M. on December 10, 1979. Present: Mayor-Commissioner Lee P. Moore Commissioner John G. Morris Commissioner David T. Fart Commissioner Eddie O. Keith City Attorney C. Vernon Mize, Jr. City Manager W. Stenstrom The meeting was called to order by the Chairman. Mr. Kirchoff stated the purpose of the meeting was to assist the County in long range plans for library service to the Sanford - Lake Mary area. He stated the old Post Office building does not have the space to implement the goal over the next 20 years. Mr. Neiswender expressed concern if the County could deliver the desired level of service from the present building, and of the awareness of the City,s problem to re- tain the books if the County transferred the library operation to another location prior to April 16, 1983. The Mayor reiterated the offer of the City to enter a long-term lease of the building and also the .adjacent vacant lot for use as a library without charge; or, if for other purposes, with the term of the lease commensurate with the improvements made by the County. The staff members of the City and County were to work out a short term lease, pending the development by the County of longer range plans. There being no further business, the meeting was adjourned. (b) Highway Automotive, Inc., 2613 Orlando.Drive, for 30 days, for a Grand Opening. (c) Poppa Jay's Restaurant, 2501 South French Avenue, for a 30 day extension from December 14,~ 1979, for Special Promotion. Commissioner Stenstrom moved to authorize Valencia Bakery and Highway Automotive, Inc., to use mobile trailer signs~:~as requested, provided the signs have no flashing lights, are located on private property not closer than nine feet to property lines and do not obstruct or block existing advertising media of other businesses or properties. Seconded by Commissioner Morris and carried. Commissioner Stenstrom moved to deny the request from Poppa Jay's Restaurant for an extension to use a mobile trailer sign. Seconded by Commissioner Morris and carried. On motion of Commissioner Stenstrom, seconded by Commissioner Keith and carried, payment of same was authorized. Memo dated December 6, 1979 submitted from the Building Official to the City Clerk, stating that the terms of office of Board of Adjustment members B. L. Perkins and W. M. Philips expired November, 1979. Commissioner Keith moved to re-appoint Mr. Perkins and Ytr. Philips to the Board of Adjustment for three year terms to expire November, 1982. Seconded by Commissioner stenstmom and carried. MINUTES City Commission, Sanford, Florida December 10 at 7:00 P. M. 19 79 Commissioner Stenstrom moved to remove from table, consideration of appointing a representative to the Seminole community Action Board of Directors. Seconded by Commis- sioner Keith and carried. Commissioner Stenstrom.moved to table same until information from the Justice Department is resolved. Seconded by Commissioner Keith and carried over dissenting vote of Commissioner Morris. Applications submitted for sale of Beer and Wine for Consumption on the Premises, as follows: (a)~ Hachem's Inn, 2708 South Sanford Avenue. (b) Pizza Boy Kitchen, 3109 South Orlando Drive (K-Mart Plaza).. The City Clerk reported that Hachem's Inn, 2708 South Sanford Avenue, would be within 500 feet of The Imperial Restaurant, 2700 Sanford Avenue, which filed and was approved for sale of Beer, Wine and Liquor in November, 1979, but which has not yet opened for business. On recommendation of the Planning and Zoning Commission, Commissioner Morris moved to authorize sale of Beer and Wine for Consumption on the Premises at the above loca- tions, and to waive the 500 foot rule for Hachem's Inn. Seconded by Commissioner Sten- strom and carried over dissenting vote of Commissioner Keith. Recommendations dated December 7, 1979 submitted from the Planning and Zoning Commission as follows: Recommended approval on a request from Peter Hachem for a conditional use, "Sale of alcoholic beverages for consumption on the premises in accordance with Chapter 3 of the City Code, and after approval by the Sanford City Commission", in the GC-2 zoned district at Hachem's Inn"-27D8 Sanford Ave. Recommended approval on a request from the floor from John Palumbo for "Sale of alcoholic beverages for consumption on the premises in accordance with Chapter 3 of the City Code and after approval by the Sanford City Commission", in the GC-2 zoned district at "Pizza Boy", 3109 S. Orlando Drive. The City Manager submitted a proposed contract between Gulf Oil Corporation and the City, for leaded, unleaded and diesel fuel f~r 1980, as follows: leaded 72,447 gallons unleaded 65,429 gallons diesel 29,439 gallons Commissioner Stenstrom moved to approve the contract. Keith and carried. $.7446 per gallon .7653 per gallon .7295 per gallon Seconded by Commissioner Commissioner Stenstrom reported he had looked up the definition of an enclave and that he feels it is clearly defined as property completely surrounded by property of another political entity. The City Manager r~po~ted~that~he~St~telof~t~ida Department of Transportation will replace a City Limits sign on the lakefront and one. on East Celery Avenue. The City Manager submitted a request from owners of property abutting the Lake Monroe bulkhead, east of Mellonville Avenue, for the City to fill behind the bulkhead in the street right-of-way that has never been opened. He estimated this would'take approxi- mately 80 to 90 truckloads of fill. After discussion, Commissioner Stenstrom moved to deny the request, since the City only has a street easement