The City Commission of the City of Sanford, Florida met in Regular Meeting on
Monday, July 13, 1992 at 7:00 o'clock P.M~ in the City Commission Room, City Hall, Sanford,
Florida.

The Chairman called the meeting to order.
Presentation of Appreciation Plaque.
Mayor Smith presented City Employee June Strine, BenefitsfTechnician, a plaque and
Letter of Appreciation for her work with the City of Sanford Health Fair this year.
Presentation by Sanford Area Modelers._
Lee Dargue, Sanford Aera Modelers, appeared and presented a plaque to the Mayor and
City Commission in appreciation for providing the Sanford Area Modelers a flying field, and
its continuing support in model aviation.
Public Hearing to consider 1992 Revised Land Development Regulations, as advertised in the
Sanford Herald on July 3, 1992.
The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, said revisions.
Director of Planning and Development appeared and briefly highlighted and reviewed
various additions and revisions which have been incorporated into the City's Land Development
Regulations.

Ordinance No. 3107, entitled:

Request from Jim Bagley, fOr Conditional Use Permit, for property located at 414 South
Palmetto Avenue, for re-establishment of Multiple-Family use within a SR-2, Single-Family,
Zoning District, as discussed at July 7, 1992 Work Session. Commissioner Howell reported the
Commission has previously denied two or three other similar requests on the same street, and
moved to deny request -to re-establish Multiple-Family use at 414 South Palmetto Ave.

Request from Thomas H. Skelton, P.E., Vice-President, Tropic Park Auto Mall, for waiver of
Land Development Regulations, to erect four free-standing signs and one multi-tenant sign at
the entrance of Tropic Park Subdivision. On recommendation of City Manager, Commissioner
Eckstein moved to permit one detached sign not to exceed 50 square feet per business, and one
subdivision identification sign up to 32 square feet in surface area, and up to 12 feet in
height above grade, all as recommended in memo dated July 8, 1992, from Director of Planning

Request from Orlando Urban Area Metropolitan Planning Organization, for City Darticipation
in Bicycle/PedeStrian Program.
Director of Planning and Development appeared and reported that this program has
been successful in planning and implementing a safety program, and that it is appropriate to
support such a program.
Commissioner Howell moved to deny request for funding for the Bicycle/Pedestrian
Program. Said motion died for lack of a second.
On recommendation of City Manager, Commissioner Thomas moved to authorize City
participation in the Bicycle/Pedestrian Program, and funding for same in amount of $1,108.41,
from Engineering and Planning's FY 91/92 Engineering/Architectural Services Budget, for MPO

Request to consolidate two part-time custodial positions into one full time position. On
recommendation of City Manager, Commissioner Thomas moved to authorize the consolidation of
two part-time custodial positions; one from the Building Maintenance Division, and one from
the Solid Waste Division, into one full time position, and to authorize the City Attorney to
prepare the proper ordinance to amend Ordinance No. 3075, thereby incorporating said change
into the "Authorized Position" segment of the City's "Classification and Pay Plan". Seconded
by Commissioner Howell and carried by the vote of the Commission as follows:

Request from Sanford Historical Society, for waiver of all CiVic Center rental fees for
~ndraiser in celebration of the City of Sanford's Anniversary on Sunday, September 27, 1992,
from 10:00 A.M. to 7:00 P.M, with all proceeds to be donated to the Henry Shelton Sanford
Library-Museum.
Commissioner Howell moved to waive all Civic Center rental fees as requested.
Commissioner Thomas seconded the motion and then withdrew same. Said motion died for lack
of a second.
On recommendation of City Manager, Commissioner Thomas moved to deny free use;
requestor to pay minimum charge to cover the City's costs in amount of $189.00. Seconded by
Commissioner Eckstein and carried-by the vote of the Commission as follows:
Reclaimed Water Service Agreement with Seminole Cowmunity College. On recommendation of City
Manager, Commissioner Thomas moved to authorize execution of said Service Agreement; with
Seminole Community College to receive one year of service at no charge, after completion of
first year there will be an initial monthly access fee in amount of $3.25 plus a consumption
charge of $.05 per thousand gallons per meter. Seconded by Commissioner Eckstein and carried

