The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on January 23, 1984.

The meeting was called to order by the Chairman.
A public hearing was held in accordance with notice published in the Evening
Herald on January 3 and 13, 1984, as follows:
NOTICE OF A PUBLIC HEARING OF PROPOSED CHANGES AND
AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF
THE ZONING ORDINANCE, AND AMENDING THE FUTURE LAND
USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE
CITY OF SANFORD, FLORIDA.
Notice is hereby given that a Public Hearing will be held at
the Commission Room in the City Hall in the City of Sanford,
Florida, at 7:00 o'clock P. M. on Jaunary 23, 1984, to consider
changes and amendments to the Zoning Ordinance, and amending the
Future Land Use Element of the Comprehensive Plan of the City of
Sanford, Florida, as follows:
A portion of that certain property lying East of and
abutting the intersection of Country Club Road and CR
46-A (West 25th Street) and between Country Club Road
and CR 46-A (West 25th Street) is proposed to be
rezoned from AD (Agricultural) District to RC-1
(Restricted Commercial) District. Said property being
more particularly described as follow:
Lot 54 South of Road, New Upsala, Plat Book
1, page 67, Public Records of Seminole
County, Florida.
Ail parties in interest and citizens shall have an opportun-
ity to be heard at said hearing.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed rezoning.
The City Clerk reported that notice was sent to the owners, P. Zeuli & Sons
Investment, Inc., et al, on December 15, 1983, and the property was posted on December 21,
1983.

We received notice of the public hearing for a possible zoning
change for the property "lying east of and abutting the
intersection of Country Club Road and CR-46 (West 25th street) and
between Country Club Road and CR-46" It is our understanding that
the proposed rezoning is from the present "agricultural" to that
of "restricted commercial" It is also our understanding that the
hearing is to be held at 7:00 P.M., January 23, 1984. We will try
attend the meeting but in case we are unable to attend, .We want
our feelings on this rezoning to be before the commissioners.
We live in the area adjacent to the above property and our homes
have been here for many years. We are strongly opposed to the
proposed rezoning of the above property because of the
probability of commercial construction on this property affecting ~
our homes and our lives adversely. We speak primarily of the
safety factor of ourselves and of the children who play in this
area that is already heavily congested by the traffic that occurs
by the comming together of three heavily traveled streets. We do
not need any commercial facility built in this area to increase
this hazard. Our homes are located close to this property and would
be affected by the increased noise level and also by the
increased crime associated with commercial enterprises.
There are other problems associated with building on this land
such as its adverse affect on the drainage of the surrounding
streets and land and what we feel was an extremely poor method
of land fill. We will not go into this at this time.
We strongly oppose this rezoning proposal and ask that you vote
NO when it comes before the Commissioners. Thank you for
considering our request in this matter.

P.S.: There are many other families in this area who appose this
rezoning effort. The families above are simply the ones closest
to the property and would be the ones most injured. These
families have no a'lternate route to their homes as they live
either on the cul-de-sac Loch Arbor court or directly on Country
Club Road.

On recommendation of the Planning and Zoning Commission, Commissioner Farr moved to
deny the rezoning. Seconded by Commissioner Keith and carried.
Philip Gunster, Chairman of the Trustees of the Carriage Cove Homeowner's
Association, appeared and submitted a petition for more police protection and patrols in
Carriage Cove. He reported the Sanford Police Department does respond when called, but they
want more patrols in the area.
The City Manager reported all of Carriage Cove is privately owned, there are no
publicly owned or maintained streets or driveways.
Commissioner Yancey indicated the Commission would try to increase next year's
budget to provide more police patrols.