there and has no right to use it unless the City opens the street. Seconded by Commissioner Keith and carried. The City Manager reported that Mr. Jernigan, the owner of Sanford Dry Cleaners, had called to express his appreciation for the action of the Fire Department at a fire in his establishment, and to congratulate the City on its Fire Department. The City Manager submitted a letter of thanks from the Sanford Tourist and Shuffle- board Club for recent City improvements to the shuffleboard area. The City Manager reported increased requests for free use of the Civic Center have been received from County-wide organizations, some on charity grounds w~h'i:~ti~kets or donations, and also, one County organization which is supported entirely by Federal and County tax money, wants to hold a fund raising event to purchase equipment to use in facili- M I N U :T E -S: City Commission, Sanford, Florida December 10 at 7:00 P.M. 19 79 21'3 Commissioner Stenstrom moved to enforce the regulations stating that free use is restricted to City or County governmental units; other organizations for public service with no admission charge or donations accepted, providing the public service must be benefic-ial to the residents of the City of Sanford, and to take a liberal view of the above for tho~e requests which would benefit the citizens of Sanford. Seconded by Commissioner Keith and~ carried. The City Manager submitted a Commendation from Mr. Ralph Tipton for the Fire Department Rescue Squad for the work they did in saving the life of Mrs. Stella Tipton, 819 Rosalia, on December 14, 1979. The City Manager submitted a request from Ms. Pauline S. Konitzer for a street light at 1203 Crescent Street. The City Manager reported that there is already a street light across the street at the lot corner. Request submitted for installJtion of two street lights on Bay Avenue· Commissioner Morris moved to deny the request for a street light at 1203 Crescent Street, and to authorize the installation of two street lights on Bay Avenue. The City Manager reported that the Sanford Housing Authority may want to initiate their lease of a portion of the first floor of the City Hall the first of February, instead of March, 1980. Mr. Hugh Pain showed a movie about the St. Johns River environmental protection, The Waterclock Crises. Mr. J T. Turnipseed, President, Friends of the St John's Inc appeared and asked the Commission to consider actiOn as follows: To consider the protection, improvement and restoration of the St. Johns River a major concern of the City of Sanford and to give it a high priority status; To appoint someone with official responsibility and authority to keep constant check on the River problem and to inform the Commission periodically on water level and pollution with special reference to Lake Monroe and also attend the meetings of the St. Johns River Water Management District at Palatka. ® To express the concern of the City of Sanford to the Government of the State of Florida about the neglect of the River and the harm that our City and area experiences because of the neglig- ence, and also to communicate as often as necessary to the var- ious State agencies related to the River the City's insistence. on action to correct and improve the condition of the River, specifically as to water flow and also pollution. To insist that the Water'Management District make definite pro- gress on the restoration of much of the former marshland areas which originally fed the River. To energetically seek the appointment of a representative of this City or this County on the St. John's Water Management District at Palatka. The Commission took no action. Mr. Glenn McCall appeared'and stated he had checked into the requirements to run the cemetery, and felt he could do it, and provide a better environment and a more pleasing place. He stated he did not plan to change monuments or the way the cemetery is operated, except to upgrade the work. He' further stated that 10% of the sale price of a space must be deposited in a perpetual care fund to be held by a corporation in a trust or savings fund and only the earnings can be used for maintaining the perpetual care spaces. The Coa~aission authorized staff to provide a comparison of the costs of privately- owned vs. municipally-owned cemeteries in this area. The Commission authorized the City Attorney to investigate the legal ramifications of closing Magnolia Avenue, as shown on the Downtown Development Corporation's plans for the downtown area. · The City Attorney reported that Ordinance No, 1495, adopted November 26, 1979, had contained errors in the legal description, and it is necessary to adopt an amended ordinance. Conm~issioner Morris moved on the passage and adoption of Amended Ordinance No. 1495, entitled: AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 1097 OF SAID CITY, SAID ORDINANCE BEING A ZONING PLAN; SAID AMENDMENT CHANGING THE ZONING OF THAT PORTION OF PROPERTY LYING EAST OF AND ABUTTING U. S. HIGHWAY 17-92 (SR 15 & 600), AND BETWEEN AIRPORT BOULEVARD AND THE EASTERLY EXTENSION OF LAKE MARY BOULEVARD FROM SR-2 (MOBILE HOME RESIDENTIAL DWELLING) DISTRICT TO GC-2 (GENERAL COMMERCIAL) DISTRICT, PROVIDING FOR SEVERABILITY, CONFLICTS~ AND EFFECTIVE DATE. M. 19.79 WHEREAS, the Sanford Junior Women's Club work has enabled the general public to enjoy and observe community improvements, NOW THEREFOR BE IT RESOLVED that the Sanford City Commission does hereby commend the members of the Sanford Junior Women's Club for their untiring service to their community and mankind.
