being entitled "Board of Adjustm_ent and Appeals" and "Decisions of the Board of A.~justment and Appeals" are hereby deleted in their entirety. Reason: Local Board of Adjustment more functional. Section 4: That SubsectiOn '%" of Section 303.2 entitled "Location" is hereby' amended to read as follows: (A) 3. That where such appliance is located in an equipment room, such room shall have an opening or door or passageway thereto large enough to permit removal of the largest piece of the appliance. Reason: Allows opening to be only large enough for service or replacement. Section 5: That Subsection "A" of Section 504 entitled "Duct Construction. and Installation" is hereby amended to read as follows: ~ (A) Joints and seams shall be securely fastened and made substantially air-tight with glass-fab and mastic. All slip joints shall have at least a one-inch lap which is mechanically fastened. Reason: Disallows Duct Tape which has not Proven to be effective. Amend first paragraph to read: "No room attic, void, hollow or concealed space shall be used as an integral part of a duct system, or "Plenum" unless the component parts of such space is con- structed entirely of non-combustible materials and/ or properly protected by means of fire dampers and/ or fan cut-off cOntrols so as to restrict the spread of fire, and arranged so as.to protect the fire re- sistiveness of the assembly. For exception, See Section'509. Such chambers shall not be used for storage or occupational purposes. Public exit halls in hotels, hospitals, institutions and similar occupancies and in multi-family houses shall not be used as Plenums. Stairway' enclosures connecting two or more stories shall not be used as Plenums. Reason: Allows Plenums to be non-combustible or protected. Both not required. Section 7: That Section 603.1 entitled "General" is hereby amended to delete the words "Sanitary Sewer Drain".from the first sentence.. Reason: Prohibits condensate drains extending into sanitary' sewer System. Section 8: That Subsection 605.2 entitled "Bleed-Off" is hereby amended to ~ead as folloWs: Ail cooling tower, water cooled air conditioner, and heat pump bleed-off.and drain lines shall .be extended to a storm sewer drain unless connected to lawn sprinkler system. Such drains shall not in any case be allowed to drain into sanitary sewer drain. Cooling tower.drains shall not in any case be allowed, to drain into yards~ streets or alleys, or on the roof of a building which drains into such areas. Reason: Prohibits mechanical system drains extending into sanitary sewer system. Section 9: That Chapter V%%% entitled Electrical Requirements be deleted in its entirety and be replaced with the following amendment: Chapter VIII. Electrical Requirements Ail electrical requirements shall conform to the National Electric Code, NFPA 70. Reason: Eliminates conflict with adopted Electrical Code. PLUMBING CODE Section 1: That Section 19-1 of Chapter 19 entitled "Plumbing" of the Sanford City Code be amended to read as follows: Section 19-1 ADOPTED That the 1979 edition of the Standard Plumbing Code, as amended, as prepared by'the SOuthern. Building Code Congress, is hereby adopted by the City, one (1) copy of which is filed in the office of the City' Clerk as a matter of permanent record of the City, and the matters and contents therein are made a part of this Chapter by reference as fully and completely as if set forth herein, and such copy shall remain on file in said office available for public inspection. M. 19 79 Section 3: That Subsection (b) of Section 1210.1 entitled "Materials" is hereby amended to read as follows: (b) Underground-Inaccessible water distribution piping under slabs shall be Copper water tube mini- mum Type L, brass, cast iron pressure pipe or gal- vanized steel pipe, all to'be installed with approved fittings and bends. Any materials subject to corrosion shall be protected when used in corrosive soils. Copper water tube under slab shall be a continuous loop, or all approVed fittings must be silver soldered. Reason: Requires copper under slab to be continuous or silver soldered to reduce probable leakage. Section 4: That Table 500 entitled "Materials for Plumbing Installations" is amended by deleting from the list of materials "concrete sewer pipe." Reason: Concrete sewer pipe not considered satis- factory alternative to cast iron or PVC. Section 5: That Subsection (a) of Section 1213.7 entitled "Safety Pans and Relief Valve Waste" is hereby amended to. read as follows: (a) When water heaters or hot water storage tanks are installed above the ceiling level, the tank or heater shall rest in a'galvanized steel or other metal pan of equal corrosive resistance having a thickness at least equal to twenty-four (24). gauge galvanized sheet metal. Reason: Requires safety' pan under hot water tanks only when installed above ceiling level. Existing CO~ requires all heaters, to have. pans. Commissioner Morris moved to authorize the City Attorney to prepare the proper ordinances and to authorize public hearings to be held to consider same. Seconded by Commissioner Keith and carried. Commissioner Stenstrom submitted a proposal for a Salary Survey, as follows: I concur with the Mayor that an expenditure of $4,500 would be "untimely" now for a salary range survey. Conse- quently, I suggest that we instruct the City Manager to establish a "team" of city employees who would do the "leg work" associated with compiling pay scheduleS from munici- palities "similar" to Sanford as well as from local and area businesses. This information could be sorted, tabulated and compared to similar positions in the city. ~ Ail of the information could be then turned over to a special Review Board appointed by the City Commission to determine salary levels for city employees equitable to the local and area labor market. This specially constituted Board would recommend various salary ranges to fit each type of position in the city's organizational structure. In my opinion this procedure would remove the stigma of the City's "team" doing the study, recom- mending salary levels, and receiving benefits. The "team" would do the leg work only. The Review Board would propose'salary ranges and the City Commission'would act if and when it chose to do so. MINUTES City Commission, Sanford, Florida August 27 at 7:00 P. Commissioner Stenstrom moved to adopt the proposal, instruct staff to accumulate information called for in the recommendation and hold the appointment of the board for 30 days, until after the Commission reviews the information. Commissioner Stenstrom reported that at a meeting held on AugUst 21, 1979, the Board of Directors of the General Sanford~Memorial Library had adopted the five proposals which were submitted to the Commission on August 13, 1979, and recommended the appointment of the eight members as submitted.