The City Manager submitted a letter from Hulon J. Black, requesting permission to
erect a temporary cross and an information board facing the street in Memorial Park, from
three weeks prior to Easter until the week following Easter, and to place a banner spanning
First Street to advertise same; further, for the City to provide and set up about 200
folding chairs in Memorial Park for the service. Commissioner Farr moved to authorize the
erection of the cross, provided it is properly secured. Seconded by Commissioner Smith and
carried.
On motion of Commissioner Yancey, seconded by Commissioner Keith and carried,
Ordinance No, 1682, entitled:

SECTION 11-30 (b) OF THE CITY CODE TO PERMIT AUTOMOBILE
SALVAGE YARDS AS A CONDITIONAL USE IN AN AREA ZONED

David Redwine appeared and asked if Airport Boulevard could serve as a buffer area
between his proposed salvage yard and the residential area nearby, instead of having to
comply with the requirement of not closer than 100 feet to any residentially zoned area.
Commissioner Yancey moved to authorize the City Attorney to amend the foregoing
ordinance to require the fence to be of solid masonry and/or wood, and the salvage yard
boundary wall must be 100 feet from the nearest residentially zoned property. Seconded by
Commissioner Farr and carried.
On recommendation of the City Manager, Commissioner Farr moved to authorize the
Seminole County Republican Committee to use the Civic Center on February 24, 1984, with
alcoholic beverages, after payment of the proper fee. Seconded by Commissioner Yancey and
carried.
The City Manager reported that the Public Service Commission is investigating
whether or not to deregulate street lighting service, the facilities used to produce light
and the maintenance of those facilities, with the charges for electricity to remain
regulated by the Public Service Commission. Further, that Florida Power and Light Company,
Inc., opposes said deregulation. Commissioner Farr moved to authorize the Mayor to execute

On recommendation of the City Manager, Commissioner Smith moved to authorize
transfer in amount of $700.00 from Contingency to Finance Department Budget to upgrade the
Canon Systel II to a double disk drive. Seconded by Commissioner Yancey and carried.
On recommendation of the City Manager, Commissioner Yancey moved to authorize
salary reclassifications as follows:
Kenneth M. Forsythe, Public Works Department, Street Division, from
Equipment Operator I E to F, $14,569.06 annual.
Elwell Ferrell, Jr., Public Works Department, Street Divls'ion, from
Heavy Equipment Operator E to F, $17,483.60 annual.
William C. Gailey, Fire Department, from Fire Chief D to E, $35,778.94
annual.
Seconded by Commissioner Smith and carried.
The City Manager reported that the Florida Department of Environmental Regulation
has agreed to reimburse the City up to $40,000.00 to help offset some of the City's costs
associated with obtaining emergency water supplies necessitated by the EDB contamination of
some of the City's water wells, further, that this amount is much less than the estimated
$283,000.00 the City will have to spend.
On recommendation of the City Manager, Commissioner Keith moved to accept said
$40,000.00, execute the Letter of Agreement for same, and thank Alex Senkavich and Frank
Hutten of the Orlando DER office for their assistance. Seconded by Commissioner Smith.
Commissioner Farr moved to table same, and thank Mr. Senkavich and Mr. Hutten, and
authorize the City Attorney and City Staff to research taking action ag,ainst the State, to
obtain a more fair compensation. Seconded by Commissioner Yancey and .carried.

On motion of Commissioner Smi{h, seconded by Commissioner Farr and carried,
the City Attorney was authorized to prepare a resolution recognizing the 100th anniversary
of the First Baptist Church of Sanford.
On recommendation of the City Manager, Commissioner Yancey moved to authorize the
permanent installation, with utility connections, of a double wide trailer for an OAIS
workshop at Second Street and Elm Avenue. Seconded by Commissioner Farr and carried.
The City Attorney reported that the proposed Final Judgment, N~tice of Entry of
proposed Final Judgment and a map indicating proposed district boundaries are almost ready
to be submitted to Judge Kovachevich for approval. Also, the question of polling places
needs to be resolved, then the only issue to be left for the Judge to decide will be the
question of majority voting vs. plurality voting. Commissioner Smith moved to table
consideration of same. Seconded by Commissioner Farr and carried%
The City Manager submitted a request from Ken Kern, 500 Laurel Avenue, for
permission to pave the parkwaY in-front of the garage at 500 Laurel Avenue, for use as off-
street parking. Commissioner Farr moved to authorize same, upon Mr. Kern submitting to and
approval of a plan by the City Manager. Seconded by Commissioenr Keith and carried.
The City Manager submit'ted a letter from Hunt Oil Company, offering to transfer to
the City, a 46 foot wide strip of land lying West of Mellonvilte Avenue and South of Silver
Lake Road in the Sanford Industrial Park. On recommendation of the Cit. y Manager,
Commissioner Smith moved to accept same. ' Seconded by Commissioner Yancey and carried.
The City Manager reported that according to the City of Lake 'Mary, they now have
1,034 active water connections, 192 inactive water connections, fo'r a 'total of 1,226.
Mr. Otto McDaniels appeared to complain of water standing'on the rear portion of
his property at 1018 West First Street. The Commission authorized the City Manager to have
prepared a map and diagram of the property and drainage in the area.
Commissioner Smith reported that some businesses in small shopping centers cannot
have their own sign, because the City Code does not permit a sign to be closer than 150
feet to another, and there is not enough frontage to spread out the signs. Mike Colif, Med-
Co Pharmacy, appeared and reported that Harper Properties, Winter park, owner of the
Pinecrest Shopping Center, will not provide a single sign for use of all the tenants of the
shopping center, and therefor Turner and Lee Meats cannot have their own sign. The
Commission authorized to discuss same at the next meeting.
The City Attorney reported that Keller Industries wants to escrow the money now,
to call the Industrial Development Revenue Bonds, Series 1977, on December 1, 1987, and has
asked the City to pass a resolution authorizing the MaYor and City Clerk to execute
documents for same. Further, that the title to the property will pass when all the
necessary funds are deposited in escrow. On motion of Commissioner Keith, seconded by
Commissioner Smith and carried, Resolution No. 1367 was read in full and adopted. Said

A RESOLUTION OF THE CITY OF SANFORD, FLORIDA,
AUTHORIZING THE EXECUTION OF AN ESCROW AGREEMENT
WITH FLAGSHIP BANK OF TAMPA, FLORIDA, WITH
REFERENCE TO THE ESCROW OF FUNDS SUFFICIENT
TO PAY ALL PRINCIPAL AND INTEREST ON THE
OUTSTANDING CITY OF SANFORD, FLORIDA, INDUSTRIAL
BUILDING REVENUE BONDS, SERIES 1977 (KELLER
INDUSTRIES~ INC. PROJECT), DATED DECEMBER 1, 1977,
FALLING DUE ON AND PRIOR TO DECEMBER 1, 1987, AND
TO REDEEM ON DECEMBER 1, 1987, THE REMAINING
OUTSTANDING BONDS OF SAID ISSUE, A DEED AND BILL
OF SALE CONVEYING TO KELLER INDUSTRIES, INC.,
THE INDUSTRIAL PROJECT FINANCED BY SAID BONDS,
AND ALL OTHER DOCUMENTS NECESSARY TO RELEASE
SAID INDUSTRIAL PROJECT FROM ANY AND ALL LIENS

WHEREAS, the City of Sanford, Florida (the "City") has heretofore
issued $750,000 of its Industrial Development Revenue Bonds, Series
1977 (Keller Industries, Inc. Project), dated December 1,.1977 (the
"Bonds"), authorized by a Resolution Of the City Commission of the City,
for the purpose of paying the costs of the acquisition and construction
of an industrial building on a site owned by the City, said site, together.
with said industrial building, being hereinafter sometimes refer~ed
to as the "Project", which Project was secured by A Mortgage, dated
as of December i, 1977, wherein Keller agreed to make installment paYments
toward the purchase of the Project, in semiannual amounts sufficient
to amortize the Bonds, and whereby Keller was granted the right to use
and occupy the Project, and
WHEREASi there are presently oUtstanding $525,000 of Bonds,
scheduled to mature on December 1 in each of the respective years, 1984
through 1992, inclusive, which Bonds are subject to redemption prior
to maturity on any interest payment date falling on or after December 1,
1987, and
WHERAS, Keller has requested the City to call for redemption
on December 1, 1987, all of the outstanding $325,000.00 of Bonds maturing
on and after December 1, 1988, has advised the Authority that it desires
to exercise its right, contained in Section 7.06 of the Agreement, to
obtain clear title to the ·Project, and has deposited with the Trustee
the sum of $709,677.50, which is an amount sufficient to provide for
the payment of the principal ($525,000) of the Bonds falling due on
December 1 in each of the years prior to and on December 1, 1987, the
interest thereon falling due on each June 1 and December 1 through December 1,
1987 ($109,705.00), the redemption premium on the $325,000 of Bonds called
for redemption on December 1, 1987. ($9,750.00), the fees and expenses
of the Trustee ($2,810.00), and publication costs $500.00), and

