The City Commission of the City of Sanford, Florida, met in Regular Session in
the City Hall in the City of Sanford, Florida, on November 13, 1979 at 7:00 o'clock P..M.
Present: Mayor-Commissioner Lee P. Moore

The meeting was called to order by the Chairman.
Mrs. Bill Gielow, representing the Sanford Woman's Club, appeared to support a
proposed bicycle route in Sanford. The City Manager submitted a proposed, updated inter-
city main route and minor route, with estimated costs of $1,535.00 for sign material. Mrs.
Gielow stated her organization would donate the money for the sign material. Commissioner
Fart moved to approve the bicycle path. Seconded by Commissioner Stenstrom and carried.
Mr. Nell Yoder, Group Representative, Blue Cross/Blue Shield Insurance Company,
.appeared and presented a refund of premium in amount of $23,712.00 from American Bankers
Life Assurance Company for group life insurance contract terminating June 30, 1978.
Commissioner Farr moved to authorize to hold the City's portion of the refund in
the insurance Fund, to be used as a reserve against future premium increases. Seconded
by Commissioner Keith and carried.
The next item of business was consideration of amending the Development Guidelines
to require the payment in lieu of land for recreational area in amount of appraised value,
and to give the City the option of whether to accept the property or the payment.
Mr. Kay Shoemaker, Shoemaker Construction Company, appeared and suggested the
City also charge a flat fee on each lot in old areas and apply the fee for recreation pur-
poses.
Commissioner Fart moved to authorize the City Attorney to prepare the proper ordi-
nance to amend the Development Guidelines to require payment in lieu of land for recreational
area to be in the amount of appraised, not assessed, value, and to provide for a fee of
$75.00 per dwelling for construction in older developed plats. Seconded by Commissioner
Stenstrom and carriod.
Request submitted for a time extension on Condemnation Report No. 79-855, Group
53, 414-414~ South Palmetto Avenue, Ernest A. Brotherson, Jr., Heir of Anna Brotherson,
owner. The Minimum Housing Code Inspector submitted a recommendation for a 90 day exten-
sion. On recommendation of the Acting City Manager, Commissioner Stenstrom moved to autho-
rize a final 90 day time extension. Seconded by Commissioner Morris and carried over dis-
senting vote of Commissioner Fart.
The City Manager reported that the Acting City Manager had authorized a request
from Mr. Larry Burney, new Manager of Fairway Market, to use a mobile trailer sign, without
flashing lights, at 2690 Orlando Drive, for a "New Management Sale" from November 2 to

sary delay. Commissioner Morris moved to authorize same. Seconded by commissioner Stenstrom
and carried.
Request submitted from Ms. L±nda Combs to use a.mobile trailer sign at the Imperial
Restaurant and Lounge, 2700 Sanford Avenue, for 30 days beginning November 15, 1979, to ad-
vertise the new business. Commissioner Fart moved to authorize same, provided no flashing
lights are used. Seconded by Commissioner Morris and carried.
Request submitted from Mr. O. J. Hammons, Sales Manager, J. B. Steelman, Inc., to
use a mobile trailer sign in front of 2017 South French Avenue, for 60 days beginning Novem-
ber 15, 1979, to advertise the Fall Sale of property. Commissioner Fart moved to authorize
same, provided no flashing lights are used. Seconded by Commissioner Stenstrom and carried.
Request submitted from Poppa Jay's Restaurant, 2501 French Avenue, to use a mobile
trailer sign in front of the restaurant, for 30 days, to advertise Luncheon Specials for the
month. Commissioner Stenstrom moved to authorize same, provided no flashing lights are used
on the sign. Seconded by Commissioner Keith and carried.
Mr. George Willis, Callbart Realty, appeared and stated that some mobile trailer
signs are placed too close to the roadway, thereby obstructing drivers' vision of traffic.
Letter submitted from Amos Jones, Executive Director, Seminole Community Action,
requesting the Commission to designate a representative to the Seminole Community Action Board
of Directors. Commissioner Stenstrom moved to table same until the next Commission meeting.
Seconded by Commissioner Fart and carried.
On motion of Commissioner Morris, seconded by Commissioner Keith and carried, Ordi-
nance No. 1495, entitled:

The City Manager submitted a letter from Roger Neiswender, County Administrator,

Commission's intention be that the building remain a public library. Seconded by Commissioner
Stenstrom and carried. The City Manager reported he is inveStigating the possibility of ob-
taining a clear title at the present date.
The City Manager reported that Jack Homer, Manager of the Greater Sanford Chamber
of Commerce had asked the City to pay one-half of the total cost of $743.40 for an ad in the
Progress Edition of the Evening Herald. Commissioner Fart moved to pay same and to authorize
a transfer from Contingency in amount of $371.70, .~Seconded by Commissioner Keith and carried
over dissenting vote of Commissioner Morris. ~:
The City Manager reported that the State of Florida Department of Transportation
had offered to install railroad crossing pavement markings at 27 locations, and advance warn-
lng signs at 25 locations, provided the City agrees to maintain the aforesaid items. Commis-
sioner Stenstrom moved to adopt Resolution No. 1272, and to authorize the Mayor and City Clerk
to execute the agreement. Seconded by Commissioner Keith and carried over dissenting vote
of Commissioner Morris. Said Resolution being in words and figures as follows:

The City Manager reported that the cost for street and sidewalk liability insurance
is $5,518.00 for period of September 10, 1979 to April 9, 1980, and that the annual premium
due in April will be in the estimated amount of $9,460.00. Commissioner Fart moved to autho-
rize transfer in amount of $14,978.00 from Contingency to Street Division, Public Liability
and Operations Insurance. Seconded by Commissioner Stenstrom and carried.
The City Manager reported that the $20,000.00 Fire and Police Life Insurance policy
is being continued with the present carrier. On recommendation of the City Manager, Commis-
sioner Fart moved to re-bid same for next year's coverage. Seconded by Commissioner Morris
and carried.
The City A-ttorney submitted a Final Statement in amount of $2,368.15 for Services
in the case Thomas H. Sands, Jr. v. City of Sanford, et al. Commissioner Morris moved to auth
rize payment of same, and transfer from Contingency in amount aC!$368.15. Seconded by Commis~.
sioner Stenstrom and carried.
The City Manager submitted a request from Mrs. Edith Beal, 406 San Carlos Avenue,
for a handicapped parking space at First Street and Magnolia Avenue. The Commission autho-
rized the City Manager to advise Mrs. Beal that the City has conformed to state law, and has
a handicapped parking space in each block.
The City Manager repozted that there have been damage claims submitted to the City
for sewer back-ups and floodings due to haavy rains. The City Attorney stated he did not feel
the City was liable for these damages, since they were caused by acts of nature, not line
stoppages.
The City Manager reported that, due to the fuel allotment, the City has not mowed
privately-owned property for the past four months, and that there are 10 properties on the
list to be mowed. The Commission authorized the properties to be mowed, and hold any more
requests.
The City Manager reported that construction plans have been prepared for the Down-
town Area, reflecting total construction cost in estimated amount of $178,775.62. Deleted
items are as follows:
fountain, brick pedestal, special street lights,
street name signs and tree grates
Said plans to be submitted to the Downtown Merchants at a meeting in the Commission Room on
November 20, 1979 at 8:00 A. M.

MINUTES
City Commission, Sanford, Florida
November 13 at 7:00 P.M. 1979
On recommendation of the City Engineer/Utility Director, Assistant City Manager and City Mana
Commissioner Keith moved to accept low bids. Seconded by Commissioner Stenstrom and carried.
Condemnation Group 56, Reports Nos. 79-929 through 79-931 submitted from the Mini-
mum Housing Code Inspector and the Fire Chief. Commissioner Morris moved to authorize a pub-
lic hearing to be held November 26, 1979, to consider same. Seconded by Commissioner Sten-
strom and carried.
The City.Manager submitted a letter from Bruce R. Granoff, Attorney, Legal Branch,
Enforcement Division, United States Environmental Protection Agency, to the City Attorney,
enclosing a consent agreement and Final Order in Claim I. F. & R. No. IV-357-C, alleging mis-
use by the City, of a pesticide.
The City Manager reported that the U. S. Environmental Protection Agency is willing
to waive all fines against the City, if the City will admit the charge and agree not to do it
again. On recommendation of the City Attorney and the City Manager, Commissioner Stenstrom
moved to authorize the Mayor and City Manager to execute the agreement. Seconded by Commis-
sioner Fart and carried.
The City Manager submitted a request from Mr. James T. Ioss, 100% Real Estate, Inc.
to permit an off-point-of-purchase sign at the intersection of Airport Boulevard and High-
way 17-92. On recommendation of the City Manager, Commissioner Keith moved to deny the re-
quest. Seconded by Commissioner Fart and carried.