Board appointments/re-appointments.
A. Code Enforcement Board: City Clerk reported that there is one vacancy
(alternate) for term to expire April 4, 1994. The Commission took no action.
System Development Fee Advisory Committee: City clerk reported that the
Commission needs to appoint five to six members to said Committee. The
Commission took no action.
The Commission concurred to discuss possible appointments to Committees A and
B above, at the next Work Session.
Youth Advisory Committee: City Clerk reported that the terms of Lance Abney,
Heather Pegram, Rachael Swann, Patrick Colbert, and Jenny Noell expire July
22, 1992. Also, on_October 1992, the City Commission inactivated the Youth
Advisory Committee. The Commission took no action.
Resolution No. 1635. Commissioner Thomas moved to adopt Resolution No. 1635, entitled:
AN RESOLUTION OF THE CITY OF SANFORD, FLORIDA, ADOPTING
A FEE SCHEDULE FOR APPLICATIONS FOR SMALL-SCALE
AMENDMENTS TO THE COMPREHENSIVE PLAN AND SPECIAL FEES FOR
LARGE-SCALE DEVELOPMENT.

Henry Shelton Sanford Memorial Library-Museum. On recommendation of City Manager and the

keep the original library and west wing as the "Henry Shelton Sanford Memorial Library-
Museum, and to name the remainder of the original building and addition as the "Sanford
Museum, effective upon re-opening of. the Museum after completion of construction. Seconded

Recommendations from Planning and Zoning Commission Meeting of Thursday, July 2, 1992, as
described in memo dated .July 7, 1992, from Land Development Coordinator.
Recommendation %1: The Planning and Zoning CommiSsion unanimously approved the 1992
Revisions to the City's Land Development Regulations. No further action required or taken.
Information %1: The Planning and Zoning Commission denied Conditional Use request
for the sale of beer and wine (ClaSs 5), for consumption on premises in conjunction with food
sales for property located at 1407 West 13th Street in a GC-2, General Commercial, Zoning
District. No action required or taken.
Information %2: The Planning and Zoning CoMmission approved the Site Plan for a
restaurant for propertylocated at 1407 West 13th Street in a GC-2 General Commercial, Zoning
District, conditioned upon City Commission waiving required paved parking..
City Manager reported that the Planning and 'Zoning Commission denied Conditional
Use request for the same location, as described in Information %1, above, and that applicant
has filed an Appeal regarding same.
On recommendation of City Manager, Commissioner Thomas moved to waive required
Paved parking at 1407 West 13th Street, with the City reserving the right to review after one

Department). City Manager reported that several months ago the City
advertised this bid, providing for considerable television monitoring
and sealing of various sewer lines throughout the City, which are
suffering significant inflow/infiltration. Further, there is no
question that this work needs to be done, however, due to now apparent
funding constraints, he recommended that all bids be rejected. Also, it
may be .necessary to re-bid when the funding situation has stabilized.

Merit Pay for City.Manager, as discussed at July 6, 1992 Budget Work Session. Commissioner
Thomas moved to authorize a 6% merit pay increase to City Manager William A. Simmons,
effective July 1, 1992, with transfer from FY 91/92 Contingency Fund in amount not to exceed
$1,228.00 for same. Seconded by Commissioner Eckstein and carried by the vote of the

City Manager reported that there is an error relative to the rolle~-back rate as

The Commission approved a Tentative Budget for Fiscal Year 92/93.
Mayor Smith announced that the Tentative Budget Hearing for Fiscal Year 92/93 will
be held on September 14, 1992 at 7:00 o'clock P.M. in the City Commission Room.
Request from Chuck Volk, President, Lake Monroe Harbour, Inc., for current fee rate of 2.5%
to continue for remainder of Lake Monroe Harbour Lease. Commissioner Howell moved to approve
continuation of current fee rate of 2.5%, for the remainder of the Lake Monroe Harbour Lease.

1983 Court Case regarding the Redistricting of the City of Sanford. City Attorney reported
that on July 9, 1992, Federal District Judge Kovachevich entered the Order Modifying Final
Judgment and Order to Complete Active Litigation, which relinquishes jurisdiction and
approves the Redistricting Plan as agreed to and submitted by Plaintiffs and the City.
City Manager reported that Staff will prepare revised District Boundaries
information for the Supervisor of Elections, to make the necessary changes prior the
December, 1992 election, and that the new district boundaries will be made available as
needed.

Bid 991/92-26, Review of Franchise and Municipal Utility Taxes. On request and
recommendation of City Manager, Commissioner Eckstein moved to award bid to ATC, which was
the only true contingency proposal option, at the rate of 40% of recoveries, plus travel
expenses in excess of 50 miles, if needed, and to authorize Staff to prepare the contract for
same. Seconded by Commissioner Howell and carried by the vote of the Commission as follows:
