RTTPPT.¥ GC~MPAN¥ The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on October 22, 1979. A public hearing was held in accordance with notice published in the Evening Herald on October 2 and 12, 1979, as follows: NOTICE OF PUBLIC HEARING OF PROPOSED CHANGES AND AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF THE ZONING ORDINANCE, AND AMENDING THE 'FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY OF SANFORD, FLORIDA. , Notice i's hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City .of Sanford, F16rida, at 7:00 o'clock P. M. on October 22, 1979, to consider changes and mmend- merits to the Zoning Ordinance, and .amending the future Land Use element of the Comprehensive Plan of the City of Sanford,.~ Florida, as 'follows: A portion-of that certain property lying east of and abutting U.S. Highway 17-92 (SR 15 & 600)~' and between Airport Boule- vard and the easterly extension of Lake Mary Boulevard is pro- posed to be rezoned from SR-2 (Mobile Home Residential Dwel- ling) District. to GC-2 (General Commercial) District, and amend- ing the future Land Use element of the Comprehensive Plan. Said propert~ being more particularly described as follows: Beginning 1166.48 feet South of the East ~ Section Post, run North 72° '43' West 1307.2 feet, North 25~° East 411.5 feet, South 71° 40' East 1133 feet, South 450.17 feet to the Point of Beginning, Section 2, Township 20 South, Range 30 East. Tmmm, Jr. City Clerk The Chairman announced that the Commission would hear from those persons present to speak in favor of, or in opposition to, the proposed rezoning. The City Clerk reported that notices were sent to property owners on September 20, 1979. Mr. M. L. "Sonny" Raborn, Realtor, appeared and stated he represented the seven petitioners, and that the businesses presently located on the property needed GC-2 zoning to operate. The Planning and Zoning Commission submitted a recommendation to rezone the prop- erty. Commissioner Morris moved ~o authorize the City Attorney to prepare the proper ordinance to rezone the property as advertised. Seconded by Commissioner Fart and carried. Request submitted from Mrs. Vernice Galley, Youth Choir Director, Church of God of Prophecy, to use a mobile trailer sizn at 2929 Orlando Himhwav to advertise a snook City Commission, Sanford, Florida October 22 at 7:00 P M. 1979 185 same, with the provision of no flashing lights to be used on the sign. Seconded by Commis- sioner Keith and carried. Commissioner Morris moved to authorize same in accordance with the recommendations. Seconded by Commissioner Keith and carried. Recommendations dated October 19, 1979 submitted from the Planning and Zoning Com- mission as follows: 1. Recommend approval to the City Commission to rezone from SR-2 to GCC2, 11 acres at 3515 Orlando Drive. Recommend approval to the City Commission a request from Edna Smith for a conditional use of "Sale of alcoholic beverages for consumption on the premises in accordance with Chapter 3 of .the City Code and after approval by the Sanford City Commission", in the GC-2 zoned district at 1509 W. 13th St. (Silver Tip Lounge) 3. Recommend approval to the Cit'y Commission - a portion of 90 lots (contiguous to Ramblewood) of a 191 lot Plat, Hidden Lake, Phase II, subject to certain requirements, presented by~.Tommy Peterson for Residential Communities of Amer~ica. 4. Recommend to the City Commission a change in Development Guidelines, adopted by Resolution 1156, July 8, 1974, .Page 1t of Site Development_.Plan. Review,. 'paragraphs 6 &.7, 'to read: 6. Where a proposed subdivision is too small to provide adequate open space according to these standards, payment in lieu of dedication shall be made to the City in the amount equal to the appraised value of the property, determined in (4) above. 7. The City of Sanford shall have the option to either require said open space or accept payment in lieu thereof. Said money to be used to purchase or develop parks in the City. Commissioner Morris moved to authorize permit for sale of alcoholic beverages for consumption on the premises at 1509 West 13th Street, Item (2), above. Seconded by Commis- sioner Stenstrom and carried over dissenting vote of Commissioner Keith. _Mr-~. George Smith, owner, Silver Tip Lounge, stated they propose to change from a Class 2 to a Class 5 Alcoholic. Beverage License'., with a restaurant. Mr. Mack LaZenby, City Engineer, stated that the requirements in Item (3), :above, were the same as those imposed in Ramblewood Subdivision~ as to density, square footage, per- cen_tage of different si:ze homes o.n the lots. Commissioner Morris moved to approve 90 lots of 'the 191 lot Plat of Hidden Lake, Phase II. Seconded by Commissioner Fart and carried. The City Clerk reported that the next meeting falls on a regular City holiday, Veter Day, November 12. Commissioner Morris moved to authorize the meeting to be held on November 1 1979. Seconded by Commissioner Keith and carried. On motion of Commissioner Morris, seconded by Commissioner Keith and carried, min- utes of October 8, 1979 were approved. The City Manager submitted a review of 1975 bike trail information. Commissioner Farr stated consideration should be given to safety bike trails on busy streets, as well as recreational trails. The Commission authorized the staff to prepare updated costs for the · '~t~o ]' bike trails. Commissioner Fart moved to table consideration of same until meeting of Novem- ber 13,1979. Seconded by Commissioner Keith and carried. The City Manager reported that the contract with Nomad Construction Company for the Sanitary Sewer Evaluation