The City Commission of the City of Sanford, Florida met in Regular Meeting on
Monday, July 8, 1991 at 7:00 o'clock P.M. in the City Commission Room~ City Hall, Sanford,
Florida.

The Chairman called the meeting to order.
The first item of business was continuation of a public hearing to consider
closing, vacating and abandoning a portion of a utility easement lying between Sanora
Boulevard and Stenstrom Boulevard and between Sanford Avenue and Hunt Drive, Mark Leppla,
owner, tabled at June 24, 1991 Regular Meeting.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, the proposed utility easement closing. No one
appeared.
Recommendation submitted from City Planner to approve subject to compatible and
matching surface materials, matched roof lines and written confirmatiOn of approval from the
Sanora Community Association Board prior to the issuance of a building permit.
Commissioner Howell moved to table until July 22, 1991, pending additional

The Commission next considered a request from Seminole County Expressway Authority,
for right-of-way use permits over a portion of American Boulevard and unopened State Street,
as discussed at tonight's Work Session. On recommendation of City Manager, Commissioner
Thomas moved to authorize said right'of-way use permits for the north end of existing
Americana Boulevard and a portion of unopened State Street, for st°rmwater retention pond and
an off-ramP, with decision whether or not to fence retention pond to be determined during
early stages of construction, and with the stipulation that the Expressway Authority pay for
any relocation of existing utilities necessitated bY their use of said right-of-ways.

Mayor Smith stated that she is Chairman of the Seminole coUnty Expressway Authority, and that
she will not receive any personal gain from this vote.
The Commission next considered a request from the City of Lake Mary, to adopt a
resolution requesting the Florida PublicService Co~mission review the local service calling
area; and requesting said service area be extended to Orlando and Apopka locations with no
increase in the basic local service fee or the local service base rate, as discussed at
tonight's Work Session. Commissioner Thomas moved to authorize City Attorney to prepare a
resolution regarding same. Seconded by Commissioner Eckstein and carried by the vote of the

The Commission next considered General Obligation Bond Referendum~for Recreation
Facilities, as discussed at tonight's Work Session. Commissioner McClanahan moved to
authority City Staff and City Attorney to begin the necessary steps to hold a Referendum in
October, 1991. Seconded by Commissioner Eckstein and carried by the vote of the Commission

The next item of business was consideration of a request from the Utility Director
to purchase a 4-wheel drive vehicle. On recommendation of City Manager, Commissioner Thomas
moved to approve the purchase of said 4-wheel drive vehicle, as described in memo dated June
19, 1991, from Utility Director, necessary for inspection/engineering review of "Site 10"

The next item of business was consideration of Joint Agreement with Seminole County
School Board for construction of a Swimming Pool Complex, as discussed at tonight's Work
Session. On recommendation of City Manager, Commissioner Thomas moved to authorize the
execution of said Joint Agreement with Seminole County School Board for construction of a
Swimming Pool Complex in amount of $1,200,000.00; City cost approximately $600,000.00, said
Agreement to contain a clause whereby the City will have the right to opt out shoUld the Bond
Referendum not pass. Seconded by Commissioner Eckstein and carried by the vote of the
Commission as follows:

The Commission next considered a request from the Utility Director to enter into
an agreement with Insituform Southeast, Inc. On recommendation of City Manager, Commissioner
Howell moved to authorize the execution of said agreement with Insituform Southeast, Inc. in
total estimated amount of $57,102.50, for sewer renovation on First Street from Avocado
Avenue to Poplar Avenue, and Highway 17-92 between 18th Street and 19th Street. Seconded by
Commissioner McClanahan and carried by the vote of the Commission as follows:

The Commission next considered a Petition for Annexation of a portion of property
lying North of and abutting Meadow Drive and between Art Lane and Driftwood Lane extended
northerly, Linda George, owner. On recommendation of Acting City Manager, Commissioner
Thomas moved to authorize water service, with petitioner to pay applicable water system fees,
and to record the Annexation Petition and annex said property when annexable. Seconded by
Commissioner Eckstein and carried by the vote of the Commission as follows:

The Commission next considered a request from Arthur and Teresa McClenaghan d/b/a
Quick Dogs, to operate an Open-Air Restaurant at 1100 French Avenue (Heilig-Meyers
Furniture), and to transfer existing license from 420 French Avenue (Sanford Tire Service)
to said French Avenue location. On recommendation of Acting City Manager, Commissioner
McClanahan moved to approve said request. Seconded by Commissioner Eckstein and carried by

By a vote of six to one, approved the Conditional use request for limited.outside
storage of vehicles for property located at the southwest corner of Jewett Lane
and Kennel Road in a RI-l, Restricted Industrial District.
Owner/representative: Scott Barnes
Opposition was concerned about the possibility of visibility of outside storage from
the proposed Seminole County Expressway.
Unanimously approved the site plan for a detached sign for New Life Word
Church, Inc, 1311 Oak Avenue, located in a MR-2 Multiple-family' Residential
District.

Unanimously approved the site plan for a detached sign for the Smith Associates,
Inc. buildings, 912-918 French Avenue, located in a GC-2, General Commercial
District.

The Commission approved a tentative budget for Fiscal Year 91/92.
Mayor Smith announced that the Tentative Budget Hearing for Fiscal Year 91/92
Budget will be held September 9, 1991 at 7:00 o'clock P.M. in the City Commission Room.
The Commission next considered Board appointments/re-appointments as follows:
Youth Advisory Committee: The City Clerk reported that the terms of Bob
Lundquist, Jennifer Campbell, Katherine Williams and Moses Aviles expire July
22, 1991, and that the Committee would like to make recommendations for
appointment/re-appointment when it meets again, in September. The Commission
took no action.
Fire Pension Board of Trustees: The City Clerk reported that Eric Kip
Parshall has been elected to replace Larry E. Helman, and that said
appointment needs to be confirmed.
Commissioner Eckstein moved to confirm the appointment of Eric Kip Parshall
to the Fire Pension Board of Trustees. Seconded by Commissioner Thomas and
carried by the vote of the Commission as follows:

The Commission acknowledged one lump sum contract approved for payment totalling
$52,252.43.
On request and recommendation of City Manager, Commissioner Howell moved to decline
Tourist Development Council funds grant for the Beachfront Project, and to request that the
Tourist Development Council consider using said funds on the General Sanford Museum/Library
project, as discussed at tonight's Work Session. Seconded by Commissioner Thomas and carried
by the vote of the Commission as follows:

City Attorney reported that the Expressway Authority has began a series of
condemnations to clear property in this area, that the City was served regarding Joe Baker's
property located near Old Orlando Highway (parcel #537), that the City received an easement
from Mr. Baker in 1975, which has not been used for several years, and recommended that the
Commission sign a Disclaimer and Waiver of any future participation in this suit. On
recommendation of City Attorney, Commissioner MoClanahan moved to authorize the Mayor to
execute said Waiver. Seconded by Commissioner Thomas and carried by the vote of the
Commission as follows:

On request and recommendation of City Manager, Commissioner McClanahan moved to
accept offer from W. L. Kirk, Jr, to donate property located west of Pincreast Fourth
Addition and Jenkins Circle, said property to be deeded in two or three sections over a two
or three year period, as discussed at tonight's Work Session. Seconded by Commissioner
Eckstein and carried by the vote of the Commission as follows:

Mayor Smith thanked Steve Alford, People's Fireworks, for his efforts regarding the
fireworks display on July 4, 1991.
The Commission discussed the use of illegal fireworks in Sanford, and directed City
Staff and City Attorney to research the feasibility of amending City ordinance to prohibit
the sale of all fireworks from temporary structures, and to report back to the Commission in
60 days with comments and recommendations.
Mr. Balzer, 222 Bradford Drive, appeared and reported that it will not be easy to
prevent illegal fireworks from being transported into the City.
There being no further business, the meeting was adjourned.
