CITY OF SANFORD,
I would like to thank you for the opportunity of
speaking with you and City Manager Bill Simmons on March
28, 1991. David Russi and I appreciated your frank
discussion of the possibilities the Sanford /Seminole
Jaycees might have in re- acquiring our building in Jaycee
Park on French Avenue.
I have enclosed a Sanford /Seminole Jaycee "Schedule
of Events" so that you might have a better understanding of
what we intend to do for our city. It is an aggressive
calender, but we know we will include various other
activities as the year progresses. I will tell you that
some of the dates are tentative, but the activities are
not!
I am sure you are aware of the activities we have
already successfully achieved since our reorganization in
November. I appreciated your participation in our "Player
of the Week" Banquet. Your presence there meant a lot to
all of the Sanford /Seminole Jaycees who were in attendance
and to the players we were honoring. We have had a
successful fundraising drive using a ticket book that many
local merchants participated in. Our "Adopt -a- Highway"
signs are up on 17 -92. We have become responsible for the
area of 17 -92 from 13th Street north to State Street, and
the first clean -up day is scheduled for this April 27.
As the current Jaycee President, I feel I have a
responsibility to make the Jaycees an exciting and fun club
for young people in Sanford. I have an obligation to the
past Jaycee clubmembers and Presidents, many of whom are
prominent Sanford citizens still today, to once again bring
the Jaycee name to the forefront of involvement in this
great community. I feel we would do a great deal of
positive things for this city and its' citizens, especially
if we had control of our own meeting place. I am willing
to share this building with other civic clubs, but more
importantly, I am willing to take responsibility for this
building and the grounds which it sits

NOTICE IS HEREBY GIVEN that the City Commission of the City of
Sanfcr F 'da, will hold a public hearing 7:00 o'clock P.M.
o aovember 12 90, in the City Comm g: commission Room, City Hall,. 300
Nort Parc Avenue, Sanford, Florida, to consider and determine
whether or not the Seminole County Junior Chamber of Commerce
(Jaycees) have breached their lease of City of Sanford property
lying between and abutting French. Avenue and Laurel Avenue and
between and abutting. Fourth Street and Fifth Street, commonly known
as JAYCEE PARK and /or as FOURTH STREET PARK.
All interested parties and citizens shall have an opportunity to. be
heard at said hearing.

The next item of business was consideration of a request from Brent Adamson,
President, Sanford - Seminole Jaycees, Inc. to lease the Jaycee Park Building, as discussed at
tonight's Woik Session.
Commissioner Thomas moved to authorize City Attorney to prepare a new lease with

Sanford - Seminole Jaycees, Inc. for the Jaycee Park Building, and to include a provision to
specifically dismiss any consideration that there be any future repayment of funds should the
lease be terminated. Seconded by Commissioner McClanahan and carried by the vote of the
Commission as follows:

The next item of business was consideration of a request from the Elks Lodge, to
waive Civic Center rental rates, for an event on September 7, 1991, where alcoholic beverages
will be served. On recommendation of City Manager, Commissioner Howell moved to deny said
request; Elks Lodge to pay alcoholic beverage rate, which would amount to $550.00 plus 6%
sales tax, and to hire one off -duty police officer. Seconded by Commissioner McClanahan and
carried by the vote of the Commission as follows:

The next item of business was consideration of a request from Sanford Christian
Worship Center, for a two -year waiver of paved parking and retention pond requirements at
1509 West 13th Street, which the City Commission approved on February 27, 1989, conditioned
upon reevaluation of said parking lot utilization if there was a significant increase church
membership, and submittal of a design acceptable to Engineering and Planning Department prior
to the installation of mulch. On recommendation of City Manager, commissioner McClanahan
moved to approve said two -year waiver, conditioned upon re- evaluation of said parking lot
utilization if there is a significant increase in church membership. Seconded by
Commissioner Eckstein and carried by the vote of the Commission as follows:

The next item of business was consideration of a request from Florida Power & Light
for a 5 foot by 25 foot utility easement on a portion of Site #10, to facilitate additional
poles and guideline anchor supports for area up- grading. On recommendation of City Manager,
Commissioner McClanahan moved to authorize the execution of said Utility Easement as
requested. Seconded by Commissioner Thomas and carried by the vote of the Commission as

The City Commission of the City of Sanford, Florida met in Work Session on Monday,
May 13, 1991 at 5:00 P.M. in the City Manager's Conference Room, City Hall, Sanford, Florida.

The Chairman called the meeting to order.
The first item of business was a discussion regarding a request from Brent Adamson,
President, Sanford - Seminole Jaycees, Inc., to lease the Jaycee Park Building. Brent Adamson

was present; Rotaract was not .represented.
City Manager reported that Rotaract was notified of this meeting, that there does
not appear to be a cooperative effort or agreement between the Jaycees and Rotaract as
previously suggested by the City Commission, and that the Jaycees do appear to be a viable
service organization within the community.
The Commission concurred that a new lease be prepared, to lease said property to
the Jaycees, and that the new lease specifically dismiss any consideration for future re-
payment of funds, should the lease be terminated in the future.
The next item of business was a discussion regarding a request from Edward Meixsell
to extend the "HARCAR" Lease (Water Well #8 Site) for twenty- years, or four consecutive
options of five years each. No one present.
City Manager reported that the "HARCAR" lease was originally entered into in 1970,
for a five year term, with a potential for options of up to 20 years in five year increments,
and that in 1975 a five year option was picked -up. Further, in 1980 a new lease was entered
into rather than a continuation of the previous lease, and that said lease does not appear
to give the leasee the right of option renewal past 1990. Also, in 1990 the City Commission
authorized execution of a five year lease, which was never executed by Mr. Meixsell and
returned. Further, originally, the lease was to provide for additional off-street parking,
and the property has been - vacant for the past five years. City Manager recommended
providing extensions as presently obligated, and not to write a new twenty year lease until
firm use is established.
The Commission concurred.
The Commission next discussed a request from Richard Casselberry, for a Conditional
Use Permit for a non - conforming structure located at 400 South Palmetto Avenue. Mr.
Casselberry, Mr. Goff, and Mr. Smith were present.
City Manager reported that comparing Mr. Casselberry's proposal with the 606 Park
Avenue proposal, Mr. Casselberry's proposal does not contain the same degree of specificity
as to what he plans to do or how it plans to do it. Further, he believes that the Commission
acted on 606 Park Avenue with a specific set of proposals, and recommended that the
Commission have Mr. Casselberry provide a more specific proposal, and that a developer's
agreement be executed and recorded to run with the land, should the Commission approve said
conditional use permit.