Project had expired at the end of one year, and that the contractor is willing to re-negotiate the unit prices by doubling them, which~ would still be lower than the other bids taken a year ago, even though construction costs have risen about 13~7o. Com- missioner Morris moved to authorize Staff to negotiate the best contract with Nomad Construc- tion Company. Seconded by Commissioner Fart and carried. The City Manager reported that the Sanford Housing Authority has indicated approval of a proposed rental agreement for space on the first floor of City Hall, and that they will pay for interior partitions in a lump sum. On recommendation of the City Manager, Commissione~ Morris moved to authorize the Mayor to execute the lease agreement. Seconded by Commissioner Keith and carried. On recommendation of the City Manager', Commissioner Morris moved to authorize salary reclassifications as follows: James E. Bennett, Refuse, from Laborer II E to F, $9,546.10 annual. Malcolm J. Lodge, Refuse, from Truck Driver C to D, $8,860.46 annual. Seconded by Commissioner Fart and carried. The City Manager reported that Hartford Insurance Company has offered to provide $20,000.00 life insurance for fire and police personnel at $10.63 per person per year, with a one million dollar maximum coverage, on any one incident. The present policy costs $12.80 per person per year, with no maximum coverage limit. Commissioner Morris moved to table con- sideration of same until the City Attorney can review the policy. Seconded by Commissioner Fart- and carried. The City Manager reported that Equitable Life Assurance Society of the U. S. wants to sell life insurance to city employees through payroll deduction plan. He further stated the City already has eight deductions of various types. Commissioner Morris moved to authorize transfers in the Sanford Airport Authority FY 1980 Budget as follows: Increase expenditure line items: 8626 - Equipment Procurement 8840 - Special Project 1-77 (Land Acquisition) Establish new expenditure line item: 8850 - Special Project 1-79 (ILS Site Preparation) Increase revenue line items: Total 890 - Federal Aid 891 - State Aid 895 - Airport Improvement Fund 896 - Cash Surplus from Previous Years Decrease Expenditure line item: $ 14,238 8900 - Anticipated 10,571 Seconded $.138,179 $162,988 $110,543 13,818 13,818 14,473 Cash Surplus 10,336 Total $162,988 Seconded by Commissioner Fart and carried. The City Manager submitted memorandum No. 79-20 from the State Bureau of Retirement, setting forth a requirement that all elected officials must be enrolled in the Florida Retire- ment System. The Commission asked for a report, at the next meeting, on possible legislation to exempt locally elected officials and/or withdrawal from'the Florida Retirement System of future employees. On recommendation of the City Manager, Commissioner Fart moved to authorize salary reclassifications as follows: Warren A. Thompson, from Mechanic E 'to F, $11,945.80 annual. Monroe Smith, Street Division, from Laborer C to D, $8,016.61 annual. Kenneth M. Forsythe, Street Division, from Laborer C to D, $8,016.61 annual. Seconded by Commissioner Morris and carried. The Acting City Manager reported that Ford Motor Company has put a hold on the Fair- mont police vehicles until after March, 1980, and recommended cancelling the order with Jack Prosser Ford and accepting iow bid meeting specifications for a street vehicle from Marc Slade Chrysler-Plymouth, from bid tabulation submitted at meeting of October 8, 1979. The Police Chief stated he would rather wait for the police package vehicles. Commissioner Morris moved to keep the order with Jack Prosser Ford for the Ford Fairmonts, with police package. by Commissioner Keith and carried. The Acting City Manager reported that a fire hydrant outside the city limits, at the intersection of Azalea Avenue and Fairmont Avenue in Sunland, is leaking and unrepairable, and is not covered by a maintenance agreement. On recommendation of the Acting City Manager, Commissioner Morris moved to have the hydrant removed and caooed. Seconded by Commissioner Keith and carried. Said resolution being in words and figures as follows: RESOLUTION ~. 1271 ..... A RESOLUTION OF TIlE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, OPPOSING'. ~THE ADOPTION OF FEDERAL AND STATE ENVIRONMENTAL REGULATIONS WHICH WOULD REQUIRE LOCAL GOVERNMENTAL'ENTITlES TO REGULATE THE PRETREATH~NT OF INDUSTRIAL WASTEi~-, WATER. WHEREAS. the City Com=tssion of the City of Sanford, Florida has been advised by the Department of Environmental Regulations, State of Florida, that the environmental regulations of the United States of America and.the State. of Florida have been rewritten in such a manner as to r~equire local goye~nmental entities to regulate pretrea~ment of industrial wastewater, and WHEREAS, it is the opinion of the City Commission that to require local governmental entities.to regulate pretreatment of industrial wastewater would cause an undue burden and hardship on local $overnmen= and that such regulation should not be imposed on ~ocal governmental entities. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Sanford, Florida, that the City of Sanford, Florida is hereby opposed to any and all regUlations imposed by the United States of America or the State of Florida, which would require a local governmental entity to regulate pretreatment of industrial wastewater. BE IT FURTHER RESOLVED that a copy of this Resolution be furnished to the Department of Environmental Regulations, State of Florida. THIS RESOLUTION adopted this 22nd day of October, A.
