AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA. LEVYING
AND IMPOSING LICENSE TAXES FOR MUNICIPAL PURPOSES FOR
THE Y'.!AR BEGINNING OOTOBER 1, 1~44, AND EAOH YEAR THERE-
AFl'ER BEGINNING OCTOBER 1st UPON THE OCCUPATIONS, BUSI-
NESSES OR PROFESSIONS HEREIN STATED; FIXING AND DETER-
MINING THE A}roUNT OF SUCH LICENSE TAXES TO BE PAID;
REQ.UIRING EACH PERSON, FIR-VI OR CORPORATION BEFORE
ENGAGING IN SAID OCCUPATIONS, BUSlliJESSES OR PROFESSIONS
WITHIN THE CITY OF SANFORD, FLORIDA, TO 1u~TUAILY PAY
SAID LICENSE TAX AND OBTAIN LICElISE FOR SUCH OCOUPATION,
BUSINESS OR PROFESSION TO BE ENGAGED IN; AUTHORIZING
THE REFUSAL TO ISSUE OR RENEtl A LIOENSE AND AUTHORIZING
AND PROVIDING FOR THE REVOCATION OF ANY LICENSE ISSUED
HEREUNDER AND PRESCRIBING A PENALTY FOR ENGAGING IN
SUCH OCOUPATIONS, BUSINE3SES OR PROFESSIONS 'NITHOUT PAY-
ING SAID LICENSE TAX AN"D OBTAIND"iG LICENSE THEREFOR AND
REPEALING ALL ORDI1"\ANOES OR PARI'S OF ORDINANCES IN OON-
FLICT HEREW'ITH.
BE IT ENACTED BY THE PEOPLE OF THE CIT'{ OF S.A.~FORD. FLORIDA:
SECTION 1: ~hat no person, firm or corporation shall
engage in any of the ocoupat1ons, businesses or professions herein-
after mentioned in the City of Sanford. Florida, unless and until
the annual license tax therefor, hereinafter prescribed, shall have
been paid and a city license therefor shall have been procured from
the City ~ax Collector of the City of Sanford, Florida, which license
shall be then and there issued by the City Tax Collector upon the
/
payment of the amount of the license tax required therefor, with-
out any additional charge or fee whatever.
SECTION 2: ]hat no license shall be issued hereunder
for more than one year and all licenses shall begin on the 1st day
of October of each year and end on the 30th day of September of the
following year and for each license obtained between October 1st
and April 1st the full tax for one year shall be paid, except as
herein provided, and for each license obtained between April 1st
and September 30th one-half of the full tax for one year shall be
paid, except as herein provided.
SECTION 3: That licenses shall be good only for the
particular business and at one particular place of business which
shall be named therein and for the person, firm or corporation to
whom issued, but licenses may be transferred when there is a bona
fide sale and transfer of the property used in the business, stock
in trade, or the removal of the same from one place in the City to
another, upon application to the Oity Tax Oollector, and said trans-
fer shall be written across the face of the original license. The
issuance by the City Tax Collector and receipt by the applicant of
such license shall in no case be deemed authority to conduct an
occupation, business or profession in contravention of any ordi-
nance or ordinances of the City now existing or hereinafter enacted,
or to establish or maintain any nuisance.
SECTION 4: That the Oity Tax Collector, before issuing
a license based an a property value or capital stock or value of
stock of goods, wares or merchandise on hand, shall require the
person applying for a license to make a written statement under
oath of the value of the property or the amount of the capital
stock or value of stock of goods, wares or merohand1se employed
or to be employed in such business. If the City Tax Collector has
reason to believe that said application and oath do not properly
disclose the value of the property or the amount of capital stock
or value of goods, wares or merchandise, such license shall not be
issued until application and oath shall correctly set forth such
information. Value of stock of goods, wares or merchandise shall
mean inventory value as of September 30th next preceding the
license year for which a license is applied.