Dear Mr. Faison:
By agreement dated December 9, 1957, the,City of gave permission for the
Seminole County Junior Chamber of Commerce,. Inc. to use City owned property "for
tourist and recreational purposes ". The agreement gave permission to erect a
building on the property "for tourist information services and other purposes
directly incidental to operation of the party of the second part."
The agreement provided that if the "buildings so constructed on said property
should cease to be used by the party of the second part for the purposes herein
enumerated ", the City may request reversion of the building to the City. In the
event of reversion, the City would be responsible to reimburse the appraised
value of the building (as determined by three appraisers), but in any event not
to exceed the sum of $10,000.00
The agreement was amended by action of the City Commission on July 23, 1973,.to
provide that the City would assume responsibility to maintain the park area,
however, maintenance of the two buildings and the parking area remained the
responsibility of the party of the second part.
As I understand it, the buildings are in need of repair and have not been used
"for tourist information services" recently. I also understand another civic
club may be willing to restore and utilize the buildings as the City originally
intended. This can be accomplished by agreement between all parties or by
reversion as described in the original agreement.

Agreement between all parties would necessitate assignment of the existing
agreement from the Seminole County Junior Chamber of Commerce to a third party
and the concurrence of the City. Questions that would have to be answered are
whether or not the Seminole County Junior Chamber of Commerce exists today and
who would be authorized to execute legal documents on its behalf.
If reversion is to be utilized, two things would need to be done. First, a
determination would have to be made (preferably following a public hearing) of
whether or not the agreement to use the buildings "for tourist information
services" had been breached. Second, a determination of the appraised value
would have to be made (by three appraisers) and up to $10,000.00 would have to
be paid to the Seminole County Junior Chamber of Commerce as reimbursement for
the buildings.

Last evening, the City Commission voted to take
back the maintenance of the City -owned park property
commonly known as Fourth Street Park (Jaycee Park)
lying between 4th and 5th Streets on the east side
of French Avenue. This letter is to serve as an
addendum to the agreement dated December 9, 1957,
between the City of Sanford and the Seminole County
Junior Chamber of Commerce.
It is understood that the Seminole County Junior
Chamber of Commerce shall maintain the existing two
structures and the parking area south of the Jaycee
meeting building. The City of Sanford will maintain
the remaining park area and take appropriate steps
to prohibit parking throughout this area.

AGREEMENT
THIS AGREEMENT, Made and entered into this 9 day
of &)Z' ,,, ,, Lx ,,/ , A. D. 1957 by and between the CITY OF
SANFORD, FLORIDA, a municipal corporation, hereinafter called
party of the first part, and SEMINOLE COUNTY JUNIOR CHAMBER
OF COMMERCE, a corporation, hereinfater called party of the second
part;
WITNESSETH,. WHEREAS, Party of the first part presently
maintains a park commonly known as Fourth Street Park, the same
lying South of Fourth Street and East of French Avenue in the City
of Sanford, Florida, and
WHEREAS, Said park is at the present time in bad condition
to the extent that the same is not a credit to the City of Sanford, Florida,
and
WHEREAS, French Avenue is at the present time the main
thoroughfare for tourist traffic through the City of Sanford, Florida,
and it is desirable that tourist information and recreational facilities
be located on French Avenue, and
WHEREAS, Party of the second part has proposed construction
of such facilities together with adequate maintenance of said area as a
park and party of the first part deems it in the best interest of the pub-
lie that said proposal of party of the second part be accepted,
NOW THEREFORE, For and in consideration of the mutual
covenants and agreements hereinafter contained and the mutual benefits
flowing therefrom, the parties hereto agree each with the other as follows;
1. The property heretofore described will be used by the Seminole
County Junior Chamber of Commerce for tourist and recreational purposes
and that party of the second part is hereby granted the right to erect a
building on said property, at the full expense of party of the second part,
to be used by party of the second part for tourist information services
and other purposes directly incidental to operation of party of the second
part, provided however, that the design of said building must be approved
by the City Commission of the City of Sanford, Florida prior to any con-
struction.
2. That the remainder of said property is made available by
party of the first part to party of the second part for construction of
recreational facilities for the use of tourists and the people of the
City of Sanford, free:of charge.
3. That if buildings so constructed on said property should
cease to be used by party of the second part for the purposes herein
enumerated, party of the first part, at its pleasure, may request
reversion of the same to the City of Sanford, and in such event party
of the first part will reimburse party of the second part for the same
upon an appraised value to be arrived at by three (3) appraisers, and
in any event not to exceed Ten Thousand Dollars ($10, 000).
4. That party of the first part, will, when practicable,
assist party of the second part in the maintenance of the park grounds,
provided however, that basic responsibility for maintenance shall be
that of party of the second part.
S. That said park shall henceforth be known as JayCee Park
provided that the conditions hereinbefore stated are met.
6. In the event party of the second part has not commenced
