The City Commission of the City of Sanford, Florida, met in Regular Meeting on
November 27, 1989, at 7:00 o'clock P. M. in the City Commission Room, City Hall, Sanford,
Florida.

The meeting was called to order by the Chairman.
A public hearing was held to consider the second reading and adoption of
Ordinance No. 2068, entitled:
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE 1689 TO PROVIDE FOR AN INCREASE
IN THE MONTHLY RETIREMENT BENEFIT OF THE FIREMEN'S
RETIREMENT SYSTEM FROM 2% TO 2.1% FROM APRIL 1,
1989 TO OCTOBER 1, 1989 AND TO OBTAIN MINIMUM
CONTRIBUTIONS; PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the adoption of Ordinance No. 2068.~ No one
appeared.

The next item of business was consideration of a request from The School Board of
Seminole County, Florida, to close Seventh Street between Myrtle Avenue and Elm Avenue,

Ron Neel, Assistant Fire Chief, Sanford, Florida, appeared to support the
proposed ordinance, and reported that one person can not properly monitor the dispensing of
gasoline according to the State Fire Marshall's Regulations.
Those appearing in opposition to the proposed ordinance were as follows:
John Pearman, President, Retail Grocers Association of Florida, Inc., 105 Live
Oak Gardens, Casselberry, Florida, appeared and asked the Commission not to pass the
ordinance, and to let the merchants work on the issue on a voluntary basis.
Tom Miller, Miller Enterprises, Crescent City, Florida, appeared and reported he
represents Handy Way Food Stores, and that he is aware of robberies to convenience stores
when two clerks were on duty.
Curtis Donahue, Vice President, DLM Research Labs, appeared and reported his
company manufactures security cameras, and read a statement.
Vern Speers, Sanford, Florida, appeared and reported the proposed ordinance would
be forcing small businesses to do something they may not be able to afford.
Commissioner Howell moved to amend Ordinance No. 2078, hours of operation, from
"8:00 P. M. to 4:00 A. M." to "8:00 P. M. to 6:00 A. M.", and to pass Ordinance No. 2078,
as amended, on first reading.

The next item of business was consideration of a Railroad Crossing Agreement with
CSX Railroad, to provide for installation of Groveview Park and Groveview Subdivision
reclaimed water lines. Commissioner McClanahan moved to authorize execution of said
agreement, and authorization to pay the one-time license fee in amount of $1,075.00.

On 11/14/89, bids were opened for our annual purchase of sanitary
and storm sewer materials. The sanitary sewer materials will be
used by the Sewer Division of the Utility Department for repairs

Works Department.

On Thursday, 11/16/89, bids were opened for procuring a trailer
mounted Asphalt Maintenance Distributor. This unit Ts a ~00
gallon capacity asphalt emulsion distributor to apply tack and
prime coats before placing asphalt overlay. Seven requests were
sent with four responses, three of the responses were no-bids.
Because of only having one bidder, we have contacted other
equipment dealers as well as our no bid dealers. There are
only a few manufacturers of this type of equipment and they only
build either small "tar kettle" units or large (1000 gallon)
truck mounted distributors. That is why the other vendors
responded with "no bid". The bidder (Linder Industries) is the
Manufacturer's only State of Florida representative for E. O.
Etnyre & Co. equipment.
E. D. Etnyre has been in the distributor manufacturing business
for many years and has a reputation for building quality reliable
equipment.
Linder Industries unit meets al1 specifications, and is the sole
source for this size and type unit. We recommend accepting their
bid in the amount of $10,909.00. This price is over the budget
amount by $1,~09.00 and reflects an unanticipated price increase.
This deficit will be made up by internal Divisions fund transfer.

Civic Center Renovation Contract Award
Bids were opened on November 22, 1989, for the Civic Center
Renovation (Bid #88/89-74 (Re-bid)). The attached bid tabulation
shows the bid results. The low bidder was Wharton-smith, Inc.,
with a base bid of $232,000. This bid meets specifications.
This project is to be funded by two (2) state grants totaling
$300,000. Exclusive of estimated engineering costs, $265,000 is
available for construction. It is recommended that initially, a
5% contingency fund amounting to $13,250 be retained. This
leaves $251,750 for the construction contract award. It is
recommended that award be made on the base bid plus additive
alternates number 1, 3, 4, & 5. The total of the recommended
award is $246,500. (If no unforeseen construction contingencies
materialize, we should be able to include alternate 2 at a later
date by change order.)
It is recommended the City Commission approve award of this
contract as outlined herein.
