The City Commission of the City of Sanford, Florida, met in Regular Meeting on
Monday, February 13, 1995, at 7:00 o'clock P.M. in the City Commission Room, City Hall,
Sanford, Florida.

The Chairman called the meeting to order.
Public Hearing to consider second reading and adoption of Ordinance No. 3240, as advertised
in the Sanford Herald on.February 2, and 9f 1995.

AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, TO ANNEX
WITHIN THE CORPORATE AREA OF THE CITY OF SANFORD, UPON
ADOPTION OF SAID ORDINANCE, A PORTION OF THAT CERTAIN

Continuation of Appeal of Denial of Certificate of Appropriateness by the Historic
Preservation Board, to replace existing chain link fence at 217 South Park Avenue, tabled
January 23, 1995 at the request of the applicant.
The Chairman announced that the Commission needs to make Findings of Fact,
Conclusions of Law, and authorize preparation of an Order, based on the record presented to
the Historic Preservation Board.
City Attorney William Colbert reported that public participation as well as
questions of participants or clarifications should be limited to the testimony/information
previously presented to the Historic Preservation Board, and that new/additional information
would be considered outside of the record and inappropriate.
Commissioner Howell asked for clarification relative Mr. Rak's statement that after
several meetings on-site he got the .impression that they had the authority to do what they
were telling them at that time.

Director of Planning and Development Jay Marder reported that Bettie Sonnenberg and
Rick Holloway would not give permission/sign-off in the field, and that the site plan does
not include a chain link fence.
Martin Rak, Vice-President, Delco Oil, Inc., appeared and explained that during the
course of the renovations he met numerous times with Bettie Sonnenberg and Russ Gibson at the
site going over the site plan and other issues including planters, trees and a dumpster
enclosure, and that he does not recall discussing the fencing in particular at any of those
.meetings. Further, he was under the impression that since he was replacing an already
existing fence in need .of repair, as indicated in letter dated November 10, 1994, from
Cumberland Farms, the previous owner, it would not be necessary to go back in front of the
Historic Preservation Board. In reply to Commissioner Howell.'s question, Mr. Rak stated that
a building permit was not pulled for the fence.
In response to Commissioner Howell's question, Russ Gibson reported that he did not
advise Mr. Rack that the-fence was acceptable. Also, he made it clear to Mr. Rak that any
exterior changes to the property would require a Certificate of Appropriateness.
Alex Ford appeared and reported that he is the attorney for the applicant, that a
number of photographs were presented at the Historic Preservation Board. Hearing, which are
not part of the record, and asked that said photographs be included. Further, chain link
fences are discouraged under the City's design guidelines; not banned outright, and,
therefore, you would have a difficult time justifying it in a court of law. Also, there is
a question as to whether.or not Mr. Rak received notification of inclusion into the historic
district, as required.
Land Development Coordinator Russ Gibson reported that he did not recall whether
or not pictures were submitted at the meeting, however, they may have been on display.
City Attorney Colbert ruled that the photographs and the issue of notification of
inclusion into the historic district were outside of the record.
City Attorney Colbert summarized the issues before the Commission as follows: 1)
Mr. Rak made a presentation at the Historic Preservation Board Meeting, 2) a letter from the
~il corporation concerning their preference for a fence, 3) a letter indicating that there
~as an existing fence in the area, 4) one neighbor's statement in opposition to the fence,
~nd 5) the action of the Historic Preservation Board. Further, it is the responsibility of
the City Commission to weigh the evidence and testimony presented to the Historic
Preservation Board, and determine, based on said evidence, that the chain link fence is
incompatible with the area, discouraged under the regulations of the City, and inappropriate
for that particular parcel of land; or there is no reason to believe that there had not been
a fence at this location previously, that the fence would not materially affect the property,
and, would not, as a matter of fact, be incompatible with the area.
Commissioner Eckstein reported that he would have felt more comfortable if the
i~istoric Preservation Board had stated that their decision to deny the Certificate of
[ppropriateness was based on the fact that chain link fences are discouraged in the historic
~istrict as opposed to against the Land Development Regulations, and recommended that this
item be tabled and referred back to the Historic Preservation Board for reconsideration.

In response to Commissioner Eckstein's statement/recommendation, Commissioner
Howell pointed out that the Application Form dated December 1, 1995, states that the
Certificate of Appropriateness was denied and that chain link fences are discouraged in the
Historic Downtown Commercial District.
City Attorney Colbert reported that there is competent and substantial evidence to
approve or deny the Certificate of Appropriateness, or, if the Commission desires, this item
could be referred back to the Historic Preservation Board for reconsideration.
After review of the testimony and evidence contained in the record created before
the Historic Preservation Board, Commissioner Howell moved to find that there was competent
and substantial evidence to support the Historic Preservations Board's decision, that the
applicant was provided procedural due process, that the Historic Preservation Board did not
depart from essential standards of law, that under City regulations chain link fences are
discouraged in the Historic Downtown commercial District, and concluded that chain link
fences are incompatible with the area. Also, to deny the Certificate of Appropriateness to
replace an existing chain link fence at 217 South Park Avenue, and to adopt the Order
attached hereto and made a part of these Minutes as though fully and completely set forth in

FY94/95 School Resource Officer/D.A.R.E. Agreement.
On recommendation of the City Manager,
Commissioner Howell moved to authorize execution of the SRO/D.A.R.E. Agreement with the
Seminole County School Board; the School Board to pay the sum of $93,844.00 in nine (9) equal
monthly installments; the first payment due October 5, 1994 with the remaining installments
due the fifth (5) day of each succeeding month. Seconded by Commissioner Thomas and carried

Cemetery Advisory Committee: The Deputy City Clerk reported that the term of
William E. Welborn expires March 13, 1995, and that Mr. Welborn has served
the maximum number of terms and cannot be re-appointed. The Commission took
no action, and concurred to consider a replacement at the February 27, 1995
Meeting.

