The City Commission of the City of Sanford, Florida, met in Regular Session in the
City Hall in the City of Sanf°rd, Florida, at 7:00 o'clock P. M. on September 10, 1984.

The meeting was called to order by the Chairman.
The first item of business was consideration of the adoption of Resolution No.
1377. Commissioner Yancey moved on the passage and adoption of Resolution No. 1377.
Seconded by Commissioner Smith and carried. Said resolution being in words and figures as
follows:

~ING HERMAN JACOBSON FOR HIS THIRTY
YEARS OF SERVICE TO THE CITY OF SANFORD, FLORIDA.
WHEREAS, HERMAN JACOBSON was appointed to the Board of Bond
Trustees on September 13, 1954; and
WHEREAS, he served on said Board as an unpaid volunteer
continuously for thirty years until his resignation on July 20, 1984; and
WHEREAS, at the time of his appointment, the City had a General
Obligation Bond Debt of $4,197,000.00 and during his tenure issued
$6,625,000.00 of revenue bonds, for a total of almost 11 millions dollars,
all of which has been repaid except $1,987,000.00.
NC~, THEREFORE, BE IT RESOLVED BY THE P~OPLE OF THE CITY OF
S~CTION 1: That the City of Sanford, Florida, thanks and cc~mends
HERMAN JAOOBSON for his thirty years of service to the City as a member
of the Board of Bond Trustees and extends to him its best wishes for the
future.

minutes of the City of Sanford, Florida, and that a copy be presented to
HERMAN JADOBSON.

The Commission presented Resolution No. 1377 to Mr. Jacobson and thanked him for
his service.
A public hearing was held in accordance with notice authorized at meeting of
August 27, 1984, to consider condemnation of structures or buildings on Condemnation Group
76, Report No. 84-1118. The Chairman announced that the Commission would hear from property
owners or representatives thereof. A review of the report was as follows:

After consideration, Commissioner yancey moved that finding the building under
Condemnation Report Number 84-1118 to be unsanitary, unsafe and delapidated, that said
structure be condemned and the owners given 10 days in which to repair or demolish said
structure; and if the structure is not repaired or demolished within 10 days, to authorize
the City to demolish same and levy a lien against the property. Seconded by Commissioner
Smith and carried.

The City Clerk reported notice was sent to the owner, Albert Leeberg, on August 3,
1984 and the property was posted on August 1, 1984.
Carolyn Johnson appeared to oppose the proposed rezoning and to question the uses
of MI-2 zoned property.
On recommendation of the Planning and Zoning Commission, Commissioner Farr moved
to authorize the City Attorney to prepare the proper ordinance to rezone the property.

Dyke Shannon, 2150 Palm Way, Sanford, Florida, appeared and reported he is
President of the Palm Hammock Homeowner's Association, and they want the area kept as a
single-family home area.
A. K. Forrest, 1355 Pine Way, Sanford, Florida, appeared and reported his property
is directly across from the proposed rezoning, that he represents three other families, and
they oppose any change to industrial zoning.
Charles Chimmick, 2500 Hallelujah Way, Sanford, Florida, appeared and reported he
agrees with Mr. Shannon.
Robert Yon, 204 Odham Drive, Sanford, Florida, appeared and reported he owns six
acres on Mellonville Avenue, about 1100 feet South of the proposed rezoning.

Aubrey Thomason appeared and reported he opposes any commercial zoning due to the
traffic on Palm Way, because there are a lot of children in the area.

