The City Commission of the City of Sanford, Florida, met in Regular Meeting in the
ity Commission Room, City Hall, in the City of Sanford, Florida, at 7:00 o'clock P.M. on
ctober 23, 1989.

The meeting was called to order by the Chairman.
Mayor Smith introduced the members of Boy Scout Troop 34 and welcomed them to the

The next item of business was consideration of request from Greater Sanford Chamber
of Commerce for waiver of alcoholic beverage fee for its Annual Installation Banquet at the
Civic Center. The Police Chief reported that in the past there had been disturbances as a
result of use of alcoholic beverages and that was the reason for the requirement for the off-
duty police officer. He stated that there was no need for the off-duty officers at this
function.
Commissioner Howell moved to waive the alcoholic beverage fee and the requirement
to hire off-duty Police Officers for the Banquet. Seconded by Commissioner Eckstein and
carried by the vote of the Commission, as follows:

The next item of business was consideration of appointments and re-appointments to
Boards/Committees. The Commission accepted the resignation of J. P. Stevens from the
Cemetery Advisory Committee. The Chairman announced that consideration of appointees to both
the Cemetery Advisory Committee and the Henry Shelton Sanford Memorial Library-Museumwould
be considered at the next meeting.

The purpose of this memorandum is to request that consideration be given to
authorize utilizing reserve funds to fulfill the City's obligation and
responsibility for the first $175,000 of Mr. Reid's' worker's compensation claim.

Several weeks ago information was provided to the City Commission regarding the
short-term and long-term considerations of this situation. The short-term
consideration ($175,000) is now a reality. In other words, the City is now in
receipt of medical bills approaching that amount. In the FY 89/90 budget a line
item of approximately $114,000 was earmarked to cover worker's compensation
payments of this nature. However, that amount represents payment on a City-wide
basis and i~eeded to remain intact to cover anticipated City-wide expenses for
the entire fiscal year.
Based on the aforementioned information it is recommended that the entire
$175,000 liability now be authorized for release from contingency funds to cover
Gordon Reid's situation. In addition, caution is advised regarding the possible
long-term implications of this situation. If the amount exceeds $5,000,000, the
City will again become liable since that was the maximum amount of insurance
coverage in effect at the time of Gordon Reid's injury.

is now able to walk and talk on his own and is still continuing with physical therapy.

The next item of business was consideration of request from Police Chief
reclassify/regrade one Police Officer position to that of Sergeant, to supervise the patrol
unit which provides the community based policing to the housing projects and perform other
duties. The City Manager reported the reclassification/regrade could be accomplished
utilizing existing FY 89/90 budgeted funds. Commissioner McClanahan moved to authorize the
reclassification/regrade of one (1) Police Officer position to that of Sergeant. Seconded

The next item of business was consideration of drafting an ordinance to incorporate
significant sections of the "Gainesville" requirements regulating the number of personnel for
all-night convenience store operations, previously discussed at October 16, 1989 Work
S~ssion.
Police Chief Harriett reported that from a law enforcement perspective, the
~inesville Ordinance is effective as a crime control measure; convenience stores would less
likely be robbed with such an ordinance, and the additional measures such as surveillance
c~meras would also deter robberies. Further, most robberies occur between the hours of 10:30
~ M. and 2:00 A.M. The City Attorney reported that the Gainesville Ordinance had been
c ~allenged and had been upheld. The Chairman asked for a show of hands of those persons
~esent in opposition to the proposed ordinance. The Chairman acknowledged the presence of
f)ur convenience store representatives: 7-11, Handy Way, Cumberland Farms, and Circle K.
Commissioner Howell moved to authorize the City Attorney to prepare the proper
c~dinance to incorporate significant sections of the "Gainesville" requirements regulating

anager reported that the "Dade County" regulations were similar to Sanford's except that
iami has a shorter time requirement, and the Miami ordinance clearly defines "abandoned
zructures" and allowes demolition of such structures if they create a nuisance.