Youth Advisory Committee: The Deputy City Clerk reported that the Commission
needs to appoint nine (9) members to this Committee.
After discussion, the Commission concurred that members of this Committee
will be between the ages of twelve (12) and seventeen (17), and residents of
the City of Sanford. Also, Director of Parks and Recreation Mike Kirby to
contact the principals of Seminole High School and both Middle Schools for
recommendations, and report back to the City Commission.

Historic Preservation Board: Commissioner Howell reported that Monte Olinger
has submitted hiS resignation from this board, and moved to accept said
resignation and appoint Don Moore to replace Mr. Olinger. Seconded by

Information regarding invoices paid during the period for previously approved lump sum
contracts. The Commission acknowledged thirteen (13) invoices totalling $752,288.53.
Minutes of various Boards. On request of Commission Eckstein, the Commission concurred that
the City Manager advise department heads and board liaisons that it is imperative minutes are
very specific/detailed when rendering a decision or providing a recommendation to the City
Commission.
Special Event Application from Sanford Chamber of Commerce for St. Johns River Festival on
March 4~ and 5~ 1995 at Fort Mellon Park~ as discussed at tonight's Work Session. On
recommendation of the City Manager, Commissioner Howell moved to approve the Special Event

Sara Jacobson, Sanford Advertising Co-op, appeared and read a letter dated February
!2, 1995, a copy of which was submitted to the Deputy City Clerk, stating that Sanford
Advertising Co-op is comprised of twenty (20) merchants to promote the shops of Sanford, that
small antiques and col].ectible items are placed in front of the stores to enhance the
storefronts, that the antique dealers have been asked to remove their special touches from
the sidewalks, asking why other shop owners throughout the City i.e. the Thrift Shop at First
Street and Palmetto Avenue are allowed to display various items, and requesting temporary
relief from the ordinance prohibiting the display of items (antiques/collectibles) in front
of storefronts; the opportunity to meet with City Staff and the Historic Preservation Board
in an attempt to create a meaningful and consistent procedure to enforce said ordinance with
good reason; and City support in establishing a committee consisting of City Staff, SHDWA,
Main Street and Sanford A'dvertising Co-op to discuss same.
The City Manager reported his concerns about providing such a waiver without
investigating/studying the ramifications of same.
City Attorney.reported that it is appropriate to consider such a waiver, however,
he would be reluctant to give advice to hold enforcement of an ordinance, which prohibits the
obstruction of public right-of-way, in abeyance because the City could be held liable should

injury occur as a result of same.

Albert Fryar appeared and reported his concerns about the drug problem at 7th
Street and Pine Avenue, 10th Street, Locust Avenue, Pecan Avenue and Southwest Road,
including individuals hiding drugs in the pockets of small children, and requested that the
City Commission instruct the Police Department to arrest individuals at random for loitering
and littering, whatever is necessary. Further, the City Commission needs to make some kind
of effort to get the job done, and suggested that possibly police officers join with citizens
in the streets as a deterrent.
Leon Brooks appeared and reported that it is regrettable that he has to continue
to come before the Commission to discuss the drug situation in Sanford, and that he is tired
of the perception that the north end of the City is not good enough. Further, the Martin
L'~lther King Committee needs to be restructured, with Commissioner Thomas in charge to provide
a black male perspective.
Bernard Mitchell appeared and reported that he sees drug activity every day on his
way to work, that something is not right at the police department, and that we need to find
some money to do something about this problem.

Commissioner Thomas reported that Police Chief Russell is doing everything possible
to run an effective department, that he has received several anonymous letters reflecting
that there are enemies within the police department out to get the Chief, and that there
appears to be a conspiracy to make the police department look bad in order to hurt Chief
Russell. Further, every effort needs to be made to get people in the community interested
in working together to resolve some of these problems.
Beatrice Jones appeared and reported that she lives in the Sanlando area off of
Locust Avenue and Celery Avenues, and discussed several concerns, including: 1) the drug
problem, 2) the trash problem which exists down Locust Avenue and Celery Avenue, and 3) the
need for sidewalks along Locust Avenue, speed bumps at the end of Valencia due to children
riding their bikes, and a mini-bus in the area.
Police Chief Ralph Russell explained that the City's Loitering Ordinance was thrown
out by the appellate courts declaring that same infringes upon the constitutional rights of
individuals. Chief Russell reviewed various law enforcement mechanisms for example: curfew,
the Citizen Riding Program, the COPS Fast Grant, and the 330-STOP Program, which received
community response, and stated that total community support is needed.
In response to Bernard Mitchell's question, the City Attorney reported that Florida
Statute establishes policy for drug free zones around schools, but does not apply to the 3-
mile radius. Also, the City's Loitering Ordinance, which was based on Tampa's ordinance, was
challenged after the first arrest and was held unconstitutional.
