THIS INDENTURE, made in duplicate, on this 27th day
of Se ptember , 1971, by and between CITY OF SANFOiiD, FLORIDA,
a municipal corporation, hereinafter referred to as Lessor, and
SEMINOLE SOCIETY, a non- profit corporation, Sanford,
Florida, hereinafter referred to as Lessee:
VVITNESSETH: That for and in consideration of the sum of
Ten and 00 /100 Dollars (10.00) and other valuable consideration
in hand paid to Lessor by Lessee, receipt whereof is hereby
acknowledged, Lessor does hereby lease from Lessor, subject to
the conditions hereinafter set out, tree following described
premises, situate, lying and being in Seminole County, Florida,
to wit:
The concession stand situate on the Southwest corner
of Seminole Boulevard on North ?ark Avenue at the
Municipal 'boo in Sanford, Florida, together with the
exclusive right to sell refreshments and souvenirs at
such concession stand and on the Zoo premises during
the term hereof,
TO HAVE AND TO HOLD said premises and right unto the said
Lessee from October 1, 1971 for a term of one year ,
expiring Se tember 30 1972, said Lessee paying to said Lessor
as rental tierefor the sum of Fifty and 00 /100 Dollars ($50.00)
per month, payable in advance.
It shall be the purpose of this lease to foster and aid the
continuing development and operation of the Zoo and concession
stand. To that end, the terms of this agreement shall be construed
so as to favor advertisement and promotion of the Zoo and'
concession stand.
As a condition, and as Dart of the consideration for this
lease, Lessee agrees to be responsible for daily locking and
unlocking; public restrooms located in leasehold premises.
The Lessor and Lessee do furt�ier covenant and agree to and
with each other as follows:
1. Lessee shall pay before the same become delinquent all
taxes and assessments levied by any taxing authority against any
improvements or property placed on the leased premises by Lessee.
2. The Lessee shall pay the cost of all utilities furnished
to the leased premises during the term hereof.
3. Lessee shall keep the said building and premises in
such repair as the same are at the commencement of the said term
or as may be put in during the continuance thereof, reasonable
wear and tear and damage by fire or other unavoidable casualty
only excepted, and will promptly replace all glass thereof
broken during the said term by other glass of the same size and
quality.
4. Le:saee shall have the right, at its own expense, to make
improvements or alterations to the aforesaid concession stand.
5. The Lessee shall have the right to erect signs, and other
advertising s, consonant with good taste, and subject to prior
approval by tie Lessor in accord with the existing City of Sanford
code and regulations.
6. Lessee shall at all times maintain such stock of
refreshment, including but not limited to hot and cold foods
and drinks, as is adequate to supply all normal demand of visitors
to said Zoo; shall have such refreshment available to visitors
at all reasonable hours, and sciall fix and maintain its charges®
for the same in keeping with the price of the same or similar
items elsewhere within the City.
7. Lessee shall not make or suffer any unlawful, improper
or offensive use of the premises, including the making of loud
or undue noise, or any use or occupancy thereof contrary to any
law of the State of Florida or any ordinance of the said City
now or hereafter made, or which shall be injurious to any
person or property.
8. Lessee shall not assign this lease nor sublet any of
said property or right without the written consent of the Lessor.
9. Default for a period of ten (10) days in the nn�ment of
any one of the aforesaid monthly rentals, or default after
thirty (30) days written notice mailed to the Lessee at its
last known Pddress in the performance by the Lessee of any of the
otrer covenants contained in this lease on its part to be performed
shall work sn immediate forfeiture of this lease, and the Lessor
shall have the right to enter upon said property and retake
possession thereof and to revoke said right without the necessity
to resort to process of law therefor.
IN WITNESS WHEgEOF the Lessor has caused these presents
to be executed in its name by its Mayor and attested and its
official seal to be hereunto affixed by the City Clerk, and the
Lessee has hereunto affixed its hand and seal, by and through
its President, the day and year first above written.
