The City Commission of the City of Sanford, Florida met in Regular Meeting on
Monday, August 24, 1992 at 7:00 o'clock P.M. in the City Commission Room, City Hall, Sanford,
Florida.

The Chairman called the meeting to order.
Public Hearing to consider Small Scale Comprehensive Plan Amendment for a portion of property
lying between Holly Avenue and Maple Avenue and between West llth Street and West 12th
Street, and to consider rezoning the property from MR-2, Multiple-Family Residential, to GC-
2, General Commercial, Hellekson Real Estate Co., Inc., owner, as advertised in the Sanford
Herald on August 17 and August 13, 1992. The Chairman announced that the Commission would
hear from those persons present to speak in favor of, or in opposition to, the Small Scale
Comprehensive Plan Amendment, and/or the rezoning of said property.
Thomas Deppen, 2304 South Park Avenue, representative, Hellekson Real Estate,
appeared and stated that he was available to answer questions.
Recommendation submitted from Planning and Zoning Commission to approve said Small
Scale Comprehensive Plan Amendment and rezoning; and recommendation submitted from Director
of Planning and Development to approve Small Scale Comprehensive Plan Amendment and rezoning.
Commissioner Thomas moved on the first reading of Ordinance No. 3126, entitled:
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING
ORDINANCE 2065 OF SAID CITY. SAID ORDINANCE BEING A
COMPREHENSIVE PLAN; AMENDING THE FUTURE LAND USE PLAN
ELEMENT TO PROVIDE SMALL-SCALE COMPREHENSIVE PLAN
AMENDMENT OF THE COMPREHENSIVE PLAN TO DESIGNATED
PROPERTY LYING BETWEEN HOLLY AVENUE AND MAPLE AVENUE AND
BETWEEN WEST llTH STREET AND WEST 12TH STREET; PROVIDING
FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
Also, to authorize City Attorney to prepare the proper ordinance to rezone the property as
advertised. Seconded by Commissioner Howell and carried by the vote of the CommiSsion, as
follows:

Mayor Smith announced that the City will advertise and hold the second public hearing on the
Comprehensive Plan Amendment on September 14, 1992.
Public Hearing to consider rezoning a portion of property lying between U.S. 17-92 (French
Avenue) and Laurel Avenue and between West 15th Street and West 18th Street, from SR-1A,
Single Family Dwelling Residential, to GC-2, General Commercial, Seminole County School
Board, owner; R. Hardwick/Tidewater Enterprises, Inc., applicant, as advertised in the
Sanford Herald on August 13, 1992.
Recommendation submitted from Planning and Zoning Commission to deny the rezoning;
based on incompatibility of GC-2 zoning with existing zoning and the City's policy to protect
neighborhoods, and to prevent incompatible uses.
Recommendation submitted from Director of Planning and Development to approve the
rezoning.

The Chairman announced that the Commission would hear from those persons present
to speak in favor of, or in opposition to, said rezoning.
Rulon Munns, Bogin, Munns & Munns, representative for Richard Hardwick, applicant,
appeared and requested that the public hearing be continued until September 14, 1992 Regular
Meeting, to allow time for Mr. Hardwick to meet with adjoining residents to address their
concerns. He stated that Mr. Hardwick has an amended site plan, and pictures which show the
type of development being considered, for City Commission review.
Those individuals who appeared in opposition to the rezoning were as follows:
Betsy Phillips, 423 West 18th Street, reported that the City of Sanford is becoming
a bedroom community to Orlando, and that the proposed commercial development of this acreage
would not be advantageous to the City.
Mayor Smith asked for a show of hands from those individuals in the audience who
were opposed to the rezoning.
Kurt Jansen, 221 West 17th Street, appeared and reported there is a major flooding
problem at 17th Street and Elm Avenue, and that the proposed shopping center is too close to
the residential area.
Sylvia Smith, 425 West 18th Street, appeared and reported that, if the Commission
denies this request, she will work with the Seminole County School Board and the City of
Sanford, and provide financial assistance in acquiring this property for a park. Further,
the neighborhood does not want any commercial development encroaching beyond what currently
exists. Also, once the property is rezoned they will have no control over what is built.
Sue Olinger, Sanford Historic Trust, appeared and reported that the proposed
shopping center is too close to the neighborhood, and that she would encourage the developer
to renovate one of the strip malls in the area.
Glen McKendree, 122 West 17th Street, appeared and reported that between 13th
Street and 20th Street, and between Park Avenue and French Avenue there are fourteen homes
for sale, four parcels of vacant land for sale, and eight vacant buildings available, which
are large enough to accommodate such a project.
Commissioner Howell moved to deny the rezoning. Said motion died for lack of a
second.
Commissioner Eckstein reported receipt of two letters regarding this issue. The
other members of the Commission acknowledged receipt of same, also.
On recommendation of City Manager, Commissioner McClanahan moved to table public
hearing until September 14, 1992 Regular Meeting as requested. Seconded by Commissioner
Eckstein and carried by the vote of the Commission as follows:

Public Hearing to consider an Appeal of the Denial of a Conditional Use for sale of beer an~
wine for consumption on premises, with a restaurant, (Class 5 Registration) at 1407 West 13~h
Street, in a GC-2, General Commercial, Zoning District, Sydney Spence, owner, as advertise~
in the Sanford Herald on August 10, 1992.
City Clerk reported that public hearing notice was posted August 10, 1992, and
owner was notified on August 13, 1992.
City Attorney reported that the Commission will be reviewing an appeal from a
Planning and Zoning Commission decision. Said review will be limited to the records and
testimony introduced into evidence at the Planning and Zoning Commission Meeting, and will
be exclusively limited to issues raised at the Planning and Zoning Commission hearing, and
the facts introduced at said hearing. Also, no individuals in the audience will be permitted
to appear before the Commission to raise new issues or introduce new facts. Further, the
Commission will need to make Findings of Fact, and Conclusions of Law.
The following individuals appeared before the Commission.
Sydney Spence, 1515 West 18th Street, appeared and reported that he owns the
property located at 1407 West 13th Street, and asked the Commission what type of business he
can have at this location. Also, he needs to be able to sell other things in addition to
food.
Deser Alexander, business partner with Sydney Spence, appeared and reported that
they have complied with the parking requirements.
Marie Alexander, business partner with Sydney Spence, appeared and reported that
they will be less competitive than the other businesses on 13th Street, if the Commission
denies their request to sell beer and wine.
The Commission reviewed the testimonies given tonight, and evidence contained in
the record created before the Planning and Zoning Commission, and concluded that the request
is consistent with zoning; conforms with the rules and regulations of the City; and that
conditions of the conditional zoning have been met.
Commissioner McClanahan moved to approve the Conditional Use Application. Seconded
by Commissioner Eckstein and carried by the vote of the Commission as follows:

Consideration of Appeal of Denial of Certificate of Appropriateness by Historic Preservation
Board, to board up property at 114 West First Street (Welaka Bui18ing)w RTC, owners/James W.
Boylew The Bywater Company, Agent.
Laura Straehla, Member of the Sanford Historic Preservation Board, appeared and
reported that the Sanford Historic Preservation Board felt it appropriate to deny the
Certificate of Appropriateness because RTC had already boarded up the Welaka Building before
making application, and did not go through the proper channels, with the added factor that
the windows do not go with the street scape on First Street.

Commissioner Eckstein moved to overturn the Sanford Historic Preservation Board's
denial of the Certificate of Appropriateness, and to approve the boarding up of the property
at 114 West First Street. Seconded by Commissioner McClanahan and carried by the vote of the
Commission as follows:

Presentation byBob tassels regarding weekly rentals in the Historic District, as discussed
at tonight's Work Session.
Bob Cassels, 709 Oak Avenue, appeared and read a petition, which he stated was
signed by 125 individuals, requesting that: 1) the definition of transient rentals, weekly
rentals, and boarding house be added to City Code, 2) weekly rentals be banned in all
districts except commercial districts, and the City enforce same, and 3) the Code Enforcement
Inspector be allowed to actively seek violations.
Mayor Smith reported that at tonight's Work Session, Staff was instructed to obtain
other ordinances regarding weekly rentals from surrounding cities, and will present same to
the Commission, for comparison.
City Manager reported that
Enforcement Citation Program, however,
the City Commission recently adopted the Code
the Judge designated as county-wide coordinator,
established a policy whereby all jurisdictions throughout Seminole County, must adopt a
uniform citation program, and provide training for those persons issuing citation, which has
been scheduled for September 1, 2 and 10, 1992. Also, he will be discussing, with the
Commission, the possibility of hiring an additional Code Enforcement Inspector as a
"Contract" employee, for period of six (6) months. Further, Linda Gentry, Code Enforcement
Inspector, is in no way prohibited from seeking other violations, as time allows; on an
average, she conducts fourteen (14) code enforcement investigations per day, there are no
restrictions other than those in the City Code and Florida Statutes, and complaints are
accepted by telephone and in writing.

Jordan Beckner, 434 Scott Avenue, appeared and reported that he still feels
residents should be given more warnings than commercial businesses, as previously stated at
July 27, 1992 Regular Meeting.

upon high quality program available to the public at no charge. Seconded by Commissioner

Request from Deacon John Knight, Chairman, The New Salem Primitive Baptist Trustee Board, for
waiver of building demolition fee, for property located at 1206 Oleander Avenue, Constance
Dent, owner. City Manager reported that on August 11, 1992', the Code Enforcement Board
waived the Code Enforcement fine/lien, contingent upon the new owners providing proof of
ownership. Also, the church representative indicated to Code Enforcement Board a willingness
to pay the demolition charges. On recommendation of City Manager, Commissioner McClanahan
moved to deny waiver of demolition/condemnation charges, with City Manager and Deacon Knight
to work out payment schedule for same, and report back to the Commission. Seconded by

Conditional Use, for a Class 3 Alcoholic Beverage Registration at 1602 West Airport
Boulevard (Riverboat Plaza). On recommendation of City Manager, Commissioner Eckstein moved
to waive the 2,000 foot separation requirement because of the church's location (temporary)
in a commercial store front in a GC-2 zone, and to approve applicant's request to apply to

to appoint Lisa Nason as alternate member to the Code Enforcement Board.

Authority, and thanked Mr. Dennison for his service on said Board. Seconded

Request to transfer Sewer Impact Fee funds for bond debt service, and for on-going
construction costs. On recommendation of City Manager, Commissioner Howell moved to
authorize transfers from Fund 451/Water and Sewer Utility to Fund 472/Sewer Impact Fees as
required, now and in the future, to meet the debt obligation needs of these funds; and
reconfirmed authorization to transfer reserves, not to exceed $2,398,000.00, from Fund
451/Water and Sewer Utility on an as needed basis to cover the on-going Construction Fund/321
costs. Seconded by Commissioner Thomas and carried by the vote of the Commission as follows:

Request from Terry McKinney, for City assistance regarding youths congregating in easement
in front of his property at 105 Sterling Court.
Terry McKinney, 105 Sterling Court, appeared and reported that neighborhood youths
use the shade tree in front of his yard, which is very disruptive to his family, that said
youths believe it is a public easement and that they have the right to be there. He
requested City assistance regarding this situation.
City Attorney reported unless there is a crime being committed, the City cannot
make an arrest, and that individuals have the right to assemble. Further, the City has the
right to lease public property if it serves a public purpose.

Requests from S.H.D.W.A.: A) For adoption of "Market on the Mall", as described in letter
dated August 12, 1992, from Chris Cranias, and 2) For $10,000.00 contribution for start up
of "Main Street Program", as discussed at tonight's Work Session. Commissioner Howell moved
to approve A and B above, as requested.

Contract with Rollins Protective Services, Inc., for emergency installation of Alarm System
at Public Works Complex, as discussed at tonight's Work Session. On recommendation of City
Manager, Commissioner Howell moved to accept lowest quote, from Rollins Protective Services,
Inc., in amount of $9,543.00, for emergency installation of alarm system. Seconded by
Commissioner Thomas and carried by the vote of the Commission as follows:
