The City Commission of the City of Sanford, Florida, met in Regular Session
in the City Hall in the City of Sanford, Florida, at 7:00 o'clock P.M. on February 27,
1989.

The meeting was called to order by the Chairman.
The Chairman introduced Mrs. Ann Brisson of the Chamber of Commerce
Beautification Committee, to present plaques to the following City employees for their
efforts in the planting and care of the "Park on Park" Project. Those recognized
included Bobby Bradford, James Jones, Steve Shay, Patricio Sanchez, Gerald Taylor,
Melvin Belline, Florence Thomason, and Cheryl White.
The continuation of a Public Hearing to consider closing, vacating and
abandoning a portion of Grandview Avenue between 25th Street (SR 46) and East 24th
Place, was tabled at the request of the Petitioner, Eric Bloch.

The Chairman announced that the Commission would hear from those persons
present to speak in favor of, or in opposition to, the proposed rezoning request.
Recommendation submitted from Planning and Zoning to rezone the portion to
ER-1 as proposed, and to rezone to PD, the portion proposed to be zoned to MR-1.
Russell Sepielli, owner of the property, appeared to speak in favor of the proposed
rezoning. He stated that this development would not be for rental or low income, but
a "For Sale Residential Community". It would consist of single family detached homes
in the range of $75,000 to $160,000, and would be a 100% residential community. The
homes will consist of two story townhouses with 2, 3, and 4 bedrooms with a minimum
1200 square feet for single family homes, and 1000 square feet for the townhouses.
Out of the 160 total acres, 50 acres will be open space/wetland conservation. He
stated that the "Adair" side will be single family detached homes; the East side
(Upsala Road) will be Planned Development, and have a masonry wall similar to the
Mayfair Villa Subdivision wall. The first 120' from Upsala Road will be Single Family
residences, SR1AA with a minimum of 1500 square foot living areas. The next 500' will
be single family detached homes, not to exceed 8 units per acre, and that he has
amended the Master Plan to reflect this.
George Hoffman, 102 Maplewood Drive, spoke in opposition to the rezoning.
He stated he'was extremely concerned and opposed to the rezoning because of effects it
would have on property values, neighborhood safety and quietness, traffic, increase
in crime rates, noise, impact on public utilities, water shortage and overcrowding of
schools. He stated that he would like to see SR1AA zoning for the entire subdivision.
Bill Simmons, Director of Engineering and Planning, addressed the issue of
traffic, public safety, and utilities. He stated that the both Upsala Road and 46A
could handle the additional traffic and were not inundated at this point in time.
Mr. William Royster, 118 Larkwood Drive, also spoke in opposition to the
rezoning. He stated that he has been actively involved in the planning for middle and
high schools, and came to talk about the inequities in the school system. He stated
that Sanford has the reputation of being a low income housing district. He said that
unless we reserve areas for housing to bring in high socio-economic groups, it will
negatively affect the programs offered at our schools.
Annette Lommerse, 540 Upsala Road, spoke in opposition to the rezoning. She
stated that she agreed with Mr. Hoffman and his reasons, and wanted to see a quality
development built.

regarding Sandefur Annexation, provided the County does not appeal the

On motion of Commissioner McClanahan, seconded by Commissioner Thomas and carried by
the uote of the Commission, a request to reconsider the denial of a prior request by
David Stump, President of Stenstrom-Stump Construction and Development, inc. to waive
the square footage requirements for a residence to be constructed at 1918 Palmetto
Avenue. Mr. Stump appeared to request the City Commission to reconsider his request
to waive square footage requirements in Ordinance No. 2000, so that he can obtain a
building permit to construct a residence at 1918 Palmetto Avenue.
The Chairman announced that the Commission would hear from those persons
present to speak for or against said waiver. Mr. Jim Lee, 1901 Magnolia Avenue, rose
and asked for a show of hands to signify the number of people in the audience he
represented. Approximately eight to ten people raised their hands in response to this
request. Mr. Lee stated that Mr. Gozeman was welcome in the neighborhood, but did not
want a 900 square foot home to be built there. Mr. Lee stated that the zoning
requirement was for 1200 square feet or more, and that was what he wanted in his
neighborhood. Mr. Patrick Mitchell, 303 E. 19th Street, also spoke against the permit
being issued. Mr. Mitchell stated that he was a new resident to the neighborhood and
to sanford, and bough his home because it was affordable. Mr. Mitchell stated that he
felt the request should be denied because Mr. Stump did not own the property in
question when he obtained the variance. Mr. Keith Hinkley, 1903 Palmetto Avenue,
also spoke in opposition to the waiver. He stated that his home was over 2,000 square
feet and felt the Commission should retain the standards in the neighborhood and deny
a waiver to build a 900 square foot residence.

The 900 Square foot residence would not look that much different that the
homes in that area, Mr. Stump stated it was not a "matchbox", and would not bring the
adjacent property values down.

Parking Lot Paving Requirement

Mr. Faison:
The attached letter of February 15, 1989 from Pastor Mary Smith
requests a waiver of the requirement for the "driveway" for the
proposed church site at 1509 W. 13th Street, for a period of two
(2) years. I believe this letter was in follow-up to a discussion
I had with Pastor Smith, regarding the need for overflow parking at
the proposed church site, and the possible waiver of the City
paving requirement for the parking lot for four cars as shown on
the site plan. At no time in our discussion was there any
suggestion that the driveway (apron) should not be paved.
Under any circumstances, the driveway apron, connecting the paved
portion of 13th Street with the edge of the street right-of-way
should be paved. Pastor Smith has indicated that at present she
has only approximately 12 church members to utilize the facility.
Under this very limited projected utilization, it may be reasonable
to waive the City requirement for paving of the parking lot, in
favor of a mulch surface. This would allow reevaluation of the
requirement for construction of a retention pond since no new
impervious surface would be created.
If City Commission choses to grant the request relative to waiving
the parking lot paving requirement, it should be with the
understanding that any significant increase in the stated church
membership would require a reevaluation of the parking lot utili-
zation and need for paving, earlier than the expiration of the uwo
(2) year requested waiver period. If the waiver is granted for
paving, it should be with the requirement that Pastor Smith provide
a design acceptable to Engineering Department prior to the actual
installation of a suitable mulch covering on the parking lot.

The City Attorney reported that he received the State Attorney's Report
on the Sanford Housing Authority, and contained a five page report by the Investigator
dated February 20, 1980. He stated that the Report found no violation of the sunshine
law; that Bob Ball did not steal travel money; and said no criminal activity of any
Sanford Housing Authority Commission members were found.
The Mayor announced that she has placed a copy of "Sanford on the Lake",
our official song, with City records.
The City Manager announced that he will be continuing talks on Wednesday
with Seminole County Officials and that the talks are going well.
There being no further business, the meeting was adjourned.