SECTION 5: 'llliat the amount of annual license tax
levied and imposed upon every person, firm or corporation or associ-
ation that shall engage in or manage any occupation, business or
profession mentioned in this section within the City of Sanford,
Florida, is hereby fixed, graded and determined as to the follow-
ing ocoupations, businesses or professions and at the following
amounts:

SE.CTION 6: ':Chat the 01 ty Commission shall have
authority for just cause to direct the City Tax Collector not
to issue or renew a license that may be applied for, but the
applicant for such license shall have the right to be heard
before the City Commission and show cause, if any, why such
license should be issued or renewed.
SEOTION 7: That the City Commission shall have the
right for just cause to revoke any license issued or renewed here-
under and may in its discretion order the refunding of any part
or all of the moneys paid for such license when the same is re-
voked and any person conducting any occupation, business or pro-
fession after such revocation by the City Commdss1on shall be
liable to the penalties as specified herein. If the City Oom-
mission desires to revoke any license issued hereunder, it shall
oause the holder of the license to be served with written notice
of its intention so to do, sta~ing therein the cause for the pro-
posed revocation of such license and set a time for a hearing on
such proposed revocation. Such notice shall be prepared and signed
by the City Clerk and served by the Chief of Police or any police
officer upon the holder of the license by delivery to him of a copy
thereof, not less than five days before the date set for the hearing.
Said hearing shall be held in the City Oommission room in the 01ty
Hall in the City of Sanford, Elorida, and the holder of such license
shall have the right to be heard, either in person or by counsel,
and if after hearing the City Comm1ssion shall determine that said
license should be revoked, the same shall be revoked and a con-
tinuance to engage in the occupation, business or profession for
which such license has been issued shall constitute a doing of
business without a license therefor. The license holder shall
have the right to apply to any court of competent jurisdiction
for a review of the order revoking such license. The provisions
of this section for the revocation of a license issued hereunder
shall not apply to a revocation of a license for the sale of
alcoholic beverages upon conviction of a violation of any of the
provisions of Ordinance No. 256, passed and adopted on the 28th
day of June, 1~37, as provided by Section 19 thereof.
SECTION 8: ~hat every person, firm or corporation
required to procure a license Shall exhibit the same whenever
called upon to do so by the Oity Tax Collector, Oh1ef of Police
or any policeman of this 01ty. Licenses of all persons having
a places of business shall be conspicuously displayed thereat.
SECTION~: It shall be the duty of the Chief of
Police to ins.pect all places of busine ss in the City of Sanford,
and to report the failure of any person carrying on any of the
hereinbefore named oCQupat1ons, businesses or professions to
secure a license theref'or or to post the same conspicuously in
his or their place of business.
SECTION 10: That the City Tax Collector shall keep
a book alphabetically arranged, in Which shall be entered every
license issued, the name of all persons holding a Oity license,
the number of license, the occupation, date of issue and expira-
tion of license, and the Sunl paid.
SECTION 11: Any person, firm or corporation that shall
carryon, conduct or manage any occupe.tion, business or profession
ror which a license is required, without having first obtained such
license as hereinbefore required shall be deemed guilty of a viola-
tion of this ordinance, and upon conviction shall be punished by
a fine equal to double the amount required for such license, pro-
vided such fine shall not exceed Two Hundred ($200.00) Dollars, or
by imprisonment for a term not exceeding Ninety (90) days.
SECTION 13: ~there the Dollar ($) Mark and the numeral
are used above it shall be deemed to express the same sum in Dollars
as if the amount and the word "dollars" were written out in each case.
SECTION 14: That all ordinances or parts of ordinances
in conflict with this ordinance, be and the same are hereby repealed,
but this section shall not repeal Ordinance No. 256, passed and
adopted on the 28th day of June, 1937, Ordinance No. 293, passed and
adopted February 12, 1940, Ordinance No. 312, passed and adopted
May 12, 1941, Ordinance No. 330, passed and adopted December 28,
1942, and Ordinance No. 351, passed and adopted July 24, 1944, so
far as the same regulate the manufacture, distribution and sale of
beverages containing more than one per centum of alcohol by weight.
SECTION 15: ~hat this ordinance shall become effective
as of the 1st day of October, A. D. 1~44.
