The City Commission of the City of Sanford, Florida, met in Regular Session in
the City Hall in the City of Sanford, Florida, at 7:00 o'clock P. M. on May 11, 1987.

The meeting was called to order by the Chairman.
The first item of business was the presentation of Resolution No. 1480 to Fire
Chief Tom J. Hickson and to Police Chief Steve D. Harriett. On motion of Commissioner
Thomas, seconded by Commissioner Mercer and carried by the vote of the Commission as
follows:

A RESOLUTION OF THE CITY OF SANFORD, FLORIDA,
COMMENDING AND EXPRESSING APPRECIATION AND
PRIDE IN THE CITY'S POLICE AND FIRE
DEPARTMENTS AND COMMENDING THEM FOR THEIR
ACTIONS IN THE SEARCH FOR A SANFORD
YOUNGSTER.
WHEREAS, the Police and Fire Departments responded to a
call regarding a lost child on March 30, 1987, and were told that the
child had fallen into a creek;
WHEREAS, the Police and Fire Departments spent over five
hundred (500) man hours searching.for the child on March 30 and 31 and
April 1 - 5, 1987;
WHEREAS, many of the Policemen and Firemen worked on-duty
and off-duty during the course of the search, volunteering their time
to this cause;
WHEREAS, the search ended in tragedy on April 5, 1987,
with the discovery of the body of the child, but it demonstrated the
resolve and dedication of our Policemen and Firemen.
NOW, THEREFORE, BE IT RESOLVED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
SECTION 1: The City of Sanford, Florida, takes pride in
the emergency services performed by the Police and Fire Departments in
their efforts to .find the child, Daniel Bradshaw;
SECTION 2: The City of Sanford, Florida, appreciates the
dedication of its Police and Fire Departments and commends them for a
job well-done.
SECTION 3: That this Resolution be recorded in the

The next item of business was the continuation of the consideration of a request
from William H. Poe, Executive Director, Seminole Work Opportunity Program (SWOP), for an
additional year of a variance, granted March 10, 1986, on a year to year basis, to place a
24 foot by 50 foot modular unit on your property located at 3422 South Orlando Drive, tabled
from the meeting of April 27, 1987.

Seminole Work Opportunity Program (SWOP) Request For One
Year Extension On Variance for Modular Unit Installed At
3422 South Orlando Drive
Mr. Faison:
On April 27, 1987 City Commission tabled the request from SWOP
for extension of the present variance to allow for the continued use
of a 12x50 modular unit now on site at 3422 South Orlando Drive,
Sanford, Florida. Review of the background on the situation has
revealed the following:
The original action by City Commission on
March 10, 1986 provided approval for
installation of a 24x50' double-wide trailer
on the property.
The unit ultimately installed on the
property, relatively recently, was in fact a
modular housing unit, not a double-wide
trailer. (The distinction between a modular
unit and a trailer arises from the method of
construction and the regulating bureau within
State of Florida. Department of
Transportation regulates mobile homes, while
Department of Community Affairs regulates
modular units. Cardinal Industries, for
instance, constructs modular units.)
City Ordinances regulate installation of
mobile units, and generally restrict their
installation to SR-2 zones. City Commission
approval for temporary installation of a
mobile unit was entirely appropriate. Since
the unit actually installed is in fact a
modular unit, this unit is eligible for
permanent installation within the existing
GC-2 zoning, following approval of a site
plan.
I have contacted Mr. Poe with this information and he is
expediting preparation of an appropriate site plan for staff review
and presentation to Planning and Zoning Commission for approval.
In view of the foregoing, it is recommended that City Commission
grant an extension of the one-year variance, previously granted on
March 10, 1986, to expire on June 1, 1987, in order to allow
sufficient time for site plan development and review.
Commissioner Mercer moved to grant an extension of the one-year variance to expire
June 1, 1987, in order to allow sufficient time for site plan development and review.

A Public Hearing was held in accordance with Notice published in the Evening
Herald on April 21 and May 1, 1987, as follows:
NOTICE OF A PUBLIC HEARING OF PROPOSED CHANGES AND
AMENDMENTS IN CERTAIN DISTRICTS AND BOUNDARIES OF
THE ZONING ORDINANCE OF THE CITY OF SANFORD, FLORIDA.
Notice is hereby given that a Public Hearing will be held in the
Commission Room at the City Hall in the City of Sanford, Florida,
at 7:00 o'clock P. M. on May 11, 1987, to consider changes and
amendments to the Zoning Ordinance of the City of Sanford,
Florida, as follows:
A portion of that certain property lying at the
Northeast corner of the intersection of County Road 427
and Tucker Drive is proposed to be rezoned from SR-1A
(Single-Family Residential Dwelling) District and AD
(Agricultural) District to RC-1 (Restricted Commercial)
District. Said property being more particularly
described as follows:
The Southeast quarter of the Southwest quarter of the
Northwest quarter (LESS the Easterly 25 feet of road
right-of-way and LESS the right-of-way for County Road
427) all in Section 13, Township 20 South, Range 30
East, Seminole County, Florida, lying North of County
Road 427.
Ail parties in interest and citizens shall have an opportunity to
be heard at said hearing.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed rezoning.
The City Clerk reported Notice had been sent to the owner, Dreyfus Interstate
Development Corporation, on April 2, 1987.
W. E. "Pete" Knowles, representing the owner, appeared to report the Planning and
Zoning Commission had tabled their Public Hearing on April 16, 1987, because of concerns
regarding an access easement for the adjoining property owner on the North; and same was
removed from the table at their meeting of May 7, 1987, where the access easement had been
satisfactorily resolved. Mr. Knowles reported the plans for the property was a small
support facility consisting of ten (10) stores to service approximately one thousand homes.
Commissioner McClanahan moved to accept the recommendation from the Planning and
Zoning Commission, and to authorize the City Attorney to prepare the proper ordinance to
rezone said property.

Commissioner Thomas moved to approve the request from the Greater Sanford Chamber
of Commerce to close Fourth Street and Fifth Street between Park Avenue and Oak Avenue on
September 20, 1987 between the hours of 9:00 A. M. and 6:00 P. M. for the Cultural Arts
Committee of the Chamber's.presentation of Sanford Presents September in the Park. Seconded

The Commission next considered the re-appointment of Gerald Gross to the Board of
Adjustments and Appeals for a term to expire January, 1990. Commissioner McClanahan
reported Mr. Gross served on a total of four (4) boards and recommended Charles D. "Denny"
Hayes, Jr. to fill the term. Commissioner Thomas moved to authorize a letter of
appreciation to Mr. Gross for his dedication and service on the Board of Adjustments and
Appeals, and moved to appoint Charles D. "Denny" Hayes, Jr. to fill the term to expire
January, 1990. Seconded by Commissioner McClanahan and carried by the vote of the

The City Commission next considered the settlement conditions proffered by
Seminole County on pending litigation as discussed at the May 4, 1987 Workshop.

Areas
Mr. Faison:
In response to questions raised at the City Commission
worksession on May 4, I have had the attached drawing prepared.
Utilities available for the subject parcels include a 10" sewage force
main across the north side of County Road 427 which extends only part
way along the Baker parcel and does not reach the White parcel.
Although not shown on the drawing we have a 6" water line in Carriage
Cove at the intersection of Hanson Parkway and County Route 427, a
distance of approximately 1500' to the southwest.

Pursuant to your request, I attempted to contact Richard Harris Turner
but did not reach him until 5:15 p.m. Friday. Mr. Turner was cordial
and candid during our conversation. He was aware of the proposed
settlement but indicated that the Paulucci family would not be
interested in reapplying for annexation at this time.
Mr. Kelly came by my office on May 7th and indicated that on behalf of
the Kastner family, he wanted to advise me and the City that they
still wanted to vigorously pursue annexatiOn.

After discussion, Commissioner Eckstein moved to direct the City Attorney to
proceed with the clarification of the annexation of the Kastner/Paulucci parcel, the

The continuation of a Public Hearing, tabled at the meeting of April 13, 1987, was
held to consider the adoption of Ordinance No. 1861, annexing a portion of that certain
property lying between Airport Boulevard and Bevier Road and lying between West Third Street
and Jewett Lane.

Bob Seigler, 2465 Park Drive, appeared to report the County has no utilities to
service the area. The County has denied the rezoning of this property, denied utility
services, has condemned the property without compensation.
Bryan Seigler, owner and petitioner, appeared to support the annexation.
Lonny Groot, Seminole County Assistant District Attorney, appeared to report the
County's objections in that this annexation was not contiguous, not reasonably compact, and
created an enclave, and submitted copies of two maps of the proposed annexation area.
Patrick Talley, 707 Bevier Road, appeared to report property owners along Jewett
Lane do not wish to be part of the City, presented photographs of area drainage problems.
S. B. "Jim" Crow, 713 Bevier Road, appeared in opposition.
Commissioner Mercer moved on the passage and adoption of Ordinance No. 1861.

The City Manager submitted a memorandum from the Director of Administrative
Services as follows:

SUBJECT:
HEALTH PLANS AND CASH SUBSIDIES TO RETIREES
RECOMMENDATION:
For the remainder of current year, FY-1986/87,
that the City Commission approve payment to all
City retirees for health premiums or an amount
equal to the cost of equivalent health premiums.
Costs for this program will total $16,916.48.
Additional monies in the amount of $5,691.48 are
required from fund balance reserves to fund this
program for the remainder of this fiscal year.
If approved by the City Commission effective June 1, 1987:
Those retirees who are presently enrolled in the City's
health plans Will continue to receive health coverage at the
City's cost.

Mr. Faison:
In response to your request I have considered a number of
alternatives for a barricade at the "dead end" stub of French Avenue
at the lakefront. I believe this request is the result of one or more
incidents of cars failing to stop and runninG into Lake Monroe.
Alternatives considered include the followinG:
Creation of a dense vegetative barrier.capable of
stopping a car.
Erection of a concrete or timber wall capable of
preventinG a car from Going into the lake.
Elimination of the French Avenue stub between the
lakefront and HiGhway 17/92.
Provision of "rumble strips" on the pavement and
erection of appropriate new dead end highway
siGnaGe.
Installation of a low curbing on the north side of
French Avenue.
Provision of a flashing light stop signal.
The distance between the north edge of Seminole Boulevard and the
seawall is approximately 10-feet. I recall that it was estimated that
in one recent fatal accident the driver of the car was apparently
Going 35 to 40 miles an hour at the time she crossed the seawall. I
feel that any rigid structure capable of stoppinG a car GoinG at that

speed, within a distance of 10-feet, would probably pose just as great
a hazard to the car occupants upon impact as going into the lake. I
believe that any type of impact absorbing structure, such as
sandfilled barrels, or thick vegetation would likely be incapable of
arresting the vehicle in a distance as small as 10-feet.
Installation of a iow curbing on the north side of Seminole
Boulevard would alert a slow speed driver that he was leaving the
roadway, in sufficient time to stop, but wOuld serve no similar
purpose for a high speed vehicle. An attractiveness of this
alternative is that there is minimum "visual clutter" along our
lakefront.
The problem of the dead end could be eliminated by elimination of
the short paved section of French Avenue north of the 17/92 curb.
Unfortunately the geometry of the intersection of Highway 17/92/French
Avenue/Seminole Boulevard does not lend itself to any reasonable
alternative for northbound French Avenue traffic to head east on
Seminole Boulevard. Therefore, this alternative can not be
recommended.
Provision of a flashing light signal at the intersection of
French Avenue and Seminole Boulevard is a possibility, but the
location of a signal at that point could create significant confusion
for a motorist northbound on French Avenue/Highway 17/92 as seen from
Highway 17/92 prior to the curb toward the west. For that reason this
alternative is not recommended.
Perhaps the most attractive alternative is the installation of a
more visable barricade at the lakefront, similar to the Type II
barricade shown in attached Figure 6-14, installed in combination with
a "dead end" sign and two arrow signs indicating traffic must turn
left or right. This barricade and signs should be in reflective
material and should be placed low enough so that it does not attract
undue attention of northbound motorists on Highway 17/92 prior to the
curb. Also recommended is the installation of "rumble strips" on the
pavement of the French Avenue stub, as well as the right lane of
Highway 17/92 just prior to the curb. This latter installation would
require approval of FDOT. (These rumble strips are similar to those
installed on Rinehart Road northbound just prior to the Route 46A
intersection.) These should alert any inattentive driver to observe
the signage ahead.
It is recommended that this final alternative be submitted to
City Commission for approval.