WHEREAS, there have been prepared and submitted to the City
Commission the following:

Trustee, providing for the escrow and investment
of said sum of $709,677.50 paid by Keller to the
Trustee (less the amount of principal and interest
on the Bonds.paid by the Trustee on December 1, 1983),
for the payment of the principal on and interest
of the Bonds falling due Subsequent to and on
December 1, 1987, redemption of the remainder
of the Bonds on December 1, 1987, and for any
balance remaining after all of the Bond~ have
been paid in full, including principal, interest,
redemption premium, and Trustee expenses, to be
paid to Keller, in accordance with the terms of
the Agreement; and ,
Deed and Bill of Sale from the Authority to Keller,
conveying the Project to Keller,
NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
SECTION 1:
That the City Commission hereby acknowledges
referred to in the preamble hereto, approves the application of such
amount to the requirements of the Bonds as set out in the preamble to
the Resolution, approves the calling for redemption on December 1, 1987,
of all of the Bonds schedule~ to mature on and after December 1, 1988,
and hereby declares (upon the advice of counsel) that with said payment
to the Trustees, said Bonds have been fully defeased and no longer constitute
obligations of the City or a lien against the Project.
SECTION 2: That the Escrow Agreement between the City and
the Trustee, referred to in the preamble hereto, is hereby approved,
and the Mayor-Commissioner and the City Clerk are hereby authorized
to execute said Escrow Agreement on behalf of the City.
SECTION 3: That the Deed and Bill of Sale from the City
to Keller with reference to the Project is hereby approved, and the
Mayor-Commissioner and the City Clerk are hereby authorized to execute
said Deed and Bill of Sale on behalf of the City and to cause said Deed
and Bill of Sale to be recorded in the office of the Clerk of the Circuit
Court of Seminole County, Florida, as a matter of public record.
SECTION 4: That the Mayor-Commissioner and the City Clerk
are hereby authorized to execute on behalf of the City any Termination
Statement, Satisfaction of Mortgage, Deed of Release, or other documents,
if any, necessary to release the Mortgage, the Agreement, and/or any
other liens and/or encumbrances in connection with the Bonds, without
any further authorization from the City Commission.
SECTION 5: That this Resolution shall be effective immediately
upon its adoption.

EXPRESSING GRATITUDE AND CONGRATULATIONS TO
THE MEMBERS OF FIRST BAPTIST CHURCH ON THE
OCCASION OF THEIR 100th ANNIVERSARY.
WHEREAS, FIRST BAPTIST CHURCH OF SANFORD, FLORIDA, was organized
on February 3, 1884, with 18 charter members; and
WHERAS, FIRST BAPTIST CHURCH has ministered to the needs of its
membership and the Citizens of Sanford for 100 years and is celebrating
its Centennial anniversary; and
WHEREAS, the membership of FIRST BAPTIST CHURCH has grown
over the years to more than 1,600; and
WHEREAS, FIRST BAPTIST CHURCH has been instrumental in organizing
other Baptist Churches in the vicinity: Central Baptist Church, Pinecrest
Baptist Church, Elder Springs Baptist Church, Ravenna Park Baptist
Church and Lakeview Baptist Church; and
WHEREAS, the members of FIRST~ BAPTIST CHURCH have served
in leadership positions in the community holding various offices
and serving on commissions and .~oards; and
WHEREAS, the City Commission of the City of Sanford wants
to recognize the role of FIRST BAPTIST CHURCH '~nd its members in the
history of the City of Sanford.
NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
SECTION 1: That the City Commission of the City of Sanford
expresses its gratitude to the members of the FIRST BAPTIST CHURCH

The City Manager reported he had received a request from John Rush, Graham
Construction Company, the contractor for Hamilton Elementary School, for a water connection
at the construction site on Eighth Street and Scott Avenue. The Commission affirmed there
would be no new utility connections during the moratorium, and suggested the contractor use
alternative methods to obtain water, such as a shallow well or bringing in water.
There being no further business, the meeting was adjourned.
