HomeMy WebLinkAbout112679-Regular Session MINUTES City Commission, Sanford, Florida November 26 at 7:00 P.M. 19 79 197 The City Commission of the City of Sanford, Florida, met in Regular Session in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 26, 1979. Present: Mayor-Commissioner Lee P. Moore Commissioner John G. Morris' Commissioner Julian L. Stenstrom Commissioner David T. Fart Commissioner Edwin O. Keith City Attorney C. Vernon Mize, Jr. City Manager W. E. Knowles City Clerk H. N. Tamm, Jr. The meeting was called to order by the Chairman. The Mayor presented Mrs. Mary Harkey-Meyer with a plaque for 25 years service as Secretary to the City Manager. A public hearing was held in accordance with notices authorized at meeting of November 13, 1979, to consider condemnation of structures or buildings on Reports Numbers 79-929 through 79-931, Group 56. The Chairman announced that the Commission would hear from the property owners or representatives thereof. Joseph Davis and Mr. Scott Burns, owners of property at 300 East First Street, Condemnation Report No. 79-929, appeared and stated they want to have the building torn down as soon as possible after the insurance proceeds are settled. After consideration, Commissioner Morris moved that finding the buildings under Condemnation Report Numbers 79-929 through 79-931 to be unsanitary, unsafe and delapidated, that said structures be condemned and the owners given a notice of 30 days in which to re- pair or give just cause why same has not b~en repaired or demolished; and after 30 days, to authorize the City to demolish the structures and levy a lien against the property for said removal. Seconded by Commissioner Farr and carried. The Commission authorized the City Manager to negotiate with the owners for a more immediate removal, and to re-route the Christ- mas Parade, if necessary. Request submitted from William L. Colbert, Optimist Club of Sanford, to use a lighte mobile trailer sign at the corner of the Zayre parking lot facing 17-92, to advertise the sale of Christmas trees, from November 26 through December 26, 1979. Commissioner Morris moved to authorize same, with no flashing lights, to be located on private property not closer than~9 feet to property lines and shall not obstruct existing advertising media of other businesses or properties; and to waive the permit fee for same. Seconded by Commissioner Morris and carried. Request submitted from Mrs. Mattie Harris, 1100 Orange Avenue, to close Orange Avenue between Seventh Street and Celery Avenue from 8:00 A. M. until 5:00 P. M. on December 25, 1979, to provide an area for children to skate. Commissioner Morris moved to authorize same. Seconded by Commissioner Stenstrom and carried. Commissioner Stenstrom moved to remove from table, consideration of appointing a representative to the Seminole Community Action Board of Directors. Seconded by Commissioner Keith and carried. Commissioner Stenstrom reported that no additional information had been submitted to him and moved to table same. Seconded by Commissioner Fart and carried. A public hearing was held in accordance with notice published in the Evening Herald on November 19, 1979 as follows: NOTICE OF A PUBLIC HEARING TO CONSIDER THE ADOPTION OF AN ORDINANCE BY THE CITY OF SANFORD, FLORIDA. Notice is hereby given that a Public Hearing will be held at the Commission Room in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on November 26, 1979, to consider the adoption of an ordinance by the City of Sanford, Florida,' title of which is' as fol- lows: ORDINANCE NO. 1495 AN ORDINANCE OF THE CITY '-OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097 oF ~AID CITY, SAID ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT CHANGING THE ZONING OF THAT PORTION OF PROPERTY LYING EAST OF AND ABUTTING U. S. Commissioner Keith moved on its passage and adop- tion. Seconded by Commissioner Fart and carried. Thereupon, the Chairman announced that the City Commission of the City of Sanford, Florida, had passed and adopted said Ordinance No. 1495, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN; SAiD AMENDMENT CHANGING THE ZONING OF THAT PORTION OF PROPERTY LYING EAST OF AND ABUTTING U. On motion of Commissioner Keith, seconded by-Commissioner Fart and carried, Minutes of November 13, 1979 were approved. On recommendation of the Suggestion Review Committee and the City Manager, Com- missioner Fart moved to authorize awards as follows: September:Diane Smith, $25.00, sign for Civil Service Office. Rubel Burfield, $10.00, self-ballast street light bulbs; $10.00, lightening attester idea in city-owned street lighting system. October: Howard Killen, $25.00, change in utility department receipt. Rubel Burfield, $10.00, permanently install electrical system in Fort Mellon Park. June Singer, $10.00, collating table next to copier. Seconded by Commissioner Stenstrom and carried. The City Manager reported he had temporarily approved a request from Mr. Fues, Village Restaurant, to use a mobile trailer sign for 30 days beginning November 19, 1979, for a grand opening. Commissioner Keith moved to approve same with no flashing lights. Report submitted from Police Captain Earl Bourquardez that on November 14, 1979 the 2000 block of Washington Avenue was surveyed to determine if "no parking" signs were needed in the area. The survey showed the traffic was light; caused no obvious complica- tions in the area, and therefore, there is no need for parking control in this residen- tial area. Commissioner Fart moved to reschedule the regular City Commission meeting from December 24, 1979 to December 17, 1979. Seconded by Commissioner Keith and carried. Commissioner Morris moved to authorize a holiday on December 24, 1979 and for City Hall to close at 4:00 P. M. on December 21, 1979. Seconded by Commissioner Stenstrom and carried. Request submitted from Jack Shubert to waive the subdivision requirements, and offered to supply the material for a fire hydrant and a 6 inch water line, if the City would install same on 25th Place from Sanford Avenue to Poinsetta Avenue.. The City Manager submitted a recommendation to deny. After discussion, Commissioner Morris moved to approve the request and to autho- rize the City to enter into an agreement with Shubert Construction Company to install said water line and fire plug. Seconded by CommissiOner Stenstrom and carried over dissenting vote of Mayor Moore. The Commission authorized to ask the Planning and Zoning Commission to review the Subdivision Regulations to determine if they should be re-written to.provide for cases when the property is already platted and subdivided. Petition for annexation submitted from the ComBank of Winter Park, for property located at the southeast corner of the intersection of Woodson Drive and Highway 17-92. Commissioner Stenstrom moved to authorize the City Attorney to prepare the proper ordi- nance to annex same. Seconded by Commissioner Keith and carried. '1273 ~:~ $5,276.00 3,995.00 1,851.00 507.00 Seconded by Commis- Said Resolution RESOLUTION AUTHORIZING THE CITY OF SANFORD TO BECOME A PARTY TO INTERLOCAL AGREEMENT AND MPO; AUTHORIZING OFFICIAL TO SERVE ON MPO; AUTHORIZING MPO TO UNDERTAKE PLANNING AND PROGRAMMING CONTEMPLATED BY INTERLOCALAGREEMENT; AUTHORIZING ITS MAYOR TO EXECUTE NECESSARY INSTRUMENTS. WHEREAS, the Federal Government, under the authority of 23 U.S.C. 134 and Sections 3.(a.) (2.),~4.(a.), 5.(g.) (1.) and 5.(1.) of the ~Urban Mass Transportation Act of 1964, as amended (49 U.S.Co 1602 (a.) (2.), 1603 (a.) and 1604 (g.') (1.) and (1.)), requires that each urbanized area, as a condition to the receipt of federal capital or operating assistance, have a continuing, cooperative, and comprehensive transportation planning pro- cess that results in plans and programs consistent with the comprehensively planned development of the' urbanized area, and stipulates that the State and the Metropolitan Planning Organization shall enter an agreement clearly identifying the responsibility for cooperatively carrying out such trans- portation planning; and WHEREAs, Rules of the Federal Highway Administration and the Urban Mass Transportation. Administration, published in Volume 40 of the Federal Register, No. 181, pages 42976 to 42'984, September'17, 1975, provide for the designation of Metropolitan Planning Organizations by the Governor; and WHEREAS, Section 334.215, Florida Statutes, provides for the creation, designation and apportionment of Metropolitan Planning Organizations con- sistent with the federal laws and rules identified above; and WHEREAS, the Governor, in accordance with the provisions of Section 334.215, Florida Statutes, has designated the City of Sanford as a voting I204 MINUTES City Co.mmission, Sanford, F1Qrida November 26 at 7:00 P. WHEREAS, the Governor, in accordance with the provisions of Section 334.215, Florida Statutes, has apportioned the membership of the Orlando Area Metropolitan Planning Organization in such a manner as to include representation for the City of Sanford through the appointment of its Mayor; and WHEREAS, the Governor, in accordance with the provisions of Section 334.215, Florida Statutes, has also designated and apportioned the Orlando Area Metropolitan Planning Organization in such a manner as to include '- voting representation from Seminole County., Osceola County, City of Orlando, City of Winter Park, City of Altamonte Springs, City of Kissimmee, Orange County, and'~he.O~lando/Orangei',County:ExpresswaY Authorit~ a~.w~ll.-.a~the city of Sanford; NOW, THEREFORE BE IT RESOLVED, that the City of Sanford shall become a party to the Interlocal Agreement by and between Orange County, Seminole County, Osceola County, City of Orlando, City of Winter Park, City of Altamonte Springs, City of Kissimmee, City of Sanford, the Orlando/Orange County Expressway Authority and the Florida Department of Transportation creating and establishing a Metropolitan Planning Organization for the Orlando Urban Area; and BE IT'FURTHER RESOLVED, that the City of Sanf°rd does authorize its designated representative to serve on the Metropolitan Planning Organiza- tion; and BE IT FURTHER RESOLVED, that the City of Sanford authorizes the Metro- politan Planning Organization to undertake the planning and programming contemplated by the Interlocal Agreement; and BE IT FURTHER RESOLVED, that the Mayor, City of Sanford, is authorized to execute any instruments necessary to accomplish this 'purpose. M. 19,79 Request submitted from Ball Motor Lines to park up to six tractor-trailer units, which may partially block Myrtle Avenue, between First Street and Fulton Street, between 5:00 P. M. and midnight, Tuesday through Friday, while loading and unloading at the old railway depot. On recommendation of the City Manager, Commissioner Stenstrom moved to authorize same. Seconded by Commissioner Keith and carried. The City Manager was authorized to work with the legislature to obtain legisla- tion to permit locally elected officials the option to be exempted from the Florida Retire- ment System.