Staff to proceed with the installation of "Type II" barricade with landscaping at the dead-
end of French Avenue at the lakefront, and rumble strips on the pavement of the French

We now have all invoices in for the Phase II street resurfacing
contract, other than the First Street resurfacing and milling. The
Phase I contract has been closed out and McCracken Road reconstruction
contract has been closed out. Reserving $7,500 for the First Street
milling change order and $16,000 for the First Street overlay yields a

total cost to date for street resurfacing since October 1986 of
approximately $1,288,779.
Gas tax revenues accumulated through September 30, 1986, made
available for street resurfacing, totaled $974,950. City Commission
previously authorized the withdrawal from reserves of $400,000
additional, providing a total of $1,374,950 for street resurfacing.
Based on the above information we now have remaining available
approximately $86,171, $60,000 of which should be reserved for the
City's share of the Bevier Road reconstruction. By the attached
memorandum, Street Superintendent has proposed that approximately
$150,000 from the Public Works fiscal year 86/87 budget be committed
to street resurfacing under the Phase II paving contract. Added to
the $26,171 remaining uncommitted from the previous gas tax and
reserves funding we have available approximately $176,171 for
potential change order to the Phase II contract to resurface
additional streets this fiscal year. Public Works has developed a
recommended list of additional streets to be included by change order.
It is recommended that this list be approved for change order, with
the exception of 2nd Street from Sanford Avenue to Mellonville Avenue,
which should be placed on temporary hold because of budget
limitations, at this time.
It is requested that this proposal be submitted to City
Commission for approval for issuance of a change order.
On recommendation of the City Manager, Commissioner Thomas moved to approve the
$1,374,950 for resurfacing and the Change Order for Phase II Street 'Resurfacing contract
with Orlando Paving Company, to increase the scope of work for installation of leveling
course and 1-inch overlay; estimated square yards of overlay is 69,564 square yards as
listed on the Paving List for Change Order to Phase II Contract (with the exception of
Second Street from Sanford Avenue to Mellonville Avenue); estimated cost for paving overlay
is $133,562.88, and estimated cost for leveling course in place is not to exceed $42,600.00
(equating to approximately 1,195 tons); and funds to be drawn from FY 86/87 gas tax

As a result of discussions at the April 20 City Commission
worksession, I have reviewed possible alternative ingress/egress
routes. Two alternatives identified are shown on the attached
drawing. I have been able to identify no other routes without
encroaching upon existing platted lots.
At this time no cost estimates have been developed for either
alternative. Alternative one involves no new right-of-way but
includes a railroad crossing, a major ditch crossing, and paving about
150' between Dixie Way and the end of pavement within Academy Manor.
Alternative two involves acquisition of approximately 130' of right-
of-way, north of the existing termination of Yale Drive and the
installation of approximately 1100' of street.
Prior to any cost estimating it is recommended that these