Dear Mr. Faison:
On September 12, 1989,.the City publicly opened competitive bids
for the above referenced project, which consists of the
construction of the Master Wastewater Pump Station at the
Wastewater Treatment Plant. The purpose of this letter is to
present the Engineer's .recommendation concerning the award of
the construction contract.
We have reviewed the 'three lowest bids and bid documents
received. A certified copy of the bid tabulation is attached as
Exhibit "A" The low bid for the project was submitted by
Wharton-Smith, Inc. in the amount of One Million One Hundred and
Thirteen Thousand and No Cents ($1,113,000.00). Our staff has
reviewed the bid documents for accuracy and completeness and no
significant irregularities or deficiencies were found.
The second low bidder, Lee Construction, inadvertently omitted
line item Number 2 on the Bid form. We calculated line Item 2
to be $185,000, by taking the base bid and subtracting all other
line items from the Base Bid. This number was confirmed by the
Contractor.
Our preliminary investigation of the low bidder's experience and
references indicate that he appears to be qualified to perform
the work involved for this project. Please see the ~
"Contractor's Statement of Business Organization", which has
been attached as Exhibit "B".
Analysis of the bids indicates that the bidders had a thorough
understanding of the Contract Documents, bidding procedures, and
scope of the project. The bids were competitive as evidenced by
the "total' prices" received from all bidders, which can be seen
on the bid tabulation (Exhibit "A" attached hereto).

Therefore, based on our review and analysis, we recommend that
Wharton-Smith, Inc. be tentatively awarded a construction
contract for the Master Wastewater Pump Station for the total
Base Bid amount of $1,113,000.O0, with conditions as follows:

Bennie Alexander, 1212 West Eighth Street, Sanford, appeared to speak concerning
drugs in the community. He stated he does not feel the City is doing all it can to alleviate
the drug situation. Further, he represents Celery City Lodge and Evergreen Temple No. 542,
and reported that people are afraid to go to the Lodge, and that "those people" knock on
doors and bang on windows and that they could not have any meetings in peace. Also, he has
given the Police Chief authority to arrest any person around the Lodge who does not have a
Lodge membership card. Mr. Alexander asked that laws be enacted to keep people from "hanging
around", and stated that the community does not want drug dealers or pushers. He stated that
the senior citizens are afraid to call the police and give their names.

The Police Chief reported there had been 270 drug-related arrests in the past 12
months in the area north of 13th Street, and police had seized shotguns, guns, and 10 pounds
of cocaine in the past few months. Hereported the problem stemmed from the judicial system
in that although the criminal might be arrested and sent to jail, he was released and did not
serve a full term in some instances. Further, conditions have improved in the Sanford
Housing Authority area, but that has displaced drug activity into other areas.
Reverend Harry Rucker, 1101 West 13th Street, appeared, and requested more response
from the Police Department. He suggested the Commissioners spend a few nights in. the drug
area to view the occurrences. Reverend Rucker further suggested that confiscated drug money
be used to help treat drug addicts;
Albert Fryer, 1805 Madie~a Avenue, appeare~ and reporte~ that he is an ex-police
officer and that in the area of Seventh Street and Locust Avenue he saw kids out of school
and graffiti on the wall. Further, Police Community relations were important. He suggested
that the Police Department make a better effort to be "on the scene."
Sylvester Chang appeared and reported he is a member of the Greater Sanford
Citizens Against Crime, and he supports the views of the previous speakers. He stated there
must be more cooperation between the police and the black community and submitted his phone
number for people to contact him, who wished to become a me~ber of the Greater SanfOrd
Citizens Against Crime, or assist in any w~y. He suggested~ that the Commissioners get in
touch with all the churches in the black community. He stated Dr. Velma Williams is another
contact person for the Greater Sanford Citizens. Againat Crime.
Commissioner Howell stated that Daryl McClain is another contact person for the
Greater Sanford Citizens Against Crime.

Amendment to Community Development Block Grant
Cooperation Agreement
On October 9, 1989 ~he City Commission approved execution of a
Community Development Block Grant Cooperation Agreement between
City of Sanford and Seminole County. This agreement was a
necessary prerequisite to the City participating with the County
· n the HUD funded Community Development Block Grant Program. A
part of this agreement was the specification that both parties
would comply with all applicable Federal regulations.
Seminole County advised us on October 20 that HUD was requiring a
specific reference to certain Federal regulations, the details of
which are included in the attached proposed amendment to the CDBG
Cooperation Agreement. The County advises that uhe executicn cf
this amendment is urgent.

October 9, I believe it was the intention of the City 'Commiszion
to approve compliance with all of the applicable Federal Guidelines
including the Fair Housing Act. With ~he concurrence of the City
Attorney, it is recommended that the Mayer execute the proposed
amendment under the authorization previously given for executin~
the basic Cooperation Agreement.