Mr. Proovey appeared and reported he owns a 5 acre tract of land adjacent to Mr.
Shannon, and that rezoning to industrial would be against the trend in the area, which is
residential.
Don Harris, 2200 Palm Way,. Sanford, Florida, appeared and reported he is opposed
to industry in the area.
Forest Weston, Jr., 1415 Palm Way, Sanford, Florida, appeared and reported his
house is under construction now and he doesn't want the increased traffic in the area.
Judy Duffendack, 2200 Hallelujah Way, Sanford, :Florida, appeared and reported they
bought their property to get away from the City congestion.
Dwight Black, 103 Shore Drive, Longwood, Florida, appeared and reported he bought
the property immediately West of the property being rezoned, because it was quiet and the
area looked residential and agricultural.
Attorney W. C. Hutchison, Jr., Trustee, owner, appeared to support the proposed
rezoning and reported this property will be an extension of the McDonald Tract, the traffic
flow will be through the present industrially zoned property, and further reported there are
ongoing negotiations which would affect the property, and the owners are committed to
developing the property industrially, similar to the industrial property on Silver Lake
Dr ive.
The Planning and Zoning Commission submitted a recommendation to deny the
proposed rezoning.
Commissioner Farr moved to authorize the City Attorney to prepare the proper
ordinance to rezone the property. Seconded by Commissioner Smith and carried over the
dissenting vote of Commissioner Keith..

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed rezoning.
The City Clerk reported notice was sent to the owners, Mr. and Mrs. James H.
Dyson, on August 2, 1984 and the property was posted on August 1, 1984.
Those appearing in opposition were as follows:
Joe Kaiser, 3001 Jewett Lane, Sanford, Florida, appeared and reported his property
is surrounded on three sides by that proposed to be rezoned. Also, that the only access to
the property is on Jewett Lane, a one-lane, 30 foot wide right-of-way, and he does not
believe the property is suitable for an industrial park.
Joe Garrett, 3000 Jewett Lane, Sanford, Florida, appeared and reported he lives
across from Joe Kaiser, one-half mile from another industrial park, and that employees at
that industrial park leave trash on his property. Further, the only access is by one-lane
roads built hy farmers in the area.
Patrick Talley, 707 Bevier Road, Sanford, Florida, appeared and reported they have
individual water wells and he ms concerned about industrial drainage into those wells.
Also, he had submitted at the Planning and Zoning Commission meeting, a petition with 76
signatures, objecting to the rezoning.
David Murray, P. O. Box 65, Lake Monroe, Florida, appeared and reported there is
no drainage in the area except through their property, 95% of the roads are privately owned
and an industrial use is not compatible with the present uses in the area.
Nancy Kaiser, 3001 Jewett Lane, Sanford, Florida, appeared and reported their
property is surrounded by the property in question, and that they recently moved there from
Winter Park, to get away from the City. Also, they have one artesian well on the property
and any run-off from an industry will go into the well.
W. C. Hutchison, Jr., Attorney, appeared to represent the owners, Mr. and Mrs.
Dyson, and reported that before the Kaisers bought their property, Mr. Dyson told Mr. Kaiser
that he planned to develop his property as industrial. Also, they have a solution for the
drainage, and there won't be as much of a drainage problem with an industrial use as with a
single-family residential district. Further, that Jewett Lane cannot handle the increased
traffic so it will be through internal roads in the Seedco Industrial Park and other
industrial areas.
On recommendation of the Planning and Zoning Commission, Commissioner Keith moved
to deny the rezoning. Seconded by Commissioner Yancey and carried over the dissenting vote
of Commissioner Farr.
Commissioner Yancey moved to remove from table, consideration of a petition for
annexation from the Grace Bible Church of Sanford, Inc. Seconded by Commissioner Smith and
carried. Said property described as follows:
Lots 111 and 112, Frank L. Woodruff's Subdivision of Lands South
Sanford, Plat Book 3, Page 44, Public Records of Seminole County,
Florida.
The Mayor announced to the Church delegation that the City had withheld action on

Mr. Raymond Bass appeared to support the request and reported the church already
has city water and a septic tank, and they are willing to wait for city sewer.
Commissioner Smith moved to authorize the City Attorney to prepare the proper
ordinance to annex said property. Seconded by Commissioner Yancey and carried over the
dissenting vote of Commissioner Keith.
Petition for annexation submitted from William Larry Bishop and Eldegard Bishop,
for a portion of the property lying Easterly of and abutting U.S. 17-92 and between Collins
Drive and S.R. 427, further described as follows:
The South 407 feet of the North 891 feet of the NE¼ of the SW¼ of
Section 14, Township 20 South, Range 30 East, Seminole County, Florida.
On recommendation of the City Manager, Commissioner Farr moved to authoriz9 the City
Attorney to prepare the proper ordinance to annex said property. Seconded by Commissioner
Smith and carried.
The City Clerk reported that Joe Oritt and Melvin Siskind, members of the Board of
Bond Trustees, recommended the appointment of B. L. Perkins, Jr. to the Board of Bond
Trustees. Commissioner Keith moved to appoint Mr. Perkins to the Board of Bond Trustees to
replace Nick Mergo, whose resignation was accepted with regrets. Seconded by Commissioner
Yancey and carried.
The City Clerk submitted a memo from the Building Official, that Leon Steinmeyer
and R. L. Harvey have resigned from the Central Examining Board. Commissioner Smith moved
to accept their resignations with regrets, and to authorize the City Attorney to prepare
resolutions commending them for the work. Seconded by Commissioner Yancey and carried.
Commissioner Smith moved to adopt, and authorize the Mayor and City Clerk to
execute, Resolution No. 1378. Seconded by Commissioner Yancey and carried. Said resolution
being in words and figures as follows:

TRUST AND DESIGNATING THE CITY CT.k~K AS O00RDINATOR
OF THE PROGRAM.
WHEREAS, the City of Sanford, Florida, nmintains a deferred
cc~pensation plan for its employees which is administered by the I(IMA
Retirement Corporation (the "Administrator"); and
WHEREAS, other public employers have joined together to establish
the I(1MA Retirement Trust for the purpose of representing the interests
of the participating employers with respect to. the collective investment
of funds held under their deferred compensation plan; and
WHEREAS, said Trust is a salutary develo~r~=_nt which further
advances the quality of administration for plans administered by the ICMA
Retirement Corporation.

SECTION 2: That the City Clerk of the City of Sanford, Florida,
shall be the coordinator for this program and shall receive necessary
reports, notices, etc. frcrn the ICMA Retirement Corporation as Administrator,
and shall cast, on behalf of the ~ployer, any reqg3jred votes under the
program. Administrative duties to carry out the plan may be assigned to the

RECOMMENDATIONS
Recommend denial of a request to rezone from AD to MI-2, property
located at NE corner of the intersection of Pine Way and Mellonville
Ave. for the purpose of industrial use. After discussion by area
residents regarding the character change industrial would bring to
the neighborhood, there was a motion to approve the request, but the
motion ~vas voted down by a vote of five to four. Rep.-Wm. Hutchison.
Recommend denial of a request to rezone from SR-1AA to MR-2, p~operty
located at the corner of Krider Rd. & Sanora Blvd. for the purpose of

The City Manager reported that Hill, Richards and Company, the City's group health
insurance carrier, has notified the City the group health insurance premium is being
increased 20%, effective October 1, 1984, and will increase the City's costs in the 1984-85
budget and that staff would prepare solicitations for bids for future coverage, and same was
approved with transfers as follOws:

The City Manager reported that a new state law requires retirees to be permitted
to participate in the City's group health insurance program, and it appears this will add
$21,821.20 per year to the City's costs.
On recommendation of the City Manager, Commissioner Yancey moved to authorize
salary reclassifications as follows:
Jean Postell, Recreation and Parks Department, from Clerk Typist E to F,
$13,820.14 annual.
Charlie Collier, Recreation and Parks Department, from Field Supervisor D
to E, $18,310.10 annual.
Seconded by Commissioner Smith and carried.
The City Manager submitted Condemnation Group No. 77, Report Nos. 84-1119 through
84-1123. On recommendation of the City Manager, Commissioner Farr moved to authorize a
public hearing to be held September 24, 1984 to consider same, and proper notice. Seconded
by Commissioner Yancey and carried.
Commissioner Farr reported that on Friday, a dead Australian Pine tree in the
unopened right-of-way of Olive Avenue between Sixth Street and Seventh Street fell on Willie
Brown's house at 1300 West Seventh Street, and that his insurance made the necessary
repairs, however, there is another dead Australian Pine tree is the same unopened right-of-
way. Commissioner Fart moved to authorize the Acting City Manager to have the tree pruned
as soon as possible to relieve the hazard, provided the other Australian Pine tree is in
fact in the Olive Avenue right-of-way. Seconded by Commissioner Smith and carried.