Academy Manor for consideration and selection of a proposed preferred

Lake Monroe Utilities Company
Mr. Faison:
The Lake Monroe Utilities Company was established some years ago
to provide utility service for the I-4 Industrial Park, located in the
northeast quadrant of the intersection of State Route 46 and I-4. The
certificated service area for Lake Monroe Utilities is approximately
as shown on the attached sketch, and most notably includes not only
the I-4 Industrial Park but also Port of Sanford and all four
quadrants of the I-4 and State Route 46 interchange. It is contiguous
with the City of Sanford 201 Plan Utility Service Area, as well as the
City of Sanford city limits (Kastner annexation).
Because of the strategic location of the Lake Monroe Utilities
service area, and our long range plans for providing utility service
to the area immediately adjacent to it, acquisition of Lake Monroe
Utilities Company could be in the best interest of the City of
Sanford. This could give the City a firm operating base along its
western boundary upon which to begin to prOvide utility service to the
Kastner annexation area, prior to the completion of water lines toward
that area and construction of the sewer system westerly interceptor
included in our Five-Year Capital Improvement Plan. Although
initially to continue operation as separate systems, the long range
plan would be to connect the sewer system and water system to the City
of Sanford main systems.
It is recommended that City Commission authorize staff to
negotiate with the owner of Lake Monroe Utilities Company and attempt
to develop an option contract which would be acceptable to both the
owner and the City Commission. Such an option contract is believed
necessary since there are a number of provisions in the Florida
Statutes, including requirement for a public hearing, which must be
met prior to the City entering into any binding contract for purchase
of a private utility company.
After discussion, Commissioner Mercer moved to authorize Staff to consider
acquisition of the facility and to procure an option for purchase, and to report back to the

Goldsboro School Site, Exchange of Sewer Line Right-of-Way
for Utility Easement
Mr. Faison:
I have been working with Benny Arnold of the School Board
relative to his plans for major expansion of the Goldsboro School and
the need for the School Board to acquire ownership of a 10-foot strip
of land presently bisecting their site, in which is located a Sanford
utility line. Construction will not interfere with the existing sewer
line and the School Board is willing to give a utility easement to the
City for the complete right-of-way strip now owned by the City. (See
attached drawing.)
Attached City Attorney letter of March 25, 1987 endorses the
legal form of both the attached quit claim deed proposed for execution
by City of Sanford, and the proposed grant of easement to be executed
by the School Board. I have discussed with City Attorney the
possibility of a sligh rewording of the grant easement to specify in
the second paragraph "...maintaining and operating municipal utiltiy
lines." vice the present wording which indicates water line.
It is recognized that the City, in quit claiming ownership, in
exchange for an easement, is not receiving "equal value". Even so it
is recommended that we move forward in the spirit of cooperation,
especially since the proposed easement, as modified, is believed to
provide all of the interest in the particular strip of land which the
City of Sanford will ever require.
By copy of this memorandum City Attorney is requested to prepare
the necessary recommended change to the easement and to coordinate it
with the School Board Attorney prior to City Commission action to
approve the proposed quit claim deed.

to execute said quit claim deed, and to approve the exchange of land between School Board

Unanimously recommended the approval of the request to rezone
from SR-1A and AD to that of RC-1, property located north of CR
427, west of the south entrance to Carriage Cove and east of
Tucker Drive for Dreyfus Interstate Development Corp. The public
hearing had been tabled on April 16, 1987. Mr. Knowles,
representative, stated that the subject of an access easement for
the adjoining property owner on the north had been satisfactorily
resolved and they had no objection to the rezone.

By a vote of 4 to 1, denied the request to rezone from MR-2 to
GC-2, property located in the 400 block between Holly Avenue and

provide a privacy fence, landscape and direct any of their
traffic onto 5th Street instead of adding traffic onto Holly
Avenue. The objection of the neighbors was that they did not
feel that it was right for a developer to buy residential
property and then rezone it to a commercial zone when there was
adequate commercial zoning existing in the area. Denial was
based on the fact that it was an existing residential
neighborhood with commmercially zoned properties readily
available and that the rezone use did not agree with the Future
Land Use Plan Map.
